(pam) new at ten: a bay area woman says... her wrist was burned by a fitbit. she says it happened while she was at work this morning. good evening i'm pam moore. (steve) and i'm steve aveson.kron4's ella sogomonian spoke to the woman in san jose... and has a response from fit-bit. it's a story you'll only see on kron4. ... friday morning around 10 denielle briseno of san jose says she felt a burning sensation on her left wrist underneath her fit bit bracelet.sot: denielle briseno, claims fitbit burned wrist//"i noticed a hot feeling to my wrist and irritation, a little, a little bit of an irritating feeling.

shifted the fit bit up a little, noticed a burn." briseno says she has worn the fit bit night and day since her husband bought the tracker back in december and has never had issues.sot: denielle briseno, claims fitbit burned wrist//"it came as a shock i've had no problems with it. i sleep with it. the only thing i do not do is shower with it. it's given me no problems whatsoever."her husband immediately contacted fitbit's online support service about the alleged burn. he says a representative called him seemingly shocked by the news and offered a refund for the fit bit.the fit bit. sot:phillip briseno, husband// "they just were very surprised they said and they wanted to get the fit bit back to do testing on it. they again were just surprised saying it wasn't something normal or that it was rare." the briseno's say they just want the company to recall the product until they can pinpoint what may have caused the skin irritation - calling it a public safety concern.we reached out to fitbit for comment regarding the claim. fitbit takes every customer complaint seriously and would like to discuss this report with the customer directly. based on images and video we

received of the device, it appears to be intact with no damage to it. our medical expert does not believe this is an injury caused by the fitbit device. in san jose ella sogomonian kron 4 news. (pam) in contra costa county -- two more cars were set on fire overnight... as the hunt continues for a serial arsonist. here is video...one car was in walnut creek -- the other was in lafayette. so far, just this week, seven cars have been torched during the overnight hours. other cities hit include pittsburg -- and martinez. kron4's hermela aregawi is live in contra costa county tonight.. do you fire investigators have any leads? (hermela aregawi)i just spoke with the fire marshall.he tells me these series of arsons are the department's primary concern.and that they're devoted a lot of their resources to catch this serial

arsonist. tonight - fire officials are looking for the person or people responsible for setting at least a dozen vehicles on fire.two cars were set on fire early friday morning.a toyota highlander on crescenta court in lafayette.and another car on juanita drive in walnut creekrobert marshall/contra costa fire marshal:the fires have been occuring all over contra costa county so we do have a fairly wide area. we don't really know if this is one individual or multiple individuals or anything like that. that's part of the reason we need the public to help us identify some of those things. if they have cameras or that kind fo thinga total of seven cars have been torched this week.one in martinez.two in brentwood.two in lafayette.and two in walnut creek.residents in walnut creek say this is part of a trend in increase in crime

deputy killed in a crash has been identified as sroeuy khin. the early morning colission happened on eastbound interstate 580 at the 205 split near tracy... and involved a tech bus. kron4's philipple djegal has the latest on the crash. (philippe) evidence markers along eastbound interstate 580... lead up to a badly battered volkswagon beetle and the tour bus that ran into it. the violent end to this deadly crash confirmed by the damage done to the bug... the man behind the wheel of the beetle was 51-year-old off-duty alameda county sheriff's deputy sroeuy (shuh-roy) khin (ken) who did not survive the collision.capt. christopher sherry/chp- "our thoughts and prayers go out to the sheriff's department, the deputy and his family." the crash was reported just after seven o'clock in the morning... and,

immediately after, the california highway patrol shutdown the three far left lanes. for reasons still under investigation.... california highway patrol captain christopher sherry says khin (ken) slowed down or stopped his car in the number two lane of the freeway just east of grant line road.... and, the driver of a tour bus carrying 51 tesla corporation employees traveling from fremont to stockton, slammed into the beetle.capt. christopher sherry/chp- "i don't have the statement from the bus driver right now. you can imagine, its reverse commute, traffic is driving faster than in the westbound direction, there's sun in the horizon. there's all types of factors involved with weather, roadway conditions, things like that that we'll be taking into consideration when we put together what happened in the collision." telsa released a statement saying all employees on the bus are safe and accounted for.nats- traffic the back-up extended for more than 10 miles into livermore. the c-h-p says the bus driver is being cooperative, and that neither drugs or alcohol appear to be factors in the crash... though its possible that person could face charges. capt. christopher sherry/chp- "anytime theres a situation like this, there's the potential for criminal charges. we'll have to wait." all lanes were re-opened just before two o'clock in the

