people are dead and 5 others injured in a multi-car crash in fremont.( darya ) that crash happened near the stevenson boulevard exit. a section of northbound 880 is closed. kron 4's will tran is live at the scene.. will. three people are dead after a multi-car crash in fremont. it happened last night on northbound i-880 at stevenson boulevard. 5 additional people were taken to the hospital... including a baby who is in critical condition. a man involved in the crash was arrested on suspicion of driving under the influence of marijuana. police say it was reported that he was speeding and driving recklessly. all lanes of the northbound 880 freeway are currently closed from auto mall parkway to

nine counts of felony child abuse against the california mother of 10 children who officials say suffered long- term abuse in a filthy home. ina rogers is scheduled to appear in court wednesday. solano county deputy district attorney veronica juarez filed a notice with the court tuesday in the case against the 31-year-old.the charges allege that rogers caused the children to be in a situation that was likely to produce great bodily injury and death. rogers told reporters earlier this week that the allegations against her and her husband are false.the children's father, 29-year-old jonathan allen, pleaded not guilty to torture and child cruelty charges and is being held on $5.2 million bail. < i want police to know that i am not an animal i am not an animal you didn't even ask me or tell me what i supposedly done...>

( darya ) happening now... a 14-year-old boy is missing in fremont and police are asking for your help finding him. his name is jack conner... and he went missing yesterday afternoon around 4-30. jack was last seen near central avenue and blacow road... and was wearing a dark blue zip-up michigan state sweatshirt... with a yellow hood. jack is described as 5-foot 7-inches tall... has brown hair and eyes... and weighs about 130-pounds. story we are following... hawaii is under a red alert. along with the lava that's now flowing from 20 fissures... there is now a new concern -- lava bombs. a lava bomb is huge molten rock that's hurled into the air by volcanic eruptions. that molten rock then solidifies before it hits the ground. they can be as big as a pickup truck... and they give no warning. this comes as scientists and health officials are urging people near the kilauea volcano to avoid toxic sulfur dioxide gases... which are now reaching dangerous levels. the volcano has forced more than 2-thousand people to leave their homes... and it could be months before they can go back. ( james ) a bay area family now living in hawaii lost everything in the lava. these pictures show just how destructive the lava can be -- you see nothing but ash and rubble. marci and david nail started building their

dream home in leilani estates 10 years ago. they finally moved-in in march. david nail grew up in brentwood. the couple ádoes have insurance that will cover their loss. ( darya ) an oakland man who killed a woman during a road rage incident in 2014 ... says he fired his gun because he feared for his life. this is video of his arrest in oakland in 2014. carl dubose testified in court yesterday. he says he got into an argument after a driver almost hit his car. he says the driver flashed gang signs and he thought he was reaching for a gun. that's when dubose reached for his gun and fired multiple shots. the driver's wife was shot and killed in the confrontation. dubose says he had never used a gun before and was just trying to defend himself. ( darya ) an arrest has been made in connection to a

20-16 homicide in san jose. joseph miller was arrested in guadalajara, mexico where police say he fled. the u-s marshalls worked with mexican authorities to bring miller into custody. in 20-16 san jose polce responed to a fight where they found the victim -- alfred perez dead. miller is currently being held in texas... where he will remain uintil he is handed over to police in san jose. ( james ) happening today... the mother of a teen who died of an overdose in petaluma will be in court. danielle foernsler is set to enter a plea. she faces charges of manslaughter and child endangerment. it happened last month on vallejo street in petaluma. investigators say foernsler and a friend put her unconcious son in the car and drove him to the hospital where he later died. police say she did not call for help. she will be in court at 8:30 this morning. ( james ) the san francisco district attorney's office is going to wipe out thousands of marijuana convictions using a computer algorithm. d-a george

gascon says this will help prosecutors identify convictions eligible for dismissal under california's revised marijuana laws. in january... gascon announced his office would dismiss more than three-thousand misdemeanor pot convictions dating back to 1975. the algorithm will search through nearly 5-thousand felony cases in san francisco. those eligible will then be reviewed by a prosecutor and submitted to the court. the problems began monday night... and according to the latest tweet from sutter health... some systems are still off line. some surgeries and appointments are having to be rescheduled. right now tech teams are working to fix the problem. patients are being told to show up for their scheduled appointments unless they have been told otherwise. ( darya ) a travis air force base psychiatrist is accused of raping patients. doctor heath sommer will stand trial on 3 felony sexual assault charges. sommer is accused of targeting female service members in 2014 and 2015. he was hired by travis air force base to help veterans dealing with p-t-s-d.

