spencer who does this boat belong to, and why is it still there? we don't have the name of the man who apparently lives on the yacht, but some swimmers say his boat is constantly in their way.the national parks service says so far...nothing has gotten him to leave. by now the anchor of this boat has probably gotten áreally comfortable at the bottom of aquatic park cove.lynn cullivan ÷ sf maritime"it's been out here over a hundred days and the reason that's unusual is because normally a permit is only for five days." but in this case, the man who owns the boat never had a permit at all.even if he did, s-f maritime spokesman lynn cullivan says any given boat is only allowed to be moored in the area for 30 days out of a given year.that means this boat is more than two months past its welcome."the cove is basically a kind of primitive camp in terms of a mooring; it doesn't have a restroom, it doesn't have pump facilities so most people will only stay in here for a few days and then they would move on."so what áis the harm of a boat floating there for so long? just about any swimmer from the south end rowing club could tell you."he says that
he doesn't have a toilet in there but more than once i have been in the water around ssix in the morning and you can smell human discharge out there in the water."the annoyance prompted somebody to tag 'move the boat' on its side.a lot of people wondered aloud why law enforcement can't just impound the boat like they would a car that was parked illegally."he's been here way too long and i don't know what the rule on that is, but he seems to be getting away with it.""my understanding is he has been arrested and has been issued citations. i believe they came from the united states park police."park police didn't return our phone calls to give details of those citations.we were also hoping to learn if and at what point towing the boat becomes a legal option. park rangers have spoken to the man on the boat...who has told them simply....that he doesn't want to leave.live in san francisco, spencer blake, kron four news. a 50 year old mom with her seven year son died in kirkwood ski resort.(vicki) the alpine county sheriff's office says the two were first reported missing last night around 6-45. they were later found buried beneath snow.the mom and son were last seen on a lift chair around 4- pm. and at approximately 9...a neighbor of theirs noticed ski gloves on the snow alongside their condo.(steve) olga perkovic of san francisco... and her son aaron were found unconscious beneath three feet of snow. they were immediately rescued and air-flighted to the hospital. but neither survived. deputies determined the two had returned to their condo by skiing through a wooded area... that's when the snow slid from the roof of the condo and buried them. they were the third and fourth to die at california resorts since a major snowstorm late last week. (vicki) three people are injured after a stabbing on a greyhound bus.(steve) and the bus...well, it was headed for oakland. the stabbing happened this afternoon near visalia. a man on the bus says the
suspect stabbed a woman who was holding her child. police say the suspect was restrained by the bus driver and another passenger. there is not yet word on how severe injuries were. the suspect was arrested. (steve) now to aldon smith...and it's yet another troubling brush with the law for the once star 49ers player. (vicki) this time...smith is accused of domestic abuse...and today...the raiders cut ties with him. grant lodes has is here with the message police have for smith tonight. (grant) message is clear...turn youself in...there's a warrant out for his arrest. san francisco police says they're in talks with his attorney about how a surrender may happen. smith...once a 49ers rising star with a bright smile and bright future...was released today by his current team, the raiders. the latest allegations: smith drank two bottles of tequila, then physically abused and bit his fiance in her apartment on bush street near union square. after the fiance called
911...smith allegedly took off...out the window. his fiance tells tmz that smith has checked into rehab...we have not independently confirmed that...but tonight, aldon smith is a wanted man. police on the peninsula are asking for your help to catch a killer.(steve) that's after this man...53 year old san francisco resident gilberto martin jr. rodriguez was found in the parking lot of a popular beach south of san francisco.(vicki) as kron-4's gabe slate reports...investigators say no tip is too small in this unsolved case. late tuesday night february 13th the body of 53 year old san francisco resident gilberto martin jr. rodriguez was found in the parking lot of gray whale cove state beach. the san mateo county sheriff's office has ruled it a homicide saying gilberto martin jr. rodriguez was shot and died on the scene.gray whale cove is located off hwy one south of pacifica and north of half moon bay..sound from detective rosemerry blankswade and public information officer san mateo county sheriff's office" it is unusual, i'm not aware of any other homicides in that area "rosemerry blankswade is a detective for the san mateo county sheriff's office, she says is normally a place of beauty and peace right on the