(steve) tonight we are learning more about deputy sroeuy khin. he was a ten- year veteran of the alameda county sheriff's office.. he is survived by his wife and four kids khin was driving home from a 12-hour overtime shift at santa rita county jail when he was killed. khin started his career with the alameda county sheriff's department in 2007.. sheriff greg ahern says khin was a hard worker and put in over time to support his family

comes on the heels of another deputy, mike foley who worked at the jail and was killed in a bus accident in feburary. tomorrow would have been khin's 51st birthday. (pam) new at ten: vacaville police have released this video showing why vaca pena middle school was placed on lockdown this morning. there were reports of a student with a gun -- which turned out to be a b-b- gun. police say they found it inside a 15-year-old student's backpack... the teen boy was arrested and charged with bringing a weapon onto school grounds. (pam) the 'in-n-out' burger restaurant in livermore .. which was closed for several days when a number of people reported feeling sick after eating there.. is back open and as it turns out... an investigation discovered... the sickness did not come from the restaurant... restaurant managers and the alameda county department of health say, they took all of the necessary steps to clean the restaurant... but it appears the people who got sick... had symptoms before going to 'in-n-out'.. back on may 6th, several college

softball players say, they got sick .. the restaurant closed its doors tuesday to investigate. in-n-out management says, all of the work stations and equipment have been thoroughly cleaned as a precaution.. they are also requiring each employee to get a health screening before returning to work. district attorney is under fire tonight. a civil grand jury has called for him to be removed from office due to misconduct ... and now the members of the union representing the attorneys who work under him. are recommending a 'no confidence' vote. kron 4's dan kerman is tracking developments. (dan kerman)in january the state fair political practices commission fined contra costa county d.a. mark peterson $45,000 after the d.a. admitted to using $66,000 in campaign funds on personal expenses violating the government code. now after it's own investigation contra costa county's civil grand jury is calling for peterson's removal from the office of contra costa county district attorney for "willful or corrupt misconduct in office"sot jim mellander/foreperson, civil grand jury 28-38mr peterson in over 600 instapnces has converted campaign funds to personal use, the second charge is he failed to report these on his campaign reporting forms.civil grand jury foreperson jim mellander says peterson is also accused

(pam) tonight ... lawyers suing wells fargo on behalf of customers... say, the bank may have opened up to three- point- five million unathorized customer accounts... that's one- point- five million more than bank regulators disclosed last year.. in a court filing today, lawyers told a federal judge they believe the millions of accounts were opened over the last 15- years. a wells fargo spokesperson claims, this new estimation by lawyers is unverified .... and based on a hypothetical scenario. lawyers are now asking the judge to approve a one - hundred- and -forty -two - million dollar settlement. important deadline in their move to las vegas. the team is hoping to have their new vegas stadium built in time for the 2020 season.... if they fail to have a lease agreement in place by the next n-f-l owners meeting later this month, the move could be delayed by a full year. as kron 4's charles reports --- at least one oakland city leader says, he will not support letting the team extend their stay at the coliseum. right now, raider's management and the las vegas stadium authority are scrambling to finish a lease agreement on a new 65,000 seat stadium that will sit just off the las vegas strip. in order to have the stadium completed and ready to go by the 2020 season, the lease needs to be approved at the nfl owners meeting on may 22nd . but if the lease agreement isn't ready in time, the next owners meeting isn't until october. any delay would almost certainly mean construction would be postponed and the stadium wouldn't be finished until 2021. currently the last year the raiders can play at the oakland coliseum is the 2019 season. meaning the team would need to find somewhere

to play for one season.city council president larry reid has been very vocal about his disappointment that the team is leaving oakland. he says that if the raiders come looking for an extenstion of their lease at the coliseum he will oppose it because he believes the team's management has not been fair to the community.sotno respect for the city that i live in and no respect for the most incredible fans in the nfl. reid also says it unacceptable that the nfl allowed the team to move before a lease agreement was in place.sotthat the nfl just arbitrarily did something that they've never done is allow a team to relocate in another jurisdiction without having all the i's dotted and all the t's crossed.at this point it's unclear where the raiders would play the 2020 season if they weren't allowed to return here to the coliseum. in oakland, charles clifford kron 4 news. (pam) in the north bay.. smart trains are testing the passenger service schedule between santa rosa and san rafael. and police are asking drivers to be extra careful. the trains will not be using their horns at intersections in marin county -- unless there is an emergency. residents along the 43- mile line have complained about the loud train horns.... in response -- the novato, san rafael and petaluma city councils have approved quiet zones ... prohibiting sounding the horns at crossings in their jurisdictions. smart trains will be running about 30-train trips a day during the week... and 10- trips on weekends for the next few weeks. (steve) another big story we are tracking tonight... the engineer involved in the deadly 2015 amtrak derailment in philadelphia has now been charged. prosecutors say brandon bostain - was going 106-miles-per-hour in a

50-mile per-hour zone - causing the trail to derail. the crash killed eight people and left nearly 200 others - injured. bostain has been charged with causing a catastrophe, eight counts of involuntary manslaughter as well as other crimes. his lawyer says he is planning to surrender - and is expected to be arraigned on the charges next week. (steve) the tennessee teacher charged with kiddnapping a student was in court today.. 50-year old tad cummins is charged with kidnapping a 15-year-old student..and taking her across state lines for the purpose of sexual activity he disappeared back in march with student elizabeth thomas. they were found 39 days later outside a cabin near redding. a federal judge told cummins he could face life in prison. a letter that cummins wrote to his wife was made public today.. in the note he tells her that he is sorry...and needed to clear his mind.
