in washington to explain there's still going to be a tax hike. we'll hear from her next. >> reporter: after a couple of brutal days here on capitol hill, approximate, the deal is finally done. but neither side got everything they wanted. after months of debating and back room deals, congress has passed a bill which will pull the country back from the "fiscal cliff." >> on this vote the yays are 257, the nays are 167. >> reporter: the bill extends bush-era tax rates for every american making less than $400,000 and couples who make less than $450,000. it delays for two months $110 billion in across-the-board spending cuts. >> i'd like to be speaking for bill but i can't. >> reporter: 151 republicans including eric cantor the number 2 ranking house member voted against the bill because it doesn't address spending. >> what we're really doing is
raising taxes to give the president more money to spend. >> reporter: president obama ahead promised to work with congress to find more spending cuts in the future. but he urged them not to play politics with the nation's debt limit. >> i will not have another debate with this congress over whether or not they should pay the bills that they have already racked up. >> reporter: treasury secretary timothy geithner has warned congress that the country is just a few months away from defaulting on its loans for the first time in u.s. history. >> the consequences for the entire global economy would be catastrophic far worse than the impact of a "fiscal cliff." >> reporter: but many republican congressmen say the debt limit debate is the last chance for them to secure the deep spending cuts necessary to pay down our nation's debt. the bill now goes to president obama for his signature. back to you. >> thank you. most overseas stock markets jumped higher today on news
that the u.s. "fiscal cliff" has been averted. here's the kospi stock exchange in korea celebrating its first trading day in 2013 it finished up today, as did hong kong, germany, australia, britain and france finishing up. the new year's first day of trading in the u.s. set to begin in an hour and a half. the house stayed late to pass the "fiscal cliff" package but members left without agreeing on federal aid for victims of hurricane sandy. the senate already okayed the $60 billion measure. new congress will be sworn in tomorrow. well, on weather news it's freezing out there this morning literally and we have cbs 5 reporter anne makovec feeling the freeze in san rafael. good morning, anne. >> reporter: i have been watching the temperature here behind me at this bank in san rafael. it's below zero, elizabeth, celsius at least. 26 degrees fahrenheit right now. a freeze warning in effect for the north bay and a frost advisory in effect until 9 a.m. for the shoreline and the santa
clara valley. temperatures in the 20s and 30s, frost of course can tell you sensitive plants outside so hopefully yours are already covered up. today is also a "spare the air" day. that's because the cold weather forces tiny particles of pollution in the air close to the ground and then there really isn't any wind so those particles stay close to the ground making it tough for some people to breathe. a "spare the air" alert means no burning allowed indoors or outdoors including wood or any solid fuel. >> what do you do when it gets that cold at night? >> i stay home, turn the fireplace on and i can turn it on because it's gas. >> you're not worried about "spare the air." >> no. i don't have to. >> you don't have to. >> no. we changed that a long time ago. >> reporter: part is lady. now, for -- smart lady. now, for "spare the air" violators if you are caught burning it could cost you $500 although they have one option for first offenders, there's a wood-burning awareness class. doesn't sound like fun so i think the best bet is to just
follow the alert. live in san rafael, anne makovec, cbs 5. >> probably a good idea. thank you. let's get a look at weather and traffic. first to meteorologist lawrence karnow. good morning. >> good morning. i suspect that class is probably like going to traffic school. >> probably. so much fun. >> hey, folks. it is freezing around the bay area right now. getting around that. clear air overnight and well, that dry air and the cold temperatures combine to bring freeze warnings in the north bay, frost advisories inside the bay in toward the san jose and santa clara areas, as well. looks like it is going to slowly warm up but boy, it's going to take time so very cold start to the morning. by the afternoon though these 20s and 30s probably running up into the 50s in most spots. looking good over the embarcadero, clear skies and cold temperatures but not bad. 30 degrees in concord. 27 degrees now in santa rosa. 45 degrees in san francisco. high pressure in control. it's going to hold on now and
