others under fire in south carolina. and here come the yankees. there goes that ball. the bombers headed for a showdown with the red sox after disposing of the cinderella a's. i'm dave briggs. welcome to "early start." >> i'm christine romans. it is 4:00 a.m. in the east. senators starting the clock on the final vote on the brett kavanaugh nomination to the supreme court. mitch mcconnell filing a motion to end the debate. that move will come to an end this week with the final vote as soon as saturday. >> the timing driven by the fbi renewed background investigation on kavanaugh. senators will read the investigation at 8:00 a.m. the white house has the report already. "the wall street journal" reports that the white house

finds no sexual misconduct allegations against the nominee. >> that doesn't an address the judge misleading the senators. the white house privately restricted the fbi from looking into kavanaugh's youthful drinking and if he lied to congress about that specifically. all that while the fbi could follow any leads as it saw fit. >> the fbi wrapped up the investigation on wednesday and having ten people in total. now it moves to undecided senators and what they make of the fbi report. correspondent phil mattingly with the latest from capitol hill. >> reporter: christine and dave, this is something republicans have been asking for for weeks and now it is on capitol hill. the fbi supplemental background investigation. this report will dictate whether or not brett kavanaugh is elevated to the highest court in the land. at this point, republicans do not have the votes to confirm

brett kavanaugh. as it stands, the first procedural vote on the nomination will be set up for friday. that would mean a final vote on confirmation could come saturday. what the republicans don't have is the 50 votes needed to move it forward. the expectation is what the fbi returns to help get them over the line. two undecided democrats. multiple of those senators have said this report will go a long way to how they vote. it all relies on what they see here. the big problem is we won't see it. it won't be released publicly. the staffers and senators are not allowed to talk about it at all. what does that mean? it will be open to interpret ratiinterpre interpretation of what the fbi found. a good metric is look at the

tone toward women. >> we all know the president cannot lead us through this time. we know he is dispositionally unable to guide us. >> and senator lindsey graham would say knock it off. you're not helping. and the u.s. navy to respond to the chinese aggression. officials describe it as a global show of force. the war ship came within 45 yards of the american ship in the south china sea. the near collision is one of many troubling developments with china. let's bring in will ripley live from hong kong with the latest. will, where are we headed? >> reporter: we just don't know, dave. first of all, the u.s. navy has yet to decide if they will go through with the show of force which would occur on one week in

november with the freedom of navigation patrols. the u.s. flying planes and has ships near the spratley islands. the u.s. does this on a regular basis. that is why there was a near collision over the weekend on sunday. what they are talking about potentially is more frequently in a concentrated period of time than what we have seen before, for china to respond. we don't know how they would respond. there certainly is the risk of more close calls or worse in the south china sea. vice president pence is expected to talk about this and express outrage over the incident. aggressive in that noumaneuvers chinese is harassment and the u.s. is not intimidated through the patrols in what the u.s. considers as international waters and china claims the

waters. the vice president is expected to attack china on a different level. i'll bring up a quote on his speech. quote, what the russians are doing, election meddling, pales in comparison to what china is doing across this territory. he is targeting red states. the trade war with beijing and washington saying china an targeting -- china is targeting the voters. china has a detailed plan in place to meddle in the u.s. elections and threatening to deny business licenses to companies that don't speak out against the administration. there is a lot in the speech that could make beijing angry. >> well beyond a trade war. will ripley, thank you. a reprieve for hundreds of thousands fearing deportation. the judge had blocked the

temporary protected status. it is for immigrants from sudan and haiti and nicaragua. it protects people from count countries hit by natural disasters or war. the trump administration denied that in the past. the judge said the decision may have been based on hostility based on non-white immigrants. the judge's decision usurps the role of the executive branch. several police officers shot, one fatally, trying to serve a search warrant in south carolina. one barricaded himself in the home with children. officers were shot and they tried to help. officials say they did not realize how much fire power the suspect had. >> fire was being shot all over.
