me wreck my life. >> shepard: you seem to be doing that all by yourself. tonight, new charges for the accused acid hoaxer and new details about how police say she used drain cleaner to do this to herself. but first from fox this tuesday night yemen launch as new offensive in an area where a radical american cleric is believed to be hiding out. at one point there was word security forces had cornered one anwar al awlaki. he is the first american citizen to be on the u.s.' government's capture or kill list. for context he is said to inspire and motivate terrorists online. u.s. officials say is he a senior talent recruiter. today on "studio b" terror expert and author of the most dangerous places robert pelton explained why they decided to target him. >> he is like a minibin laden. is he more powerful than bin laden because speaks perfect

english and motivates people in this country to do violent acts. >> shepard: that's what he has done. linking him to the fort hood massacre and underwear bomber and times square and two others. catherine herridge, what do we know about his status right now. >> push where he is believed to be hiding is highly significant. today the paper reported that the u.s. born cleric was allegedly in the town in houghton where security forces had surrounded the area. this newspaper article was obtained claiming members of al qaeda in yemen were under siege. late today both u.s. and yemeni officials told fox there was no evidence al awlaki was among that group, shep. >> shepard: coincidence that the raid took place when the white house terrorism advisor was in yemen? >> the official line, shep, is that the two are not connected. some outside observers say a raid like today's can only help the yemeni government by showing

they are actively pursuing al qaeda. today the homeland security homeland security advisor personally delivered a letter to president obama to the yemeni president. today they said brennan's visit on monday was not connected to the raid. >> i have seen the reports of the actions in yemen. i'm told they are not tied to anything that john did or said or his presence there. >> a senior u.s. defense official tells our pentagon team that the u.s. military is providing intelligence and surveillance over the operation adding that yemeni security forces have really stepped up ground operations in the last year. and it's important to note, shep, that yemen is now the beneficiary of hundreds of millions of dollars in u.s. economic and military aid. >> shepard: catherine herridge live tonight in washington. well, the iranian president mahmoud ahmadinejad says it's time for a new world order because he says capitalism just isn't cutting it. the iranian leader spoke at the

united nations today and called for fundamental reforms in how the world goes about its business. >> the undemocratic and unjust government structures of the decision-making bodies in international economic and political fields are the reasons behind most of the plights today humanity is confronting. >> shepard: demands for capitalism has caused suffering all over the world. he has saved provocative audience for much smaller audience. eric, ahmadinejad made a pretty strong threat in front of some reporters. >> yeah, shepard. he attended a breakfast this morning with a select group of journalists. we were not invited. at that meeting he was asked what would happen if the u.s. attacked iran's nuclear facilities. he said that would unleash a war that would be quote, no no boundaries. he also claimed that the united states is unprepared for the consequences if it attacks. and he claims, shep, that iran is on the brink of becoming a

nuclear power. >> shepard: you just spoke with the defense ministry. what did he say about all of this. >> he called ahmadinejad a colorful dictator. iran has a nuclear and military capability. barack does tell me there is still time for sanctions. after that though he said it is still on the table. here is what he said. >> does israel have the will to attack the iranian nuclear facilities? >> i don't think that's an issue to talk about in front of the tv. israelis saw this tape that the argument is to be responsible for its future and we, of course, reserve whatever circumstances -- >> he said he thinks that sanctions are being effective, but the defense minister was adamant he said no one should test us. shepard?

>> shepard: eric shawn live at the united nations. there are new details tonight about what life may have been like for the american woman held prisoner in iran for more than a year and for her fiance and friend still stuck there the iranians of accused them of spying. they claim they cross the the border by accident. sarah shourd now back in the united states. iran reports it released her because of concern that she might have cancer and after somebody paid a half million dollars in bail. so far sarah shourd has not talked about her 13 months in captivity but another american woman is telling bus her ordeal. she is the journalist who spent more than three months in iranian prison on charges of spying. >> when i was taken there

