in san francisco, police are on the scene at oakland because the signal lights are out. mass transit, all on time this morning. we have no delays -- well, specific too soon, metering lights are on with minimal delays. authorities are preparing if a large protest over a sheriff deputy shooting a 13-year-old to death. the boy's family is ready for his funeral. we go to the newsroom with that story. >> we have new information: police are warning neighbors of a large protest mapped today -- planned today for the police shooting of a teen boy rallying in the name of 13-year-old andy lopez in downtown santa rosa. new information about deputy would shot lopez: 48-year-old erick gelhaus is a 24-year veteran of the department, a

firearms instructor who has written articles for law enforcement on the use of deadly force. >> it is maddening. they used excessive force. >> we can never take back what happened. we can express our sympathy and our sorrow to the lopez family and the community. >> lopez was carrying a realistic-looking assault rifle that shoots pellet that closely resembled an ak-47. deputies stopped him and ordered him to drop it and opened fire hitting him seven times killing him. officials are saying leave all toy weapons like this one at home. yesterday, the sheriff told abc7 news that he did not believe ratism was involved saying that the sheriff has done much in the past three years to build bridges specifically with the latino community. >> new details this morning on

the deadly crash that least a peninsula couple dead. the driver accused of hitting them is expected in court and we are learning new information of the dog that was severely injured in the accident. matt keller joins us from menlo park. >> i spoke with a worker at the veterinarian clinic and said the doc, teddy, is making great strides. but right here, a reminder of what was lost: a memorial for a father and mother of three teens hit and killed by a car. the driver is charged with manslaughter under the influence of alcohol and felony drink driving. show was intoxicated when she hit and killed the couple. show was scheduled to enarraigned yesterday but the hearing was postponed. her brother visited her in jail and says she doesn't remember what happened.

>> she said somebody cut me off but she don't remember nothing. >> she has been arrested dozens of types on misdemeanor drug offenses and driving violations but only once for d.u.i., a misdemeanor last november. the victims were walking their dog when hit and killed. thing do was taken to an emergency vote with trauma. he can be released as early as today. her arraignment was postponed until later this afternoon. >> the families of two best friends are living with the consequences this morning of drinking and driving. the 17 year old jason park was killed when his car spun out-of-control and crashed in fremont on sunday morning. jason was not behind the wheel, his best friend was would volunteered to drive because jay son was too drunk. authorities say both teens were