looks like it's going to stick around for a while so we are going to see cold nights and dry air over the next few days and then the temperatures by the afternoon not too bad with mostly sunny skies no threat of rain probably until the weekend. the temperatures going to look like this. plan on those numbers mainly into the 50s, about 57 in the afternoon in san jose, 57 santa clara, east bay temperatures probably low 50s by the afternoon. inside the bay 53 degrees in san francisco, 55 oakland, 52 sausalito. check out your temperatures online at cbssf.com. let's check the roads with gianna. thank you, lawrence. we have been monitoring this water main break in hayward which seems to be a problem as chp has now issued a sig alert in the area. so the water main break is located at jackson street and santa clara street right at that intersection just east of 880 and the 92 interchange. chp has shut down one lane of the eastbound 92 off-ramp at jackson because of flooding in the area. so they are advising you to
avoid the area until they mop up. so it's jackson street and santa clara street but if you are coming off jackson off east 92, that right lane is now shut down. chp and hayward pd are on scene. we have live look coming up in the next few minutes to get you updated on this area. we'll do that as soon as the lanes open, as well. the san mateo bridge, westbound towards foster city no problems. eastbound into hayward not showing any delays right now, traffic looking good. and a live look at the bay bridge right now, our freeways are very light. not a lot of accidents to report on the roads right now. in fact, traffic have very quiet on the pay gates into san francisco. back to you. >> thank you. two people are dead after a driver crashed a car while trying to get away from police in san francisco's mission district. officers tried to pull over the chevrolet impala because it matched the description of a car connected to shots fired at a san francisco housing project. >> as officers approached the vehicle, the vehicle took off
at a high rate of speed and ran through the next two intersections colliding with the white vehicle that is now come to rest at the portal of the store. >> the crash killed the driver of the other car and a pedestrian at 21st and south van ness. officers arrested the suspect, who was injured in the crash. police say they did find a gun inside his car. another drowning on the marin county coast. the third in just the last few days. it happened at a point reyes beach. a man was swept out to sea from north beach shortly after noon yesterday. the man was walking with his wife and their dog when a sneaker wave knock them into the surf. while witnesses rushed to help the woman and dog get out of the water, the man was carried away. the coast guard and other agencies launched a search it. the waves were bigger than normal. >> the helicopter circled around very tight and low to the water for quite a while and we were thinking, wow, maybe
we'll see them rescue somebody. but no. >> it was about three hours later when a helicopter crew spotted the man's body. last week a father and son drowned when they were swept off the shore near the golden gate bridge. a vigil in fremont to honor the 23-year-old new delhi woman who died after being raped and beaten on a bus. the vigil last night at the hindu temple was one of many around the world. organizers say they wanted to express solidarity as indian- americans with the family of the victim and with the nation of india in mourning her loss. in india, thousands have taken to the streets in the two weeks since that brutal attack to protest the crime. six men have been arrested and charged with murder. in other bay area news, a court appearance is scheduled for later this afternoon for at least one of the four people accused of killing a millionaire in his monte sereno home. meanwhile the "mercury news" reports victim ravi kumra had been accused of trying to hide millions of dollars from
creditors. water rates may go up in contra costa county. a proposal to raise rates 3.5% goes before the contra costa water district board tonight. that meeting is open to the public. it starts at 6:30 tonight at the district headquarters in concord. this is the last day of operations for a san francisco museum before it picks up and moves. the exploratorium will close for good at the end of the business day at its location near the palace of fine arts. it has been there for 43 years. the museum is scheduled to reason -- is scheduled to reopen along san francisco's embarcadero at its new location april 17. 5:10. coming up, the hardest tackle of 2013 has already happened. plus, tragedy in los angeles. how a paparazzo was killed while taking photos of justin bieber's car. and homeless heroes, two good samaritans help stop a robbery and it is all caught on tape. so what's cool about your school? you can submit your nomination on our website, that is

a surveillance camera caught it all on tape. police say a suspect attacked a businessman who had just withdrawn cash from an atm. that's when two homeless men jumped in and stopped the suspect from punching the victim and helped police find the suspect who ran away. he was arrested and faces robbery charges. time for a check of traffic. gianna has been busy following a water main break blocking streets in hayward. gianna, what's the latest? >> liz, it sounds like a soggy mess out there in hayward. it's located at jackson street and santa clara street in hayward on surface streets. the problem is as you come off jackson off east 92 they have lanes blocked there as well because of the flooding in the area. so chp and hayward pd are on scene of this water main break causing a mess through there. this is jackson and santa clara at that intersection. so chp saying avoid the area if you can even though one lane is only block on that off-ramp. it may be a mess through there. we have chopper 5 headed to the scene as well as a photographer to bring you live pictures within the next few minutes. now, elsewhere, the rest of the