>> shepard: she says the iranians kept her in solitary confinement for two weeks but never physically tortured her: if you are gay and want to fight for your country, you can't be open about it. the gay part that is it's the law in america. senate republicans blocked the legislation that would have changed that. it would have repealed don't ask, don't tell. democrats attached a provision on the defense spending bill $726 billion to fund the wars. they hoped the minority would be hesitant to vote against that bill. they weren't. every senate republican voted no. shannon bream live on capitol hill. shannon, what happened? >> well, shepard, as you outlined they were talking about the defense authorization bill and democrats have successfully gotten that attached to it, that rider that said we're going to repeal don't ask, don't tell. he needed 60 votes to get that vote to a bill on the floor. he only got to 56 as you mentioned. republicans did stick together. one of the big leaders on this case for them was senator john mccain. he says, listen, we have asked the pentagon to review this. their report is due

december 1st. why are we hurrying up and pushing it through now. he made the accusation it has to do with election year politics. here is his take. >> this is a blatant political ploy in order to try to galvanize the political base of the other side which is facing a losing election. >> he made that accusation a number of times, shepard. it was vehemently opposed by democrats and independents alike. >> shepard: on the other side gay advocates said they are worried they missed a true opportunity at quality. >> we want to give you a little bit of reaction from senator jack reed who once served in the army. he now serves on the armed services committee on the senate. here is his reaction after the vote. >> so, just the missing this opportunity today to get the bill on the floor in debate lessens, i think, obviously the chances of getting it done quickly before the election. >> those were the key words before the election. they all acknowledged here on the hill that the numbers could change after november 2nd and there is a lot of fear among the

construction. construction of single family homes which is a much larger sector was up but only 4%. while construction of bigger buildings rose 32%. now to the issue experts are concerned about. as new homes hit the market there is growing concern about houses that are already out there. banks have repossessed a record number of homes in recent months. some economists are warning they could start to unload them for ridiculous prices and drive down the values in the process. phil keating is in our south florida newsroom tonight. explain how that would work. >> analysts picked a number of homes bank owned nationwide right now about 1 million. in the florida market about 60% of the market bank owned. now, as those inventories sit on the sidelines, unable to sell today for what the banks originally wrote the loans for, they are costing these big banks plenty of money in monthly upkeep and maintenance. if they dump all the properties into the market right now. it's going to send the supply surging and drop the existing market rates even further under water.

>> shepard: there are analysts that don't belief this going to be a problem. >> realty track is the largest publisher of bank owned problems. it likens to the cold war super powers. each one being the first to press that red button. >> the banks don't want to be the ones to flood the market and take the real estate industry down. they know it would really cause a chain reaction and everybody would flood the market. and it would dessem mate the whole finance system. >> in addition to flooding the markets really risk the banks folding themselves. they would lose a lot of capital. what the banks is doing strategically is releasing limited numbers of these inventories per month. >> shepard: phil keating in south florida. thanks. a washington state woman who said a complete stranger threw acid in her face is facing charges herself. bethany storro said somebody threw acid in her face and now she says it is a lie. now we know how she did it in a sworn statement to police she

>> shepard: an indiana teenager who admits he strangled his own 10-year-old brother wanted to be just like the serial killer he had seen on tv. so says his former girlfriend. she testified in court today that before last november's murder this young man conley tried to talk to her about the title character in the fictional show time series dexter. just one more disturbing development in a very sad case of a now 18-year-old boy who claimed he was sexually abused repeatedly attempted suicide and who confessed to investigators that he rarely feels any emotions. he also explained on video how he killed his brother conner. knocking him unconscious with a head lock. then dragging him into the kitchen. >> okay so you were leaned over like that? >> yeah. >> okay. and you were -- you had your hands around his neck? >> um-huh. >> okay. >> and then i took the -- i took the glove off. and then i just go like -- like

that. and then i took his -- this glove off and continued to do this until he was dead. and then i reached for that drawer. i pulled out a bag. i put it over his head. i got the tape. i got the electrical tape and i -- >> shepard: imagine the family hearing that today conley expressed remorse for the attack saying he doesn't understand why he did it mike tobin has been following this case from our midwest newsroom. man, quite a statement he delivered, mike. >> it really was, shepard. andrew conley was described as calm, even detached as he apologized in court for killing his younger brother conner. andrew shed and -- said and i will give you the quote here. i'm very sorry for murdering my little brother. i still have no idea why this

happened but i really wish i did. i will accept wholeheartedly the punishment i'm given and deserve. the only contrast between this erie apology and the statement he gave police is that connor expressed little remorse with his original matter of fact confession. >> i think it's just what i've been feeling for a while is actually starting to become a reality. >> which is what? >> that i'm bound to hurt people. >> conley said when he choked his little brother, he wanted to stop but couldn't. he compared himself to a hungry man eating a burger. he says he believes he is sick and it just happened, shepard. >> shepard: a complex case, mike. clearly this man has been through a lot of problems. tell us about what you know. >> it's a very complex case. he expressed desires to hurt other people as well as himself.

