to the u.s. the president says the men appear to be in good health. the men were accused of spying in north korea. this release comes and president trump is planning a historic summit with north korean leader kim jong un. ( james ) breaking overnight in oakland... what started as a driver needing assistance on the side of the road turned into a shooting. ( darya ) kron 4's lydia pantazes is live in oakland with the details. lydia? at approximately 2:15, a motorist received a flat tire while traveling on sr-24, through the caldecott tunnel. the motorist pulled over to the center median just west of the tunnels and awaited assistance. shortly after, a cal-trans tow truck driver arrived and made contact with the motorist. when the

cal-trans worker attempted to get the motorist to drive his vehicle to the right shoulder, a verbal altercation occurred. at some point in the altercation the motorist drew a handgun and pointed it at the cal-trans worker. the motorist then pointed the handgun up and discharged a few rounds into the air. a friend of the motorist arrived, and they both fled the scene. chp units arrived on scene and shut down all lanes of sr-24 wb, in order to process the scene. officers went to the suspect's residence and placed him into custody without incident. the cal-trans worker did not receive any injuries as a result of this incident. ( darya ) the golden state warriors will take on the houston rockets in the western conference finals.( james ) the warriors beat the pelicans last night to advance. the warriors beat the

pelicans 113 to 104 last night at oracle arena. steph curry led the way with 28 points. kevin durant had 24 points of his own. with the victory the warriors tied an n-b-a record with their 15th straight home playoff win. the warriors will the warriors will now play the top seeded houston rockets in the western conference finals. golden state lost two out of three to the rockets in the regular season. after the game steph curry talked about taking on the rockets.

( darya ) in the east bay... students and staff are mourning the loss of a teenage boy... who drowned in their school's pool.( james ) it happened yesterday afternoon at san ramon valley high school in danville. kron 4's sara stinson joins us live. sara... students and staff found the 15-year old student underwater in the deep end of the pool. several students and teachers jumped in the water to try and save him. he was rushed to the hospital but unfortunately did not survive. students told us they could not believe their classmate is gone.

( darya ) in the south bay... the santa clara county board of supervisors has approved a premiliminary gun regulation ordinance. the new ordinance prohibits the sale or shooting of guns and the sale of ammunition on county property. this includes gun shows that do ánot already have a contract with the county. similar ordinances have already been passed in san mateo and alameda county. the ordinance does not include police officers. the preliminary approval will be brought for a final vote next month. ( darya ) fremont police are looking for a man who groped a woman in her garage. this happened monday in the ardenwood district. the woman told police that the man grabbed her breast... and when she screamed he told her -- "oh sorry, wrong house."

( darya ) in the east bay... police are investigating an armed carjacking at a bart parking lot. it happened at the west oakland bart station. three men approached the victim with a gun. the victim was not hurt... just shaken up. police are looking for the thieves and the victim's car. that car is a red toyota camry, the license plate number is on your screen. it's 6-a-q-b-4-9-9. ( darya ) the oak grove school district is on high alert after a bomb threat was made against the schools. a district employee called police yesterday morning about a threatening email about a bomb on school buses. police searched the buses and campuses and did not find anything suspicious. they will have extra patrols this morning. ( james ) take a look at this.new video of the kilauea volcano on the big island of hawaii. the lava lake in the center is bursting with activity.now police are going door-to-door to get people living near volcanic vents out of the area.

those vents are emitting dangerous gases near the leilani estates ... where lava has been pouring into streets and backyards for the past week. 14 vents have opened since the volcano erupted last thursday.the national guard is monitoring toxic fumes levels. officials are pleading for people to stay away. ( darya ) as temperatures heat up -- sharks off the west coast are now starting to show up. these are pictures taken from a helicopter flying over aptos waters near santa cruz. pilots say they counted more than 15 mid-sized great whites. pilots also captured a pod of orcas in a feeding frenzy. just last week lawmakers passed a bill that would grant more resources to scientists and researchers studying local sharks, in an effort to make our beaches safer. santa clara county judge aaron persky is opening up about his fight to stay on the bench. next month ... voters will decide whether or not he should be recalled. persky has faced mounting pressure to step down or be removed since issuing what critics call a light sentence in the brock turner sexual assault case at stanford. in 2016 ... turner was sentenced to six months in jail and three months probation after he was convicted on three counts of sexual assault.

