layoff clause. something that the city might not be able to live with. for the first time, san jose's recently hired chief admits the layoffs of 49 firefighters is impacting response times in the city. san jose from 203 firefighters on duty to 179. >> there is times we knlt get there quick enough z our capacity is not near what it was before. so we need to put more firefighters on the streets. >> the chief welcomes an announcement the federal government is giving san jose millions to rehire firefighters under a program called safer standing for safing for adequate fire and emergency response. fema approved 58 safer grants nationwide, there is nine in california. and san jose gets by far the lion's share of the golden state money, nearly $15 million. the mayor says the problem with the grant is that there

are strings attached f the city accepts funds it must promise not to layoff firefighters for two years. >> we'll need a 10% pay cut in the way of kons yegss. the question is whether or not we need more than that in order to make this happen without having to hire firefighters and layoff someone else in order to cover costs. >> the balancing act will be difficult. the city faces a $110 million short fall. last year the firefighters union refused to accept the mayor's 10% demands. the union president told me today that they will do their part in the negotiations process. no one wants to walk away from the $15 million check. >> everyone swril to pull their weight. and the department or council and mayor and our city manager as well as firefighters. we need our firefighters to assist us in finding a way to make this happen. >> and representatives from the firefighters union were at city hall making a prose

poseal. the city is going to explore possibilities the government could waive that no layoff clause there. is going to be a lot of number crunch brg the city council accepts this washington wind fall. in san jose abc 7 news. >> thank you. >> and uc berkeley confirmed painful cuts to the sports program. there will be no cal baseball season next year nor men's gymnastics. three other sports have been saved. the university needed $25 million to keep teams but only raised about half of that. why so many supporters donated money are angry tonight. >> cal baseball players were told to stay hopeful despite their program being cut. >> the first thing that went through our minds is we're dangerous. you know? we're all -- mad. >> the heart breaking part is that it took us a long time to build the program to be a playoff contender. that is what we are. and to see that come crashing

down and all at once it's difficult to watch. >> the university announced it's cutting five sports because of the budget deficit. a fund raising campaign began with a $25 million target. only half was raised. and according to the university baseball came up short. >> baseball... would have needed to raise six times as much money. for them to have been able to show the same financial capacity that rugby showed use rugby was spared and so was womens lacrosse and gymnastics. had the university cut all of the five sports it would have put them out of compliance with title 9. would it have meant cutting more men's sports. and flemer was told it was all or none. >> that was a requirement when we first talked to the university that it was not baseball alone.

for many people who live there. and we could not do that. >> drivers we spoke with say the escorts are only a short term solution. >> first, san francisco supervisors passed what they called strictest local hiring order nens in the country. now an assemblyman has countered troin dusing a bill stripping away state money from projects. abc 7's vic lee has the story. >> we need to focus on creating jobs regionally. not just in each city or county. >> this assembly managery hill joined by a host of public officials from san mateo county. all voiced their opinions to called local hiring ordinance. in december, supervisors passed an ordinance requiring 20% local hirings for city public works projects increasing to 50% in 2016.

hill's legislation preventing state moneys from being used on those projects as well as others in city was a similar ordinance. standing in the wings were workers from san francisco who opposed this bill. most were from bay view hunter's point. >> we need jobs in the community. we're the last ones hired and first ones fired. >> hill maintains san francisco's local hiring till bill would apply to projects at sfo in san mateo county. carol groom is president of the county supervisor autos for a neighboring county of ours to say that men and women cannot work on projects in san mateo county is unacceptable. >> the author of the local hiring ordinance is supervisor john avilos. >> there is an attempt by jerry hill to get his name in the papers. >> he says if hill's

>> closed captioning brought to you by mancini sleepworld. there is a growing wave of concern about the dmv. people are complaining about huge delays in getting their licenses renewed. one young woman has been waiting months to get her first one. >> let me tell you. the dmv is having a rough time getting licenses to drivers. abc 7 news reported on that weeks ago. the state said they're getting things under control. but now i've received a bunch of new complaints. here is just one of them. behind the wheel there, that is rachel brown.

for a young driver she's doing great. she knows rules of the road has a car and now she needs a driver's license. >> i am 16 but have been 16 seven months now. i still don't have my license its not for lack of trying. she went to dmv passed her test and got the picture taken. called back weeks later by dmv and needed to take a picture again. she was told to wait four to six weeks. a license didn't arrive. she called dmv and said it needed another picture. >> and another month goes by. and still, no license. here is rachel. >> the last time i called they checked it said your december 14th trip to the dmv the picture is processing. i said well good. what does that mean? we want to get a permanent license. they said you'll have to call dmv in sacramento. >> they did. and then they called me.