bay area problem-free. our freeways not showing any delays. here's a live look at the golden gate bridge nice ride out of marin county easy all the way into san francisco. northbound out of san francisco, into marin county, no delays now. no caltrans projects to report. that gets back under way tonight. elsewhere, 880 looking good northbound no delays. it's been a nice rise southbound, as well. we had reports of a minor accident in hegenberger on the right shoulder not causing any problems this morning. you can see in our live look, traffic cruising in both directions. off the eastshore freeway, towards the bay bridge toll plaza, not seeing any problems. everything is in the green coming away from pittsburg or highway 4 if you head towards the 80 interchange there through richmond. traffic looks good towards the bay bridge nothing coming out of the maze right now. all good for mass transit, as well. bart right on time. ace back in service. muni, caltrain, ferries no delays this morning. your south bay commute looking good westbound 237 only six minutes between 880 and 101. new york 101 through san jose,
so far so -- northbound 101 through san jose, so far, so good. 101 at mckee traffic light in both directions. that's a look at your morning drive. it is cold out there, lawrence. freezing around the bay area this morning, gianna. one of the coldest days we have had in a while. in fact, out the door bundle up. we have some chilly temperatures continuing to drop down to 27 degrees route now in santa rosa, 29 in fairfield, 31 degrees in livermore and 34 in san jose. you're going to find widespread frost around the bay area if you are heading out. the good news is, we have a nice dry day ahead. lots of sunshine coming our way, too. temperatures will be staying cool into the afternoon but not bad. good news also we have some dry days ahead. we are going to stay away from the rain and get a break from the stormy weather. heaps giving us noose clear nights and cool days. jet stream sending the storm track well to the north of the bay area, maybe getting a hind of rain on sunday. traveling not a problem around the state today.
clear in the central valley. 50s into sacramento and also into fresno. the high country of course just a ton of snow up there. 38 degrees in lake tahoe, 42 degrees in yosemite, 54 in redding for the high. i think we're looking good around the bay area this afternoon. lots of sunshine about 57 degrees fairly comfortable into san jose. east bay temperatures a little cooler. plan on highs about 50 in antioch, 50 fairfield and about 52 degrees in pleasant hill. inside the bay mid-50s into oakland. about 53 degrees in san francisco. 56 degrees in santa rosa. next couple of days other than a couple of passing clouds lots of sunshine in the afternoon. some chilly mornings then a slide chance we could see some showers as we head in toward late saturday night into sunday. monday and tuesday back to some dry weather. opportunities in newtown, connecticut are getting a tour of their new campus today. tomorrow will be the first day back to school since a gunman
killed 20 students and six adults at sandy hook elementary school. students are getting a tour today. classes will be held a few miles away at a new location. desks from sandy hook have been brought to the campus along with backpacks and other things students left behind. 14 people are hospitalized after a tour bus crashed off an interstate in oregon. nine people died sunday when the bus plunged down an embankment on route 84. investigators are trying to determine if the driver was at fault but the road was icy at the time. pennsylvania governor tom corbett is going to sue the ncaa over the jerry sandusky scandal at penn state university. the league handed down sanctions against penn state that included a $60 million fine to help pay for child abuse prevention programs. he says the league sanctions would only leave 25% of that money in his state. he wants all the money to go to
pennsylvania's children's programs. justin bieber is offering his condolences this morning to the family of a photographer killed what i trying to take pictures of the singer's sports -- killed while trying to take pictures of the singer's sports car yesterday after officer's pulled over justin bieber's white ferrari. the singer wasn't in the car. his friend was driving. the photographer had stopped to take pictures when he was hit by a car. >> i just came it pay -- i just came to pay my respects. he was just a great kid. some people will say another crazy paparazzo trying to make the money. actually he was not a paparazzo. he was just another kid from new mexico. >> bieber says in a statement that he hopes this tragedy will inspire new laws to protect the lives and safety of celebrities and photographers. it is 5:19. on the verge of tears, stanford's coach reacts to their big rose bowl win.

