refugees. >> these were trained terrorists in the art of bomb making that are inside of the united states and quite frankly from a homeland security perspective, that greatly concerns me. >> reporter: the kentucky case unfolded in the city of bowling green, where two iraqi al qaeda cell members had moved in to quiet neighborhoods, living here and here. authorities say that they were able to come to the u.s. because of a flawed system of background checks that did not pick up their terrorists pasts. the system failed here, though. >> if you are asking my opinion, i'd say the system failed. otherwise they wouldn't have been here in the first place. >> reporter: in iraq, the two men were part of an al qaeda group that carried out a relentless series of attacks against u.s. forces with road side bombs, including one that killed four members of the pennsylvania national guard in 2005. >> these two individuals, specifically, are innately evil. >> reporter: during the fbi undercover operation, the men

said they wanted to carry out new attacks in the u.s. and kill a u.s. army captain who served in iraq. >> they wanted to assassinate this particular u.s. captain. >> reporter: a big break in the case came out of this fbi warehouse in washington. >> this is basically america's bomb library. >> reporter: the repository for some 100,000 bombs used against american targets around the world. fbi technicians were able to find the fingerprints of one of the kentucky men on a bomb that had been planted in iraq in 2005. >> you can see right here and right there. yep. >> what was it like when you made the match? >> like finding a need until a hay stack. >> reporter: now there is an urgent effort to go through a backlog of other bombs, looking for fingerprint matches with other refugees in the u.s. who may have also been able to hide their al qaeda ties. the discovery of al qaeda in kentucky led to a six-month

suspension of the refugee program, which has helped to resettle tens of thousands of legitimate refugees them. the immigration service says it tightened security and background checks. in effect closing the barn door after the fact. brian ross, abc news, new york. this morning there are behind the scenes negotiations to free an elderly american tourists now being held by north korea. merrill newman is a korean war veteran and grandfather seen her here in his retirement community newsletter. he was wrapping up a sightseeing trip to north korea when they pulled him off the plane. the u.s. in afghanistan have reached a tentative deal to keep american troops there the next decade or so. >> the agreement is being considered by top afghan tribal leaders. we are joined from kabul with the late developments. good morning, mohammad. >> reporter: good morning, john and diana. a very big week here in afghanistan. the future of the entire u.s.

mission here rests on what happens in the next few days. as we speak, nearly 3,000 afghan delegates from across the country are gathering in a large public tent to debate whether the u.s. should stay here after the mission officially ends sometime next year. it's called a loi yeah ya jirga. it is basically a public assembly. for centuries, it is how afghans have been settling their disputes. the delegates will be voting on a document that spells out the relationship between america and afghanistan. some highlights include nine american bases still here in afghanistan, full freedom to move american troops in and out of the country and one of the more controversial points, full immunity for soldiers. in other words, when they commit something wrong, they cannot be prosecuted under afghan law. since this war began, more than 2,000 american soldiers have given their lives with so many historic moments. few would have seen the most important mission would come not in the battlefield but a public tent where afghans will be voting. the vote is expected on sunday. john, diana? >> thank you. a new poll just released by

abc news shows the growing impact of the nsa leaks. 48% of those responding say they think the nsa intrudes without justification on the privacy of americans. that's up 8% from just last month. 60% say edward snowden's leaks have harmed u.s. security. that also jumped 11% from october. congresswoman from new york city recovering from a mugging on capitol hill. democrat grace ming was hit from behind, knocked out on her way home from a restaurant on tuesday evening. this happened just blocks from the capitol building. she wasn't seriously injured and by yesterday afternoon she was back home casting votes in the house. some developments in the sexual assault investigation involving a florida state quarterback winston. dna provided by winston matches the sample taken from the underwear of the woman accusing him of sexual battery. a statement from the accuser's family said the police in tallahassee warned the young women about pursuing the case against winston. the accusers attorney was told

her life could be quote made miserable if she presses charges. he has not been charged and his attorney denies any wrongdoing on his part. the battle between rodriguez and major league baseball has come out behind closed doors in a major way. a-rod and his attorneys are appealing his 211-game suspension for violating baseball's drug laws. when an arbitrator refused to order commissioner bud selig to testify in the proceeding yesterday, rodriguez stormed out of the room. in an interview a-rod asked if he thought selig had gotten personal. >> 100% of this is personal. i think it is about his legacy and my legacy. he's trying to destroy me. by the way, he is retiring in 2014 and to put me on his big mantle on the way out is a big trophy. zpl the commissioner's office said they chose a different official to represent it in the ongoing hearings, and it is noted that selig hasn't testified in a single drug-related case. >> but he apparently doesn't have to. >> right. >> all right.

