southbound 680. this is in walnut creek. we are still seeing some big delays. how far we're seeing gridlock? we'll let you know coming up. >> good morning it's wednesday, july 17. good to have you with us, i'm frank mallicoat. >> i'm michelle griego. time now is 6:00. let's get right to lawrence and talk a little bit about this heat wave. >> yeah, guys. we are going to crank up the temperatures starting today. of course very gloomy around the bay area the last couple of days but now the sun, well, it's rising and looking good as we are going to see more sun on the way although we are starting out with some low clouds and fog extending well into the bay this morning. you might think it's going to be a similar day but a strong ridge of high pressure is building in overhead so temperatures are mild this morning. we have 50s and low 60s outside already. by the afternoon, it is going to be running much warmer than yesterday. in fact, yesterday we topped out in the 60s and 70s. today, moving well into the 80s. 90 degrees into livermore. i think we could get near triple digits as we head toward the weekend. we'll have more on that in a moment. let's check the roads with elizabeth. thanks, lawrence. we want to start off with a look at the bay bridge toll

plaza. the delays are not bad so far this morning. about 5 minutes ago there was no traffic and in the last few minutes we see some backups in the middle of the parking lot. they may have activated the metering lights. we'll let you know in the next traffic report. here's a live look at our maps. our sensors, all lanes are now back open of there was a traffic alert in walnut creek we had two separate crashes one at north main and another approaching 24. everything is off to the shoulder but we are still seeing a lot of gridlock as far back as pleasant hill. westbound 580 slow and go this morning out of the altamont pass. 31 minutes towards the dublin interchange. bart, muni, caltrain and ace all on time. that's traffic. back to you. >> thank you. we're following breaking news out of san jose. a police officer shot and killed a pit bull. kpix 5's cate caugiran is gathering more information. she joins us live at the scene. and i understand, cate, police say the dog bit one of the

officers? >> reporter: frank, we're learning the reason officers were here in the first place is because of a follow-up investigation into stolen mail and now they are continuing the investigation. but just a few moments ago -- we want to show you this video -- we saw san jose police handcuff this man and put him into a police car. we are not sure of his involvement in this case. before that, we caught up with the owner of that dog shot and killed. this was your dog, ma'am? >> yes. >> reporter: shot and killed your dog. yes. >> reporter: did you answer the door when officers came here? >> no. [ crying ] >> reporter: that woman identified herself as shauna. this whole investigation started at around 1:30 when witnesses saw three suspects steal mail from an apartment complex about 4 miles from here and drive away. police tracked the license plate.

they came here and knocked on the door. they found out the owner was on searchable probation. the woman answered the door, the pit bull came out of the basement and bit the officer in the lower left leg and the other officer shot and killed the dog. the officer is now recovering at a local hospital. san jose police say he suffered nonlife-threatening injuries and is expected to be okay. live in san jose, cate caugiran, kpix 5. today marks a week since 21- month-old daphne webb was reported missing. her father called police last wednesday saying someone abducted her from his suv at 79th avenue and international boulevard. tonight a candlelight vigil will be held at 79th and international boulevard where the girl's father said the girl was last seen inside his suv. kpix 5 reporter anne makovec reports oakland this morning where most of the family gathered yesterday. they have a lot of questions today. >> reporter: good morning. yes. searchers and police are really trying to establish this morning a timeline for when little daphne and her father were last seen together sometimes over the last two weeks.

many of daphne's family gathered together last night. she has been missing since last week when her father says someone kidnapped her from his car while he went to the store to grab a drink. the father was arrested on suspicion of child endangerment but released. police say he is not a suspect in daphne's disappearance but he was noticeably absent from yesterday's family gathering. our linda yee asked marc klaas about that. he is helping the family with the search. >> you have to know when the last time the child was seen. >> reporter: it implies you suspect of father of having something to do with the disappearance. >> it implies we need to find someone who saw the child since the 27th. that's what it means. you can read what you want into it, linda. i think that already a lot of suspicions out there. and they need to be either alleviated or confirmed. >> reporter: are you suspicious? >> sure. >> reporter: now, in the meantime, searchers have scoured the waterways in the area.

