the most urgent part right now is that police are on the hunt for the third suspect in the lundy killing. the confrontations with police ended with police fatally wounding those two suspects. police are looking for the third suspect. they said at a news conference they'll be releasing video showing this masked suspect in the commission of that killing. we expect that video sometime later tonight. as for the killing that happened here on kirkhaven, it all started with a police chase. >> reporter: this is how it sounded on police radio. a gun battle and car chase with a murder suspect who's on the run and may be threatening the life of his passenger. >> suspect has a female occupant in the vehicle. per our last information, 187-er. >> reporter: 187 is police code for murder. >> kirkhaven court. shots fired. one suspect down. >> reporter: the

woman was apparently unharmed. s.w.a.t. officers had been tailing the man as a suspect in an august 13th murder on lundy avenue but police say the man took off when they realized they were following him. he apparently was trying to go to his house on kirkhaven. police say he crashed his car, ran toward his house and reached for something in his pants while on the front porch. >> the officer fired at the suspect once he did not comply with officers' demands. the suspect turned around and the officer fired again. eventually the suspect fell and he was pronounced deceased at the scene. >> reporter: it was the second time in less than a day that officers shot and killed a suspect in the same lundy murder case. sunday night police shot and killed another man in a strip mall parking lot. they were the fourth and fifth deadly police shootings this year. >> i don't have the data to know why we're seeing more right now. >> reporter: mayor sam liccardo

said each case will be investigated by police and the district attorney's office. >> it is not surprising to me that two very violent homicide suspects might be engaged in some way in provoking but i just don't know and we need to find out. >> reporter: family members of the latest shooting victim did not want to speak to reporters but they gathered near the spot where the man was killed and laid a bible down in the street. >> friends and family of that victim are starting to gather here at the scene. they planned a vigil for later tonight. police said at a news conference this afternoon they initially believe that suspect was reaching for something, possibly a gun in his waistband. they said today at a news conference he was unarmed, however, they did recover a tech 30 weapon, semi automatic assault weapon. they wouldn't say where that weapon was found but they believe it was a weapon used in the commission of the lundy

killing. reporting live in san jose, len ramirez, kpix 5. >> the fatal shootings trace back to a murder last week at a san jose office park. our coverage continues with kpix 5 devin fehely and chilling photos taken moments before a brutal killing. >> at that point he knew he was going to be shot. i struggle with that. >> reporter: it's this image that haunts michelle, a snapshot from a security camera obtained by the mercury news that shows her friend and former coworker christopher max wren, hands raised and in an apparent sign of surrender moments before he was shot and killed. >> i can't imagine what the victim was going through. >> reporter: investigators have not said what triggered the shooting but court records paint at least a partial picture. for more than a decade he's been in and out of trouble with the law, arrested and convicted multiple times for the possession, sale, or use of methamphetamines. >> the suspects were running

after and intimidating and terrorizing the victim. >> reporter: she says her former coworker was polite, charming even, and has well documented problems with drugs only tell part of the story. >> his brother had posted on facebook how much he's going to be missed and how great the out pour was for him. a lot of people loved him. >> according to court records, wren was arrested most recently in february of this year for being under the influence of drugs. that's around the same time he lost a job. friends and co-workers say after that arrest they had struggled to help him get back on his feet. devin fehely, kpix 5. right now the california air national guard is trying to save a man's life hundreds of miles at sea. the rescue mission started this afternoon in mountain view. a sailor is in trouble 900 miles out in the pacific. allen martin is following the developing story from our news room. >> pretty daring rescue they're

going to attempt here. the guardsmen will parachute in to the water and make their way in to the ship where there's apparently a medical emergency. chopper 5 caught the c130 as it took off this afternoon. normally the 129th rescue wing would use this in a combat mission. here's another look at the plane just before take-off. they've loaded it up with supplies to perform this rescue. not a lot of details available but we know the injured man who needs help is on a vehicle carrier called the green ridge. those onboard with him don't have apparently what they need to take care of him medically. the air national guard did get the call this morning from the u.s. coast guard. >> we at the 129th rescuing specialize in rescue operations and since we hold this responsibility at california air national guardsmen to the state of california we will respond in the most severe cases only for a rescue operation. >> the 129th air national guard

