aveson.(pam) and i'm pam moore. the incident the mother is talking about... happened several weeks ago, but now, the parent is finding out about the video that students at school have already been passing around. (steve) kron four's spencer blake brings us the story from vallejo that you'll see only on four. (nats: yelling, hitting)the sixth-grade girl getting beaten up in this video is the daughter of emma simms."i pulled it up on youtube last night and i was horrified. i haven't been the same since i seen that video."she knew about the incident the day it happened in early march, but she had no idea how bad it was, nor that a student had been recording it.her daughter, on the other hand, has known for a while about the youtube video, which has more than six hundred views. "people won't stop talking about it.who? everyone at school?everyone in my class." so the re-victimization continues.simms says her daughter has special needs, and though they live on the other side of town, she transferred to solano middle school to have those needs met.

her daughter says she was sitting down, ready for her p-e classwhen the attack happened.(nats) "when i send my child to school, she's supposed to be protected." though a teacher who didn't want to identify herself told me the attacker in the video was suspended for multiple days, simms is trying to see if more can be done about the video making the rounds."the assistant principal called it a fight and i told him, no it was not a fight, it was an assault."monday she stopped by the district office, and was instructed to fill out a complaint form about what happened.(looklive)we weren't able to meet up with anyone from the district who could speak about the incident, but i'll follow up again tomorrow. i did grab one of those complaint forms.once it's turned in, the district has 15 days to confirm receipt, and then has 60 days to perform an investigation into a complaint. in vallejo, spencer blake, kron four news. big story we've been following for months. a verdict reached in the kidnapping and murder trial of morgan hill teenager sierra lamar. the 15- year old girl vanished five- years ago.(steve) tomorrow a jury will reveal the fate of defendant antolin garcia torres. kron 4's ella sogomonian is live at the santa clara hall of justice with the latest. sierra lamar's family has waited five years for any sign of closure now they may be the closest they've been.she was last seen walking to a bus stop to get to school back in 2011. tonight i spoke with a legal analyst familiar with the case who says the jury has had to face certain challenges in this murder trial. there has never been a body recovered, there was no crime scene nor a weapon found. so prosecutors have tried to convince the jury that la mar could still be alive which would make it impossible to convict antolin torres garcia of murder. defense however has pointed to dna evidence found on torres garcias property like a rope in his car. and although 11

hours of deliberation may sound like a long time to the average person - the analyst says that is pretty quick for a decision in a trial that started back in january. steven clark, legal analyst and former prosecutor "obviously the threshold question for this jury that needed to be decided was, 'is it possible that sierra lamar still be alive?' and that's what the defense hammered on in its closing argument. and that could explain why this jury came back quickly if they don't believe the prosecution was able to prove that sierra lamar is dead then they really wouldn't reach a verdict on a homicide." another unnerving possibility for lamar's family could be that if torres garcia is found not guilty and her body is recovered in the future - he could never be tried for her murder again. the verdict is expected tomorrow morning at 9. live in san jose ella sogomonian kron 4 news. with his family...says, the transit agency could have prevented the mob attack last month... and now...he is taking legal action.(steve) grant lodes has been closely tracking this story for us and is here with this man's powerful words. (grant) we knew it was bad when 50 some teenagers stormed the bart train that saturday night...and beat and robbed several people. but bart has not released surveillance video and this is the first victim to detail the horror. rusty stapp, his wife and their 18 year old daughter were just returning from san francisco after celebrating his daughter's birthday when the mob began pounding on the dublin bound train as it pulled into coliseum station. strapp and his family have filed million dollar claims against bart alleging the transit agency did nothing to prevent the april 22 mob attack and robbery.

claim. if bart rejects it, stapp's attorney says a civil lawsuit will be filed. ( pam ) bart is trying to crack down on people who do not pay for their ticket..these "fare cheats" cost the system almost 25- million dollars a year. but, if you are under 18- years old, getting in criminal trouble for not paying... will not happen. kron 4's justine waldman is live tonight in san francisco with why bart cannot cite young fare cheats.. here at the glen park station i saw a handful of people pass through the fare gates without paying.but bart police can't do anything to those cheats who are under 18 years old.because that is against the law. the fare evaders sneak out.. usually through the emergency swinging doorwhile other riders pay their fair share to ride bart.16 year old aleigha beavan-szabo sees kids her age skip out on paying, often.

sot if you just don't have two dollars to pay for bart it is not something you want to go to jail for sometimes it is out of necessity and you just don't have the moneybart police officers have been directed by the chief not to arrest or cite kids under 18 years old.. for not buying a ticket.this follows a new law which went into effect in january for all public transportation systems in the state.. sb-882 is meant to prevent minors from getting a criminal record full of misdemeanors.bart riders kron 4 spoke with somewhat agreed with it.sot i don't think you should put a criminal record on a minor for something that doesn't hurt anyone it hurts the system sot i would make that fine go to the parent why would you fine a child anyway the law does not mean young offenders get off scott free bart can not let them in or kick them out if they don't have a ticket.and is looking into other punishments like community service.sot there has to be something they do to pay it back but not be labeled foreverfor aleigha, she pays her ticket and would like to see the kids who don't be held accountable in some way.. sot i think that would be better and more serving to the community than paying a fine or going to jailnat bart train

