"obviously the threshold question for this jury that needed to be decided was, 'is it possible that sierra lamar still be alive?'one of many challenges a jury has had to face before making their decision in the kidnapping and murder trial of morgan hill teen sierra lamar. the fifteen year old went missing five years ago as she was walking to a bus stop to get to school. but because her body was never recovered, there wasn't a crime scene and a weapon

wasn't found the jury could possibly find defendant antolin garcia torres innocent of murder.steven clark, legal analyst and former prosecutor "and that could explain why this jury came back quickly if they don't believe the prosecution was able to prove that sierra lamar is dead then they really wouldn't reach a verdict on a homicide." the defense however has pointed to dna evidence found on garcia torres 's property like a rope in his car. "what they were able to show with the forensic evidence and the defendant's own statement is that he had the opportunity to commit this crime and there was never a definite explanation for that dna transfer."and although 11 hours of deliberation may sound like a long time to the average person - the analyst says that is pretty quick for a decision in a trial that started back in january."there was competing evidence on virtually every aspect in the case. from the forensic evidence to the defendant's statements to the issues of sierra lamar being a runaway. i'm surprised the jury was able to condense that and come to a verdict so quickly." if garcia torres is found not

(steve) we are learning gruesome details about the murder of a castro valley woman... found dead inside her home. the alameda county sheriff's office say this man on your screen... luckie dacaney recently confessed to the brutal murder of andrea st. john police found the 59-year-old's burned body inside her castro valley home on grove... way back in december. investigators

say in addition to confessing to killing andrea st. john...video evidence also helped confirm the suspect's identity. "we were able to look at some video from the neighborhood and it looked like he was just walking around and just randomly picked this residence. we matched the video with a stolen vehicle that was also recovered" st. john... was a widow, mother and grandmother. the marin county county coronor.. accused of sexually assaulting a young girl, made his first court apperance today. this case dates back to 2008. that is when prosecutors allege ... darrel alan harris started sexually assaulting a girl... and then later again, when she was older. harris was arrested recently in eureka... and brought back to marin county. he is now in jail on 750- thousand dollars bail. harris' attorney and family believe the 46-year-old part- time photgrapher... is innocent. drivers might not like... there is a proposal to turn highway- 37... into a toll road. kron4's charles clifford breaks down the potential plan -- and has reaction from commuters. well, 40 thousands cars use highway 37 every day. it connects marin, sonoma, napa and solano counties. but the traffic backups and frequent flooding have become a problem here. recent estimates have suggested it could take billions of dollars to fix thos issues. at this point, charging commuters a toll to address those problems is just an idea but one that is being seriously considered.for the past few years, a committee of elected officials from across the north bay has been working on finding ways to reduce congestion on highway 37 and address the flooding problems. under normal circumstances, it

(steve) then on friday, the sonoma county sheriff's office said the killer was in custody. reporter lynsey mukomel sat down with jason's parents.

(steve) the suspect in the case was already in custody -- accused of killing his brother. police say they used that opportunity to talk to him again about the killing of the couple. and he allegedly told them information only the killer would know. (pam) the valero oil refinery in benicia ... is being fined for violating regional air pollution rules.... following the flaring incident on friday. the bay area air quality management district says, it has issued four violations. one for causing a public nuisance, and three for releasing excessive smoke. it all started with a power outage at the refinery on friday morning that led to flaring... which released massive plumes of thick, black smoke into the air, prompting a shelter in place and an evacuation in the area. there will be continued flaring at the valero refinery this week while crews work to restore operations at the facility. there is no word on how much longer the flaring will continue.
