repairs to san francisco's troubled millennium tower are under way again. for how long in tonight, an expert reveals new concerns to kpix5. >> we have not gotten to the worst part of the fix.

the risky part of the fix. and hundreds of passengers run on to the tarmac at l.a.x. a suspect in custody, what happened tonight. mountain lions and bay area tonight, how they are able to travel so far so fast. plus, one woman's close encounter. [music] and tonight, halloween is back and the displays bigger and better than ever in one east bay neighborhood. good evening i'm elizabeth cook. >> i'm ken bastida. >> a working report on the leaning tower resumed today. >> kpix5 spoke to a structural engineering consultant who believes it is time to put the brakes on the entire project, max? >> reporter: for months we reported on this fix to the tower that actually has

been making the problem worse than better. construction crews were out here today once again working on one part of the project. that structural engineer thinks there is serious potential that this retrofit will hit another big roadblock. >> reporter: construction crews were busy on the corner of mission and fremont today as work on parts of san francisco's leaning tower retrofit resumes. work on the fix was put on pause just before labor day once it became apparent construction methods were making the problem worse. >> we have not gotten to the worse part of the fix yet. the most risky part of the fix. >> reporter: david williams is a structural engineer and deep foundation expert. in 2017 concerned unit owners hired him as a consultant after learning their luxury high-rise barely seven years old at the time, sunk more than a foot and leaning to the northwest. >> there was evidence of a lot of places with water intrusion.

>> reporter: williams noted extensive water damage in the garage but he says the floor of the towers basement exposed what appeared to be a bigger problem. it was dipping in the middle. something referred to as dishing. >> the dishing of the floor there which is the dishing of the mat, it was significant. clearly it has been disstressed. >> reporter: he predicts the pileup grade may run into serious problems when new piles, anchored to bedrock are connected to the weakened foundation. >> when they start jacking they are doing a load redistribution and they are depending on the integrity of the existing structure. >> reporter: he hopes it will be discussed when they have hearings at city hall next week. >> the supervisor called for the hearings. >> the building today not in any imminent threat of structural failure. the question that has not been

answered is as what point is the point of no return? >> reporter: a spokesperson for the homeowner's association sent us a copy of a letter from a contractor working on a leak repair design for the garage. now, according to the contractor the gar acknowledges not underneath the main tower of the tower but the smaller one that is adjacent to it and the water intrusion does not pose a life safety concern. ken, liz? >> max, you mentioned constructions resumed once again, do we know if there is a point when they would have to pause work again? >> reporter: so, ken, they are installing new casings on the northwest side of the building, now, according to a letter that the city sent to both of the tower gm and the hoa if any of these casings result in about a quarter of an inch or settlement or more per

casing work will stop immediately. ken, liz? >> all right, max, thank you. we have been digging into the problems at the tower for months now. you can see all of our original reporting on kpix.com. new at 11:00. scary moments at l.a.x. tonight where reporters of an active shooter grounded some flights and sent hundreds of people running out on to the terminal, out of the terminal and on to the tarmac. officials say they received a report of someone with a gun in terminal one. no shots were fired and no weapon were ever recovered. one person was detained, though. no further details have been provided. airport operations are now back to normal. this comes just 24 hours after a flight attendant was attacked midair. there is a call to action by

the most powerful aviation agency in the u.s., the fight for safer skies. the latest attack from a flight attendant in a trend of physical assaults in the air. passengers booed the suspect accused of punching the airline employee twice. and breaking her nose on a flight to santa ana from jfk airport. >> she had blood on the outside of her mask. >> reporter: in the first eight months of 2021 the faa issues more than a million in fines to unruley passengers. flight attendants duct taped this passenger after he groped them in july. this passenger was charged with two felonies after allegedly refusing to put on her mask and punching a flight attendant. >> i think it is sad. i think they are there and doing the best that they can. it is a hard situation for everyone. i think we need to work

together during this time. >> people just need to chill out and be kind. kind is the most important thing right now for sure. >> reporter: the suspect on yesterday's flight is now banned from american airlines. the association of professional flight attendants wants to take it a step further and have the faa and depamentof anspta prosecute violatorweas ban from every airline. >> we need passengers to feel safe on board the aircraft. if it is with the virus or if it is with knowing it is going to be safe and they are not going to be attacked or witness an attack that puts the plane in jeopardy at 35,000 feet. >> reporter: any sense tonight about what set off that passenger? >> >> reporter: according to the union spokesperson the flight attendant bumped the passenger before he confronted her in the galley. also important to note that the union's call for the faa to lay down the law comes as more