i have no excuse for what i've done. >> reporter: it took just minutes inside of a washington, d.c. courtroom for this florida congressman to admit to buying cocaine. representative trey radel, a tea party darling, and self-professed hip hop congressman pleaded guilty to possession of a controlled substance. radel former tv news anchor was bought buying cocaine in d.c.'s dupont circle neighborhood. little did he know it was part of a joint operation between the fbi and dea after the congressman had been identified by a cocaine dealer. according to prosecutors, radel purchased cocaine several times from an agent and turned over to authorities more cocaine from his house. >> i'm doing so because i want to be a better man. i want to be a better man for you. i want to be a better man for -- and most importantly i want to

be a better man for my family, my dad, my mother-in-law, my father-in-law, my wife and my little guy. >> reporter: he is one of one of washington's more colorful characters. he received one year probation and will seek treatment in napals, florida. >> thank you. the 78 people on board a jetblue fright from ft. myers, florida, to georgia had a frightening story to tell. the plane diverted to orlando after an emergency evacuation slide deployed inside of the cabin. one passenger told our boston station the slide pinned a flight attendant to a small area at the front of the plane. >> behind the crew cockpit in front of the front seats, in that area where the flight attendants usually greet you when you walk in the aircraft, it basically filled up that whole cavity. >> the flight attendant suffered minor injuries. no passengers were hurt in the incident.

the plane that malfunctioned was taken out of service and a new one flew everyone to boston later on. new rules requiring seat belts for on board large buss are being put in place. the government said at the beginning of november 2016 they must have new lap belts for the passenger and driver. that doesn't include school or transit buses. the new rules come after accidents, some of them fatal, involving intercity buses. experts said it could reduce fatalities and serious injuries by up to 45%. two teenager students who have been cleared of all charges connected to the death of a 12-year-old girl allegedly bullied in to killing herself. now in a new twist the attorneys for the girls accused of doing the bullying are calling their clients the victims. abc's larry jacobs has the story. >> reporter: there will be no jail time for a 12-year-old and her 14-year-old friend accused of tormenting a classmate so relentlessly it drove her to suicide. the florida state attorney saying on wednesday all charges have been dropped. the two have been accused of cyberbullying rebecca sedwick so

cruelly, urging her to drink bleach and die and she should kill herself. on september 9th the she climbed a silo tower and jumped to her death. the case drew attention after polk county sheriff showed mug shots of the juveniles says they showed no remorse for sedwick's death. >> we could have gone to court with it but would that have been in the best interest of the children? as a result we see the children are going to get the services they need. >> reporter: younger girls' attorney defended his client. >> i don't think that rebecca's death had anything to do with the conduct of my client. >> reporter: but says the girl, in fact, was a victim herself. >> we plan to get her extensive counselling because she had issues of her own. she had been bullied on her own. >> reporter: he says he is pleased with the outcome that the two juveniles will get help but --

>> let's don't lose focus that we have a 12-year-old child that's dead. that child was tormented. that child was harassed. that child was beat up. there's a victim. >> reporter: larry jacobs, abc news, new york. >> a lot of people support that sheriff. >> that's true. because these two girls, according to -- if you look at what was posted on facebook it is clear to see they really did seem to torment the girl. we have to remember one of the girls bullying the 12-year-old who killed herself was her best friend who was turned by this other person. so this is the younger girl we are seeing here. the fact that now her attorney is coming out to say she was also bullied, i can almost understand how she could have been bullied in to bullying her best end. >> the attorney we saw, if she looks familiar he represented casey anthony. must be some attorney by the way. he's demanding an apology. there was some talk that the girls may seek a lawsuit against the sheriffs office. >> we will have to wait and see on that one. >> yes, we will.

