( robin ) ( robin ) our top story this morning. a young boy is dead after a playground accident at a private school in san rafael. the school says classes will be in session this morning. the accident happened yesterday on the playground at mark day school on trellis drive.

the school says other students and staff witnessed the accident and tried to provide aid for the young boy. he died at a hospital. the school is working with police to investigate what happened ... and the section of campus where the accident happened has been closed off. mark day school released this statement saying ... "the death of someone so young is devastating for all of us, and even more so under these circumstances and at this time of year, when we are surrounded by celebrations while we mourn. all of us at mark day school express our deepest sympathies to his family, classmates and friends." there will be counselors on campus today for students who need support. (robin) in the east bay. concord police are removing big r-v's that are illegally taking up space for days, weeks and even months. as kron 4's gayle ong shows us ... two people are now without

their homes. cell phone video shows a man appearing to be upset and concord police officers standing by.the incident happened around noon thursday keri gerosolimo was on her way home from work and filmed the exchange on her iphone, she says the man named this rv that's about to get towed - apparently at least two large rv's were parked day after day on flamingo drive next to the shell gas station, making it hard for residents to drive into the neighborhood. gerosolimo says she understands vehicles were towed but feels bad for the people living in them who are now back on the streets.

( robin ) all three people accused in the death of a bay area father will be walking free by mid- january. kaveh bayet walked out of the san mateo county jail a free man thursday after prosecutors decided not to retry him for the murder of keith green. prosecutors had accused bayet

of actually shooting and killing green in april of 2016. green's ex- girlfriend... tiffany lee was acquited of the murder earlier this year. a jury deadlocked over bayet's guilt. ( robin ) san mateo county district attorney steve wagstaffe says he continues to believe the evidence shows li and bayet were accountable and responsible for keith green's murder. the decision not to re-try bayat could change if new evidence is discovered. ( robin ) take a look at this. a large tree smashed into a home around in the hills above redwood city near

interstate 280. the oak tree broke free from its roots and fell onto a home while homeowners were inside. they were not hurt. they are now waiting to get the tree cleared... get an estimate on the damage and hire a contractor to fix their home. ( robin ) oakland police seized six firearms -- including an a-r 15 semi- automatic rifle during an operation earlier this week.. police arrested one man.. no details on what led to the gun seizure.. they say the investigation is still active. ( robin ) san francisco police arrested these two men ... in connection to a shooting back in september. police say... 26-year-old ájarillo estebaná from oakland -- on the left -- and 22-year-old átony castilloá from daly city -- on the right -- fired two shots into a group of people gathered in the city's mission district. one person was injured. police used survellance footage to identify the

suspects.. they arrested esteben last month ... castillo earlier this month... both are charged with attempted ( robin ) in the east bay... police are looking for a man accused of exposing himself in public. alameda police are trying to identify the man on the screen. they say he entered a subway restaurant on webster street tuesday.... and exposed himself. poliuce only have a generic description of the man. ( robin ) police in american canyon are looking for a man accused of stealing credit cards from an elementary school and going on a shopping spree. it happened earlier this month at canyon oaks elementary school. police say the man stole cash and credit cards from several teachers on campus. then went on a shopping spree in pleasant hill and benicia. he was seen driving a silver or white nissan maxima s with either a rear paper plate or temporary plate. ( robin ) police in

benicia are looking for a man who used pepper spray on a gas station clerk before stealing money from the cash register. this video shows the robber holding a pistol in one hand... then pepper spraying the clerk. this happened at the "fast and easy mart" gas station in benicia. police say the man in the video pretended to be a customer before attacking. ( robin ) police have released this video showing the thief leaving the scene in a white jeep cherokee. the owner of the gas station says this type of incident is rare. in fact this is the only time

he has been robbed this (robin) coming up on the kron 4 morning news... at least three people have died from the flu in the bay area this year... now there is a new warning from doctors. (robin) and an 11- year-old girl in the south bay jumps into action to save her family from a house fire. (robin) and california's earthquake warning app sends out its first earthquake alert and it is being called a success. (ácommercialá) back.

( robin ) the developers of the 'myshake' earthquake earning app say the app is actually sending out alerts. the state's earthquake warning app ... sent out an alert less than 10- seconds after a small earthquake shook monterey county. it was the first time an alert was sent since being developed at u-c berkeley. doctor peggy hellweg is the operations manager for the myshake app. ( robin ) the app was released to the public back in october. it has been downloaded more than 900- thousand times. ( robin ) los angeles county prosecutors say --

they didn't find any animal cruelty or criminal activity linked to scores of horse deaths at santa anita park. the l-a district attorney formed a task force after 56 horses died between last july and this november. the d-a says -- greater precautions are needed but improved safety policies ádidá reduce the number of fatal racing and training incidents.