people are expected to travel for the holidays. >> absolutely. >> yeah. a lot more people on the roads and in the air. thank you. new at 11:00. nearly 2,000 mental health care professionals at kaiser have voted now to authorize a strike. the union says the vote came after kaiser rejected proposals to ease caseloads for psychologist, therapists and social workers. they say they also need greater staffing to abide by a new state law on follow up appointments. kaiser calls the vote a bargaining tactic. they are saying quote we have to work together to address this challenge in a way that honors and rewards our employees and recognizes they face increasingly difficulty in paying for health care. two mountain lion sightings alone in the north bay in the last two

weeks. now, a resident says she saw one walking on the trail at the shores. kpix5 caught up with her and a wildlife expert about the sightings. >> reporter: the expert i talked with say creeks like this one is a network of highways for mountain lions. it can cover a lot of ground and go from one neighborhood to another. >> what convinced you this was a mountain lion? >> his face. the face for sure. >> reporter: a lunchtime walk turned into one scary and memorable moment. >> i snapped a quick picture and then i kind of hustled out. >> reporter: it was a snapshot of an animal lurking in the bushes along the trail. it comes on the heels of this mountain lion being spotted in santa rosa. >> it was about 100 yards away from a key habitat feature which mountain lions would use, that would be a creek. >> reporter: he says the big cat was less than a year old. efforts were made to shoe it

away. when it did not move it was anqupointed to a healthy feline. >> his condition was really good. i would doubt that he will be doing that well on his own at this age. so i think that he is being sort of helped out by his mom. >> we have decided to release the lion back to nearby habitat to give it the best chance at reuniting with its mother. >> a tracking collar was placed on the mountain lion and the information shows he is back up in the hills. his movements will be monitored in hopes of finding out if he, indeed, reunited with his mother. back to you. still ahead tonight. it is not quite halloween yet but don't tell that to these folks in contra costa county. how they are getting an early jump on the holiday. we don't have water, we have to stop the fire somewhere, this is our

there are rain chances farther down the line in the forecast. sunday night, monday, wednesday night, thursday, we have all of these up. we have quarter of an inch to the santa clara valley. east bay. half an inch to an inch. and an inch or two of additional rain for most of the north bay. even more than that in the higher terrain. we need the rain. this is last week's drought monitor map. exceptional drought? it shrinks that category. the rest of us are in the second worst category of extreme drought. so we definitely need more rain. it is nice to see there is more of that in the forecast. looking outside right now. a little bit of fog on the horizon. more of that by tomorrow morning, it will dissipate. temperatures in the upper 50s and 60s. dropping down to the lower 50s in most locations by tomorrow morning, the temperatures tomorrow, very close to normal for late october. today, we are well above

normal. tomorrow, backing off a little bit. should be pleasant out there. upper 60s around the bay. lower 60s along the coast and mostly lower 70s farther inland and temperature drop on saturday. even though the best chance of a shower will be for the north bay and along the coast. everyone will see more clouds than sunshine most of the day on saturday and drops temperatures a little bit. good chance of showers late sunday night after the trick or treaters are done. continues monday with another shower chance wednesday night into thursday. we will keep you updated on all of the rain chances, nice to see them as we get closer to the weekend. charlie? >> a surprising departure in oakland. plenty of names will not return. the one people expected back the most, i say, is gone. and the fourth quarter remains idol hour for steph curry. can his teammates

sought to create fire breaks by demolishing structures. they ran into the owner of the west coast largest whiskey repository. >> fire continued to rage downtown where the army continued to dynamite buildings in an effort to stop the flames. the owner of this building at 455 jackson pleaded with the military captain in charge to spare his structure. he had something inside worth more than gold and silver. >> i am sorry it is for the good of the city. we have no water. we will have to stop the fire somewhere. it is our only weapon. he said no, you don't understand we have 5,000 barrels of whiskey in our building. >> firefighters joined the fight to save the whiskey even to the point of rigging up a one inch fire line that stretched over telegraph hill a mile away to the bay. the city's churches and hospitals may have burned to the ground but the
