shooting is talking for the first time. on monday a 12-year old student brought a gun to school and shot and killed math teacher mike landsberry. two other students were wounded in the gunfire. one of them was 12-year old mason. he was shot in the abdomen as he tried to help his fallen math teacher. he says the shooting has given him a new perspective on guns. they are all weapons and they can kill you. they are not just boys. i used to treat them kind of poorly. they kill people.

police records show that the boyfriend of the woman who was shot to death after a car chase outside the u.s. capitol had expressed concern about her emotional stability and the safety of their infant daughter. a report from the stamford, conn., police department says miriam carey told officers who responded back in december of last year that president barack obama had her under surveillance and she described herself as the "prophet of stamford." the 34-year-old carey was killed oct. 3 after trying to ram her car through a white house barrier with her daughter in the vehicle. the girl survived.

just how much tolls will be increased by coming up. on to our top story this morning. the protests for 13 year old andy lopez cruz will continue today. he is the 13-year-old santa rosa boy that was shot and killed by deputies on tuesday. joining us live now kron 4's mike pelton with the latest. mike? the police department is handling the investigation and they are releasing more affirmation about what exactly took place. an autopsy on the boy shows and he was shot up to seven times and two bullets to lopez's proved fatal. police said the deputy fired eight shots at tam in 10 seconds. they said the deputy saw what he thought a ak-47 and after lopez did not comply

with a verbal commands to drop the gun the deputy opened fire. turns out the gun was a replica and those at this memorial are demanding answers. this morning i spoke with a one up and these friends who saw him moments before the shooting. >>: all people who know him or pretty much appreciated him. he was kind. he never put anyone down. he was pretty close friends and he was always there for people he had a plastic gun and his hand. i don't see how the police cannot distinguish a real one from a fake memo they say he was carrying a gun for a friend and was walking to return it there is a protests later on today. the plan as for children's at middle schools are asked to walk out of class at 10:00 to show their support and they will walk from city hall to the sheriff's police department.

>>mark: on to our top story this morning. and onto and other top story. kron4's will tran has an update. >>will: a very emotional interview. we will have more from the family coming up at 830. i can tell you this happened on a chuckle at constitution permits the couple 51 and 46 year-old. there were walking on the left side of your screen on the bike path. around 7:00 last night walking their dog. they were slammed into from behind. they never saw this coming. according to the police to permit it was a 4054 year-old woman who slammed into them so hard that she launched these two people into the air and they died at the scene. she lost control of her car, goes over the center median, slams into another car, keeps going and ultimately slams into a couple trees

of menlo park this morning. where an alleged drunk driver hits and kills two people walking their dog. kron four's will tran is live at the accident scene with more on how it happened. >> i spoke with the family members. some of them live in the bay area. they drove here overnight just to be here. this is the location. they were all here walking their dog about 7:00 p.m.. the sun was about ready to set and then it became dark. you can see on the left side of the screen, their backs were to the driver according to the police that the driver hit these people so hard that that what they're born and they died on the scene. they stated that the driver slammed into a car and then kept going. the car also slammed into trees. you can see some of them on the ground. we