this morning." >> your realtime captioner: linda marie macdonald captions by: caption colorado firstname.lastname@example.org good morning, it is wednesday, january 2. i'm elizabeth wenger. frank and michelle are both off this morning. time now 5:30. and we will start with this developing story. a water main break is sending water gushing in hayward. let's get right to gianna. good morning. >> all right, thank you, elizabeth. let's go to chopper 5 right now. you can see in our live picture here that that water is still gushing from that water main break here. we have quite a puddle there at the scene. this is located at jackson and santa clara. mostly affecting eastbound side of jackson vote at santa clara. so they have that roadway blocked off in the meantime while they mop up this mess. we have a photographer on the scone and you can see from ground level that water is still gushing out causing a problem in the area. so chp has issued a traffic alert for that eastbound side of jackson. also, for the jackson street off-ramp. one lane is blocked as you work
your way off the eastbound 92 because of the flooding so avoid the yar if you can. again, not affecting the main lines of 92 right now. just the jackson street off- ramp as you work your way into hayward. we'll continue to keep you updated on that. the rest of the bay area as far as traffic goes checking in problem fremont your drive time through the east bay all in the green no delays on 80, 580, 880 or 24. we have some very cold temperatures to start out your day too if you are heading out the door. some freezing temperatures especially in the north bay some of those numbers down into the 20s right now. freeze warnings up there. so watch out for that frost advisory inside the bay and toward the santa clara valley. temperatures in the 20s to 30s all around the bay area so very cold frigid start to the day. you have mostly clear skies though looking toward the embarcadero. let's check the temperatures outside. it is 30 degrees and freezing in concord. 28 degrees in santa rosa. 34 in san jose. and 45 degrees in san francisco. widespread frost showing up all

it was more than three hours later when a helicopter crew found the body of the 59-year- old man. his wife and the dog both made it back to shore. san jose police say they may have prevented a mass killing when they arrested a naked man who was armed with a sword. officers and that mentally disturbed man were in a standoff for about two hours yesterday morning. vta's bascomb light rail station. the investigators say the man had an assault rifle in his truck which police were able to retrieve during the standoff. and some bay area kids can apply for free muni passes starting today. it is the first step in a new program offering free rides to low income youth. muni is accepting applications online. those free rides start march 1. some downtown san francisco streets will be closed today as work resumes on that central subway project. work was halted near union square six weeks ago to make it easier or shoppers. with the holidays over, the

mess there at the intersection of jackson and santa clara. you can see live in our chopper 5 pictures here it's a big puddle right now on eastbound jackson mostly right at the santa clara intersection. they do have some lanes getting by. one lane on that left-hand side there on jackson itself looks like a couple of lanes are shut down on the westbound side, also. so chp and hayward pd are advising avoid the area if you can. it's causing a mess in the area. so chp is doing traffic control through there at jackson and santa clara. also affecting the roadways as you come -- in fact, let's go to the san mateo bridge. eastbound headed into hayward, that jackson street off-ramp coming off eastbound 92 is blocked because of the water main break. other than that traffic is okay on the westbound side as you work your way into foster city. now, jumping over to the bay bridge, the rest of the roads are quiet this morning. in fact, live look at the bay bridge we are seeing a lot more volume than yesterday because