they have put flyers up in the neighborhood and police are asking anyone who saw daphne or her father in the last two weeks to come forward. that father says he doesn't know who might have seen them together. he says he has mainly stayed home with daphne during that time period. the fbi is now helping in the search for daphne. back to you. >> all right. anne makovec live for us this morning in oakland, thank you. daphne is 2 feet tall, 30 pounds, missing part of her left ear. oakland police officers outnumbered protestors in the fourth night of demonstrations fourth night of demonstrations after the verdict in the george zimmerman trial. the protests were peaceful much of the night. our cameras did capture a brief clash with officers when police asked the group to turn down a loudspeaker. an oakland organization that gives a voice to young people is dealing with damage from vandals. youth radio needs $15,000 to replace windows that were smashed monday night. a youth radio personality says he doesn't think the vandals knew the group works to tell the stories of young people.

endangerment and ayou will sa. a 329-count indictment has been filed against him. among the charges, 53-year-old is accused of murder for terminating a pregnancy of one of his victims. boston bombing suspect dzhokhar tsarnaev will appear on the cover of rolling stone magazine. the cover features a self- portrait of tsarnaev with shaggy hair labeled as "the bomber." the cover is sparking outrage. three people were killed, more than 200 injured in the marathon bombings in april. the magazine will hit newsstands august 3. one of two juries on an east bay rape trial has reached a verdict. the judge has sealed the verdict that has been reached. the second jury will resume deliberations this morning. two men tried in the same courtroom before two different juries. they are accused in the gang- rape of a 16-year-old on the richmond high school campus in 2009. a state committee is calling on pg&e to pay a record fine for the deadly pipeline explosion in san bruno.

the total amount of the penalty is still $2.25 billion. but under the new plan, at least $300 million of that would be paid as a fine to the state's general fund. it would not be tax-deductible. most of the remaining money would go toward gas pipeline upgrades, easing the financial burden on ratepayers. >> our shareholders have already been committed to roughly $2 billion and that would actually take combined with what the cpuc proposed today would take us above $4 billion and that's 40 times higher than the highest penalty ever assessed. >> the public utilities commission is expected to vote on the plan before the end of the year. a former marin county sanitation executive is busted in an exotic beach town in the philippines. brett richards is charged with embezzlement, money laundering and other felonies. he was general manager of the ross valley sanitation district in 2012. arrangements are under way to return him to marin county. the charges stem from a

being called a hero for saving a woman who fell on the tracks. surveillance video shows a woman spinning around yesterday inside a philadelphia subway station. then she suddenly falls off the platform. another camera shows the man calling for help at an emergency call box. then he jumped on the tracks. >> hope that they got the train off in time because i was scared that the train was going to come. >> the man stayed with her until police and medics arrived. the woman has a medical condition. the guy thought quickly. bay area headlines now on this wednesday. the public can weigh in tonight on plans to improve san francisco's congested market street. the public works department wants to make the street more inviting and efficient for pedestrians, cyclists and transit passengers. tonight's workshop starts at 8:30 at the park 55 hotel. as the parking spaces in san francisco weren't already scarce, there could be hundreds fewer by early next year. yesterday, the mta moved ahead

with a two-year trial plan to reserve up to 900 on-street spaces for car sharing vehicles. public hearings about specific locations will have to be held before the plan goes up for final approval. perfect segue to traffic, liz. take it away. >> unfortunately, looks like a parking lot in parts of walnut creek. it's because of this earlier traffic alert on southbound 680. our latest traffic sensors showing a lot of revved. we have seen some improvement n last couple of minutes. all lanes are open but it is still gridlocked from at least pleasant hill, looks like towards 242. the one accident was approaching 24. there was another one at north main. it took a while to clear because some tow crews were actually stuck in the backup. it's also sluggish this morning coming out of the altamont pass. that drive time is up to 36 minutes now so there were no incident. it's just your usual traffic coming out of tracy and continuing heavy all the way to about vasco. and then we see some improvement in the westbound

