for the second time in a week a roller coaster in pennsylvania's hershey park has

came barreling in. luckily, she got away with only a small cut on her leg. the driver of the suv accidentally stepped on the gas instead of the brake. no one else was hurt. let's hope things are a little smooter on the roadways this morning. heavy rain a threat this the center of the country. flash flooding a possibility in the desert southwest. if you're flying, airport delays possible in minneapolis and kansas city. family friends, and neighbors gathered in charlotte, north carolina to remember a deaf man fatally shot by police. >> the family of daniel harris said they want answers about his death. harris was killed after an attempted traffic stop. he led police on a long chase before he was shot by a state trooper. neighbors believe he was trying to communicate using sign language when a state trooper opens fire. >> his family says he was unarmed. police have not confirmed that. the incident now under investigation. the police officer has been placed on administrative leave. and take a close look at the man in this video.

issues. quickly checking our traffic maps we are in the green for traffic through this morning but we have a power outage in antioch. that is coming up in 10 minutes. >> this morning a former santa clara county deputy who guarded the jail is facing possible jail time himself the latest in the string of guards accused of using excessive force against inmates. matt keller is with us in san jose. matt? >> this former deputy used to work here and after the arrest last night he was booked into the santa clear county jail. the former deputy's name is timmy tri and bail was set at $75,000. he has been arrested on suspicion of assault with a deadly weapon and assault under color of authority. the sheriff deputy said this dates back to 2013 when called to help restraint a combative inmate during a drug el the department said tri kicked the inmate in the head and face two or they times and the inmate suffered a broken cheek and cuts

to the face. according to a spokesman the gap between the assault and the arrest is just the result of gathering all of the facts. >> he submitted the case to the district attorney. the district attorney had additional questions. we resubmitted the case to the district attorney and got an arrest warrant. >> tri is the latest jail guard to be arrested. three former deputies have been charged with the beating death of inmate michael tyree. two others are charged with betting another inmate garcia, and breaking his view. >> police in oakland are looking for the two men who shot a man to death. officers were call to the scene before 5:30 yesterday. the man was shot at least once. he died at the hospital. police say the suspect car could have been damaged in gunfire. all the santa clara county judge behind the sentencing of a stanford s
