water district have rerouted the water to those homes. they have not located the exact location of the break. it's the second break in that area just in the past eight days. our terry mcsweeney will have a live report coming up later in this newscast. >> and a san jose police officer is on paid administrative leave and could face charges after being accused of exploiting his position stopping his teenager stepdaughter and boyfriend from having sex. theresa garcia is live at the police department with this story. >> this is a case that involves some questionable parenting skills to now maybe criminal charges. the cop involved said he was never presenting to arrest this young boy but invited to use scare tactics. the situation for this veteran san jose motorcycle officer is that he's being investigated by the district attorney's office to see whether he committed a criminal false imprisonment last month. the 15-year-old boy's parents feel the officer abused his

authority. the parents say the officer pulled up to their house in full uniform after his shift ended, berated and warned the boy to stay away from his stepdaughter and handcuffed him and told him he could face sexual assault charges. later the officer unlocked the cuffs telling his parents that he just wanted to scare the boy. abc 7 legal analyst dean johnson says the officer should have referred the situation to another investigator. >> if it's not technically a crime, if it's not, say, assault under cover of authority, at the very least it was -- it was an unwise move. >> the boy's stepfather video recorded some of the encounter on his cellphone and the parents reported the incident to san jose police internal affairs. after they complained, a detective interviewed the boy and then cited him for a misdemeanor of unlawful sex with a minor. the officer's daughter was also cited. the names of the teenagers' parents are being withheld to protect the identities of the

minors involved. at this point the d.a.'s office say a prosecutor has reviewed the case but referred it back to the police for more information. >> hayward police are investigating the cause of a car accident that left an auto parts store in shambles. take a look at the damage to this craigen store on jackson street near mission boulevard. the driver of the car went on to the sidewalk and then crashed into the store front. it happened just after 10:00 last night. the store was closed and no one was inside fortunately. firefighters had to pull the driver out of the car and take her to the hospital. we don't know the extent of her injuries or what caused her to drive into the building. >> this morning san francisco police are investigating a major accident involving eight to ten cars that injured at least three people. let's take a look here. investigators say a reckless driver began smashing into cars near mission and new montgomery in downtown san francisco last night. at least three people were taken to the hospital to be treated for injuries. all are expected to survive.

police are trying to determine if alcohol played a factor. a federal judge is considering lifting his ban on executions in california which could open the door for capital punishment to resume as early as next week. lisa amin gulezian reports some are questioning the timing of it all. >> the fate of death row inmates will be decided on the fifth floor of the federal courthouse in san jose. that's where attorneys for the state and condemned inmates michael morales and albert brown are pleading their cases. the attorney general's office wants executions to resume on the 29th with the death of convicted murderer and rapist albert brown. >> to go ahead and push these executions i think is unfair, not just to the condemned but those people who really want to know what's happening with the process. >> the state claims the process has changed. just as federal judge jeremy foggiel ordered when he halted executions in 2006. now the execution rooms are

bigger and staff is better trained but defense attorneys don't buy it. >> they seem to have the same pressure -- procedure with the same people doing it. we've been down this road. >> the federal judge in charge of this case is trying to keep things focussed. he wants the state to let him know by today whether the drugs used in executions can go from the current three down to one. he is expected to make a final ruling friday. in burlingame, lisa amin gulezian, abc 7 news. >> well, the debate to resume executions is getting reaction in the governor's race. the democrat and attorney general jerry brown wants to reinstate the death penalty although he personally opposed it when he was governor. he says as governor he pledged to uphold the law. as attorney general he pledged to uphold the law and he will continue to do so when he is governor next year.

meantime republican candidate meg whitman campaigning in burlingame last night, she didn't mention the death penalty but released this statement: even on matters of life and death jerry brown is willing to play politics. none of it squares with his record and must have reporters scratching their head. >> a supervisor is scheduled to vote on an agreement that could increase advertising at san francisco international airport by 75%. airport travelers could see 187 more ads under a proposal between sfo and clear channel as part of a three-year contract extension. it would have ads on jet bridges and transit shelters. the advertising would generate $23 million over the next three years but the whole deal could not happen because of previous ad limits approved by voters. >> all right. sfo this morning pretty clear if you're coming in for a landing, maybe a little bumpy. >> check out some of those

trying to sign up for classes than were actually attending class. foothill lost a combined $20 million in state funding this year forcing them to eliminate about 500 courses. that has left 7,000 students on wait lists to get into classes they need. >> we're at virtually full capacity. we brought 1700 students off wait lists last night into courses. we've added sections where we can but we're frankly at the max of both our faculty and staff's capacity as well as just room. >> students have until friday to get into their classes. if they can't, they're going to have to wait until january. >> a new book puts the white house and obama administration in the spotlight but not for something positive. the book called obama's wars written by prominent journalist bob woodward depicts intense battles inside the white house. woodward claims the president's aides were deeply divided over the war in afghanistan. in the book he claims the

off to a quiet start this wednesday morning. trafficwise looking good but still road work going on. i'll have those details coming up. >> an a. c. transit is expected to decide today whether to slash night and weekend service. help close a $56 million budget deficit. >> it's 5:30. i'm jenelle wang. >> i'm kristen sze. let's begin with this story. a san jose police officer is in hot water this morning accused of staging a fake arrest. the reason? apparently to scare his stepdaughter's boyfriend. abc 7's theresa garcia is live in san jose with the story. theresa? >> well, the officer got involved last month when he found out that the 15-year-old boy was having sex with his 14-year-old stepdaughter. now, he says that the parents were okay with him using scare tactics and this was really to help the boy or stop him from actually, quote, heading down the wrong path. now that san jose veteran motorcycle officer is on administrative leave and he's under investigation to see whether he committed criminal false imprisonment.

