so you don't wait for life. you live it. today san francisco became the first urban area in the state to expand its reopening plan into the yellow tier. disappointed and frustrated. california gives the go ahead for 49ers fans to return to the stadium. why santa clara county officials say not so fast. two more rounds of dangerous winds and dry conditions. hollywood comes to san francisco. check out this muni bus sawed in half and you can see right inside of it. i'll tell you what they're filming in my story. abc7 news starts right now. tonight san francisco becomes the first bay area county to move into the state's

yellow tier status. that's the least restrictive tier and means new reopenings. >> but wasn't just san francisco. napa county is moving forward from red to orange. only sonoma county remains in the most restrictive purple tier. >> first we start with abc7 news reporter luz pena who spoke with san francisco owners and they are excited. >> reporter: prior to covid-19, this is what a regular night at the irish pub looks like. it has been seven months since they last opened and this is the reality now. the decorations are still up and today they're feeling hopeful? i was surprised. >> today city officials elevated. its reopening to the yellow tier, aka the minimal level. >> reporter: next tuesday, october 27th, that is when

nonessential businesses are going to reopen. the next date to pick in mind is november 3rd. that's when bowling alleys as well as indoor pools will reopen. then theaters, zoos and aquariums can increase to 50% capacity. by mid-november bars like this one are on track to reopen with 50% capacity. >> planning to get my permits. >> reporter: according to california's covid-19 website, san francisco has a 1.5% health equity positivity rate. >> we are being equitable in our approach. >> reporter: next week fitness centers are allowed to go up to 25% capacity indoors. >> we're probably going to go to about 18%. not that full 25. >> reporter: in san francisco, luz pena. abc7 news. >> let's take you to the south bay where santa clara county is it very clear, professional sports venues and theme parks

will not reopen to guests. despite the state allowing that, amanda del castillo explains why. >> reporter: we've taken over the usual tailgating area. levi's stadium remaining empty and silence at great manager. santa clara county announcing it is going against guidelines that would allow theme parks to reopen at limited capacity. >> this is the worst thing to be doing at a time when california is beginning to see some light. >> reporter: the county receiving back lash from great america. in a statement saying, cedar fair is extremely disappointed and frustrated with the look of reasonable consideration given to the opening of california's most popular theme partial. state guidelines would allow levi stimd open doors to 49ers fans after 20% capacity with ticket sales restricted to a 120-mile radius. but the county isn't ready.

>> the only method of treatment for covid is to keep people apart. keep them masked. keep them socially distant. >> reporter: the 49ers organization says it will continue to collaborate with public health officials on a plan. in a statement for ongoing impacts saying we welcome our fans and their support of local businesses and vendors that are critical to our local economy, especially during these difficult times. abc7 news. meanwhile, don't count on a disneyland trip any time soon. theme parks can't until the county they're in are in the yellow tier. orange county is in the red tier. when the parks do reopen, they'll be limited to 25% capacity. today napa county became the first north bay county to enter the orange tier. that means restaurants, fitness

centers and movie theaters can move people inside, starting tomorrow. >> i don't think the rules make sense now. they're not consistent. why can i reopen but some other business cannot? >> county officials stress if covid cases rise, they could slip back. san quentin must cut its population in half following a coronavirus outbreak. inmates must be released or transferred. also prisoners over the age of 60 who have served at least 25 years of their sentence must be included in any release program. >> all the strategies in the state have excluded this when they're the obvious people to let out. they've aged out of crime. they're already old and they

face the highest rigs of covid because they are old and suffer from health problems. >> there are about 3400 inmates at the marin county hospital. it is estimate 75% have been infected. cdcr has received the ruling and will determine next steps. however we respectfully disagree with the court's determination as cdcr has taken extensive actions. new at 11:00, a new policy. they voted in favor of a lottery system for lowell high school. the school admits students based on grades and state text scores. due to the pandemic, it will be dropped for the next school year. keep in mind for one year only. we've made it easy to keep tabs on where you live.

this is on our website, aibt 7 tens of thousands of pg&e customers could be without power tomorrow night. it is across 19 counties because of gusty winds and wildfire risks. here in the bay area, it is about 6,500 homes and businesses across six counties. we are under a red flag warning but just as it ends, another one will go into effect tomorrow night. if pg&e calls for power shutoffs, there is an easy way to find put to you'll be affected and what you should do if the power goes out. new developmentes with the scott peterson case. a hearing is scheduled for friday morning to determine whether he has a lawyer or will need a public defender. the state supreme court overturned his death sentence and ordered his murder conviction to be reviewed. it is not clear if he will make an appearance either in person or by video from san quendin. in the south bay, someone

danger in the north bay tomorrow morning. and then as the winds pick up, you start to see the yellows and oranges lt the hour by hour forecast for the winds, they'll be ramping up. 22 to 25 miles an hour in the lower elevations. this evening it was a lovely sight to see the fog rolling in through the golden gate and it appeared it was regrouping. we have a few poched. those numbers, from 46 gres 67. the good thing is air quality is good across the entire bay area. moderate in san jose. here's a look at the air quality forecast. >> to moderate the next four

on the peninsula two masked suspects broke into a bank this morning. >> raccoons! the bank was closed at the time but a customer using the atm outside spotted them. officials think they crawled into an air duct and fell through ceiling times. officials said to our knowledge, they didn't abscond with any money. why are they so much cuter inside a bank than inside trash cans? >> they may not have gotten away with any money but i'll bet they got away with some
