>> reporter: prosecutors and defense attorneys will argue over a package containing a notebook, holmes, mailed to his psychiatrist, lynn fenton, intercepted by police. >> they want that out of the hand of the police and das, because there is a physician/patient privilege. >> reporter: we tried asking the doctor what if anything did she know about holmes and his alleged plans. dr. fenton? she wasn't answering. experts point out there is always a chance she knew nothing, that holmes kept his alleged plan a deadly secret. clayton sandel, abc news, aurora, colorado. fascinating day in court. talking about the 12 counts of first-degree murder, 58 counts of attempted murder, 58 counts of first degree assault, reckless endangerment, all said and done, could be hundreds of charges against him. >> the defense can claim, holmes

is not competent to stand trial. not sure if that could come this week. this is different from an insanity plea, as well. but this is just the first step of many. about 30 days down the road we have the preliminary hearing. then you have arraignment, months from now. then sentencing. this could drag on for a while. >> a long process. >> but just really key to emphasize he will not make a plea tomorrow. today rather. >> he will not do that. the bar is pretty low in terms of is someone competent to stand trial. experts believe he will be found competent enough to stand trial even down the road if he is found insane. important to note. and this will move forward in terms of the trial the gets started later today. moving on, police in the heartland are looking into bomb threats against several wal-mart stores. those threats were made against three walmarts in leavenworth and lawrence, kansas.

the stores were temporarily closed. no bombs were found. yesterday's threats followed similar ones that happened in eight communities in missouri last friday. again no bombs were found at those stores. in other news this morning, protests stemming from two police shootings in anaheim, california, have taken place for nine straight days. more than 300 demonstrators were out, voicing their anger against the city's police whom they accuse of racism. two protestors were arrested. federal prosecutors and the fbi are looking into the shootings to see if civil rights investigations are warranted. some new information about medical leave of congressman jesse jackson jr. the democrat from illinois is being treated for depression and gastrointestinal issues at the mayo clinic in minnesota. there is no timetable for his recovery and his return to congress. jackson has been on medical leave since early june. his whereabouts and condition have been unclear. mitt romney heads to poland

this morning where he will visit the site of the first shots fired in world war ii. on top of that, he will also pay tribute to the country's anti-communist movement. yesterday, romney met with an old friend, israeli prime minister, benjamin netanyahu. the visit meant to send a message that friendship matters at a critical time in relations between israel and iran. >> personal friend of mine and a strong friend of the state of israel. >> israel faces enemies who deny past crimes against the jewish people and seek to commit new ones. >> romney said israel has the right to defend itself against iran and that the u.s. must lead the effort to keep iran from getting nuclear weapons. >> romney and his wife stopped at a sacred jewish site which has been visited by so many leaders in the past. abc's david muir reports from jerusalem. >> reporter: it was a powerful backdrop for a presidential campaign that brought mitt

romney and his wife to the western wall. both leaving their own separate notes their prayers. >> before we went to the wall we both sat down and wrote prayers. you know, i read to her what i had written. and she read to me what she wrote. my thoughts were with regards to peace, my family, my wife, and -- and -- source of our salvation. >> reporter: two prayers written together, now left behind here. so many have made the pilgrimage to the wailing wall to pay respects to the great symbol of the jewish people. it is tradition to leave a prayer, a message. in 2009, barack obama left a note reportedly leaked to an israeli newspaper. in it he asked god to give me the wisdom to do what is right and just. hillary clinton came when her husband was running for re-election. and there was also then-governor george w. bush, his hands touching the wall. other famous faces elizabeth taylor, richard burton in 1975. and in 2000, ailing pope john paul ii made an historic trip, attempting to build a stronger relationship with catholics and jews, we wish to commit ourselves to genuine brotherhood to the people.

two more prayers added with quiet wishes from america. mr. and mrs. romney, writing the prayers together, adding to so many powerful moments at the western wall. david muir, abc news, jerusalem. >> and, again this is just about halfway through his international tour. he said, he said yesterday, that preventing iran from obtaining nuclear capabilities that is going to be his highest national security priority. >> right. and david, part of the interview, pressed him, said your strategy in terms of iran, israel doesn't seem too different from how the obama administration handed it. we will see if there is a strict difference here. some have been critical saying, israel, american tensions have never been worse than right now. so he is trying to heal some of those wounds and mend fences. see how it, how it plays out. >> one thing he is not doing on this tour, not, he is trying to not publicly criticize president obama or, really, really, critique him on foreign soil. he says he wants to stay away from that. that's not his place.

