a fellow student told police that the teen was planning a school shooting. when the student told the teen that the threat was going to be reported to police, the teen threatened the student. napa police arrested the teen last week. police say they believe there is no current threat to any students at this time.

( james ) new this morning ... a 75 year old man has died after being hit by a car in martinez. it happened late last night in the area of berrellessa and green street. here is a map showing you where the accident happened. the elderly man was taken to the hospital but his injuries were too severe and he died. martinez police say the driver is cooperating with the investigation. ( james ) also overnight ... a pedestrian in san francisco was killed while walking on i-80 on the the the struck and killed just before midnight. in this

is happening at 6 o'clock tonight.you can also watch it live at kron4-dot-com. the white house says tax refunds will go out during the government shutdown ... which now enters its 18th day. the acting director of the office of management and budget says the administration is working to make the shutdown "as painless as possible." the announcement is a reversal of a long-standing policy to withhold refunds during shutdowns. san francisco's department of public works is stepping up to clean some tourist hot spots which have been neglected during the federal shutdown. city crews cleared trash bins near aquatic park and then scooped up the overflow..... before tossing the bag into the back of a city truck. the mess was so widespead -- a department of public work team... worked out of their juristiciton. the spokesperson for the city agency says it decided to pitch in at land's end -- a park popular with tourists.

with the intent to engage in a sexual act. the soccer club has taken steps to prevent him from having any access to the soccer club and playing fields. ( james )peninsula ... the san mateo sheriff's office is looking for a man who robbed a restaurant with a knife. deputies say, last thursday, this man approched an employee at the taqueria el tulense on spring street. he forced the employee to open the register at knife point. the suspect took the cash and ran away south on spring street. anyone with information is asked to contact the san mateo sheriff's office. now to the latest on an east bay woman, who was arrested for biting a jogger during a confrontation on a trail. i spoke with the woman's attorney. she says her client is a dog walker and only took action when forced to defend herself and her dogs. emily dahm, attorney. i think this is shocking how this is one sided and that is why i am talking to the media. attorney emily dahm says this is her client, alama cadwalotter - at the center of case. she says - it all unfolded last week when alma met on a trail jogger cyndi stainner. alma's two dogs were off leash

allowable per park rules. dahm. i understand the jogger being startled... but she then started pepper spraying the dogs, alma said to stop, then she the jogger grabbed her by the hair and kneed her in the groin and my client had to bite her to get her to released her grip.dahm says her client left the park, but then the matter escalated, with east bay park police investigating then rolling the case over to the alameda county district attorney's office. alma was arrested on several felonies, including false imprisonment, and battery and causing serious bodily injury.dahm. i understand jogger is upset, but this is not a felony case. alma was expected to be arraigned monday, but the da is still reviewing the case. in the meantime, her attorney says all of this has about this all. in alameda county terisa estacio

rafael responded to an apartment fire early this morning on labrea way. officials say the call came in around 4-15 this morning and managed to have it out 4-30. they say there was limited damage but it did displace a family of four. no injuries were reported and the red cross is assisting the family. the cause of the fire has not been determined. ( james ) a suspect in a deadly bowling alley shooting in torrance is behind bars. police arrested 47-year-old reginald wallace in los angeles sunday. he served 17-years for assault with a deadly weapon, before being released on parole in 20-17. the shooting broke out at a busy bowling alley friday night, leaving three people dead, and four others wounded. witnesses said it star after a group of people got into a fight. police didn't arrest anyone at the scene, but they asked witnesses for cellphone videos of the incident. investigators say they believe ( james ) former arizona

congresswoman gabby giffords returns to capitol hill today to help introduce a new bill on gun background checks. the legislation would require background checks on private gun sales. it falls on the 8th anniversary of the shooting that nearly killed gifford and left six others dead. she'll join newly-elected house speaker nancy pelosi and california congressman mike thompson, to unveil the bill. ( terisa ) in the east bay ... oakland mayor libby schaaf will start her second four- year-term today ... by serving meals to the homeless in the city. yesterday she was sworn in again ... after winning the november election in oakland. during her inauguration speech ... she touted the city of oakland ... saying it is no longer among the 10 worst places for violent crime. she also sees that turnaround as one of her biggest accomplishments.

police in placer county are investigating reports of hazing on the placer high school basketball team. the accusations involve junior varsity basketball players. the team has been suspended indefinitely and staff members put on administrative leave. right now, investigators are not commenting on what exactly may have occurred.. but they did say it happened during this school year. police say if charges are brought, they would likely fall under misdemeanor charges. some parents say they want to know why the school has yet to tell them about the investigation. in a statment, the school district said in part.'we take all threats to student safety very seriously, and are taking immediate actions to ensure the safety of all student athletes.

twice as much on health care as our peers. that's according to a new report from john hopkins' school of public health. the study found that it's ánotá because americans use more medical services than other developed nations --- but because of higher drug costs, higher paid doctors and nurses and higher price tafs for hospital administration and medical services. the high cost of drugs is expected to be a focus of r health this morning. a new study hopes to shine some light on two different vaccinations for the flu. the study looks at the effectiveness of the traditional flu shot versus the nasal spray. researchers found that the spray may not work as well as the shot against the flu in children. they say the

shot is around 51-percent effective and the nasal spary is 26-percent effective. health officials say while neither vaccine is 100-percent effective ... it's still important to get vaccinated. water officials ... its welcome sign as the rain helps fill up the reservoirs. kron 4's charles clifford has an update on our local and

state water levels. after several weeks of dry weather, heavy rain returned to california and the bay area giving our reservoirs and snowpack a needed boost.as of early monday morning, the 7 reservoirs used by the east bay municipal utlity district are holding a total of just over 600 thousands acre feet of water. that's about 78 percent of full capacity.the lafayette reservoir here is currently 69 percent full.in the south bay, the santa clara valley water district reservoirs are on average about 28 percent full. for san francisco, hetcy hetchy reservoir near yosemite is 68 percent full, but 123 percent of capacity for this time of year. and in marin county, the reservoirs are 3/4 full , which is slightly better than this time last year but a little below the historical average for early january.statewide, most of california's big reservoirs are at or near the historical average for this time of year but still have ways to go to