( james ) in the east bay... hundreds of people in oakland are demanding an end to what they say is a misuse of public resources. this comes after a white woman called police to complain about a black family barbecuing at lake merritt. kron4's michelle kingston has the story. 8-year-old, autistic daughter. ( darya ) kron 4's sara stinson is here with a look at the video. sara. ( sara ) this happened in vacaville. the bus was on its way to drop kids off at browns valley elementary school. the surveillance video from the bus shows kim klopson confronting the girl for blocking the aisle with her leg. as the girl tries to get off the bus... you can see klopson grabbing the girl's backpack and ordering her to stay seated. a few minutes later she was caught on camera taunting the girl who is crying. ( sara ) then for almost 4 minutes the driver is alone with the girl... yanking her up and back down... ripping off her jacket before eventually dragging the girl off the bus when a teacher's aide comes to get her. the district says

klopson has been fired. klopson says the video should never have been released... but declined to comment further. the family has reached out to an attorney and does plan to sue. back to you. ( james ) happening today... the man accused of stabbing and killing another man at sonoma state university will make his first court appearance. police say tyler bratton killed steven garcia inside a dorm at the university on sunday. neither man was a student at the university. ( james ) in the east bay... a federal judge has struck down the city of oakland's ban on coal shipments through its port.. this is a major setback for city leaders... who argued the coal operations are unsafe and unhealthy. but the judge ruled that there's not enough evidence to support that claim. the judge also said the city made mistakes in its report -- including the claim that tons of coal dust would be blowing around. oakland mayor libby schaaf

says she is frustrated with the judge's decision -- tweeting the fight is not over. ( darya ) san francsico's bus fleet is going green. officials have passed a resolution to make the city's fleet all-electic and battery- powered by 20-35. the move would allow for the removal of the overhead wires seen throughout the city because the new electric buses would not need them. under the new resolution, muni would begin purchasing electirc bueses in 20-25 giving them a decade to reach all-electric. with the new battery- powered buses, muni would have to build new facilities to charge fleets of buses. ( james ) in the east bay... a federal judge is backing the city of berkeley in its fight to save a historic post office building. the post office was built in 19-14 and is listed in the national register of historic places. the battle began in 20-12 when the postal service said it wanted to sell the building in downtown berkeley for commercial purposes. the city filed a lawsuit to stop the sale of the building... and the postal

service fought back by filing its own suit against berkeley. a judge rejected the postal service's arguments. ( darya ) the treasure island music festival is back on... but this time it will be in the east bay. the festival will now be held at middle harbor shoreline park in oakland. it was on hiatus last year as organizers tried to find another location. the festival was forced to relocate because of construction on treasure island. it's now happening october 13th and 14th... and the lineup will be announced soon. ( james ) san francisco's airport has one of the worst 'on tme' track records in america. and it's all because of fog. airport officials are now putting in new technology that could help pilots navigate through fog. and it would improve on-time departure and arrivals. an sfo spokesperson says they've been testing out the technology for a year and so far it's been a success.

will be facing nine additional child abuse charges.... investigators accuse rogers of putting her children in a situation that was likely to cause bodily injury and death. (take vo)solano county authorities say the children suffered puncture wounds, burns, bruising and injuries consistent with being shot with a pellet gun.30-year old rogers and 29-year old jonathon allen, the father of her ten children were arrested after their 12-year old child was reported missing.once the child was found they searched the home due to concerns for the safety and health of the other children.officers found nine more children, ranging in age from 4 months to 11 years old, investigators say the

children were living in "squalor and unsafe conditions."solano county prosecutors charged the father, jonathan allen with 16 felonies.. including 7 counts of torture, and 9 counts of felony child abuse. we spoke with allen about those charges. ( darya ) new this morning... a proposed plastic ban could change the way people eat out in san francisco. the possible new law would prohibit the use of plastic foodware items like straws, lids and utensils. city supervisor katy tang says about a million straws are used in san francisco each day. she says straws end up in landfills, sewer systems and in the ocean. she's concerned with the amount of waste generated from plastic.

( darya ) happening today... the man accused of stabbing and killing another man at sonoma state university will make his first court appearance. police say tyler bratton killed steven garcia inside a dorm at the university on sunday. neither man was a student at the university. ( darya ) in the east bay... a federal judge has struck down the city of oakland's ban on coal shipments through its port.. this is a major setback for city leaders... who argued the coal operations are unsafe and unhealthy. but the judge ruled that there's not enough evidence to support that claim. the judge also said the city made mistakes in its report -- including the claim that tons of coal dust would be blowing around. oakland mayor libby schaaf says she is frustrated with the judge's decision -- tweeting the fight is not over. ( darya ) san francsico's bus fleet is going green. officials have passed a resolution to make the city's

(take vo)solano county authorities say the children suffered puncture wounds, burns, bruising and injuries consistent with being shot with a pellet gun.30-year old rogers and 29-year old jonathon allen, the father of her ten children were arrested after their 12-year old child was reported missing.once the child was found they searched the home due to concerns for the safety and health of the other children.officers found nine more children, ranging in age from 4 months to 11 years

