>> a senior administration official telling us that president trump will announce $8 billion for his border wall. we are told he plans to use the executive action to move around or sort of free up money from various federal agency to get money, the funding for the border wall. we are also told he does plan to declare national emergency. the senior administration official tells us of the president they are not sure when the physical copy of the funding bill will make its way to the white house but they said that president trump at this point in time is planning to sign that. they are expecting him to sign that tomorrow morning. a statement earlier, white house sarah sanders said this -- a new report by abc news the d.o.j. is telling white house the courts will step in and block a national emergency declaration and it's "nearly

certain" to be blocked by the courts on at least a temporary basis preventing the immediate implementation of the president's plan to circumvent congress and build the wall using his executive powers. in 2014, president trump criticized then president obama on the day he announced series of executive actions relating to immigration, tweeting the pubs must not have allow president obama to circumvent the constitution for his benefit when he's unable to negotiate with congress. right now, president trump seems to make move on his own and they seem unconcerned about the legal action that is surely on horizon. >> shannon: thank you very much. now straight to capitol hill where democrats are warning he better not declare the national emergency. but the white house says he is on firm legal ground. david? >> this has been a night on capitol hill.

the deadline was february 15 at midnight. less than an hour. guess what? congress made it. and it appears that the government will be funded. no 9 with the wrangling and the fighting between the inner fighting. the vote in the house, 300-128. thenate 83-16. the white house standing by of the bill. we have new video of pelosi signing the legislation in a photo op before it was sent to the white house for the president's signature. congresswoman alexandria ocasio-cortez progressive democrat from new york voted no because of the bill's funding for part of the department of homeland security. same story from congressman omar who wants to defund the department of homeland security. speaker pelosi said today declaring the national emergency sets a dangerous precedent for the future president. she mentioned gun violence as this is the one-year anniversary of the parkland, florida, shooting. >> you want to talk about a

national emergency? talk about today. the one-year anniversary of another manifestation of the epidemic of gun violence in america. that is a national emergency. why don't you declare that emergency, mr. president. i wish you would. but a democratic president can do that. democratic president can declare emergencies as well. >> meaning a democratic president could choose what constitutes a national emergency in the future. back in the senate, majority leader mitch mcconnell made it clear he had assurances from president trump it will would be signed. it calls for $1.57 billion for borders enough for 55 miles of fencing on the texas border. but there is a provision for homeland security to discuss construction with the local leaders before any of the construction takes place on the wall. this issue wedged the republicans together. spoke to the texas congressman louis gomer who said he is concerned about the it litigatin

that will come from the national emergency. >> i came in today, this morning thinking you know i may be able to vote for this. but then when i started to get the language i was incredibly disappointed. i couldn't vote for this stuff. there were all kind of land mines in here. call it a poison pill. semi-poison pill. there will be a lot of litigation coming out of the bill. >> the congressman from tyler, texas, says he has concerns. congress is in recess next week but they did meet the deadline of february 15. there was concerns that wouldn't happen now. it's in the hands of the white house. >> shannon: thank you very much. we'll watch and wait tonight as they consider their strategies there. so as the white house cobbles together billions in additional funding that it says can legally go to the wall, democrats are vowing to fight efforts to use money for border security. senior capitol hill producer chad has the latest. >> hey there. one of the big issues here is how much can the president

move around in they talk about the $8 billion. look at the appropriations bill. he can go up to $750 million there. that won't get you to $5 billion. but if you move from defense to military construction, v.a. he can get there. the problem is you can't technically do that. even if you move around in one silo and one homeland security bill or another bill individually you have to have sign off by appropriators. going over the line is why people think this is constitutional. we talked with jerry nadler the chair of the house judiciary committee earlier. he said this is a power grab and it would upset separation of power. the chair of the house appropriations committee said she might consider putting riders in the future legislation to try to harness the president. >> all right. we know all administrations test the limits of executive power. i covered a number of the cases over the supreme court.

this isn't the first time this has happened. why does it bother member of both parties so much? >> the republicans think it sets a bad precedent. you don't know what comes next. if you start to move around in the appropriation bills, all of the programs and the pet projects have the constituencies among the lawmakers of both parties. you are robbing peter to pay paul. if you move money from defense to ships or airplanes or wall, someone cries foul to say wait. you are taking our money. there is a constitutional issue here. article 1, section 9 of the constitution says that congress has the power of the purse and if you cede that to the executive one wonders if they are playing within the rules. >> we look like we don't an overnight government overshot -- overnight government shutdown. we have done enough of those. following a stunning interview by ousted official andrew mccabe lawmakers on both sides of the aisle say they will force him to testify on capitol hill.