lanes. there's some roadwork in the eastbound lanes of 580. mass transit good to go, bart, muni, caltrain and ace all on time. we'll take you outside show you a couple of our live traffic cameras so obviously the metering lights have been turned on now over at the bay bridge. we are seeing backups at the 880 overcrossing 10 to 15 minutes to get on the span. on the bridge, things are fine especially past treasure island. east bay 880, nimitz freeway we had some overnight roadwork from hayward towards oakland earlier but that's cleared. so it's a smooth ride towards oakland airport. that's your latest "timesaver traffic." things are heating up. lawrence has the forecast. >> we are going to see a lot of sunshine toward the afternoon. temperatures will really heat up especially inland along the coastline. we have some low clouds and fog even into the afternoon. starting out with gray skies for most folks this morning.

some mild temperatures to begin with. by the afternoon, more sunshine on the way. and those numbers going to be pushing 90 degrees as we head in toward the afternoon and hot days are ahead. high pressure now building in out of the desert southwest again as it moves back toward the coastline. anywhere away from the immediate coastline going to see some very hot temperatures. so the warming trend a little heat wave coming toward the weekend. high pressure overhead that means it's going to compress this marine layer meaning the fog will burn off earlier and more sunshine and with that in mind these temperatures are going to start to warm up throughout the bay area. so numbers around the state today, about 99 degrees in fresno, 66 monterey bay, 81 lake tahoe. around the bay numbers warming up, 88 in livermore, 87 in concord, 83 napa valley. next couple of days we crank up the temperatures. threatening to get triple digits as we head in towards saturday and sunday. next week more clouds and

cooling temperatures. >> 99? you can't put a triple-digit there? >> i couldn't go for it. but it's going to be close. i wouldn't be surprised if we saw a few. >> thank you. legalizing gay marriage in england now rests in the queen's hands. the country's lawmakers passed the bill paving the way for same-sex marriage. all that piece of legislation needs now is queen elizabeth's signature to become law. similar law up in scotland is expected to make gay marriage legal there by the year 2015. >> the number of applications for marriage licenses in the bay area has doubled in the past month. on the consumerwatch, sue kwon on how much money same-sex marriages are pouring into the local economy. new business from same-sex couples across the state and elsewhere. >> that's rather meek. >> a ucla study found over the next three years, california could gain about $500 million in new business all from same- sex couples from across the state and elsewhere.

and we begin with breaking news, gathering new information involving news from san jose. a police officer shot and killed a pit bull north of downtown. kpix 5 reporter cate caugiran is there and you saw a man taken away in handcuffs. >> reporter: i did. but at this point, we're not sure about his involvement in this case. but officers have reopened up the roads in this area. look at this video. we caught it with our cameras. we saw the man being handcuffed and taken away and just before that, we also caught up with the owner of the dog. [ inaudible ] >> reporter: the woman identified herself as a resident who lives in the same house as that woman. he tells us that the dog's name is bully and he kept his distance from him. we're also learning that the reason the officers -- [overlapping speakers] -- >> reporter: -- were here in the first place was because of

struggle -- >> when the end came the end -- >> he was justified. >> he was justified in shooting trayvon martin. >> four other jurors do not agree with her. they released this statement saying, juror b37 is not speaking on their behalf. the statement went on to say in the end, we did what the law required us to do. healthcare reform is back on the front burner on capitol hill today. the house is expected to vote to delay portions of president obama's program. the republican majority wants to postpone two key mandates, one that requires americans to purchase insurance, and one that requires employers to offer insurance to full-time workers. democrats are urging republicans to work with them to fix any problems. >> they should just get real and understand this is a law that's important and we -- they need to work with us to improve it. >> the white house has already announced a one-year delay on the employer mandate to give companies more time to "adjust." and this just in. queen elizabeth ii gives her