emphasizes the call in to action only in the most extreme instances. we got an up-close look at what they do a few years ago. normally they're flying in to war zones. this was just a practice run but you can see how daring it is. they take hundreds of pounds of gear with them. the team credited with saving the lives of more than a thousand people. and of course we'll continue to monitor the mission, get you the update tonight on how it turns out. allen martin, back to you. east bay m.u.d. is having to answer tough questions tonight after nine water lines broke following yesterday's 4.0 quake. new at 6:00, kpix mark sayre on whether our water system ready for a big quake. >> while the damage from yesterday's quake was minor, it definitely does serve as a

warning. >> reporter: when the ground shook on monday morning it did more than just shake up animals and people. east bay m.u.d. said nine water lines broke including this one in richmond. the good news, they were all smaller lines and only about 100 customers in all lost water service. >> the pipes that broke were mostly the older 1920s, 1930s cast iron pipes which isn't surprising. these are brittle pipes more susceptible to ground movement. >> reporter: but when a bigger quake hits, the entire water delivery system could be at risk. most of the water is on a fault. one of the signature accomplishments, the massive claremont tunnel that crosses the hayward fault and will flex in the event of a big quake. >> it can move within the fault lines.

if there was a large jolt on the fault, we should be able to withstand it or at least not have as much damage as we would have. >> east bay m.u.d. is on five reservoirs. in the event of any kind of disruption. >> we don't know how long we'll be without water when the big one does hit. >> reporter: major infrastructure improvements are underway on the hetch hetchy system. that project includes replacing huge pipes that bring water to the peninsula and san francisco. water planners are busy reinforcing the physical infrastructure. the very easy steps you can take, experts say make sure you have a three to seven-day supply of water in the home in the event of a major water disruption. mark sayre, kpix 5. >> the numbers are in and they're not good. the drought is costing california's farmers

hayward police need help finding three people suspected of killing a teenager about to join the marines. they released these sketches. all of them are described as latino, aged 17 or 18 years old. they escaped in a silver suv. they're wanted for shooting keonta murphy two weeks ago. the three teens approached him. police say after exchanging words with the suspect, murphy was gunned down. a two-alarm fire broke out this morning that sent a massive plume of smoke over the neighborhood. the fire broke out around 10:00 between 46th and 47th avenues on tereval. it scorched the rip tide bar, a popular hangout for surfers and

locals. it also caused minor damage to the great highway market next door. state health officials have confirmed tonight a second visitor to yosemite national park has been diagnosed with a case of the plague. that disease is carried by wild rodents and their fleas. earlier this month a child contracted the plague after visiting yosemite. the park has closed several campgrounds as they treat the area with insecticide. a polish tourist who went missing at lake tahoe has been found safe in missouri. police began searching for the man after his rented board and go pro were found on the lake. these were the photos on the camera according to police. someone in a personal water craft bumped him off his board. rather than risk drowning trying to get to it, he just let it float away. tips led police to a friend who reported he was safe and continuing his vacation. a fiery wake-up call in las

his daughter's brave actions. >> when the firing occurred, she was out front with the children and she was running to her children to protect her children when this happened. and she was struck with a bullet. and passed away. >> a 38-year-old man was also shot and killed in the same crossfire. homicide investigators have collected footage from several surveillance cameras in the area. they believe the person of interest was inside this black truck, likely a dodge ram. a $2 million discovery at a beverly hills pawnshop turns out to be the key to solving a new england art heist. how a reality tv star helped catch the thieves. >> reporter: the star of the reality tv show, beverly hills pawn, known for selling high end goods and dealing with works from street artist banksy.

he recently became the center of an investigation. 37-year-old oscar roberts seen in this picture. he's been sentenced to 28 months in federal prison after he tried to send paintings. the office got a tip that works were being moved from new england to southern california late last year. >> because it was too hot to sell them up there. >> reporter: the investigation led to beverly hills where it landed in michelle steeler's hand. >> we average 2,000 pawn slips a month which michelle looks at. >> reporter: steeler cross referenced the information on the pawn slips with an fbi database and got multiple hits. the paperwork led to roberts and two other men who have been convicted in the case.