he told doctors about fantasies of killing other people and i will spare you all the details here but they are horrific and barbaric methods he talks about. he also showed police where he hurt himself, where he had cut himself. also told about trying to kill himself a number of different ways which included throwing a space heater into a bathtub with himself. the defense said this whole disassociation is linked to that sexual assault he endured. >> shepard: he is about 18 years old now. what about the amount of prison time here? >> talking about 45 years to life in prison. the defense wants him to get a lesser sentence because they believe he is mentally ill. the prosecution says is he a monster who will kill again if he gets out, shepard. >> shepard: mike tobin in our chicago newsroom tonight. thank you. the fbi reporting the gunman who killed one woman and injured another on a texas army post yesterday was a 63-year-old retired army sergeant. it happened at a convenient store in fort bliss in texas near el paso. they killed the shooter near the scene it was isolated incident unrelated to terrorism.

bell, california who reportedly paid themselves enormous salaries. one in six of bell's 40,000 people lives in poverty. the excity manager robert rizzo alone made more than $780,000 a year. that's twice president obama's salary. trace gallagher in los angeles tonight. it sounds like the d.a. is pushing for prison time here. >> yep. the d.a. has said the worst offenders will get substantial prison time. it's not as if former city manager robert rizzo in the meantime will be wandering the streets because his bail has now been set at $3.2 million. and if for some reason he makes bail, the d.a. wants to know where he got the money. along with rizzo, former assistant city manager angela patchy was also arrested. and the current mayor oscar hernandez was arrested but cops had to get him out with a battering ram to break down his door. the other five on the list are all city council members. three former and two current. here is the d.a. talking about

the case. listen. >> rizzo and the others are accused of misappropriating at least $5.5 million. the complaint alleges they used the tax dollars collected from the hard-working citizens of bell as their own piggy bank, which they then looted at will. >> we should note the attorney general jerry brown who is running for governor has now frozen the pensions of those city leaders pending the owng o- outcome of this case, shep. >> shepard: the other go getter was police chief. >> randy adams was making $457,000 per year which by the way is more than the new york city police chief. chicago police chief. los angeles police chief. miami, on down the line. but even though his department only has 24 officers, he made that much money. now, the d.a. says they have 3,000 pages of documents and evidence and there is no evidence that adams committed a crime. listen. >> being paid excessive salaries is not a crime.

it's not a crime. illegally obtain those salaries is a crime. >> now the d.a. did acknowledge that he knows randy adams personally but says that had nothing to do with it. he says that if his mother committed a crime and he had the evidence, he would arrest her. shep? >> shepard: trace gallagher live this afternoon in l.a. trace, thanks. well, after another bloody day in afghanistan, nato officials now say this is the deadliest year for coalition forces there since 2001 invasion. 529 international troops reportedly killed since january. the latest include nine americans who we're told died in a helicopter crash today. it happened in the zabul province in southern afghanistan. the taliban claiming credit. nato officials say there was no sign of any enemy fire. president obama says it's never too late to honor america's war heros. today he awarded the nation's highest military honor to a master sergeant who gave his life to save a fellow air men more than 40 years ago.

[ applause ] >> richard exberger's three sons. he served as technician during vietnam. had no formal combat training at all. the military had only recently issued him a rifle. the president said today he was the very definition of an officer and a hero. >> richard etch burger lived the creed to never leave a airman behind to never falter to never fail. >> shepard: back in 196 the air force told his son that etch burger died in a helicopter crash. now the whole world finally knows the real story. the fox correspondent jonathan hunt from new york. >> for decades rich etch burger's covert mission wasn't acknowledged by the air force. today the family watched as that wrong was put right. >> of all the military declarations that our nation can bestow, the highest is the medal of honor. >> this was lima site 85.

a top secret u.s. air force radar facility from which a team of air men directed hundreds of air strikes against the north vietnamese me. chief master sergeant richard etchberger was a member of that covert team living at the tiny base on top of a 6500-foot mountain. the dropoff was almost vertical on all sides. and u.s. officials therefore assumed the base was impregnant nabil. they were wrong. on the night of march 10th, 1968, north vietnamese me soldiers scaled those cliffs and launched an assault that killed 11 of the 19 americans working at the station. with his colleagues lying injured, chief etch burger single-handedly fended off the north vietnamese for several hours using only his m-16 and a radio to call in air strikes. when rescue helicopters arrived at dawn, he placed his wounded comrades one by one in rescue slings to be hoisted to safety. each time exposing himself to

enemy fire. finally, he was hoisted aboard the chopper himself but as it flew off, bullets pierced the underside and hit chief etchberger. he died on the floor of that helicopter while the wounded men he had saved survived and made it home. >> he was the kind of guy who would be here saying i was just doing my job up there. i think he would be really humbled but proud of his achievements. >> it took this long for chief etch berger to be recognized largely because the base campaign was largely illegal under the geneva agreement. even when the u.s. government made that part of the war effort public, officials still said nothing about lima site 85 and the grord exploits of chief etchberger until information began to leak out in the mid 1980s. but today, shep, 42 years after his death, an american hero finally recognized. >> shepard: jonathan hunt, live in new york. jonathan, thank you.