livermore, 88 also in antioch, and about 87 degrees in concord. inside the bay we'll see some sunshine and 70 degrees in oakland. more on that heat wave coming. right now let's check the roads with elizabeth. thanks, lawrence. for a while we were kind of concerned we were getting word of an accident on the lower deck of the bay bridge but it looks like it's already cleared. with eastbound 80, just past treasure island, as you can see, so far no delay on our sensors. it looks like it was just cleared out of lanes. let's check the bay bridge toll plaza. westbound traffic in the commute direction is backing up to about the foot of the maze. the metering lights were turned on just after 6:00 or right before 6:00 this morning, actually. so yeah, that's about 20 minutes to get on the bridge. then on the upper deck it's fine and the san mateo bridge commute is off to a great start here. the right side of your screen, that's the commute direction westbound 92. it's a nice drive out of hayward. that's traffic. back to you guys >> thank you. four pilots from asiana flight 214 are in the hospital in south korea. they are being treated for

injuries from the crash at sfo and for psychological trauma. south korean authorities are now questioning the pilots about that crash-landing. "wall street journal" says the pilots expressed concern though about being criminally charged. south korean law allows prison sentences up to three years for pilots that are negligent. the final decision will hinge on the country's own investigation. asiana meanwhile is facing its first lawsuit. a bay area woman and her 8-year- old son accuse the airline of wanton and willful disregard for the rights and safety of all the passengers. they suffered back and neck injuries and are suing the airliner now for some $5 million. a deadly mix of drugs and alcohol killed "glee" star cory monteith. the 31-year-old actor was found dead in a vancouver hotel room saturday. the coroner in british columbia says monteith died after overdosing on heroin and alcohol. monteith had a history of addiction and had been in rehab earlier this year.

a medical mystery in southern california. a u.s. navy veteran woke up with no memory of his past and speaking only swedish. police found 61-year-old michael boatwright unconscious in a palm springs motel in february. days later he woke up in the emergency room. he said his name was johan eck and that he had never heard of michael boatwright. doctors diagnosed little with a rare form of amnesia. >> stressful events, life changing events, family death or loved one's death. recent travel or major accident. >> clues suggest boatwright was a tennis coach and was in southern california for a tournament. a social worker discovered he lived in sweeten in the 1980 -- in sweden in the 1980s. no one knows where he lives now. a picture is worth 1,000 words but now there's a 3-d memento pregnant mothers can

guadalupe river.... it had some sort of plastic tie around her bk and was having trouble swim. resc a beaver got some much- needed help in san jose. she was found near the guadalupe parkway river. she had a plastic tie on her and was having trouble walking and swimming. rescuers trapped her yesterday and freed her. >> this looks like a newspaper strap. it's a little smaller than a packing strap. and it's not too big in diameter so you can imagine, you know, how much it must have been constricting on her. >> took about a dozen people to

rescue the beaver. she has been nicknamed mama beaver. and we're told she is doing fine. >> good to hear. you might think a grocery store would be a safe place for shelter from a storm. >> not so for a woman in louisiana. the woman had her 2-year-old in a grocery cart when the storm hit so she tried to get out of the weigh in the store and that's when -- she tried to get out of the weather in the store and that's when she was instructed by lightning. >> i pushed her out of the way and it went straight through me. it went from my head down the back of my spine to my left thigh and on my foot. >> oh, boy. she is going to be okay, though. so is another mother from the same town who was struck by lightning a couple of weeks ago while she was cooking jambalaya in her kitchen. scary, right. >> probably not a good idea to have a grocery card in your hands. >> i have heard of stories of people getting electrocuted in showers. >> there's a book that says you

