>> reporter: the next closure will be labor day weekend. tomorrow morning everything will be business as usual at their regular times. >> vicki: a health alert has been lifted for the rodeo community in contra costa county following a fire at the phillips 66 refinery. officials first issued the advisory around 3 this afternoon after receiving a report of a flare up at the refinery. firefighters were able to extinguish the fire within an hour. around 5 tonight. no injuries were reported. the cause of the fire is under investigation. >> vicki: a parolee at large was captured in walnut creek today.less than 24 hours after police requested for help from the community via social media. james g. beldin was wanted in connection to a case that occurred on friday.

>> reporter: police say wilburn shot and killed officer sean bolton during a traffic stop. investigators say saturday

bolton approached a car for a parking violation and interrupted a drug transaction. >>: "a digital scale and a small baggy of marijuana about 1.7 grams were located inside of the vehicle." >> reporter: investigators say the passenger -- wilburn -- confronted bolton. after a struggle -- police say wilburn shot bolton multiple times. >>: "i heard it, just 'bang bang, bang.'" >> reporter: a bystander used bolton's radio to call for help. neighborhood residents say they couldn't get through. emergency responders rushed bolton to the hospital in critical condition. but he later died from his injuries. bolton was a veteran of the marines and served one tour in iraq. he was 33 years old. >>: "we want this person brought to justice, and out of our neighborhood, and out of our community." >> reporter: the driver of the car turned himself in, but was released and not charged. investigators say wilburn was out of prison on supervised release for bank robbery. police say he is armed and dangerous. >>: "when you look at this individual, you are looking at a coward. he's a coward. you gun down, you murder a police

officer for less than 2 grams of marijuana. you've literally destroyed a family. for less than two grams of marijuana a misdemeanor citation and a fine." >> reporter: i'm andy rose, reporting. >> vicki: a 35-year-old man was killed when a tent collapsed during a brief storm at a suburban chicago festival earlier this afternoon. police identified steven nincic.a resident of the suburb of wood dale. fifteen people were injured and transported to local hospitals. several other slightly injured people were treated at the scene and released. witnesses say a strong wind gust picked the tent up and slammed it down to the ground on some of the crowd. >> vicki: president obama is moving ahead with even tougher greenhouse gas cuts on american power plants.setting up certain confrontation in the courts with energy producers and republican-led states. obama will unveil the final version of his unprecedented regulations on monday.
