--- the president has officially declared a national emergency over funding for his long promissed border wall this morning.( darya ) he said in his speech this morning that it is long overdue --- and he was stopped from doing it earlier in his administration because lawmakers didn't step up and get it done in congress. he h that the emergency declaration will be upheld in court --- if it goes to the supreme court. destroyed in a mudslide that buried a woman in the rubble. she made it out alive.( james ) (ááádoubleboxááá) kron4's will tran is near the scene of the mudslide this morning with the latest. will? this morning all access to the damaged homes has been cut off either by barricades or police officers as the rain continues to come downthe mudslide picked up susan gordon's home and carried it down hill .. slamming it into another home on thursday in the overnight hoursthe 76 year old gordon was asleep at the time and described it as sounding like a tornado she was injured and was covered in mud and darkness remove hertyngineers say there were no concerns before thursday that the ground would give outrescuers used cadaver dogs all day to look for any other possible victims but fortunately did not find any

( darya ) bart's board of directors voted unanimously today .... to name a throughway next to the fruitvale station - "oscar grant iii way." grant, a 22- year old black man from hayward ... was fatally shot in the back by bart police at the fruitvale station on new year's day, 2009. the shooting ... captured on cellphone video by a bystander ... was one of the driving forces behind the

'black lives matter' movement. the former bart police officer who shot the unarmed grant was sentenced to two years in prison for involuntary manslaughter. ( darya ) five homestead high school students were arrested in connection with a group assault on a 69-year-old man in cupertino. the victim told police a group of juveniles approached his car at a mcdonalds on stelling road. he says they then spit in his car window. he got out to confront them... and they began fighting the man. police have video of the fight and are holding it for now. they used it to identify the boys with the help of homestead high school officials .. ( darya ) the big story we are following. president trump declared a national emergency in order to pay for a border wall.( james ) first he signed a bipartisan spending bill to avoid a government shutdown and then he used executive action. the president 8-billion dollars to build his wall. the president is expected to draw on a variety of administration funding sources to help finance the wall's construction... including the military.
