right now at 11:00, a family searching for justice. this morning, the suspect faced a judge for the first time and he will remain in jail without bail. good morning and thank you for joining us. i'm marcus washington. that suspect is not charged with a hate crime but that has been the subject of discussion. this is after numerous attacks on asian-americans right here in the bay area and across the u.s. let's get straight to alameda kounlt right now. nbc bay area's tom jenson is live outside the courthouse in dublin with what happened this

morning. tom, fill us in here. >> reporter: good morning, marcus. everybody appearing via remote link for the hearing this morning, including the suspect, 26-year-old tiant ebayly, who has an extensive criminal record, according to the judge, dating back to when he was just 18 years old, including home burglary invasions and assault. also an alleged robbery last year, and robbery and assault just last month. but now bailey is also charged in the death of 75-year-old pak ho who died at highland hospital yesterday. ho was assault and critically injured during a robbery on a walk early morning tuesday at lake merrit. his three daughters were bye be attacks on asian-americans across the nation, as you said. the bay area has not been immune to it. it was something that the president did talk about during his first prime time address. bailey is not charged with a

hate crime but does now face new charges of murder, assault of an elderly person and those two unrelated felonies in february. he's charged with violating his release on a 2020 robbery charge in san francisco where he spent 100 days in jail before being freed with an ankle monitor. bailey is scheduled to be back in court here in two weeks, where he's expected to enter a plea. thom jensen, nbc bay area news. >> thom, thanks for that info. the city of minneapolis has just reached a $27 million settlement. this is with george floyd's family. that news comes down minutes ago just weeks before trial is scheduled to begin for former officer derek chauvin, charged with floyd's murder. they filed a lawsuit against the that lawsuit took issue with the neck restraints and police the city council unanimously

approved the bay area, new at 11:00, another alleged hate crime against an asian victim. this man you see right here, 32 johann streidham of san francisco will be arraigned for allegedly grabbing an asian woman by her neck and throwing her to the ground while yelling expletives. he faces charges of assault with intent to commit rape with a hate crime enhancement. the woman's boyfriend and other witnesses stopped the attack and followed that suspect until police arrived. san francisco police are making headway in that case of the recent viral video right here showing the uber driver being assaulted and harassed. here is that video if you haven't seen it just yet. the young woman wearing the red has turned herself in. the one seen snatching the mask

way from the driver is expected to turn herself in soon. the driver is relieved but faults the women because instead of apologizing, they took to social media. >> i, myself, believe in second chances, but instead of that, defending what they did made it worse. >> the woman in custody is identified as malaysia king. she is booked in a las vegas area jail. one of the women also used what they say may be pepper spray when they were getting out of that car. just in a coyote that's bitten at least five people, including a 3-year-old in the east bay has b the department of fish and wildlife says that the coyote was captured and that dna testing confirms that that coyote caught was responsible.

now to the pandemic. san francisco and first chance residents in the city to get the johnson & johnson vaccine. pete suratos is live to tell us about it. pete? >> reporter: that johnson & johnson vaccine, one-shot dose, is being administered here at the city college of san francisco. this was the first city mass vaccination site. they'll be administering 1,000 shots here today. this is a one-dose shot. it will be for eligible residents in that phase 1a to 1b group. beginning monday, you expect to see changes with folks with a wide range of eligible to get the vaccine as well.ak wo johnson & johnson vaccine shot as well as dr. grant colfax with

san francisco public health department. i spoke with them about the challenges ahead as the eligibility for the vaccine increases on monday. >> i'm very excited. i'm more excited than i thought i was going to be. it's a relief. do you know what i mean? and i'm one and done so that's even better. >> we're excited that we're able to open up more eligibility, but we're still waiting for more vaccine to come in. from what we know right now we'll not have enough vaccine yet to meet demand. >> reporter: out here live in san francisco where those johnson & johnson evacuations are being administered. of the three vaccines that are available, he is hopeful they'll meet the demand but are expecting an increase in vaccinations in a few weeks. 10% of the u.s. population is fully vaccinated. 11 million californians have received at least one dose,

including the million doses for underserved neighborhoods on governor newsom's priority list. more than 3 million people statewide are fully vaccinated. if you're looking for information on how or where to get that shot go to planyourvaccine.com. put in the state you live, age and occupation. it will pull up the closest vaccination sites to you. tracking a developing story. contra costa county could move into the red tier of reopening in the next 72 hours. bob redell joins us now. this could really happen in spite of contra costa's higher case rate. >> reporter: yes. good morning to you, marcus. indeed, because of new guidance that could be issued today by the state that will allow contra costa to move into the red tier on sunday. in order to move into the red tier you need to be 7 cases per 100,000 people each day. right now contra costa is at 8.3 cases per 100,000. however, governor newsom said that the state will loosen that

case rate restriction to 10 per 100,000 people once the state has administered 2 million shots in low-income, underserved communities. that is expected to happen today. the east bay times reports contra costa to could then move into the red tier 48 hours after those 2 million shots are handed out, which would put us into sunday. sonoma county, should also be eligible. once in the red, restaurants, gyms, movie theaters can resume indoor operations at limited capacity. contra costa, sonoma, they're still only the ones in purple. the rest are in red. mayor london breed expects her city to move into the orange tier in the next week and a half. starting tomorrow, the state will allow breweries, wineries and distillries that do not serve food -- that's the distinction. talking about establishments that do not serve food, will allow them to reopen outdoors in the purple and red tier

prior to this, those businesses there are caveats. customers must have advanced reservations, their visits are limited to 90 minutes and all alcohol must be consume bid 8:00 that night. breweries, wineries and distillries that do serve food will continue to operate under the rules issued for restaurants. bob redell, nbc bay area news. >> bob, thank you. san francisco schools are one step closer to their planned reopening next month. the board unanimously approving the reopening. through fifth grade, special education and students with the most need starting april 12th. hybrid two to four days a week, depending on the class. teachers will vote on a deal by tomorrow. meanwhile, elk grove plans to have students back in the room for hybridearning for de.

degrees. ukiah, 67. mill valley definitely going to be comfortable as well. let's talk about the long-range outlook. that low pressure system that impacted us on wednesday and thursday, and that's going to continue to move on out of here. we're not worried about that anymore, right, as far as the low system goes. now we're welcoming in high pressure, that big h will keep us dry and warm. looking ahead to sunday, we have another low pressure system. what does that mean for us? the official start of spring starts on saturday. and we spring forward on sunday. the time change. don't forget about that. we'll set our clocks ahead one hour. sunrise at 7:20. we lose an hour of sleep but gain an hour of sunlight. the sun won't set as early as it does now. you're looking out the window, thinking, 10:00, but it's really