>> out of respect. also david asked him, what about controversial comments you made in london. got a lot of headlines, obviously. romney said i don't regret it, pretty much. he stood by his comments. which is good. it may not have been polite. he did think express concerns, people have about the games. >> he says i usually say it what i'm thinking. >> i appreciate that. moving on this morning. syrians are fleeing their country in droves as a fierce battle continues to rage in its largest city. amateur video in commercial hub aleppo shows rebels celebrating after seizing a government tank. the opposition has reportedly taken over large sections of the city while squalling for international help to arm the rebels. meanwhile, the syrian regime is accusing saudi arabia, qatar and turkey of trying to destroy the country. boeing's highly touted dreamliner is under federal

scrutiny after one of the new jets sparked a fire in south carolina. the 787 experienced what boeing is calling "an engine issue" during preflight testing over the weekend. debris reportedly fell from the jet and started a grass fire near the runway. the high-tech dreamliner debuted last year after years of delays. it is supposed to offer more comfort and fuel savings. frightening moments at a six flags theme park in california. a new superman ride got stuck right at its tallest point leaving a dozen people stranded 15 stories in the air for more than an hour. luckily they were in the upright position. a good thing. a crane was brought in, but, park workers were able to restart the ride, sending riders safely to the ground, backwards. >> imagine if they were upside down. >> oh, man. those guys must have been freaking out. >> ooh. >> no backing out now. no place to go down. we admit that the phrase "end of an era" is a little overused. just a little bit.

this is a story that you could do something about. the american red cross is sounding the alarm about a critical shortage in the nation's blood supply. >> it is actually called the worst in more than a decade. there is a surprising reason why. abc's ryan owens explains. >> reporter: severe weather can knock out power, blow down trees, and flood streets. but this year all of those summer storms hit something else -- the nation's planned parenthood supply. the american red cross says the supply has dropped to its lowest level in 15 years. >> it really puts our community in a very difficult situation. patients don't get vacations. they're in the hospital and they

need blood. >> reporter: summer is always slow. the red cross says the severe weather canceled many blood drives. what's more, doctors say the extreme heat is keeping many regular donors at home this summer. >> you never know who is going to be the next person that needs blood. it might be your next door neighbor, it might be your child and it might be you. >> reporter: hospitals may cancel elective surgeries or postpone more serious procedures because they require so much blood. >> patients having elective procedures are encouraged to donate blood, two to three months ahead of time for their surgery to ensure their procedure is not canceled. >> reporter: august is traditionally the slowest month for blood donations. the red cross is hoping that by sounding the alarm now they can weather this storm, too. ryan owens, abc news, los angeles. >> they reached emergency levels june 25 with 50,000 fewer donations in june.

in full swing of course, about to enter day three of the competition. >> the united states doing well. china has six gold medals. four silver, two bronze. 12 total. united states, three golds. five silvers. and three bronze medals. we are slacking. italy, third, as abc's tom rivers reports, records are being shattered. >> reporter: dana volmer led sunday. the 25-year-old won gold in the 100-meter butterfly in world record time. the men won silver in the 400 meter freestyle relay, earning michael phelps his 17th medal. but his great performance wasn't enough to get ahead of the french team. abby johnston and kelci bryant earned silver in the diving pool, the first olympic synchronized diving medal for the u.s. and kim rhode achieved gold in women's skeet and made olympic history. 393 year old first american athlete to win five medals in an individual event in five

