this man was arrested for driving drunk for at least the eighth time. what needs to change to keep dui offenders off our roads? a flight instructor is dead, a student pilot injured after a helicopter crash. i'm amanda del castillo in palo alto. a local restaurant owner says she was targeted. menace. >> reporter: absolutely, dan and ama. orlando is a repeat offender here in san mateo county, as well as san francisco and alameda counties, which have all prosecuted him and sent him to prison for drunk driving. for at least the eighth time, 43-year-old orlando delleon was arrested for drunk driving. on monday, at 10:00 in the morning, he was pulled over here in south san francisco for driving more than 60 miles per hour in a 40 zone, with a suspended license. police say he had an open container of beer in his car. >> rules mean nothing to him and he's endangering every citizen on the road. >> reporter: the district attorney handed me this court document for a felony dui case stemming from another traffic spot in february. >> his blood-alcohol was 0.27. if something doesn't change, he will kill somebody. >> we know that license

suspension does not work. >> reporter: mary clark's son was killed by a re-pete dui offender in 2001 in santa clara county. soon after they started the bay area chapter of mothers drunk drivers. >> we can't put all the people in jail. but we can give them a lock on their car. i don't want them to drive impaired. >> reporter: in order to keep drunk drivers from repeat offending, the laws need to change. he says all he can do about d l delleon is to ask a judge for a high bail amount. kate larson, "abc7 news." we're learning new details about a helicopter crash that killed a flight instructor and

seriously entired a student. >> cleared you to take off, so all you have to do is go. >> that instructor was wayne projer. he is there on the left. his friend says projer was an amazing man, amazing instructor and extremely safety conscience. cornell bernard is live where he spoke with a witness to the crash. cornell? >> reporter: yeah, some witnesses describe the sound of that crash as something unreal. the wreckage remains several hundred yards here off the tarmac. >> i heard a loud banging and i looked over there and i saw a little bit of smoke and i saw -- it was just a lot of commotion. >> reporter: scott mathis heard >> reporter: offic student were doing training flights.

>> they were practicing hovering, which is unique to helicopters in the air and they can stay in one place. and something happened. and the helicopter crashed. >> reporter: the student pilot was injured, but the flight instructor killed. the coroner identifies him as wayne projer. friends say he was a long-time in* for at vertical flight helicopter school. >> i rode with him several times. >> reporter: the faa says projer and his student were flying this robinson r-44 represent. >> the robinson models of helicopters are very popular for flight instruction. >> reporter: the chopper is owned by pacific helicopters. what caused the crash is still unknown. officials say that student pilot remains hospitalized tonight with critical injuries. members of the ntsb are heading to the bay area tonight to start their investigation. they'll be here in the morning.

cornell bernard, "abc7 news." >> thank you. a person was struck and killed by a smart stratrain tod. the accident happened just after 4:00 p.m. north of highway 101 ere sheriff's office is investigating the death as a possible suicide. >> everyone is going to assume that a person -- one of the conductors may have mentioned it could have been someone that jumped in front of the train. >> three of the last five deaths involving smart trains have been ruled suicides. a man who admitted to a double murder that baffled investigators was sentenced today in sonoma county. >> the man who confessed to killing a young people on the beach in 2004 was sentenced today. shawn michael was sentenced to two life terms without parole.

"abc7 news" is focusing on issues that affect us all, in an e. to build a better bay area. >> a restaurant owner the south bay says she was harassed because of her religion and is taking the bad experience and doing good with it. >> amanda del castillo joins us now with the story. amanda? >> reporter: dan, ama, she admits that at first she was concerned about coming forward with her story. but then she realized in order for anything to change, she couldn't stay quiet. in palo alto, many are familiar with this restaurant, named after the owner, it was it was but just last week, khan was forced out of her comfort zone, harassed by a stranger during the business lunch. >> he approached me and said where are you from? i said pakistan. he said are you muslim? i said yes. after that, he turned around and

said terrorist, terrorist to me a couple f times. >> reporter: after that, she knew she had to turn a bad situation into good. khan announced he will use her bay area restaurants to help immigrants suffering far worse the harassment she faced. >> i thought if i face this, what do other imgrants face? >> reporter: specifically, khan says planned i.c.e. raids need to stop and needs to be an end to broken families at the border, vowing to donate up to $5,000 a year to the aclu. >> this is yet another incident showing the problems of xenophobia, even in the bay area, a pocket of the country where we expect that immigrants are welcome. >> reporter: khan says she only hopes that the man who harassed her now realizes that his

actions mean more immigrants will get more support through those planned donations. in palo alto, i'm amanda del castillo, "abc7 news." >> amanda, thank you. we want to hear your ideas about building a bay area. share them by joining our group on facebook. a hiker who vanished for days in death valley has been found alive. 60-year-old cheryl powell is doing well. she disappeared friday, and family says she walked away with her dog to use the restroom, but saw a man with a knife coming toward her. she ended up running deep into the woods. her son says it took seconds. >> my dad went down the hill, he came back up the hill. when he came back, they were gone without a trace. >> powell says she survived by drinking stagnant water, eating cactus, and traveling at night to avoid dehydration.

the sheriff's office is investigating what happened. the famous daffodil hill has become a victim of its own popularity and is closing. people have been flocking there for decades to view the flowers. the owners say thousands of people showed up for opening weekend, jamming up the roads for hours as they waited to park. they say the traffic was just too much, and it's become a safety concern, which is a shame. a victim of its own success. so we have some more summer weather coming our way. >> yeah. sandhya patel is here with the forecast. >> we're very lucky, we had nice-looking weather today. as we look at the sunset tonight, you see what's in store. watch it carefully. notice what's in the forecast. more fog tonight, that fog is going to play a role in our forecast for tomorrow did not interfere with this. almost a full moon here. look how amazing this shot was. this was earlier tonight.

the fog is going to be a bigger player in your forecast, and you can see just how murky the view is right now as we take a live picture of san francisco. foggy start for the coast and bay. gradual cooling trend this week, and temperatures dropping below average for the end of the week. it was a little above average today. 5:00 a.m. tomorrow. watch out for the fog, right around the east bayshoreline, as well. around the peninsula, 8:00 a.m., the fog will still be producing reduced visibility as we head into the afternoon hours. most area also still be looking at sunshine. there will be a few areas that fog will be hanging tough as we look at the temperatures first thing in the morning. in the 50s, 60s, 60s inland. right around the coast and the bay, mostly in the 50s. might be a little mist and drizzle around the coast, as well. tomorrow afternoon, 89 in morgan hill. 82 in san jose. warm day in gilroy. 90 degrees but not as hot as today. 78 in palo alto. 79 mountain view. mid 70s around san mateo.