our media partner, the san jose mercury news, feel the boy's parents feel the officer abused his authority. he pulled up in full uniform, berated and warned the boy to stay away from his daughter and handcuffed and told him he could face sexual assault charges. later the officer unlocked the cuffs telling the boy's parents he just wanted to scare him. legal analyst dean johnson calls the officer's actions an unwise move. >> anytime a police officer is personally involved in the case where his relative or a close friend is a complaining witness or a party to the case in any way, the best practice would be for the police officer to refer it to another investigator. >> the boy's stepfather video-recorded some of the encounter on his cellphone and later reported the incident to internal affairs. a detective interview the boy

and cited him for a misdemeanor of unlawful sex with a minor. the officer's daughter was also cited. the names of the teen's parents aren't being released to protect the identities of those minors. the prosecutors are looking into this case right now but have referred it back to the police for more information. really a tough case of questionable parenting skills versus now possible criminal charges. live in san jose, theresa garcia, abc 7 news. >> thanks, theresa. on friday a federal judge in san jose is expected to decide whether california can move forward with lethal injection executions. officials at san quentin say the death chamber is ready for a scheduled execution next week if the judge lifts his moratorium. they are enlisting judge jeremy fogel. he will submit by today whether or not the lethal injection can be administered as a single dose instead of a triple shot.

a police chase spanning from the north bay to the east bay. this is where it ended at roosevelt street and harbor way in richmond but began when vallejo police chased a stolen car at speeds above 100 mph. the car eventually crashed into a parked truck near roosevelt street. this truck caught fire and the flames with apartments on six floors. firefighters put the fire out quickly and determined the building was damaged but still safe enough for residents to return. the driver of the car is hospitalized with moderate injuries. police say he faces numerous charges. a female passenger was also detained. >> richmond is the latest bay area city to regulate marijuana dispensaries. the city council approved a measure last night that limits the city to just three medical marijuana dispensaries. patients will be limited to purchasing one ounce per day. the police chief will hold public hearings before issuing

the three permits. richmond voters will decide november 5 this weather the city should tax the sales. oakland has already passed similar measures. >> board of directors will look at cutting bus routes in order to save money. the transportation agency is considering cutting night and weekend bus service to reduce a projected $56 million deficit. the proposed cuts would save $13.5 million. overnight service would be reduced to just two lines and more than half of the weekend service would be eliminated. the union representing drivers points out a. c. transit has spend hundreds of thousands of dollars on legal fees to try to avoid court-or theed contract arbitration. >> some of the worst roads in the nation are here in the bay area. a national research group called trip said 64% of the roads in san jose are riddled with bumps and potholes. the national average is 24%. los angeles comes in second followed by honolulu. concord, new hampshire, is 4th

events at clubs register online with the city's entertainment commission. he says the legislation could prevent avoidable tragedies. there was a fatal shooting outside jelly's dance cafe in july at pier 50 and a fatal shooting outside the suede nightclub last february. clubs would only be allowed to work with those promoters who have registered. >> an employee has sudan oakland school claiming she was laid off claiming she was bidden by the college president's dog. pamela reid was the executive assistant to the president pictured on the left. reid says she was preparing a fun raising event at homegreen's home last year when the terrier bit and latched on to reid's leg. she suffered minor injuries and reported them to oakland animal services. there was tremendous tension in the office after that and she was laid off in january. homegreen's office says these claims are without merit.

>> another shuffle in president obama's economic team and more companies are saying cheers. the bloomberg business report straight aheed asome of the nation's largest health insurance controversial action to get around the health bill. how it affects millions of families with children. >> on capitol hill, tough questions are expected today for the owners of two iowa egg farms at the center of a nationwide salmonella outbreak. what were the facts? fact: march 7, 2000. brown asks voters for new mayoral power to appoint school board members. he gets it, and promises better schools. but the drop out rate increases 50%. the school budget goes into a 100 million dollar deficit. the schools become so bad the state has to take them over. it was "largely a bust," he admitted. jerry brown. failure as governor. failure as mayor. failure we can't afford now.

reports some major insurance companies are going to stop selling new policies for children. anthem blue cross, aetna and others will hold new child only policies in california and other states. the company says the new rule taking effect could create huge and unexpected costs. they include a ban from rejecting youngers with preexisting conditions. >> the heads of two iowa egg farms linked to last month's salmonella outbreak are set to testify before congress this morning. members of the house energy and commerce committee want to find out more about wright county egg and hillendale farms. the salmonella outbreak resulted in the recall of a half billion eggs and sickened up to 1600 people, including dozens here in the bay area. an fda investigation found towers of manure, bug and rodent infestations at the farm. the two egg farms also had positive test results for
