foreign entity. in washington, i'm scott mcclain. >> before joining the fbi mueller ran the federal prosecutor's office here in san francisco. this morning, cal/osha is expected to announce regulations set to improve safety conditions at local refineries. kpix 5's anne makovec is live at the richmond chevron refinery where a massive fire sparked calls for change. anne. >> reporter: these rules have been about five years in the making. this morning there is going to be a hearing on regulations for refine rice around the state of california including the chevron refinery where i am right now. and there's been pressure on the state to crack down on refineries since this 2012 explosion that blanketed the east bay with a dark cloud of toxic smoke causing 15,000 people to seek medical attention after inhaling the smoke. richmond then sued chevron claiming the refinery willfully

disregarded public safety as a matter of corporate policy. >> decisions that we believe created and set up what happened on august 6 of 2012 are decisions that are made in board rooms and those decisions deal with how much money are you going to budget for safety? >> reporter: another more recent issue for the refinery the bay area air quality management district issued four violations to the chevron refinery here in richmond over a flaring incident in december that led to dozens of complaints about a foul odor. two of the citations were for excess levels of hydrogen sulfide detected by ground level monitoring equipment. and two violations for creating a public nuisance. now, the regulations being announced today according to labor unions will better prevent explosions, firings and releases from refineries like chevron. live in richmond, anne makevoc,

kpix 5. today witness testimony continues in the sentencing phase of the 25-year-old man accused of killing a missing morgan hill teen but a new development might change the course of the event. doubt has surfaced over the conduct of santa clara county sheriff's sergeant herman leon who is a central investigator in the sierra lamar case. the issue, a judge from a different case believed that leon testified to statistical inaccuracies so significant that murder convictions had to be overturned for two defendants. >> if the court feels that there's credibility issues involving one of the main detectives and that should have been disclosed to the defense, that will certainly be grounds they will look at to ask for a new trial in this case. >> defense attorneys in the lamar case say that they want the previous judge's ruling on detective leon discussed before jurors to spare antolin garcia- torres the death penalty. today in san francisco, uc regents are set to vote on the

budget which could entail a tuition increase. yesterday, uc students broke down a symbolic wall as a form of push back to the proposed hike. they are hoping regents will change their minds about the increase approved in january. many felt it was especially unfair after a state audit revealed the university failed to come clean about $175 million in funds. up for debate a cap on out-of- state student enrollment also up for discussion. today is the grand opening of san francisco's newest public art collection at trinity place in the mission. it will open up to the public. at the center of the art collection is a 92-foot sculpture called venus. it's part of the festive celebration legendary singer frankie avalon will sing his hit "venus." the music world is mourning after a loss of a grunge rocker. >> and fraternity at a northern california university is in hot water with police after a weekend trip to a national

billboard magazine reports police in detroit are investigating his death as a suicide. new this morning, a fraternity at chico state is in trouble for reportedly destroying part of a forest. the u.s. forest service filed a criminal complaint against the university's chapter. some of the members reportedly chopped down dozens of trees in the national forest. the boys are facing vandalism and illegal firearms charges. they are expected in court next month, the men are expected in court next month. a sacramento teen went missing after jumping into the american river last week. dramatic video shows the last time 19-year-old ray was seen alive before he was swept away. it shows him trying to swim to shore. his friends immediately called 911 but soon lost sight of him. ray's family says they decided to release the video to bring attention to his disappearance and rally the community to search for him. >> still imagine that he is still out there cold didn't

tim, you got a fair, festival? let me know. all i know about is "bay to breakers" on sunday. we'll begin to cool down under partly cloudy skies. average 64 degrees. it is start time in the high 50s by the time you head to the beach. also in the 50s. but during the race in the 60s perfect running conditions for "bay to breakers." all right. take a good look at this. see that right there? this is clear skies at the coast except a swath of clouds along the san mateo coast. that's about it. our futurecast does illustrate that we have some clouds out over the open waters. wants to interfere with our friday but high pressure keeps it out over the ocean. by saturday that marine layer gets closer and closer and there you have it playing tag with the city of san francisco. that's why we introduced those clouds during the running of the "bay to breakers" race. satellite-radar does suggest that this area of high pressure is diverting the storm track well to the north of us as it noses in. it's going to continue to dry out the air mass. the temperatures go up, the pollen goes up, as well.