aretha franklin's son in the hospital after an attack at a gas station in detroit. so says a spokeswoman for the queen of soul. to men and a woman beat him so badly last night that he needed emergency surgery. police tell the detroit news when they tried to question him today he had already left the hospital. we're told they waited for him to contact them to file a police report. the florida father who says bullies on the bus threw an open condom on his little girl's head appeared in front of cameras today. he apologized for storming on to that school bus and yelling at the kids and said in those moments he was only acting like the bully. surveillance video caught the whole thing. look. this is my daughter and i will kill the -- who fights her. >> the father says the kids harassed his little girl who has cerebral palsy from the first day of school and that when he first got on that bus he really only meant to speak to the driver. >> you don't see when the bus come late and everybody is hanging out the bus and my

daughter is standing back like she wanted -- -- when i see my daughter just break down, as a dad, i snapped and i apologize again. i deeply apologize for that. >> shepard: he faces two misdemeanor charges. we have more on his story tomorrow when he joins us live on "studio b." 3:00 eastern time, 2:00 central right here on fox news. the ceo of a struggling michigan bank left work on sunday and disappeared. investigators say he left the car there he didn't go home. he hasn't used his credit cards. his name david bidlack there are signs that somebody went through his office but little indication of where he may be now. this morning i spoke to the sheriff to ho is heading up the investigation. and he described the last time he left the bank. >> we do know he left around 8:30. he left out the bank side of the bank, which is very unusual. when he did, he didn't go near his car or by his car. he walked off into the streets. we don't know if he was meeting somebody. if he was distraught over

something dealing with the bank or some personal issues. we just know that he has been missing since that actual sunday evening. >> shepard: he heads the central bank in mount clemens north of downtown detroit. they lost $13 million in the last year and falling to zero star rating. leaving the white house while many americans express frustration over the economy. it's his turn to fall. where we're going in terms of a replacement. stands are supposed to hold fans at sporting events. details on this thing next.

divided up and spent before election day. >> all funding requests will be in by september 26th. our goal is to have that money completely out in the field no later than october 4th to be spent as we head into this electoral cycle. >> shepard: only rule nobody can use the cash to push a specific candidate. tea party patriots call themselves the largest tea party group with 100 local chapters. of course, we have already seen clear evidence of the tea party's impact? some of this year's primaries. they have helped knock out republican establishment candidates in favor of people including christine o'donnell who just reported a big win in delaware. in fact, she is about to be on hannity tonight. even more evidence now that o'donnell's victory might actually mean a win for democrats. latest fox news battleground poll shows chris coons leads the race 54% to o'donnell's 39%. if they had chosen mike castle coons would have been trailing by 15 points so says the poll. the tea party helps shape the political landscape in nevada.

there, things look a little more even. in fact, very even. the latest poll shows the senate majority leader harry reid and hair ron angle in statistic kel dead heat. nearly half of respondents there say their vote will express support or opposition to the tea party itself. the white house today announcing a big change to its economic team. the top advisor larry summers is session to leave the administration after the elections in november to return to harvard university. mike emanuel with the news live at the white house. mike, what is the president saying about this? >> well, shep, essentially president obama thanked larry summers for his service, issuing a statement late today saying, quote: i will always be grateful that at a time of great peril for our country a man of larry's brilliance, experience, and judgment was willing to answer the call and lead our economic team. the statement goes on to say, quote, while we have much more work ahead to repair the damage done by the recession we are on a better path, thanks to small noe small measure, to larry's wise counsel.

he is leaving for harvard. he will will be here until then. bill. >> shepard: summer makes three of the president's financial team to leave that says something. >> christina romer, the council of economic advisors chair now summers returning to harvard. what harvard told us is essentially summers had two years to maintain his tenured position at harvard and then he had to come back and so he will be there for next semester. >> shepard: i wonder if john boehner will take credit or blame. >> he did blast president obama's economic team and said they needed to be replaced base their policies is not working. obviously the white house is not going to say john boehner's idea this is why these people are leaving it does give president obama a chance to pivot to say we have three new members of the economic team. brand new ideas, frederick energy, we're going to try some new things in the years ahead, shep. >> shepard: mike emanuel.