of the holiday. so folks are getting back to work. but traffic still is expected to be light today. metering lights are still off. no delays as you work your way into san francisco. a stall though at howe street off the eastshore freeway towards the bay bridge may be blocking a lane. we have one trouble spot to road northbound 680 at mission, some sort of debris vehicle hit, blocking a lane. so a little busy on 680 because of that. you might see brake lights approaching the scene. let's check the cold forecast with lawrence. chilly around the bay area, gianna. out the door, grab jacket, temperatures in the 20s in some parts of the bay area. let's check the numbers right now. further south into san jose 34 degrees right now so you're likely seeing frost showing up on a lot of cars, rooftops and even the grass out there. 31 degrees in pleasanton. 30 degrees in san ramon. and 41 degrees in oakland. 35 in hayward where they have that water main break. temperatures a little further
to the north are colder. 28 degrees in santa rosa. 30 in the napa valley. 29 degrees in fairfield. we have some freeze warnings up in the north bay. so some very cold temperatures through 9:00 this morning and then they will start to melt away. toward the afternoon we are expecting lots of sunshine. temperatures going to be staying cool especially in the east bay but dry days are ahead as high pressure sits overhead as well and that means, well, the jet stream well to the north. that means we are going to stay dry as the storm will follow the track north of the bay area much of california getting a much-needed break. but we have some cold nights ahead for us and really kind of some cool days. sfo, well, no delay there expected. we are going to see sunny skies all day. the temperature about 54. if you are traveling across the country, the major hub looking okay. in fact, mostly cloudy skies but dry into houston and 52. 36 degrees partly cloudy in denver. 30 in chicago. and 32 degrees and freezing if you are heading toward new york. still, we are going to see some fairly mild temperatures into
the south bay. plan on 57 degrees in san jose. only 52 degrees though in pacifica. 54 in hayward. east bay is going to stay cool. those temperatures running generally in the 50s although you will notice blue over the mountaintops keeping the temperatures there mainly into the 50s. so upper elevations will be chilly. north bay, 56 degrees santa rosa, 53 in san francisco and 54 in san leandro. i think the next couple of days we are going to see plenty of sunshine into the afternoon hours but some very cold mornings. and then on the weekend things change a little bit. a few more clouds come our way on saturday. there's a slight chance of showers mainly near the coastline on sunday as a weak system slides by. then on monday, tuesday, it is back to dry weather and in fact the extended forecast fairly dry through at least the middle of january. elizabeth, back to you. >> thank you. we can put away the umbrella. >> for now. >> thank you. a little business news now. stock futures are sharply higher ahead of the first trading session of the new year and with your financial news, here's ashley morrison of cbsmoneywatch.com
, good morning. and good morning to you, elizabeth. well, news of the "fiscal cliff" green gave asian markets a big boost this morning. hong kong's hang seng gained almost 3%, kospi nearly 2%, tokyo's nikkei closed. we will see how wall street reacts to the agreement today on the last day of trading in 2012 the dow up 166 points, the nasdaq up 59. stock futures are significantly higher at this time. well, investors had reacted positively to the deal. it's going to result in less money in your paycheck, though. washington leaders decided to discontinue the social security tax cut any acted two years ago. the -- enacted two years. the payroll tax will rise 2% to 6.2%. so a person making $50,000 a year will see about $1,000 more taken from his paycheck a year. and the bill headed to president obama also contains a provision averting the so-

break located at jackson and santa clara streets. so parts of the road are completely blocked off. chp and hayward pd are on scene providing traffic control so the water main break was reported about 4:30 this morning but you can see this our live shot it is still gushing water. there's quite a big puddle through there. from our photographer here that water is still significant around the area. it's not shut off. no word when it will be completely under control and will take time to mop up the mess in the area. so again this is jackson at santa clara street in hayward. it's affecting the jackson street off-ramp from 92 eastbound as you work your way into hayward. one lane is completely blocked off. chp has issued a traffic alert as a result so they are reminding people to avoid the area if they can until they get that mess monday up through there. now, it's not affecting the main lines of 92 or 880. 880 very close to the area, as well. you can see traffic is flowing pretty well in and around that area. north of that live look at 880 northbound through oakland, no