consecutive olympic games. it was also a good day for american men's basketball. after a lackluster start, the superstar squad beat france 98-71. >> when you see lebron james diving for a ball, the first couple minutes of the game, what does that say? >> it shows how much we want it. >> reporter: michelle obama was on hand to cheer the players and provide hugs. u.s. women's gymnastics team moving on to the finals without jordyn wieber, the world champion came in a shocking third only the top two qualify for the all-around medal competition. the 17-year-old sobbed as she left the arena. and the first win for american male volleyballers, todd rogers and phil dalhausser beat their japanese counterparts in two sets. tom rivers, abc news, london. >> that was really a big upset with, for gymnastics, jordan -- jordyn wieber, a world champ. looks like she was underscored. some of the u.s. commentators. >> did you watch a lot? check it out? >> i did. i did. >> there is the gold, prompter reading, the gold goes to paula faris.

>> that news has gotten pushed to the back burner a bit. we shouldn't forget about the very tense situation between iran and israel, how the situation is going. we had that incident a few weeks ago with 13 israeli tourists -- tourists blown up on the bus. netanyahu talking tough, all the diplomacy and sanctions have not set back the iranian program by one iota. that's why i believe we need a strong, incredible military threat coupled with the sanctions to have a chance to change that situation. so that situation is still very much at a boil. >> romney, his fourth trip to israel. clear he is working on the alliance with benjamin netanyahu. they have a relationship, i think the '70s, worked at the same boston consulting firm. he doesn't take, trying not to take any swipes against the president, while on the

international tour. he did say we can't stand silent as those who seek to undermine israel voice their criticism and we should not join in the criticism. >> the president said all options are on the table when dealing with iran. we'll see. >> the tour continues. well, the suspect in the colorado movie shootings is to be formally charged with murder later today. james holmes expected to face 12 counts of murder in the first degree and hundreds of other count including attempted murder and assault. >> if he gets convicted of one count of first-degree murder, the punishment will be either the death penalty or life without possibility of parole. >> we are also learning that the company which runs the aurora theater hired off-duty police officers as security guards in other locations but none on duty at the aurora theater. syrian troops are unleashing

heavy fire power on rebel positions in its largest city. as the battle intensifies, the u.n. says more than 200,000 people have fled the city of aleppo in two days. abc's reporter is inside northern syria and brings us the latest. >> reporter: fighting continued to rage in aleppo, syria's commercial capital. regime forces shelled neighborhoods taken by opposition forces desperately clinging on calling for heavier weapons. we crossed into syria early this morning, our first stop was a city which had seen heavy violence last month outside aleppo. the devastation was staggering. there hardly seemed to be a single building left untouched. and virtually a ghost town. also remarkable was traveling all day across northern syria, we didn't see a single government tank or troop. which tells you how far these opposition forces have come. but until they take a city like aleppo they have a long way to go. >> alex marquardt reporting there from inside syria. two big developments in syria.

one, the chemical weapons, removed, transported, eyes of the world wondering if assad will use them, when and how. and the use of helicopters. the first in the last couple weeks. bombing his own people here. and defense secretary, panetta said using helicopters against his own people was a nail in his coffin. talk getting very, very tough. wondering if assad's days are in their final numbers here. >> leon panetta saying he lost all legitimacy, right now the battle between the rebels and government. government troops saying they recaptured a part of aleppo which is what they're fighting for, capital of syria right now. the government declared victory on sunday in aleppo. it is sad to see what's going on there. and leon panetta almost like begging for the united states to do a little bit more. but it's a tough situation for all parties involved. >> if it was not an election

year would we see more action, probably. politics complicate is a lot of stuff. moving on to weather news. eastern pennsylvania is roughing from another round of damaging storms. strong winds and heavy rain, rolled in over the weekend. knocking down trees and power lines like this one that caught on fire. thousands of folks in the philadelphia area lost power. and wildfire danger in new mexico is getting worse as beetles swarm a forest there nesting and feasting. they reproduce quickly with one adult female laying up to 200 eggs. the beetles were introduced to thin out the trees but weren't expected to move quite this fast. >> beetlejuice. >> don't say it three times. bugs will be here. >> three times. don't say beetlejuice three times. sorry. i just flashed back to my junior high days there. >> ha. here is your monday forecast.
