bay. outside number roughly right around 67, 68 degrees towards the delta but boy, the winds again up to 30 late day. 62 in san rafael. we do have warmer weather coming. i'll pinpoint the days that you can expect the 90s to return right here. that's still coming up at 18 after the hour. in just a few hours, sentencing begins for the man convicted of killing 15-year- old sierra lamar. kpix 5's sandra osborne reports reports. >> reporter: kenny, the defense is actually moving forward as though 26-year-old antolin garcia-torres is innocent even though he was found guilty of abducting and killing 15-year- old sierra lamar and also three other attempted kidnappings of women back in 2009. now, this next phase is called the punishment phase. he faces either the death penalty or life in prison without parole. today the jury will be back inside the courtroom where the

prosecution can call for testimony from sierra's family and friends. >> because that process requires respecting the jury's decision and to be free from any interference, there can be no further comment from this office about what comes next. >> reporter: now, we do know there will be emotional videos and photos of sierra shown to the jury showing what a vivacious and loved girl she was. the prosecution wants to also reference a lack of remorse from garcia-torres. the defense, however, will also try to win sympathy from jurors painting a picture of garcia- torres as a young father of two with a rough upbringing. the judge will decide if his alleged childhood abuse, neglect and poverty will be factors the jury should consider. regardless, right now, his life is in the hands of the jury. proceedings begin at 9:00. live in san jose, sandra osborne, kpix 5. today lawyers for families of the ghost ship fire victims will announce plans to combine multiple lawsuits into one

case. the families say living conditions were dangerous at the oakland warehouse well before 36 people were killed in the december 2 fire. alameda county district attorney nancy o'malley is now deciding whether to file criminal charges against the building's owner. turning to politics this morning president trump is responding to a bombshell "washington post" report which claims that he shared highly classified information with the russians. mr. trump took to twitter this morning writing, quote, as president i wanted to share with russia at and openly scheduled white house meeting which i have the absolute right to do, facts pertaining to terrorism and airline flight safety, humanitarian reasons, plus i want russia to greatly step up their fight against isis and terrorism. >> the president and the foreign minister reviewed a range of common threats. at no time were intelligence sources or methods discussed. >> the post report does not say sources or methods were disclosed but rather that a specific plot was discussed. current and former u.s.

officials reportedly told the paper the president went "off script" and described details about an "islamic state" terrorist threat related to the use of laptop computers on aircraft. >> i think that the white house is playing word games to that effect to try to, um, to try to blunt the impact of this story. >> one official tells cbs news the sensitive intelligence concerns the makeup of a possible isis laptop bomb and new calculations of its explosive power. >> the suggestion that he might have shared highly classified information inappropriately with the russian foreign minister is deeply troubling. >> it's disturbing and let's find out what the details are, whether it actually happened or not. >> on the campaign trail president trump criticized hillary clinton who the fbi said mishandled classified information on her private email server. >> hillary clinton lied about her handling of confidential information! >> as president, mr. trump has the authority to declassify the information. so he did not break the law. house minority leader nancy pelosi said:

today at the white house, president trump will meet with the prime minister of turkey. ays to >> today at the white house, president trump will meet with the prime minister of turkey. topping the agenda ways to further global cooperation to confront terrorism. security researchers have found technical evidence they say could link north korea with that global cyber attack. it impacted computers in more than 150 countries. hackers are demanding $300 in ransom to decode them or they would be destroyed. the attack is among the fastest extortion campaigns on record. >> the magnitude of the attack here is tremendous. we are talking 200,000 computers across 150 countries so this is really the biggest cyber shakedown in history. >> this morning hackers are threatening to release disney's latest "pirates of the

caribbean" on the web unless the company pays them a ransom. more bay area headlines. there is going to be a discussion about pot in walnut creek today. city council members are deciding whether or not to extend the city's smoking prohibition to marijuana smoke. they are also talking about how to regulate and tax recreational marijuana. earlier this month, the city asked residents for their input on how it should be regulated. they will share some of those results at tonight's meeting. it starts at 6:00 at city hall. in our bay area watch, oakland city council is expected to discuss relief for the city's homeless population at a meeting today. one proposal would use funds from a bond measure to acquire buildings like motels to provide expanded housing and support for the homeless. the homeless problem has been contentious in the community especially after dozens of tents caught fire at an encampment this month. the meeting starts at 5:30. today the marin municipal water district will sign off on water rate hikes during its board meeting.

