state of emergency. it is time. >> for the legislature to reassert its constitutional authority as a legislative body of this state. and and this endless emergency, the bill senate concurrent resolution 5 was dusted off for its first hearing after senator melissa melendez introduce the push in december of 2020. she says the state of emergency has given the governor too much power and noted. 29 other states have ended their emergencies. the governor has come close. >> or possibly has. >> violated the constitutional separation of powers doctrine by legislating through executive order on a party line vote. members of the committee on governmental organization rejected ending the state of emergency for to sting state of emergency for claim by the governor. >> is absolutely important to ensure that the state can quickly and efficiently continue to respond to the covid-19 pandemic. it be prepared for possible future variants of surges. some democrats, including senator ben allen opted out of voting

with questions about how exactly this could affect federal funding and response to future surges. melendez said the resolution would not hinder any of it. i do think that it's important that this be ended at some point. i would love to get some some further clarification information from. from from experts on this after the vote. a spokesperson for the governor said in a statement, quote, elected officials should focus on what best serves their constituents and stop with the political theater. the state will continue to be guided by the latest science and data as we respond to the evolving pandemic. the chairman of the committee agreed to grant the resolution reconsideration, meaning it can be brought back for another vote later this year in sacramento. ashley zavala kron. 4 news. >> the federal covid programs are losing funding and the cuts will start hitting americans in just a few days. >> starting next week, americans without health insurance will no longer be able to submit claims for covid tests or treatments. and in 2 weeks they will no longer be able to submit claims for vaccinations. the biden administration says it has pleaded with congress for more

funding to continue these programs. but so far those pleas have gone unanswered. the white house requested 22.5 billion dollars in covid funds earlier this month. happening today, we can learn of teachers in the mount diablo unified school district plan to go on strike this afternoon. the teachers union is expected to announce the results of the vote whether to authorize a strike. the union has been negotiating with the district over a new contract for more than a year. if the union did vote to authorize a strike, it is not clear when that strike would actually happen. teachers in san francisco are continuing their sleep into demand paychecks from the school district 100 say they have not been paid in months or they've been paid incorrectly. the school district says the issue started when they switch to a new payroll system recently, the district says they agree with teachers and the unions that these teachers need to be paid and that they're working quickly to resolve the issue. teachers we spoke to at the sleep inn say there living

paycheck to paycheck right now or there taking second jobs to try and survive. >> this is humiliating that you have to go for what you for what is written in full because it's part of our contract colleagues who are being underpaid. i mean, i'm missing 60% of my paycheck. and i know that i'm not the thing. >> that did district superintendent made a statement saying that they are writing checks for back pay to those who have been impacted the most first they say they responded to a little over 1000 reports of under payments is switching to that new payroll system of those reports 942 have been resolved. 59 are still outstanding. we have video showing a smash-and-grab robbery at a jewelry store in san jose. we first told you about this on monday right here on kron 4. it happened monday morning at j hus customer jewelry at the eastridge mall. the owner says as many as 9 people use hammers to break the display cases getting away with more

than half a million dollars worth of jewelry. we're told that this is the second time the store has been targeted within the past 6 months. san francisco mayor london breed has introduced legislation to make a portion of jfk drive car free forever. a 3 mile stretch of the road between lincoln way in case our drive have been closed since the early days of the pandemic to make outdoor and socially distant recreation easier. 3 city supervisors rafeal mandelman matt haney and dean preston are co sponsoring that legislation while the destrehan advocacy groups kids safe as f and walk us up a plot. the measure, the proposal also faces some strong opposition, the full board of supervisors is expected to vote on that legislation as soon as april. well, ahead in sports, the lawyers are heading in the right direction with the return of draymond green. >> sports director jason dumas has reaction from steve kerr. we'll be right back after the break. by the time.

maybe spring shopping job. >> that's an easy one. right i can do some springs up into. we can do that once again. would not complain about it. but the spring cleaning part. that's a little tougher to motivate ship for. but hey, the forecast next week may just motivate you to get out there. clean that garage out. do some weed pulling in the backyard. all those things that i know i've been avoiding a little bit. your view outside right now is showing you those clear skies that we do have from your berkeley hills. you can see some low cloud cover in the distance, though. and this morning is a mix of both of those. some of us are clear than others. there's definitely a few low clouds and even foggy spots still hanging out across the bay. yesterday's rainfall now having moved well out into the great basin as well as the rockies in the form of rain at lower elevations, some snow with those upper elevations. they need it just as much as we do. the rockies, especially in the death of drought. much as we are here in california.

now, skies today do dry out. that's going to help our temperatures to feel a little bit nicer because we've got a lot of sunshine overhead and then much calmer winds. so those 60's and 70's going to be feeling really good. we do have a weak system that's going to try to pass overhead tomorrow and in the process going to try to give us some rainfall. but yeah, as i mentioned the system just a little too weak, losing its steam by the time it reaches the bay. a couple of sprinkles up in mendocino county. but that's all we really got for your thursday friday. a nice and dry want to start the weekend before saturday. your last day of winter. a cool down is another cold front slides through and even more rainfall just around the corner for that one. so really looking forward to that saturday, rain, potential don't played a whole lot of outdoor activities on saturday. maybe move those to this afternoon if you can on a wednesday because it's going to really nice day. lots of sunshine, some 60's, some 70's for your daytime highs, calmer winds. all of it does add up to a really nice field as you're stepping outside this

midweek, fairfield vacaville are 2 warmest spots on the map today, all the way up to a really comfortable 74 tomorrow, a little bit cooler. we've got that weak system. that's going to be up in cloud cover, but not giving us much of a chance of rain friday. a few clouds still the highs back in the low 70's before temperatures really plunge into saturday. our last day of winter and feeling like it with the rainfall cloud cover and highs only in the 50's sunday will quickly clear out as we move into spring highs climb back into the upper 60's and by monday to tuesday of next week. look at those daytime highs climbing right back into the upper 70's to even low 80's. so wasting no time getting right to the spring. feel rain and looking forward to those 80's. john, thank you for that. okay. so we do have a hot spot. this is out in san rafale. >> north san pedro road 3 lanes are currently blocked there this morning. let's get a look at your commute into the city, though. 10 minutes heading right so that fremont street exit san mateo bridge,
