attack. suing tesla ceo elon musk for fraud. could he be sued? i'm christine romans. >> good morning. i'm dave briggs. it is friday, september 28th. 4:00 a.m. in the east. i said yesterday this is one for the books. >> it was wrenching, honestly. it felt like two phases. a crescendo in her testimony and in the end, defiant brett kavanaugh. some said it clawed his way out and back to the top. >> ultimately we all may be worse off for it. the nomination to the supreme court hanging in the balance as the senate judiciary committee prepares to vote this morning. members of the committee heard dramatic testimony from brett kavanaugh and dr. christine blasey ford. the woman what says he sexually assaulted her when they were teenagers. now in the hands of four key

senators. republican susan collins and lisa murkowski and jeff flake and joe manchin. >> collins left capitol hill without commenting. manchin says quote there are concerns people have. murkowski says she needs a chance to think about all that's gone on. a gop source close to the process tells cnn they are not sure they have the votes to push kavanaugh across the finish line. it is definitely close. we have phil mattingly with more from capitol hill. >> reporter: christine and dave, republicans are moving forward. every one of them is staring with wrapped attention. gripping testimony from christine blasey ford and supreme court nominee brett kavanaugh. after the testimony was over, more than eight hours, committee members and witnesses testifying and members back in their office watchin

watching. republicans still planning to move forward. they had a meeting afterwards and they decided the senate judiciary committee will continue the plan to vote on friday on the nomination. the key individual to watch on the committee is senator jeff flake. he is still undecided. he still has not made up his mind. he told my colleague after the meeting today he had more doubts than certainty about what would happen next. if they don't have the votes on the committee, mitch mcconnell said behind closed doors they will move forward to the floor. a procedural vote is planned for saturday at noon. what does this mean? at this point in time, republicans do not have the votes to confirm brett kavanaugh. republicans could have the votes to confirm brett kavanaugh. a couple of democrats could vote with them as well. those votes have not committed yet. republicans are taking a gamble and pushing forward with the president's support and vice president's support and takes

vote. the vote could come as early as today. democrats are rejecting that, of course. take a look at what the president sent out after the hearing ended. judge kavanaugh showed america why i nominated him. his testimony was powerful, honest and riveting. this process has been a total sham. an effort to delay, obstruct and resist. the senate must vote. no mention in the statement about christine blasey ford. that was someone the president was watching testify intently. he called her testimony, i'm told, compelling. he found her believable. he clearly wanted to hear from judge kavanaugh. he wanted to hear anger and push back from judge kavanaugh. that is what judge kavanaugh ga gave him h. i'm told he turned that audience around. the president did not want him to lose faith in his nomination.

i do not recall the events described by dr. ford in her testimony. it would help if members could get more information from judge. the american bar association is calling to halt the nomination vote until they have have a hearing. they submitted a letter. each appointment to the nation's highest court with all others is simply too important to rush to a vote. deciding to proceed without conducting additional investigation would not only have an impact on the investigation, but have a lasting impact on the senate's rep reputation. the organization gave judge kavanaugh it's highest rating for the supreme court. well qualified. kavanaugh touted that rating at thursday's hearing. >> like the rest of us,