( darya ) new this morning... a proposed plastic ban could change the way people eat out in san francisco. the possible new law would prohibit the use of plastic foodware items like straws, lids and utensils. city supervisor katy tang says about a million straws are used in san francisco each day. she says straws end up in landfills, sewer systems and in the ocean. she's concerned with the amount of waste generated from plastic. if the plan is approved by the board ... it will go into effect in july of 2019. ( james ) an oakland man who killed a woman during a road rage incident in 2014 ... says he fired his gun because he feared for his life. this is video of his arrest in oakland in 2014. carl dubose testified in court yesterday. he says he got into an argument after a driver almost hit his car. he says the driver flashed gang signs and he thought he was reaching for a gun. that's when dubose reached for his gun and fired multiple shots. the driver's wife was shot and killed in the confrontation. dubose says he had never used a gun before and was just trying to defend himself. ( james ) an arrest has been made in connection to a 20-16 homicide in san jose. joseph miller was arrested in guadalajara, mexico where police say he fled. the u-s marshalls worked with mexican authorities to bring miller into custody. in 20-16 san jose polce responed to a fight where they found the victim -- alfred perez dead. miller is currently

( james ) a big story this morning... a bay area family says they plan to sue their school dsitrict after video surfaced showing a bus driver getting physical with their 8-year-old, autistic daughter. ( sara ) this happened in vacaville. the bus was on its way to drop kids off at browns valley elementary school. the surveillance video from the bus shows kim klopson confronting the girl for blocking the aisle with her leg. as the girl tries to get off the bus... you can see klopson grabbing the girl's backpack and ordering her to stay seated. a few minutes later she was caught on camera taunting the girl who is crying. i am extremely proud of jackie, gaby and stephanie. we worked with pg&e to save energy because we wanted to help the school. they would put these signs on the door to let the teacher know you didn't cut off the light. the teachers, they would call us the energy patrol. so they would be like, here they come, turn off your lights! those three young ladies were teaching the whole school about energy efficiency. we actually saved $50,000. and that's just one school, two semesters, three girls. together, we're building a better california. the school. chicago t.v. stations are reporting that there was a fight between the officer and former student. the gunman opened fire on the officer... the officer then fired back, injuring him. the school resource officer was not injured in the shooting. no students were harmed. ( darya ) happening now... a 14-year-old boy is missing in fremont and police are asking for your help finding him. his name is jack conner... and he went missing yesterday afternoon around 4-30. jack was last seen near central avenue and blacow road... and was wearing a dark blue zip-up michigan state sweatshirt... with a yellow hood. jack is described as 5-foot 7-inches tall... has brown hair and eyes... and weighs about 130-pounds. the university on sunday. neither man was a student at the university. ( james ) san francisco mayor mark farrellwants to add 250 more officers to the police force. we first told you this story yesterday morning. but now the mayor has officially announced his budget proposal. mayor farrell says he is investing 34-million dollars in public safety. ( darya ) in the east bay... a federal judge has struck down the city of oakland's ban on coal shipments through its port.. this is a major setback for city leaders... who argued the coal operations are unsafe and unhealthy. but the judge ruled that there's not enough evidence to support that claim. the judge also said the city made mistakes in its report -- including the claim that tons of coal dust would be blowing around. oakland mayor libby schaaf says she is frustrated with the judge's decision -- tweeting the fight is not over. ( darya ) san francsico's bus fleet is going green. officials have passed a resolution to make the city's

fleet all-electic and battery- powered by 20-35. the move would allow for the removal of the overhead wires seen throughout the city because the new electric buses would not need them. under the new resolution, muni would begin purchasing electirc bueses in 20-25 giving them a decade to reach all-electric. with the new battery- powered buses, muni would have to build new facilities to charge fleets of buses. ( james ) in the east bay... the city of walnut creek is focusing on affordable housing. the city introduced a panel made up of experts from the business, medical, transportation and education sectors. city housing officials say walnut creek currently offers 560 affordable housing units... with more than 140 other units under construction. ( james ) in the east bay... a federal judge is backing the city of berkeley in its fight to save a historic post office building. the post office was built in 19-14 and is listed in the national register of historic places. the battle began in 20-12 when the postal service said it wanted to sell the building in downtown berkeley for commercial purposes. the city filed a lawsuit to stop the sale of the building... and the postal service fought back by filing its own suit against berkeley. a judge rejected the postal service's arguments. ( darya ) san francisco's airport has one of the worst 'on tme' track records in america. and it's all because of fog. airport officials are now putting in new technology that could help pilots navigate through fog. and it would improve on-time departure and arrivals. an sfo spokesperson says they've been testing out the technology for a year and so far it's been a success.
