judge jeanine: breaking tonight, president trump defies the pundits and vows that he can and will win the election. welcome back to "justice." i'm judge jeanine pirro. president trump: if you win ohio in history, you never lost and i election. but they never lost an election, we are winning this election. judge jeanine: more from president trump's raucous rally for georgia's senate candidates. but first my open. when 100 million people vote before an election and a huge portion are mail-in ballots, extraordinary regulatory oversight is required.
when election laws are changed on the eve of that election in violation of the constitution, extrregardy oversight is needed. the attorney general bill barr has proven himself to be anything other than extraordinary. this week barr commented that he has not seen fraud on a scale that could have affected another outcome in the election. really? it's curious, barr, the head of the doj would affirmatively make a statement regarding a penning investigation. as a former prosecutor i and virtually everyone similarly situated know doj guidelines do not alou comment on investigation. they neither confirm nor deny the existence of an
investigation. if barr goes beyond that before some states are certified, affidavits alleging fraud continue to come in before electors have even voted. that there is not sufficient evidence. so why would barr do that? why would he not continue an investigation as the evidence continues to come in? why would he even share information on the pending investigations? it's just not done. before you have make that blanket costatement, did you con election night why was the counting stopped? why were observers not permitted to reasonably observe about lot count? why were observers removed from counting areas. why did counters cheer when republican observers were removed.
why were windows board up in detroit so observers could not observe. why when observers were allowed to reenter was there an unusually large number of ballots with 90 and above for joe biden. and why was there a failure to match signatures on mail-in ballots. why was there destruction of mail-in ballots envelopes that must contain signatures. why did they estimate 20,000 people who don't meet residency requirements were casting votes in georgia where biden's margin is 12,000 votes. why are there record numbers of dead people voting. how is it that ballots in pristine condition without creases not suggesting they had
not been in mail-in envelopes as required by law. why is joe biden the first candidate to lose florida and ohio and still become president? might it be at florida and ohio have safeguards in place that the other states do not. why have the bellwether counties indicative of a presidential win, won by trump and not biden. why did he win in the swing states of milwaukee, detroit and philadelphia, each known historically for voter crumbs. how is it joe biden under performed with african-american voters everywhere, but in those swing states. why were about lot watchers in pennsylvania not allowed to observe so they had to get a court order.
and when they got one they still weren't allowed to observe. why is it james barrack and others say that mail-in ballots are the less security. have your u.s. attorneys finished their investigation? you know many were impressed with you bill because you were unflappable and you said all the right things. but you haven't done anything that makes you any different from your predecessor who wanted to spend two years hiding under a desk, jeff sessions. where is the durham report and the prosecution of individuals referred to you about it inspector general for perjury. how is it as soon as you became attorney general you affirmatively came out protecting barack obama and joe biden. >> whatever their level of involvement, based on the
information i have today, i don't expect there durham's work will lead to a criminal investigation of either man. judge jeanine: since when does an attorney general say that unless the investigation was complete and you knew they had no involvement. but then if the investigation was complete, where are the prosecutions? do you want america to believe one low-level fbi attorney named kevin clinesmith is the only one responsible for the russia collusion delusion. joe biden running for president who is in the oval office where obama and comey discuss the logan act, and you were not willing to do anything as the democrats trumped up a russia
collusion delusion against him. and you are not wanting the durham report to come out before the election? gee, that would only help biden. you say you don't want to weaponize the doj against political enemies. charging someone who commits a crime is not weaponizing the department of justice. it's fulfilling your mission, it's your legal obligation, your job. you said the doj used one standard for hillary and another for trump. and you can't allow that to happen again. how? if you don't sanction or penalize, of course it's going to happen again. you created the precedent that these cases are not to be prosecuted. so what are we going to do, bill? should we write a nonsensical