i went to sacramento looking for answers. >> if she had to come in and take the picture three times that is very rare. i don't know why that happened. >> three pictures is out of the ordinary. but a long wait and expiring temporary license is not. here is the problem. new high-tech licenses. delays began last year and in recent days complaints to 7 on your side office increased still, dmv increased things are going better now. >> the vendor that makes the license was having start up issues because of the complexity of the licenses. so we've had a little bit of a delay and backlog. they're starting to get things more rectified. the backlog is getting less. >> it leaves rachel and her dad where they were when she first took the test back in september. >> now they say that they'll send it in four to six weeks

again. i just had to renew the paper license. >> have you received that. with an expieration date of may 6th. we're crossing our fingers that a real license will come in the mail. >> dmv is working really hard on this case. a family tells me three different dmv officials contacted them today alone. now if your license is about to expire you feed to call dmv. it will not send out a new one unless you ask. how bad is this problem? there has been a massive improvement and still one out of every 10 licenses has to be remade. >> no kid something. >> that is a lot. >> there is a six week wait. think about it that is -- outrageous. thank you. >> and this is a very important weekend. >> it is. we have a last chance to enjoy full sunshine. >> people have been walking around saying it's going to be beach weather. there is beach weather today.

a small businessman in san francisco is accusing city officials of corruption and influence peddling. at issue are those contracts to run the city parking garages. dan noyes is here now with his investigation into this. >> the city attorney is investigating the businessman's claim he's filed. he won bidding to run six of the most-profitable garages and somehow lost the deal. for fred the american dream was quite real. he imgreated from ethiopia 30 years ago working up in the parking business. >> i was a cash year and valet

attendant everything. i said it's time to do this. i can do this myself. >> he manages three garages for the city. when the transportation agency or mta announced a new open and fair process he saw a chance to take his business to the next level. >> i bid. yes. i bid. it was -- . >> you won? >> completely. fair and square. >> kelly partnered with a canadian company and won the contract to manage six of the city's most-profitable garages including civic center and golden gateway. but behind closed doors the wheeling and dealing was about to begin. >> the companies who did not like the outcome were able to influence people in the city to give this thing reverse or reject it and that is what happened. >> the claim the kellys attorneys filed allege unfair business practices retaliation, intentional interference with contractal

relationships and more. at the center of the controversy, the relationship between mta executive director nat ford who oversees this process and prominent san francisco attorney steven day. this is file video of day from 1997. he told us he is his personal attorney but they had no conversations about the contracts. >> any conversation with steven day? >> not in terms of parking contracts. he's -- he represents me as my attorney from time to time. but... no involvement. >> here is the personal and confidential letter steven day sent ford on behalf of pacific park management who lost the contract to fred. day calling it an unjust process asking ford to set aside results.

the same day day sent that letter and mta staff member wrote an e mail saying ford was now discussing rejecting all of the proposals. and there is a is a meeting at day's penthouse office on new year's eve 2009. >> my partner told me there are other companies second and third place winners want to meet with us. >> and this claim says day claimed he was given approveal to mediate by mr. ford and that an executive from five-star parking made a threat. >> if they don't renegotiate and give up garages they'll stall the process and maybe get it rejected. >> my client was told we have enough juice, they used the term juice to, stop the contract. >> and he did inn.fact lose

the contract. it looked like the vote would go well at the board meeting in march. and staff recommended bakelly get the contract. >> we feel it would be in the best interest to go ahead with the awards at this time. >> and he thanked nat ford. >> i would like to thank the board and also... ford. >> somehow bakelly didn't get the vote. >> two eyes and three nos the motion is not approved. >> one board member tells i team he wasn't sure which contract they're voting on but had a hard time getting answers from ford. so fred had one option. return to the board one last time with a new lawyer... former president of the board of supervisors. >> boy rather not be talking about damages a year and a half from now or two years

there is a push in sacramento for the state to act as food police. and there is one senator proposing legislation to

prevent people from using those for junk food and sodas. with few exceptions food stamp recipients in the cal fresh program can buy virtually anything at the grocery store even junk food. now a lawmaker wants taxpayers to stop footing the bill for unhealthy eating. state senator rubio proposing to ban ban them from being used for things like chips and soda. and doesn't want them used at fast food restaurants either. >> the senator hopes to curve the obesity problem. the democrat says that many food stamp recipients end up with medical problems from eating poorly and taxpayers likely to pay for their care. and opponents say it's not fair. >> we don't just think we should single out low income
