>> a lot is happening on this monday. a gut wrenching investigation as to what led to the tragic parade, the crash near milwaukee. police now are saying the suspect was trying to get away from another crime. the death toll is now at five people with nearly 50 people injured. many of them are kids. a warning here. the video you are about to see is disturbing. let's bring in nbc's jay gray in wisconsin. >> reporter: the investigation continues today in waukesha where an suv turned a weekend holiday parade into a scene of panic and pain. >> i saw maybe three people right in front of me get hit. >> reporter: 39-year-old darrell e. brooks from milwaukee is in custody after the event. >> the suspect prior to the incident was involved in a domestic disturbance. at this time the waukesha police department is referring five counts of first-degree intentional homicide. >> reporter: an suv crashing through the holiday parade

route. everyone marching and watching the parade struggling to find safety. >> my wife got out of the way and by the time she did the car came right past me within at least two feet. i could have touched the car going by. >> reporter: in waukesha, prayers for those lost and injured as the search for answers continues. still not a lot of clear information. we know dozens are injured including at least 12 children, some in criticalwaukesha, wisconsin. closing arguments are under way in the trial of the three white men accused of killing jogger ahmaud arbery last year in georgia. the prosecution argued that arbery had no gun, no weapon of any kind, not even a cell phone. the defense, however, says a neighborhood crime spree had been under way and the men who chased arbery wanted to question him about that. arbery ran and that is when the defense attorney for travis mcmichael says he fired his gun

in self-defense. the prosecution maintains you can't claim self-defense if you instigated or provoked the situation to begin with. more high profile allies of former president trump have been subpoenaed now by the committee investigating the january 6th attack at the capitol. long time friend roger stone is ordered to produce documents and testify to the events that led up to the attack. president trump commuted stone's prison sentence before leaving office. the committee also wants to hear from alex jones, a conspiracy theorist who claimed the 2012 sandy hook elementary school massacre was a, quote, hoax. the committee has also subpoenaed three others who organized and promoted president trump's rallies. former trump lawyer michael cohen has completed his three-year prison term. today cohen left manhattan federal court after signing documents and speaking with authorities about his three-year term of supervised release. he also read a statement telling reporters he will continue to cooperate with law enforcement

investigations. cohen pleaded guilty back in 2018 to campaign finance charges and to lying to congress among other crimes. with the thanksgiving holiday just days away and covid cases rapidly rising, top health officials are urging all adults to get boosters as soon as possible. increased travel, indoor gatherings, and the colder weather are driving worries of a fifth covid surge. nbc's alice barr has the latest from washington. >> reporter: a surge in holiday travel this week slamming airports cross the country with more than 2 million passengers expected each day just as covid cases are once again on the rise. >> we've been traveling. we're all vaccinated. i feel perfectly safe. >> reporter: health officials urging everyone to bring one thing to your thanksgiving gathering, the protection of full vaccination including a booster for all adults. >> the increase in protection you get from a boost over and above the original vaccination

is substantial. >> reporter: the effects start kicking in right away so there is still time for an extra dose before dinner. with every adult now eligible, some states are shifting their standards. the governors of connecticut and new mexico now say you'll need a booster to be considered fully vaccinated. >> if you are vaccinated more than six months ago, you're not fully vaccinated. >> reporter: the white house announcing 95% of federal workers have now met president biden's requirement to get at least one covid shot or an approved exemption by today. that includes 93% of all tsa workers, with a spokesperson tweeting, quote, the employee vaccine mandate will not impact holiday travel. this week testing fears of another virus surge as people gather inside for winter months and adding urgency to the drive to vaccinate. the white house says there is enough supply for all adults to

get a covid booster shot though you may still have some challenges finding an open appointment. doctors reminding us it is okay to mix and match if you're able to find pfizer's more widely available booster with johnson & johnson and moderna in shorter supply. in washington, alice barr, nbc news. >> thank you. now to the house of representatives that passed the build back better bill, the senate is getting encouragement to change a key provision called salt. it stands for state and local tax and matters especially for a lot of people here in the bay area. let's bring in our political analyst. we've talked about this for many years. salt is about high earners for the most part. give us a quick explanation again. >> there are high earners here, but i mean here not so high. we have such a high area of income and cost of living. what is high in say iowa $150,000, $200,000 here, unfortunately, is not so high. that is what happens with salt.