report on lessons learned? one that nobody reads. but used to bury in your case corruption? another benghazi report with lessons learned that we already learned from the bombing of the u.s.s. cole? you say the russia cleution investigation will not be swept under the rug because you made john durham special counsel. durham was supposed to wrap up last summer and he didn't. why? don't give me -- if biden is president, he will ask every united states attorney to hand in their resignation and that will include john durham. biden can still direct the
attorney general to fire durham. how sad it is it was the republicans who wanted to stop president trump from firing special counsel mueller. but i doubt there is any democrat who will try to tell joe biden he can't fire john durham especially since adam schiff stated the attorney general perhaps should end the inquiry into the trump investigation. surprise surprised. the democrats will get away with it again. americans are for was over the russia collusion hoax. we need answers. we need action. we need justice. and you, mr. barr, are so deep in the swamp you can't see beyond your fellow reptiles, and

could stop it very easily if he knew what he was doing. i don't run the elections. i don't run to see people opening suitcases. that's up to your government here. for whatever reason, your secretary of state and your governor are afraid of stacey abrams. they are afraid of her. judge jeanine: here with reaction to my open, the president's rally in georgia and much more. lara trump joins me. there seems to be a little tension between the president and governor kemp which i find curious given the fact that governor kemp was nowhere, he was in a primary that called for a runoff. after the president came in he moved up 45 or 50 points. and the president continued to support him even when barack obama, oprah winfrey and
michelle obama came in and supported him. but he won't do what he has the power to do while there is an emergency in the form of a pandemic in the state of georgia. >> governor kemp owes his position as governor to donald trump. it would be nice if he reciprocated in some way not just to make sure this goes the way we know it should for the president. but for the american people. he owes it to all of us to do the right thing to make sure we are calling out this fraud and this election is a legitimate election. we have seen so many outrageous voter fraud, especially in the state of georgia. i can see why the president is anoid with the way he sees things go there. judge jeanine: aside from what one person does for another person, the truth is the secretary of state took it upon
himself to, you know, agree in a consent decree with stacey abrams to change the voter law. and under the constitution he cannot do that. so what is the harm, what is he afraid will happen if we are able to look at what the allegations are in georgia of fraudulent voter count? >> that's a great question. i think we would all like that answered. and we would like to know what happened in the state of georgia. a typically very red state. i don't think anybody believes joe biden won the state of georgia. and we don't believe after we saw the video of the suitcases being hauled out from underneath these tables in the middle of the night when everyone else had left. and you see a huge spike for joe biden at the time that video was taken because they were running
these very clearly illegitimate ballots. we want to get clarity on what happened in the state of georgia. 5,000 people voted in -- 15,000 people voted in the state that don't even live there. we are pressing forward from the campaign. we know donald trump won the state of georgia. we knowe won this election -- we know he won the election in a landslide and we'll prove that very soon. judge jeanine: with the affidavits sworn to under penalty of perjury, there are all kinds of allegations of wrongdoing, whether it has to do with those boxes being pulled out after the poll watchers were supposed to leave over a water leak that weigh apparently was a urinal that overflowed. it would seem that this governor
has within his powers to call a special session of the legislature, and he's now blaming the secretary of state. he has the power to do it. why won't he do it? what is he afraid of? >> it's a great question. he's probably afraid we'll see there was rampant fraud in his state. this is something we have all been saying for a long time. we need to make sure we are not changing the voting system 90 days out like universal voter by mail. it's december and we are still having to deal with this. when you have fraud that's so egregious across the country, we have gone to the state legislatures in so many states. they held hearings where we have been able to bring witnesses forward to tell their own testimony about what they saw and what happened to them.
the constitution gives the right to the state legislatures, the exclusive right to the state legislatures, to choose the electors. we are going to the state legislatures to make sure the will of the people is not ignored. when laws are broken the right thing needs to happen. judge jeanine: lara, do you have plans to run for the united states senate in the state of north carolina? >> it's a question i keep being asked and i'm so flattered and humbled that i would be considered. i can't decided what's going to happen next. it's my home state. i love it dearly. i can see the really positive of what you can do whatever you are able to enact great positive change for people like we have seen president trump do. i have no news to break tonight.