chief intelligence correspondent catherine herridge has more on the claims that mccabe is now making and the fire storm he reignited. is there -- >> you have having a conversation whether you to invoke that. >> he did not rule out subpoena to compel testimony from rosenstein and former f.b.i. director andrew mccabe. about discussions to remove president trump. >> i would imagine if the shoe were on the other foot my democratic colleagues would want to know about that conversation. if it involved a democrat. >> graham was responding to mccabe's upcoming "60 minutes" interview. according to cbs mccabe confirmed the long-standing media reports including by fox he believed rosenstein was serious about wearing a wire to record the president. >> i was speaking to the man that had just run for the presidency. and won the election for the presidency. and who might have done so with the aid of the government of russia.

>> may 17 is a pivotal month. rosen sine was two weeks in the job when comey was fired by the president. investigation of obstruction of justice opened in addition to the russia probe. >> i wanted to make sure the case was on solid ground. >> in a statement, they stopped short of rosen sine removing the president. saying he never authorized a recording that mr. mccabe references. based on his personal dealings with the president there is no basis to invoke the 25th amendment. in a tweet, president trump hit back and characterized mccabe as a disgrace and puppet. >> last spring he was fired for violating the code of ethics for lying and mccabe's case is now with the u.s. attorney in washington for possible criminal prosecution. shannon? >> shannon: catherine herridge, thank you very much. bring in the top republican on the house judiciary committee

congressman doug colins from georgia among those demanding that both mccabe and deputy attorney general rosenstein show up on capitol hill under oath to explain what a lot of folks say is a biased hit job against the president. welcome. great to have you with us. >> great to be hear. >> you say that there has been testimony and you have heard from people about the conversations about whether there was a discussion to wear a wire, talk to president or use the 25th amendment. what can you tell us? >> what we are seeing for the first part, a lot of people say the investigation, judiciary committee in the house have been doing and reform committee, many of us look in this for well over two years now. we are chasing windmills. conspiracyerer theory. but today mccabe showed the theories were real. but what made it worse this is worse than the '60s movie "seven days in may." this was a time we see the department of justice using the full force of the power to contemplate what is nothing

less than a coup. going a whip count to see who in the cabinet members would go about this. this is confirmed by the other testimony we have seen. this goes back to a corrupt try -- triumbrant. if you look at this, this goes back to 2016 and follows through. this is not the f.b.i. as a whole. this is a kabul that found the time in eight days that comey was fired and this is the time to act. he confirmed what we have known through the text and the communications and the transcripts of f.b.i. >> you are asking for them to come testify under oath. senate side it look like bipartisan call for this as well. democrat, senator blumenthal says -- full fact-finding demands, mccabe be called to the judiciary committee in public under oath and others

explosive claims cry out for the clear-eyed exposure. this is what the new chairman of the committee lindsey graham says. >> this interview, the excerpts i have seen suggests that mr. mccabe was hell-bent on stopping donald trump not only from becoming president but trying to make sure he did not stay president. this should scare every american when the law enforcement community becomes political operatives and they are advocates for a political cause. >> shannon: any american, if that is true, should be worried about this. are you confident or any hope that the democrats controlling the house judiciary committee will want answers you are looking for? >> i believe they will. i'm going to think of better angle but i'm also skeptical. it's amazing to me that up until the transition and they took over on january 3, they didn't want anything to do with mueller. they wouldn't question. they told us we were getting too close. they stayed away from it. they didn't want to believe what we were seeing and they

could see as well. they were in the same hearings. now all they want to do is talk about mule maul and talk about the president -- talk about mueller and talk about the president. what the chairman sid is important. this is something for everybody watching tonight. just to think for a second. what if this had been four years earlier in 2013 and this was the justice department and changeover in which the questions were asked about president obama. when he had his conversation with the russian president. after the election i'll be more agreeable. more flexibility. would that have disturbed them? they have a realization, they didn't like the election results in 2016. they had been allowed by the obama administration to become politicized. you see that with strozk and page and the text messages. you see the insurance policy. all the things that just goes back to you had corrupt influence that needs to be rooted out. bill barr's first step is go

public housing is $32 billion in debt. we generate more wealth than anywhere on the planet. long island city is the fastest growing community in the country. we are not going to have a problem with recruiting to long island city. this is a handout to the richest man and no reinvestment in the community. >> one estimate is $25 billion would have come in, in the next 25 years to the locality. phil oluva ran as a republican for congress in new york said the people who proposed the economic security for those unwilling to work, part of the doreen deal, celebrate kill tag,000 high paying jobs for willing. #socialism kills. the far left is happy about this and say they have won one. >> why do you celebrate driving 25,000 jobs out of long island city? what's ridiculous.