it caps your state and local deductions to $10,000. no more than that. that is fine in iowa or nebraska but not so much in california. quite often housing costs are in seven figures here which means you won't get the property tax in there all of it much less any other tax. when the trump tax cut was passed in 2017, they included the deduction now ending at $10,000. that affects 2.3 million californians and is costing them $33 billion a year. >> so a quick way to look at it, the rich people against the middle or lower class, that is the controversy. what is likely to happen here? >> it is a controversy. let's remember we have a number of senators on the east coast, new york, new jersey, connecticut, massachusetts, where there are high end, high cost states as well as

california. they have been pushing. remember, one of those is charles schumer, chuck schumer who is the majority leader. they have been pushing to ease this up to $80,000 for people making 400 -- excuse me. $80,000 in exemptions for people making $400,000 a year. so you can raise that salt tax up to 80,000 at the most for people making $400,000. no more than that. and so the idea is to take these folks sort of like in the middle or upper middle class in california, which is not so upper middle here, and give them back much of the break they lost. remember, it's $33 billion this state is paying but it wasn't paying before. >> quickly, when could this happen if it does pass? is this asap? >> look, we've been saying if forever. schumer would like to get this done by christmas. if it is not done by christmas we've got a brand new ball game come january because that's an election year and if you think things are political now, wait

till january when they'll really be political. so a lot of pressure on the senate to pass. then it has to go back to the house. then if everything goes well it goes to the president. a lot to do in a very short a senate that doesn't operate too quickly. >> that salt tax will be a big conversation with a lot of people and their accountants especially as we head into tax season. thank you, larry gerston. well, president biden will row nominate jerome powell as federal reserve chair. the president was joined by powell and his choice for vice chair lael brainerd in a brief announcement this morning. brainerd was a rival for chair but our business and tech reporter says by sticking with powell biden is sticking with a known entity. >> powell's term was due to expire in february but with biden nominating him to a second term, wall street and the american economy get eight years with the same fed chair. it also ruffles as few feathers as possible in the democratic

flock. brainerd had support for more liberal democrats who thought she might be tougher on wall street and banks. she was under secretary for the treasury under barack obama and reserve board of governors sinc whoever he picked would disappoint someone and that the decision really came at a lousy time when he is trying to unify democrats around build back better, not split them apart. but in the case of build back better, now that it's passed the house, satisfying conservative democrats is probably way more important than making the liberal wing happy. >> thanks, scott. you can see scott mcgrew and the rest of our morning team every week day. now as we kick off this monday. a lot of big things. thursday, a big event? >> i am hungry and ready. >> we're taking a look at the airport delays. if you are heading out tonight or expecting somebody we did want to show you the national weather map. we just have a little rainfall up toward the pacific northwest. also rain holding on over toward the east coast. but again, nothing too major. currently when it comes to airport delays we're running 41 minutes behind at newark. washington 30 minutes behind. across the midwest no delays to speak of. we are tracking this system just offshore. it looks like it is going to be producing big weather here at least on the first glance but i can tell you there is no rainfall with it. we'll get on and off cloud cover. the biggest thing no doubt is the chillier temperatures coming our way as we roll through tomorrow morning. got to have the jacket weather. but hey, it is november. we're in the week of thanksgiving. so it'll make it feel like the holidays.

you can see as we started off tomorrow morning we are down to an average of, yes, 43 in the south tri valley 40. coming in with the crill chest weather in the north bay at 39. san francisco 48. east bay at 40. as we move through tomorrow i think we are still in for a good rebound. in the south bay up to 64 in los gatos and also mid 60s through san jose. a little bit of a breeze here, 5 to 10 miles per hour. over toward the east bay no big adjustments in the temperatures through our micro climate. if you are in the south bay heading to the east bay also look for mid 60s. for the peninsula anywhere from 61 in daly city to 65 in redwood city. let's move off to san francisco. low 60s from downtown to the mission right to the outer sunset and for the north bay 63 in ukiah, 65 sonoma. all good as we move through tomorrow. just a little cloud cover there for the afternoon. what about your thanksgiving? we're looking good. dry, mixed with some sun, clouds, start off cold here with some 40s.