judge jeanine: welcome back. you heard president trump updating america and the alleged voter fraud. jenna, i don't know if you heard my conversation with lara trump. but we were talking about the fact that governor kemp in georgia clearly has the power to call for a special session of the legislature to resolve some of the clearly illegal issues having to do with the consent decree by the secretary of state, as well as the act there appears to be evidence of illegal voting that dead people
voting, boxes being pulled out after people are told to leave. no reasonable observer being able to see any of the ballots observed. the same thing going on in arizona i understand with governor ducey. >> it's shocking that these governors are so receip -- so ro act. we had over 5,000 ballots cast illegally. 11,000 overvotes. more votes were cast than registered voters. just that alone would change the election. when democrats say there is no evidence of election fraud, they are willfully lying. but the state legislatures don't need the governors. they have the federal constitutional authority themselves to call for their own
special session where they can deliberate and reclaim their authority to resolve this election issues. that's what team trump is asking for. we need to make sure that corruption does not reign in america. judge jeanine: what we are talking about is article 2, section one of the constitution. it's not like we are making this up. those legislatures shall appoint in such manner as the legislature may direct. this is in the constitution. yet the governors will not do it? what are they afraid of? the amazing thing is, the legislators are a majority
republican. the president was elected by 10 million more votes than at least they are admitting to, and only corruption in some of the swing states where they had the biden astronomically high numbers after they stopped counting. the circumstantial evidence aside from the affidavit is so strong. am i wrong? >> absolutely. mayor giuliani had witnesses test my in pennsylvania, michigan and georgia, their state legislatures. the evidence these witnesses testified to, and the direct evidence from witnesses who were there and sow the ballots being counted in secret. from election officials who told
these poll workers to violate the law. this is absolutely election fraud. the state legislature didn't realize they had the power under the constitution. you put that up there. it's right there directly in the constitution. they need to act. the fact that they are republicans shouldn't matter. it shouldn't matter that they are americans and they have the courage to put forward their power and say we are not going to go along with false certifications. if they fail to act, they are complicit in this fraud. >> in light of the fact that the united states attorney general is refusing to act, and it seems that the legislature -- legislators in those particular states will have to get a spine and stand up for what's right. thanks so much. next, president trump's sterling

the fact that thanks to the underlying strength of the trump economy on the eve of the pandemic our economic recovery today has exceed even the most optimistic forecast. but you say when still need another stimulus relief package. why? >> no question we do. it's a movement coming at us. the first three phases of the stimulus and relief bill are going off. they are over essentially. and so that's gone. and what we also have now is economic lockdowns hitting us harder and harder the next several months. on top of that we have large structural adjustments in response to the virus that are hammering our cities, certain sections of our economy, sports, entertainment.
and education. this is lockdowns that hits the people who are least able to withstand this. what we need is a strong stimulus package that has three components. we get the business ppe plan going again, top, get that going. we have another round of stimulus checks, $1,200er household. $500 per child. then we need to reasonably increase the amount of unemployment compensation. we need a bridge through the spring when the president's beautiful vaccines will take hold and get us back towards normal. capitol hill, we are going to have a pelosi recession. she purposely didn't get a bill passed so she could hurt trump in the election.
judge jeanine: she ended up hurting herself in the house. when you talk about a regressive tax. some of these lockdowns are hitting the small business owner in this country. it's 9 small business owners, not the big box companies. in california where the governor is shutting the southern part of the state down, some counties are saying we are not going to do it. that would fight the regressive tax as you discuss as hitting the small business owner and american business owner. correct? >> correct. this is the re-alignment of the two parties. the beauty of donald trump is he basically transforms the republican party as the party of the working class. what we have now with this far left democrat party, the wine and cheese thing going on, there doesn't seem to be empathy for
the common men and women in this country just suffering and worried about their rental payments and mortgages and where the next meal is coming from. the combination of not acting on the fiscal stimulus and the economic lackdowns accelerating, we have got to deal with that and face that reality. otherwise it won't be that dark winter that other guy who didn't win the election, and we'll prove that, basically talked about. judge jeanine: peter navarro. thank you so much. we love having you on. coming up. can there ever be justice for my next guest after what evan his family endured. my exclusive interview with general michael flynn is next.