delays to report right now. in fact, very light. 15 minutes northbound 880238 to the maze. once you hit the maze no delays just yet. south 880 a nice ride into hayward. it's clear into the south bay. of course, if you want to avoid the freeways, a little busier this morning than it's been, use bart, mass transit is right on time. everything on a regular schedule. ace train back in service after yesterday's holiday. muni, caltrain and ferries all on time this morning. in fact, your drive times for the east bay not too bad. eastshore freeway, 880, 24, all problem-free. the only delays we're seeing on the freeways itself is through the altamont pass, westbound 580 slow from the altamont pass to 680. looks like that will take you about an 19-minute ride because we're starting to see brake lights out of tracy as you head into the livermore valley. 680 itself no major problems. we had an earlier trouble spot at mission blocking a lane but that's been cleared. of course we are starting to see brake lights through
antioch in both directions. westbound highway 4. looks like we're seeing slow conditions off the antioch bridge as well eastbound also and pittsburg good lots of green through there. coming out of marin couldn't no delays to report southbound 101, 580 to the golden gate bridge toll plaza, only 13 minutes. the good news for today no major caltrans projects are scheduled just yet. that will get back under way looks like about 10 p.m. tonight. so so far, so good but again overnight you might experience some delays. coming off the eastshore freeway towards the bay bridge toll plaza, metering lights are off. we are, though, seeing a few extra cars mostly in the cash lanes. no delays for the fastrak users. in fact traffic clear up the n klein. that earlier stall at powell is in the clearing stages. same for the south bay. was bound 237, 880 to 101 connector, looking very good. let's take a look at your forecast. it's very cold out there, lawrence. >> it is chilly around the bay area. freezing temperatures if you are headed out the door this morning. bundle up, folks. we have some very cold temperatures. freeze warnings are up for the north bay valleys there.
you can see also down into the salinas valley and the monterey bay area, as well. and a frost advisory inside our bay toward the santa clara valley so a cold start to the day. many temperatures now dipping into the 20s and the mid-30s. we're waking up to some widespread frost around the bay area and you may have to chisel some ice off your windshield before you go to work. out over the city right now, we are looking good if the embarcadero. you have mostly clear skies. the temperatures falling like a rock with some very dry air right now. we have 27 degrees, very cold into santa rosa. 34 degrees in san jose. 45 not too bad in san francisco. but 30 degrees in concord at this hour. still, high pressure is holding on here and it's going to stick around for a bit as the ridge sends the jet track well to the north. that means we'll stay dry for the next few days but it's bringing us clear cold nights around the bay area with that dry air in place so we are going to see that play out over the next few days. i think the next best chance we could see some rainfall probably on sunday. but even that just a slight
chance of showers. in the moon time, though it is in the meantime, sunny in sacramento. 54 fresno. high country lots of snow in the lake tahoe area. 38 degrees there and chilly. 42 degrees in yosemite and 60 degrees into monterey bay, mostly sunny skies looking toward the afternoon. around the bay today, we are looking at temperatures running up in the 50s at san jose, 55 milpitas, 56 morgan hill. cooler in the east bay highs in the 50s although in some of the mountaintops there probably has only in the 40s. so we have some chilly temperatures outside around the bay area even in the afternoon and the east bay. inside the bay, temperatures at the ocean moderating things a bit so plan on 55 in oakland, 56 degrees in san francisco and should be about 54 degrees in hayward. so looking out over the next few days, it looks like we'll stay nice and dry through thursday and friday. by saturday, we start to cloud