earlier this morning a man was inside a home with a gun according to the contra costa county sheriff's office and a "shelter in place" was put in place for this neighborhood. we are on robin hood road and this happened about a block away at robin hood and knotting ham. there's an elementary school nearby so hopefully it will clear up before school starts. we talk to a man who was out for a morning walk with his dog. he usually comes this way and was surprised to see everything. again, we believe this situation has ended. just about 10 minutes ago. and it is a safe situation here. in el sobrante, jackie ward, kpix 5. right now, firefighters are on the scene of a fire in san jose. this is a live look along south white road. it started at 3 a.m. we are told the building used to be an o'reilly auto parts

despite improving job prospects for college graduates, many are headed back to their parents' homes to save money. census bureau data shows one- third of 18 to 34-year-olds live at home. cbs news business analyst jill schlesinger is here to share some ground rules before you lay down the moving truck. all right, jill. so parents like to say, my house, my rules. i have said it many times. but when an adult moves back home -- [ laughter ] >> -- is that still the case? >> reporter: it is. you are moving into your parents' house. but here's the idea. both sides really need to review their expectations for this arrangement. you start with how long you expect this situation to last. and then what are we going to do about communication? do i get to nudge you if you come home late? like what are we doing here? so just agree to something. will those kids pay rent? will they contribute to the households in another way? maybe they will do grocery shopping, maybe they will mow the lawn. i don't know. but you got to talk about it. parents your goal isn't to soak your kids for money but you

want to foster good habits ultimately financial independence. hey, good news. kids may be a little more receptive. a bank rate study released this week found millennials think people should pay for their own housing at age 22 their own car at 20, their owe cell phone at 18 without the help of their parents. so that's good. once you decide what the ground rules are just put it in writing. you want to revisit it every three months. >> wow. that's surprising. 18, 22, still seems young but gives them that responsibility. so you say that some parents are putting themselves at risk with these kinds of arrangements. how? >> reporter: well, the problem according to certified financial planners is that there are some parents who are supporting their children to the point that they are putting their retirement at risk. so in some cases, to help carry the extra costs of those adult children, people are reducing their retirement contributions. this is happening at the very time when they should be increasing those contributions. even more dangerous, with the stock market higher housing

bay. the crimes happened all ac we are getting our first look this morning at the suspected firebug behind the string of arsons in the east bay. the crimes happened all across contra costa county. he has been identified as 36- year-old james bishop iii of pittsburg. officials have charged him with 14 counts of arson but they believe he actually set as many as 30 or more cars on fire. officials set up a countywide task force to catch him. police and fire investigators caught bishop after a fire saturday they believe he set in a benicia driveway. home surveillance video also helped lead to his arrest.

>> an older toyota rav-4 was identified through security video provided by homes and businesses close to fire occurrences. >> bishop is being held on more than $3 million bond. san francisco police are searching for the suspects who beat and stabbed a man in the middle of dolores park. witnesses tell police that a group of six people chased the victim through a stretch of the park around 5:30 yesterday. soon they began hitting him with a golf club and bottle. the attackers fled after people nearby started shouting at them. a paramedic says the victim had two stab wounds. fire in the hole fire in the hole! >> boom just brought the former fort ord one step closer to becoming part of the national monument. explosives dating back to world war i made this stretch of monterey unsafe for the reuse plan. but projectiles, rockets, grenades and mortars were destroyed yesterday during three blasts to ready the area

"skydrone5" giving us a bird's- eye view. caltrans' plan was to demolish the midway overpass and build a new one to meet standards but then biologists discovered the hawk and a nest since the hawk is on the protected list, crews cannot work within 600 feet of the nest. >> these bridges are built back in the '50s. and it's something we have to update. and take care of. >> historically there were about 17,000 of these type of hawks. today there are about 4,000 breeding hawks. >> so for now crews will focus on the meridien overpass just down the road until the nest is gone. the oakland a's might have a new fan. he roots for the mariners but the a's showed him some real team spirit. >> oakland's ryan healy lobbed