should never take a shower in a lightning storm. >> i think that's very bright. >> yes. >> that's a good book. around the bay area today, we have some low clouds and fog surging well onshore again although it's going to break up early on and that means we are going to see more sun and warmer temperatures coming our way. in fact, this is going to start to get hot in spots inland. more sunshine around the bay area today, cloudy at the coastline but toward the the weekend, probably talking about temperatures near triple digits in some of the valleys. high pressure building in out of the desert southwest going to bring some of that desert air back into the bay area. more sunshine, warming trend begins today. we are seeing the clouds and still delays at sfo on arriving flights of just over an hour there. by the afternoon, we should see some sunshine and about 70 degrees. houston looking at some thunderstorms popping up there and 90 degrees. 90 in denver. 92 and partly cloudy in chicago. and also new york. looks like around the bay today, we'll see those temperatures soaring into the 80s into san jose.

upper 80s into morgan hill. still 60s at the coastline. east bay into the upper 80s in many spots well inland. high as 89 in brentwood. 87 in concord and 88 in livermore. and inside the bay 70 degrees becoming sunny in the afternoon in oakland and 66 degrees and comfortable in san francisco. next couple of days we crank up that heat. those temperatures soaring near triple digits on saturday and sunday. then some slow cooling a few more clouds come monday and tuesday. let's check the roads with elizabeth. thanks, lawrence. we'll start off with a live look this morning out towards westbound 580. so that is one of our worst drive times right now. it got started early with the gridlock coming out of tracy and now it's continuing into the livermore valley. once you get past vasco road we see some improvement but then there was this new crash just reported in the center divide westbound 580 by santa rita. so again in the center divide but maybe sluggish closer towards the dublin interchange. so traffic is still a mess through walnut creek. there was an earlier traffic alert much earlier long since cleared but we had two accidents one approaching north

main another one at 24. and it's still backed up into pleasant hill. southbound 242 looks pretty backed up, as well. mass transit is our bright spot this morning. so far no delay. bart has 54 trains all running on time. muni, caltrain and ace trains one, three, five, so far all should be good to go so far for this morning. let's go outside and show you a couple of live traffic cameras. here's a live look at the golden gate bridge. a nice flow of traffic this morning from san rafael to sausalito. no delay across the span. coming up, we'll get a last check of the bay bridge. in the meantime, back to you guys. yahoo's earnings report has some disappointing numbers. but there is some good news, as well. kcbs radio's financial reporter jason brooks joins us with more. >> reporter: sometimes you have to dig a little bit to find the good news. on the surface yahoo's 2nd quarter results not all that great. profit did top expectations but revenue was down 7% from a year earlier to $1.07 billion.

that missed estimates. but yahoo also disclosed that chinese e-commerce giant ali baba in which yahoo owns a 23% stake saw its revenues soar. since they own such a big stake, it's privately held one of the most anticipated ipos out there yahoo stands to reap a big payday when that happens. as a result, yahoo shares are up by more than 4% primarily based on that. housing starts in june slowed down their pace a bit. commerce department says they are off about 10% from we what we saw in may but an apartment building is largely responsible as it took a dive by 27% on a good side of things, single family building permits rose for the third straight month and that's key in the current housing recovery that we're seeing. fed chairman ben bernanke delivering his semi-annual testimony on the economy to members of congress this morning. once again reassuring that there will be no tapering of its massive monthly bond purchases until the economy is

customers and promises to explore all options. checks are in the mail for many who bought skechers shape- ups. the federal trade commission is mailing more than a half million checks to consumers who bought the so-called toning shoes. the company agreed to pay a $40 million settlement after it was accused of deceiving consumers with false promises saying the shoes would help people lose weight and strengthen muscles. nike pulling its new t- shirts off the shelves after it failed a geography test. here it is. the t-shirt shows carolina panthers logo with the letters nc inside an outline of the state of south carolina. problem is, carolina panthers play in north carolina. nike's spokesman apologized for the merchandising mistake saying the t-shirts should have never been sold. keepsakes now, i guess, though. in your healthwatch this morning, 40% of americans think marijuana should be legalized according to a new survey by the partnership at drug- free.org. a majority of those polled believe pot should only be