. judge jeanine: former national security advisor general michael flynn joins me in a "justice" exclusive. we are very happy to have you on and pleased with your pardon. let me get right to it. barack obama when donald trump came in as president said there were two people trump should worry about, kim jong-un and general michael flynn. how did you get into that distinguished group? why not blow the lid off all of them and tell us what you knew that they didn't want us to know. >> i must have put the fear of gods into barack obama and still do because of this long four-year saga they put me
through, and frankly the entire country. one of these days i will lay it out. but pretty amazing for the transition in the united states of america from one president to another. that was two points that the there are wanted to share with the president-elect at the time, donald j. trump. it's amazing. judge jeanine: you can't give us an idea, an inkling. so many of us were cheering for you. >> president obama knew that donald trump was going to have plea in some capacity in his administration, and likely there is a national security advisor or some other position. when he chose me to be the national security advisor they knew that their little plan of spying on donald trump would fall apart and many other foreign policy blunders they got
our country into, whether it was the iran deal, issues going on in the asian-pacific theater. trade, all sorts of issues that were in play that the last administration did to frankly run this country trite into the ground. they knew those were the types of things i was aware of. let's face it. barack obama appointed me twice. i was senate confirmed twice during the time i was in the military. so it's amazing that that would be what he would focus on during the transition for the united states of america. it's outrageous, actually. judge jeanine: it's unbelievable. you know better man anyone else about sydney. she doesn't give up. she is now involved in the presidential election. she is talking about all kinds of fraud. do you think that she is on to
something? >> yes, absolutely. i call sidney powell america's guardian angel of justice. her client, sidney powell's client are the people of the united states of america. that's who she is fighting for right now. she has her teeth into georgia, arizona, michigan, wisconsin, and the stuff that she has laid out in her various filings, it's going to play out here. as the president just said tonight, he mentioned some of the issues that we know are just a complete disaster and embarrassment for our country in this latest fraudulent election where there was in fact massive fraud. it's just incredible. we have to stop all engines right now. all these governors and quote-unquote leaders of the their states, they have to take responsibility and do something to stop what they are doing.
do not certify these elections and go back and do a far more detailed technical mail ballot and signature audit instead of just saying to the american people, hey, nothing to see here. we are just going to continue to move on to an inauguration. that's not what the american people want and they won't stand for it. judge jeanine: through all of this, your wife laurie has been described as the real hero and biggest victim. explain your relationship to coupled out there whose problems pale in comparison to yours. >> i'm a crazy irishman and she is a beautiful portuguese woman. a solid strong relationship, we have been together since we were 1 years old. it's hard work. but it's a lot of the fun together. she is my absolute rock.
judge jeanine: small businesses across the country are paying the price with more covid lockdowns. my next guest has seen the suffering firsthand. patriot and activist scott lobaido joins me now. how would you describe yourself. >> i'm a patriot, artist, activist. my job is to light the fire people have in their bellies. people are fed up. you know it, judge. i have been promoting patriotism for 30 years with my artwork. it's not just waving a flag on the 4th of july. patriotism is exactly what's happening right now which is people standing up for their rights.
a story broke in staten island this afternoon. hundreds and hundreds of people were online at the staten island mall buying candles that were 50% off at bed, bath and beyond. they are saying all the little businesses in this town can't have 15 people in there to have a beer it's disgusting. judge jeanine: the staten side pub closed down by the sheriff. you see that as a complete inequity. you see the sheriff shutting it down as taking a position against small business opposed to the big box companies. why do you think that's happening in america. >> our emmy-award winning governor. what did he say touts. he said do not congregate in your homes.
that's the most dangerous place to spread the virus. where are people going? they can't goat out. they are going home. we seem posting their parties they are having. 10, 20, 30 people. so it's ass backyards, excuse me. it's not fair to have a business across the street open, a big box store. this guy max and half the businesses in staten island are going down. they said we want to go down with guns blazing, so we came up with this autonomous zone. and they are breaking their own rules. the governor should be petrified. everybody in the city is now catching on. it's not that we don't believe in the virus. it's about being fair.
judge jeanine: and very quickly. the fact that on an airplane people are jammed in on american airlines. i have been on it. every seat is full. but the poor businessman who wants to support his family can't do it. in the end where do you think this will all end up? >> we'll win. i have never seen people more fired up. i have been planting the fire for people to get out there for so long. i am so excited the giant has woke up. and this quite is not going to end. we are not going to stand for communism. it's not going to happen. judge jeanine: we are out of time of withi --time, scott.