after holding a public meeting and reading 1,000 pieces of mail on the subject, the water utility is expected to approve a 14% hike to be carried out in steps through 2019. the average user's annual bill would go from $660 to $744. the water rate hike is expected to cover pipe improvements in the area among other initiatives. today san jose city council is set to vote on a plan that would give locals plenty of options to power their homes. kpix 5's jessica flores is live in our newsroom to break down the fine print. >> reporter: san jose city leaders want to make it easier for residents to go green. the city is considering a plan to create its own electricity utility. the plan would start san jose's first community choice energy program. it promises to give consumers options to create their own mix of energy sources. so under the plan residents would be able to choose to stay with pg&e or they could opt in to a range of green energy

choices like solar stations and wind farms. city leaders say their proposed plan would be cheaper because they don't have to deliver profits to shareholders like pg&e does. >> we certainly see the opportunity for savings but we also see a great opportunity to really move the needle and reduce our carbon footprint. >> other cities such as san francisco have similar programs but san jose would be the largest to offer its own electricity plan. san jose gets 30% of its energy from renewable sources now. but with the community choice that could go up to up 50%. in the newsroom, jessica flores, kpix 5. game 2 warriors versus spurs. right here at oracle arena tonight. coming up after the break, we'll tell you what fans have in store. >> so imagine sitting around in your shorts by a pool in 90- degree weather with an adult beverage perhaps? that's not going to happen today.

morning hearing some very important testimony before they make that big decision. now, the defense maintains that 26-year-old antolin garcia- torres is innocent even though he was convicted for the abduction and killing of sierra lamar and for the attempted kidnapping of three other women in 2009. defense attorneys plan to try to win sympathy from the jurors by showingist a young father of two the prosecution plans to show emotional videos and photos of sierra painting a picture of a loved teenager. family and friends of the teenager will testify also. we heard from sierra's sister after the verdict. >> not closure. but it is a good first step. and the jury did the right thing. >> reporter: now, the family didn't comment on the penalty they would like for the man convicted of killing sierra. this phase the sentencing phase it could be time-consuming.

yesterday i was inside the courtroom during a hearing just the prosecution alone had a list of at least 11 people that they would like to testify during this phase. the next proceeding begins at 9:00 this morning. live in san jose, sandra osborne, kpix 5. a santa cruz county doctor and nurse have been arrested on suspicion of committing sex crimes against children. police arrested neurosurgeon james koh hut at a home in santa cruz. a nurse who worked with him rashel brandon was arrested in watson villas week. both are facing charges including lewd acts on a minor. a third suspect in another state was arrested. that suspect's identity isn't released. right now, federal investigators are on the scene of a massive fire in emeryville. there are still hot spots after the fire erupted three days ago. since then, crews have been trying to get it under control and getting rid of the debris. they are using drones to spot any dangerous areas. the developer says that this is

would be able to choose to stay with pg&e or they could opt into a range of green energy choices like solar stations and wind farms. city leaders say their proposed plan would be cheaper because they don't have to deliver profits to shareholders like pg&e. customers we talked to welcome any plan that saves them money. >> the rates seem to be, um, something we're forced to deal with so if you could provide me a new option i'll take it definitely. >> the. >> reporter: the city estimates the energy plan could save customers more than $20 million a year. san jose gets 30% of its energy from renewable sources right now. but with the community choice program, that number could go up to 50%. in the newsroom, wilmer flores kpix 5. senator dianne feinstein is pressuring the trump administration to release funds tore caltrain's electric upgrade saying she will oppose every transportation nominee until the white house approves the $647 million grant.

construction. commerce department says the housing starts are down about 2.5% in april second straight monthly decline and the lowest level in five months. building permits were also down. it's interesting because it comes at the same time as the national association of builders says its optimism index is at a second highest level since the end of the great recession. now, builders are expected to be very busy as there are very few existing homes for sale on the market. those levels are historically low. builders expect to fill that gap. stock market got off to a positive start this morning. that meant record highs for the nasdaq and the s&p in the process. right now, dow back over 21,000 on a gain of 24 points. nasdaq up 7. s&p up by 1. back to you. >> thank you. there could be changes coming to traffic tickets. a proposed bill would tie the fines to the driver's income. a senator who proposed the measure said it would help lower fines for poor people.

is your extended forecast with that modest warmup on wednesday. terrific conditions on thursday. approaching 90 by friday. look at the beaches saturday and sunday in the 70s. and low 90s away from the bay. we have ourselves a baseball game. the giants are going at it tonight against the dodgers. breezy and cool in the 50s. dress in layers heading to the ballpark. caltrans crews will start repairing the pfeiffer canyon bridge. it will involve full and partial closures of area roads. the deliveries will include 50% of the rock and sand that will create the concrete abutments for the new structure. crews have also been creating steel girders for the bridge in vallejo. some of the winter damage is causing problems for firefighters who may not be able to get through mudslides and damaged roads. officials say hundreds of roads
