walk off the job at twelve oh' -one a-m this thursday. if a new contract deal is not reached. one union representative expressed the main negotiating concerns >> we have had to a tentative agreements and that we have brought to our members. our members have overwhelmingly rejected days. they're concerned about their safety, health care coverage and the amounts that they pay a month. >> in response, the president of the a-c transit board of directors expressed his frustration saying, the board and union leaders had come to two agreements before but both were voted down by the rank and file. the most recent offer made on october second offered of a 9- point- 5 percent pay increase over three years. upwards of 600- thousand commuters could be affected if bart and a- c transit workers both strike. we spoke with the metropolitan transportation commission about the threat of this double whammy for commuters.
>> if bart goes out, that will be a big inconvenience. people who are just a traveling not just across the bay. this is a irreplaceable transportation. we just cannot replace it. it is too much for us to deal with. if you live on the east bay not only as a bart riders you do not have a option but a lot of other people do not have options. this will be a very big deal. >> m -t -c says, when bart workers went on strike in july a- c transit took on a large proportion of the commuters who needed to get across the bay. but if a -c transit and bart both strike-- alternate transportation options will be limited or non-existent for some riders. >> a 3-point-2-magnitude
earthquake was recorded near berkeley this morning. according to the u-s geological survey the temblor, which occurred just after one this morning was centered about two and a half miles northeast of berkeley. the u-s-g-s says it had a depth of four and a half miles. >> new this morning. one person is dead and two others injured following a shooting in san francisco. the shooting happened around 7-30 last night on rose street near buchanan in the city's hayes valley neighborhood. one man was taken to the hospital with life threatening injuries. he later died. two others had less serious injuries. police are looking for suspects this morning. >> in the south bay, a child is in the hospital this morning after being hit by a light rail train in san jose. v-t-a officials say the train was approaching the gish station around 7-30 last night when it struck the young child. the santa clara county sheriff's office is now investigating what lead to the collision. the child's medical condition has not been released.
>> we are waking up to another day of clear conditions. when it is clear outside that generally means that the temperatures are on the cold side. 49 degrees currently in san mateo. 49 out the door in livermore. you should grab a jacket if you are heading out. we are not even in the morning commute but the temperatures will continue to drop. we may see temperatures in the upper '30's. satellite and radar shows clear conditions. high pressure is building over the east pacific. that means that we will see consistent stable weather. as for today we will be a little bit warmer from yesterday.

>> a second worker has died at the construction site of the new 49-ers stadium in santa clara. police say, 60-year-old edward erving lake junior was killed yesterday morning after unloading a delivery truck. this is video of the construction site from our helicopter partnership with a- b- c 7 news. edward was severely injured, when a bundle of rebar fell on him.
he was transported to the hospital. where he later died. this is the second death at the site since construction started. a spokesman for the construction company describes the effect on the >> it's tragic. i mean we had a fellow coworker loose their life and i think that sank in really quick. and pretty emotional. it's pretty banged up in there. >> the 49- ers released a statement saying, quote - " our sincerest thoughts and prayers are with the family, friends and co- workers affected by this tragedy." officials say, they believe this was an accident and say the job site at the new stadium is safe. >> a grieving bay area mother is speaking out about her daughter's death-- after allegedly being theullying. sheila pott had to bury her daughter audrie, 13 months
ago. now shelia is discussing the suicide and a bulling event that the mother says led to audrie's death. audrie pott attended saratogo high school and hanged herself-- just one week after passing out at an unsupervised house party. the pott family says three boys sexually assaulted audrie at the party where the teenagers were drinking. what followed was allegedly a ruthless case of bullying.with pictures of audry passed out.being shared among classmates. sheila pott discussed the troubling situation on katie couric's talk-show. >> i cannot even imagine what it will feel like to be betrayed by your friends, the people that you trust. to have to walk the world, your high-school and feel like people are looking at you. >> all three boys involved in this case are facing criminal and civil charges. >> no one has claimed immediate responsibility for a bombing today in a crowded mosque in northern iraq. at least 12 people were killed and 24 were wounded. the explosion happened in
kirkuk as sunni worshippers were coming out of the mosque at the start of a major muslim holiday. afghan officials say a bomb placed inside a mosque in the country's east has killed the governor of logar province. they say the explosion happened as governor arsallah jamal was delivering a speech tuesday morning to mark the muslim holiday of eid al-adha. the governor's spokesman says the bombing happened at the main mosque in the provincial capital of puli alam. police say 15 other people were wounded, five of them critically. >> in the philippines, rescue and recovery efforts are under way after a seven- point-one magnitude earthquake struck early this morning. officials say at least 85people were killed. the quake was centered near a town in the bohol province nearly three dozen people are missing. the tremor toppled buildings, including historic churches, and sent terrified people into the streets. it's feared some may be trapped underneath collapsed buildings. >> we are talking about

another dry ice explosion at los angeles international airport has authorities wondering who the culprit or culprits might be. police say a blast happened monday night at the airport's tom bradley international terminal. just like in the first incident, no one was hurt. on sunday, a plastic bottle of dry ice exploded in an employee bathroom in a restricted area. small plane carrying 14 missing in mexico's baja mexican authorities say a small plane carrying at least 14 people is missing in northern mexico but they have suspended the search because of bad weather. communications and transportation department officials say the pilot of the cessna 208b lost contact with air traffic controllers shortly after taking off monday morning from the airport in the beach town of loreto, a popular destination for american and canadian tourists. the plane was headed to ciudad another town in baja california sur. the search is expected to resume later today. >> an american hero is finally being honored for his actions in afghanistan.
former army captain william swenson has been awarded the medal of honor. it is a long time coming for swenson, his nomination file for the award, was lost for more than a year. some say, the delay was "punishment" for swenson who spoke up to senior officials, after things went wrong that day in battle. but now, he is finally being recognized. he describes what happened that day. >> "he called out to me and said i'm hit and he wasn't panicked, there was no indication of pain. i said okay hold on i can't get to you i am pinned down keep fighting." butted to >> "he was completely under control of the whole situation; he knew exactly what had to be done and when." >> during the battle which merited the honors swenson dodged enemy fire to help another soldier who had been shot in the throat. and he was determined to get everybody out-- including the bodies of those who had died. he is the first army officer since the vietnam war to be awarded the medal of honor. maligned coming up on the kron four morning news.

align >> u-c berkeley campus police are warning students and staff. about a rash of robberies over the last week. there have been four incidents. either on. or right off campus. on thursday, a 57- year old woman, affiliated with the school, was robbed at gunpoint and assaulted. later that day, a 19- year old female student was mugged in front of a dorm. there was an attempted armed robbery of a male student on campus saturday. and sunday. another male student was held up by two -suspects, one of them with a gun. in all cases, the suspects got away. we spoke to some students who say the crimes have them on edge. >> its is concerning. all of this is happening during midterms. we are walking around with our computers.

the third time. last friday was suppose to be the first day, not today. they stated that this is a good sign. he would not allow them to leave the bargaining table. this means said they are close to reaching a deal. we are in front of the caltran district where they are negotiating. once that, and will try to get a live interview. in the meantime, the union people are all here. it has been a very long night for the negotiators. we would just have to wait and see. in the meantime if you are waiting a lot of them had to wait till find out whether not they had to get up. the good nils is that the trains are running, that is not a problem. i had a chance to talk to both sides of the bargaining table before they went back inside and this is