amazon shouldn't get the tax subsidiaries but new york doesn't win when they lose all the jobs. you see the governor talk about the loss this is. he has to balance a budget. he says we are not winning driving the rich out of new york or driving businesses out of new york. ocasio-cortez doesn't have to balance a budget. she doesn't care about the cost. >> governor cuomo has a history of not taxing real estate developers. his backers are the 1% of new york. he is not in long island city or astoria or the bronx. he doesn't see how expenseive is it to survive in new york. he has more concern about the real estate backers not paying taxes and preserving their tax incentive than people of new york struggling to get by.

the worst income inequality in the country. handing out tax breaks and talking about 25,000 jobs in new york. there is no proof of that. >> shannon: but let me ask you brian is this good for republicans because it looks to a lot of the average americans who would love to have a job and have the opportunities and are saying hey, bring your company to my red state. i'll take it. >> yes. hand out to republicans. they are saying the green new deal that you heard about promising utopia. the people behind that love to kick businesses out of their own city. the republican mayors say come here and set up the shop. create jobs. we have a choice. you can be a city or state friendly to business or be one that is run by the hard left and kick them out. when you are bun by the hard left you are only undercutting opportunities for your own people. people of the long island city losing out here. >> shannon: we have to leave it there. >> small business. invest in small business.

is moving this direction. i think he has some legal authority to do it. i consider what is going on, or the look of what is going on the failure of congress, not as trump. but i don't want to give more power to a president. congress has to do its job. there is a political remedy. change congress. >> richard, tonight i talk to someone in the white house who said they know this is a risk but they don't feel like it is because they feel like they are on good legal ground. the question, is it tied up or immediate injunction to put the whole thing on hold? they think they will ultimately win it, is it a good gamble? >> look. the president can declare anything. he can declare that the sky is green. border crossing is at a low, down since 1971 down from 2000. the national security chief testified before the senate a couple of weeks ago when they were asked what is the top security risks are to the

country. none of them mentioned the border wall. so he can say what he wants. the issue will be when he tries to move the money. jason knows as a former member of congress, congress has the authority to say what the money should and should not be used for. they said what it should be used for and they haven't said it should be used for this so-called wall. so i think he is on thin ice. i understand the white house lawyers have to tell him what he wants to hear. that seems to be the way it works. >> shannon: you think you want to hear what reality is because you have to deal with it and you think you want to give the president realistic look at what he is facing. there is no doubt someone files a lawsuit. i got e-mail tonight from says it's drafted and we are waiting for him to do it and we'll file it in the ninth circuit. >> the reality i think that this has the feel of kabuki to me. everybody knows that before the ink is dry on whatever executive order he signs, someone is marching in to the

federal court to get it put on hold. what happens from there the democrats are able to say and the rest of trump opposition to say they didn't cave and they didn't give him what he wanted. he is able to say he fought as hard as he could and was stopped by the courts. everybody still has the political issue for 2020. we go forward. >> andrew mccabe has a book coming out and he is talking about what led him to launch the investigation against the president. there are folks out there who say listen, this is a situation they want to hear from him. democrats and the republicans say we want to get you on the hill and hear what you have to say. jason, you were knee deep in this and you have written a book about it. where do we go from here? >> he did the nearly impossible. he was fired as a federal employee. that was done by his

colleagues who found him so disagreeable, lying, the look of candor they dismissed him. the scathing report from the inspector general. this is not a person that can be trusted. it is interesting that he thought rosenstein was serious about wearing a wire on the president. mr. mccabe saying that there is concrete evidence that the president in collusion and two years later the senate intelligence committee comes together and says no, we have seen no evidence. the guy has issues and ultimately he may end up in jail. >> shannon: today, sarah sanders from the white house obviously not a fan of mccabe says this. andrew mccabe was fired in total disgrace from the f.b.i. because he lied to investigators on multiple occasions including under oath. andrew mccabe has no credibility and is an embarrassment to the men and the women of the f.b.i. and our great country. >> i hope that mccabe is forced to testify before any