rosa junior college as a student. the 41-year-old transient was wanted out of southern california...where he was on parole and failed to register as a sex offender. police became aware of lee because of reported unusual behavior in one of his classes. he was listed on the megan's law website. he has committed a number of sex crimes including indecent exposure, child molestation and assault with the intent to commit rape. today - the head of the coroner's office in marin county, was in court - facing charges he sexually assaulted a young girl. this case dates back to 2008. that is when prosecutors alleged...darrel alan harris started sexually assaulting a girl...then later when she was older. harris was arrested recently in eureka...and brought back to marin county. he's now in jail on 750- thousand dollars bail. harrs' attorney and family believe the 46-year-old part time photgrapher...is innocent. "i have not seen any reports, but i have spoken to a lot of people in the system . mr. harris is well known at the civic center. the unanimous rection is shock and no one believes this to be true. harris did not enter a plea today...but will be back in court next week. (pam) two people died in a plane crash near lake berryessa this morning.. 55-year-old jon karkow was the pilot... and 41-year-old cagri sever was the passenger .. when the plane crashed. both are employees of icon aircraft operated out of vacaville. the crash happened just after 9-am between pleasure cove marina and markley cove resort. officials have not yet figured out why the single- engine icon a-5 plane crashed. when paramedics arrived at the scene they found both people onboard were dead. the crash site is inaccessible by vehicle, so emergency personnel are getting to the site by boat. the crash is under investigation. are looking at the idea of making highway -37 a toll route. traffic congestion is a growing problem for the road... and as we found out this past winter, it's also prone to flooding.(steve) the idea is that by charging commuters a toll, the money could be used to fix some of those problems in a timely manner.kron 4's charles clifford was in the north bay today. he has details on the plan and reaction from commuters. well, 40 thousands cars use highway 37 every day. it connects marin, sonoma, napa and solano counties. but the traffic backups and frequent flooding have become a problem here. recent estimates have suggested it could take billions of dollars to fix thos issues. at this point, charging commuters a toll to address those problems is just an idea but one that is being seriously considered.for the past few years, a committee of elected officials from across the north bay has been working

on finding ways to reduce congestion on highway 37 and address the flooding problems. under normal circumstances, it could take caltrans years or decades to secure the necessary funding and fix the roadway but the committee says that charging tolls could be a way to speed up the process. maybe getting the work done in less than a decade.sotwe are at the beginning of this processmarin county supervisor damon connolly sits on the committee. he says that so far there are no specifics on how much the tolls would be or how that money would be collected.sotwhat we are seeing is some sort of public private partnership potentially and tolling could be a part of it.monday afternoon, i asked several people in novato what they thought of the idea of paying a toll on 37. amanda drives that way almost every day. she would be ok with a toll as long as the highway gets an upgrade.sotsure, if they ad another lane.sotvic barlogio runs a business in marin. he worries that paying tolls could impact his company's bottom line.sotpersonally, it would be an excessive expense for me because we use that road frequently.at this point, the idea of charging commuters a toll is just that. . an idea. connolly says that if it happens at all, tolling on highway 37 is still years away. in marin county, charles clifford kron 4 news. the assyrian church of the east say they are fearful tonight. (pam) this... after someone deliberately started a fire early yesterday morning.(pam) thankfully no one was hurt ... and while there was no threat against the church... federal investigators were automatically called out because the fire was at a place of worship those who work at this church... fear returning for service. (sot) " i am worried about my kids, my sunday school kids, i want them to be safe, i don't want them to see this." so far there is no apparent connection .. but there have now been five suspicious fires in the willow glen section of san jose in the past week. three were trash fires and the other involved two cars. (steve) the san francisco police department is reporting a drop in officers' using force. in the first

quarter of 20-17 force was used in less than one percent of incidents. that's a nearly sixteen percent drop compared to last year. police chief william scott says it shows the department's training. and de- escalation tactics are paying off. (pam) california is borrowing up to a half- billion dollars ....to repair the nation's tallest dam. heavy waters damaged the oroville dam back in february. it tore giant craters out of both spillways... forcing nearly 190-thousand people to evacute their homes. the state department of water resources is rushing to repair the main spillway before the next rainy season. president trump already announced more than 200- million to fund repairs. complete repairs are expected to take up two years (steve) a live look outside at s-f-o tonight... (pam) earlier today, kron4's haaziq madyun was at the alameda county sheriff's office ... when the announcement was made that a suspect has been charged.. 36-year-old luckie dacany, currenlty in custody for a sexual assault crime in san juaquin county, has confessed to the brutal murder of andrea st. john...alameda county sheriff greg ahernback in december 2016 the victim, 59- year-old andrea st. john was in her home on grove way in castro valley when investigators say dacany allegedly broke-insheriff greg ahern/alameda county: "we believe the suspect went to the residence late in the evening to commit a burglary, steal some items out of the garage and was confronted by the victim and at that time he killed her and then burned the resident in the structure at that time to hide the evidence"