there are some urgent behind the scenes negotiations to free an elderly american tourist held by north korea. meryl newman, 85 years old, is a korean war veteran and grandfather. that is him seen in his retirement community newsletter. he was wrapping up a sightseeing trip when he was pulled off the plane. an american missionary was detained under similar circumstances last year. in fact, foreign citizens are held in new york this morning charged with trying to smuggle 200 pounds of meth to the u.s. the men were arrested in thailand as part of a dea sting operation. they have pled not guilty and held until a bond hearing. ceelo green is back in court after attorneys argue the ground rules for his drug trial. he's accused of giving ecstasy to a woman during a dinner date without her knowledge. abc's brandi hitt has the latest. >> reporter: ceelo green was back in a los angeles courtroom

after a day after his appearance on the nbc reality show "the voice." the 39-year-old grammy award-winning artist whose real name is thomas decarlo callaway is facing a felony charge of furnishing a controlled substance. during a dinner last year, prosecutors say green slipped a woman the drug mdma, better known as ecstasy. the two then went back to her hotel room where the woman claims she woke up naked next to the singer not knowing how she got there. ♪ maybe i'm crazy >> reporter: the popular entertainment figure behind the hit "crazy" pleaded not guilty and his attorneys claim the accusations are false and unfounded. >> bail remains $30,000. >> prosecutors also did not charge the singer with sexual assault. >> if only one juror has reasonable doubt in this case, then the prosecution will lose. and i will tell you cee lo green

authorities. his traveling companion and neighbor, bob hamrdla, a former stanford university official, telling abc news there has to be a terrible misunderstanding. i hope that the north koreans will see this as a humanitarian matter and allow him to return to his family as soon as possible. the state department issued a warning of reports that north korean authorities are arbitrarily detaining u.s. citizens and not allowing them to depart the country. newman would be the second american detained under the young leader kim jong un. missionary kenneth bay was grabbed last year. friends say merrill newman thought it would be a fun, interesting trip and even though they are not saying the u.s. government is certainly seeking ways to get him released and as you can imagine he's the talk of his retirement home. martha raddatz, abc news, washington. the fbi investigating evidence that known terrorists

have been allowed to set until the u.s. as refugees. this fbi surveillance video shows an admitted al qaeda terrorist who killed american soldiers in iraq trying to get weapons to kill more of them. he was allowed to settle in bowling green, kentucky, because of a flawed system of background checks. if you are asking my opinion, i'd say the system failed. otherwise they wouldn't been here in the first place. >> you think. the immigration service says it has tightened security on background checks in an effort to keep other terrorists out. florida lawmaker caught buying cocaine is taking a leave of absence from congress. trey radel spoke about the scandal for the first time last night. with more, here's abc's pierre thomas. >> will you make a statement, sir? >> reporter: congressman radle took the walk no politician wants to take, the walk of shame as he left court after pleading guilty to cocaine possession. a long distance from the

hallowed halls of congress from a first term conservative who pushed for drug testing for people on food stamps. >> we stand up and say our society is not about i the federal government, it is about we the people. >> his image evaporated when his cocaine dealer told dea and fbi agents he was a regular customer. on october 29th, they set up a sting outside of this upscale restaurant in washington's dupont circle. radel bought $260 worth of cocaine from undercover agents. later that night, authorities told him he just bought drugs from an undercover federal agent. radel threw himself on the mercy of the court saying, your honor, i apologize for what i have done. i've hit the bottom. >> i've let down our country. i've let down our constituents. i've let down my family. including my wife and even though he doesn't know it, i have let down my 2-year-old son.

>> reporter: radel sentence to one year probation,. radel says he is an alcoholic headed to rehab. pierre thomas, abc news, washington. >> say this for the guy he's said all the right things. his apology didn't leave anything out. he really dotted his is and crossed his ts, he's the anti-rob ford. >> not only has he done it right so far, but he is also promising to donate his salary to charity while he's on this leave of absence. once again, i think, like you said, said the right things and if he follows through he will do the right things as well. >> let's hope so. moving on now, president obama was joined by president clinton at arlington national cemetery as they paid their respects to john f. kennedy. they laid a wreath at the gravesite marking the 50th anniversary of his assassination. president obama recognized president clinton with a presidential medal of freedom. an award created by kennedy as he reflected on president kennedy's legacy.

line. that $15 blood pressure pill, hospitals can buy it for just three cents. and it turns out the north side hospital system, whose ceo makes $2.1 million a year, has been criticized before by a consumer advocacy group for it's inflated pricing. >> i want to pay my bill but not overpay. >> reporter: in this month's special edition of "the journal of american medical association, a panel of experts across the country takes a critical look at our nation's health care system. we asked dr. moses why hospital pricing is so secretive. who's keeping it from the light of day? why don't we know this information? >> there's no incentive to make the information clear and every incentive to make it mysterious. >> reporter: the american hospital association told us hospitals like north side lose millions of dollars a year from patients who don't pay their bill and on medicaid and medicare shortfalls. so people like tracey end up having to make up the difference.