he says the paintings came in to the store unframed. they say the works suffered damage which caused them to drop in value. >> they were valued between $1 and $2 million. >> we report everything. we have to report it. >> reporter: two other paintings are still missing. now the fbi is offering a $20,000 reward to help close the case picture-perfect. >> fbi officials say those two missing paintings could be anywhere in the world. it could take years to find them. still ahead, walgreen's on the hook big time. >> what the drugstore chain failed to do for its pharmacy customers and the bay area connection to the case.,,,,,,,,,

case, you're going to have laws covering people with disabilities and people with disabilities will be pressured to end their lives. >> in order for the right to die bill to have any chance of becoming a state law, it must pass both houses of the state legislature before september 11th. one of the nation's biggest pharmacy chains is promising to make some changes. as consumer watch reporter julie watts explains, walgreen's will be giving out more than just pills to people who fill prescriptions. >> a lawsuit accused walgreen's of failing to offer patients a personal consultation with the pharmacist. that's something required by california law so customers can ask questions about their drugs. according to a lawsuit an undercover investigation revealed walgreen's pharmacists routinely didn't give customers that opportunity. walgreen's agreed to pay a half million dollar

fine and agreed to implement new measures. the drugstore did not admit any wrongdoing. if you made a purchase on the pottery barn kids website last week, you may be getting a refund. last monday pottery barn kids offered 20% to 25% all sheets and do -- and duvets. they refused to refund the difference. that is a violation of ftc truth and advertising regulations so we brought it to the regulator's attention. >> they're more sophisticated than you think they are. they do know about our rules for disclosures on websites. the advertising principles of conspicuously disclosing critical terms and conditions is not new. they also know not

encountering black people. >> reporter: when she shot the video she was on her way to talk to an editor about her latest project, police brutality. and as we were reporting our story where the first incident took place, police took down another suspect from a robbery with a heavy presence. want to see it unfold? check youtube. there were cameras all over. mike sugerman, kpix 5. >> police are asking for the entire half-hour video shot by that woman. the family of a woman taken hostage and killed during a bank robbery is suing stockton and its police department. it ended in a wild chase in a shootout on city streets. more than 600 shots were fired and when it was over, misty holt-singh was dead. a report yesterday called the actions of the police excessive. now her family has filed a lawsuit claiming negligence, battery, and violations of civil

rights. >> we believe the right thing for the city to do is to continue to accept responsibility and get this matter resolved. to not do so is wrong to paul, to ms. huber and ms. castoya and a dis-service to the police officers involved and the community. >> the city and police department haven't commented on the lawsuit. when it comes to the report, the police chief said the robbers pose adrisk to the community and had to be stopped. it's a first in a 60-year history of the army rangers. two women have just earned the elite ranger tag. allen martin shows us it wasn't easy. >> reporter: after 62 days of grueling training, two women are now on their way to graduating alongside 94 men from the army elite ranger school. the two were among 19 females who took

part in the first ever co-ed training. >> carrying the rough sack which is pretty heavy, running missions, learning how to do patrolling in different types of environment, none of that is aided by the fact that the students probably average between two and four hours of sleep a night. >> reporter: they started the grueling journey in april with hundreds of other soldiers, first doing 49 pushups, 59 sit-ups and a 5-mile run in 40 minutes. they mastered military mountaineering, parachute jumps and air assaults. >> the route of everything, the purpose is to create combat leaders and help make the rest of the army better. >> reporter: the female graduates won't be able to join the 75th ranger regiment since the force remains closed to women. >> the military is expected to keep some combat roles male

>> we need a lot more basic research to figure out how these things work and if they work. there's something here that this field is based on a solid foundation. >> reporter: unlike his scientific counterparts who signed the letter, he's working with bay area tech startup akili to develop video games that could actually improve a person's memory. this one is called neuro racer and it focuses on multitasking. the player drives a car through a 3d course. sounds pretty easy, right? at the same time the player must respond to the road signs that pop up at the top of the screen and the game gets harder as you get better. he's the chief science advisor for the game which was originally used to help seniors improve their memories. but he says this kind of challenge could have a positive impact on people of all ages. >> since the game is active at improving cognitive control, the

idea is it can have an impact on populations outside of older adults. >> reporter: he says he hopes neuro racer can one day be used to treat psychiatric disorders. >> the doctor hopes to test his hypothesis by putting the game through the fda approval process for medical devices. some pediatricians are concerned the video games may be used instead of traditional treatments that are proven to be about 80% to 90% effective. as they head off to college, we're getting a look at the mindset of students from the class of 2019. since most were born in 1997 or later, they've always had google. cell phones are so common that teachers might not know if they're being used to take notes or set up a party. in their lifetime hong kong has always been under chinese role and mr. jones and mr. smith have always been the men in black and not their next