firm lead in the polls... leading republican businessman john cox by 11-points. the primary is june 5th. ( james ) there is a new push in san francisco for a city department that would advocate for sexual assault victims. supervisor hilary ronen says the idea came after hearing stories from sexual assault survivors who say they have experienced insensitive treatment from city employees. ronen says she hopes the new deparment will improve how city officals respond to sexual assault and harassment. ( darya ) another airline scare to tell you about this morning. smoke forced passengers on a delta flight to use emergency exits to deplane on a runway in denver. the flight flew into dever from detroit last night. smoke was detected in the cabin after the plane landed and was taxiing to the terminal. the flight crew activated slides and the over-wing exits to help the 146 passengers get off safely.

hapeened on university avenue near jefferson in berkeley. here's what her windshield now looks like. she said the cyclist chased her down after she passed him and began punching and kicking. the cyclist told her that she drove dangerously close to him but banda says there was plenty of room. witnesses say the cyclist was extremely violent. ( darya ) banda did file a police report and wants anyone who may recognize her attacker to come forward. ( james ) in the east bay... public school students are bearing the cost of the rapid growth of charter schools in oakland. a new study shows the expansion of charter schools has led to 15- hundred dollars less

funding... for every child enrolled in an oakland public school. that's 57-million dollars annually. the california charter schools act does ánot allow school boards to consider how a charter school may impact a district's educational programs or financial health when weighing new charter applications. ( james ) in the south bay... a police officer is filing a 6-million dollar claim for damages against the city of san jose. this is an update to a story we first brought you yesterday morning. officer nabil haidar has worked for the san jose police department for 21 years. he says early on, his colleages began to make fun of his race and religion... but he never reported the incidents. two decades later, officer haidar filed a complaint after he says he was ridiculed during a meeting in front of a commander.... and harassed by a fellow officer. he explained to kron4 why he did not report the behavior sooner. < "just you have to let it go, young officer, you have

( james ) dozens of homeless have been living in tents near 27th and northgate in oakland for years...but that's all about to change. starting tomorrow ... a group of homeless people will be moving into community tuff shed cabins. the new cabins will be at 47th and northgate. there is other homeless housing on sixth and castro in oakland. 40 people have lived there since january. the city hopes this second location will be just as successful.

( darya ) a federal judge says the undocumented immigrant acquitted of killing kate steinle faces an uphill battle on gun charges. jose garcia zarate claims he's the target of a vindictive federal prosecution. steinle was killed in 2015 on pier 14 in san francisco. in november... garcia zarate was acquitted. 5 days later... federal officials charged him with illegal gun possession. garcia zarate's attorney says police targeted him out of frustration. this case has been mentioned by the president arguing it's an example of why the sanctuary city policy is a dangerous idea. ( darya ) san francisco 49ers star reuben foster has pleaded not guilty to felony domestic violence and weapons charges. foster was

( james ) a federal judge says the undocumented immigrant acquitted of killing kate steinle faces an uphill battle on gun charges. jose garcia zarate claims he's the target of a vindictive federal prosecution. steinle was killed in 2015 on pier 14 in san francisco. in november... garcia zarate was acquitted. 5 days later... federal officials charged him with illegal gun possession. garcia zarate's attorney says police targeted him out of frustration. this case has been mentioned by the president arguing it's an example of why the sanctuary city policy is a dangerous idea. ( james ) in the south bay... a police officer is filing a 6-million dollar claim for damages against the city of san jose. this is an update to a story we first brought you yesterday morning. officer nabil haidar has worked for the san jose police department for 21 years. he says early on, his colleages began to make fun of his race and religion... but he never reported the incidents. two decades later, two decades later, officer haidar filed a complaint after he says he was ridiculed during a meeting in front of a commander.... and harassed by a fellow officer. he explained to kron4 why he did not report the behavior sooner. < "just you have to let it go, young officer, you have aspirations to become something, to move on, to move into specialized units, you don't want to be that guy">( james ) the san jose police

( darya ) a federal judge says the undocumented immigrant acquitted of killing kate steinle faces an uphill battle on gun charges. jose garcia zarate claims he's the target of a vindictive federal prosecution. steinle was killed in 2015 on pier 14 in san francisco. in november... in november... garcia zarate was acquitted. 5 days later... federal officials charged him with illegal gun possession. garcia zarate's attorney says police targeted him out of frustration. this case has been mentioned by the president arguing it's an example of why the sanctuary city policy is a dangerous idea. ( james ) the santa clara valley water district is now supporting a project known as the "california waterfix." it's pledged 650 million dollars toward the 17 billion dollar project. this is part of governor brown's plan to build 2 tunnels to bring water from the sacramento