this san francisco snowboarder ... unconscious after he was buried in an avalanche.(vicki)other snowboarders pulled him to safety.catherine heenan has their stories. "i heard this sound, sounded like a train, coming through the woods."and i turned around and all of a sudden it just blew up. the snow went probably 100 feet in the air all over the place, you couldn't even see anything." "there was a mist of white and we could feel the pellets on
our face"survivors say everything grew eerily quiet, then came the calls for help. county fairgrounds. just last month...the venue hosted a "code of the west" gun show...where people buy and sale guns. in the wake of the parkland, florida high school massacre...supervisor yeager says the buying and selling of guns...even though legal....is not consistent with promoting the health and well being of residents. (sot) yeager says his ban.... would not impact county sponsored gun buyback programs. police and district officials are taking extra steps to keep kids safe at a san francisco elementary school. this comes after a person who made threats against rooftop elementary school... was released from jail yesterday. police
are not identifying the suspect who made the threats. they do say he was affiliated with the school... but not an employee. access points to the school are being watched closely by police officers. district officials are also offering extra emotional support to students and staff. (steve) and a monterey county middle school went on lockdown today...after a student was stabbed in the chest. the 12-year-old student was flown to a nearby hospital with life-threatening injuries. police said the accused attacker is also 12. it's unclear what led up to the incident, but police said it happened before class. the suspect was taken into custody and is now facing attempted murder charges. no other injuries were reported. (vicki) controversy over a statue at san francisco state university has been resolved. san francisco arts commissioners have voted to remove the "pioneer monument" that shows a native american man at the feet of a conquering spanish cowboy and catholic missionary. the decision was unanimous and is the final word on the removal
of "early days." the statue was built in 18- 94...and part of it depicts early settlers dominating over a native american. advocates for its removal clapped and cheered after the vote. new ahead at 8 a couple shocked after finding their dog died from suffocation... the common object they are now warning others about. and next. california fighting back against one judge's ruling to give sex offenders early parole. appeal a judge's ruling that california must consider earlier parole for potentially thousands of sex offenders. including those convicted of raping an unconscious person. brown will fight the order made final by a sacramento judge today.. the order upholds last month's tentative ruling that prison officials must rewrite part of proposition 57. the 20-16 ballot measure allows earlier
parole for most prison inmates... but brown promised voters sex offenders would be excluded. the state will challenge that judge's finding that the exclusion can only apply to those serving time for a violent sex offense. (steve) the senate is set to take up a bill that would roll back some of the banking regulations put in place by the obama administration. supporters say this will help small, community banks. critics worry it could lead to the same bad behavior that led to the financial crisis. our washington correspondent jessica smith has both sides of the debate. a decade after the financial crisis -- the senate is considering weakening the banking rules meant to keep it from happening again. sen. mike crapo (r-id): the bill is the result of a thoughtful, deliberative process over several years//republicans and moderate democratic senators designed the bill, which would loosen some of the dodd-frank regulations for small and mid- size banks. about two dozen banks would no longer face a stricter level of federal
supervision. sen. heidi heitkamp (d-nd): when it comes to regulation, we have to look at the benefits and the costs. democratic senator heidi heitkamp says the regulations are too expensive-- and hurt small banks' ability to do business. the american bankers association says dodd frank treats small banks the same way it treats large banks that impact the entire economy. wayne abernathy(american bankers association): keep in place the parts that are designed to deal with safety and soundness -- but get rid of the parts that just get in the way of serving customers. jessica smith reporting: the democratic party is divided on this issue -- senator sherrod brown says loosening restrictions could lead to the same problems that caused the financial crisis. sen. sherrod brown (d-oh): why should we do anything for the banks that consistently failed to follow the rules -- why should they benefit from statutory, regulatory rollback? supporters push back, insisting the bill does not give wall street a break. wayne abernathy(american bankers association): all this bill does -- is say what works, what doesn't. let's get rid of the parts that don't work. on tuesday, the full senate is expected to vote to begin debate on the bill. in washington i'm jessica smith. coming up at eight..

(steve) new at 8. a family's lawsuit against the stockton police department is moving forward.(vicki) it's over a deadly police shooting that happened nearly 10 years ago, that's when a 30 year old man was killed in a police shooting..(steve) as kay recede reports..the man's widow claims police started shooting with little warning. the apartment that melecio arquinas jr and his wife called home no longer stands... in its place... a simple wooden cross...now — his family is left with heartache after they say the 30 year old man was killed by stockton police.(rey arquinas, melecioús brother)'if they handled that situation way more better úcause that situation was just terrible, my brother, no doubt heúd be alive today.'rey arquinas is melecioús younger brother...

the dog was reaching for a bag of chips when it got its head stuck in the bag and suffocated. now his owners want to help other families avoid the same tragic accident. chrissy young and christian villareal got petey -- a pitbull mix three years ago. he was a part of their family. a couple of weeks ago, they returned home from work to find him unresponsive -- his nose in a tortilla chip bag. chrissy young/owner:"we had the bag of chips that was fairly slim bag that was made of cellophane and it had been on the countertop the whole weekend. we had been snacking on them. we had come and gone even throughout the weekend and he never messed with them." the two rushed petey to four seasons vet hospital but it was too late. dr. allison erkman says she has heard of cases like this, but it was a first for their clinic.dr. allison erkman/four seasons veterinary hospital:"anything on the counter within their reach or a trash can that's easily knocked over. dogs will follow their nose to just about anything, and i think if they find it tasty enough, they'll go into it."the vet says while they'll never know exactly what happened, the bag may have gotten stuck behind petey's ears after eating the chips.and dogs' first instinct is to shake their heads first before pawing at something. chrissy young/owner:"he was very -- i felt -- an agile and
