at 1:00, 79 at 5:00 p.m. down from afternoon high of 81. i think you are going to like the forecast into the rest of the workweek as well. that's up ahead. kyndell, back to you. >> anchor: thank you. police are looking are the gunman or suspect who killed a man near nellis air force base. this happened before 8:00. police say someone pulled out a gun and started firing at the victim. the man was rushed to umc r where he was pronounced dead moments later. it is not clear what sparked the shooting. police have not yet released the description of who they are looking for. >> anchor: a man accused of killing a woman in her home three years ago won't get another trial. prosecutors say morgan shot and killed a 75-year-old woman after breaking into her home in may of 2013. just two weeks ago a judge

the facial tattoos in front of a jury. a local mother is charged with murdering her own 7-year-old son. roshaun malone is the second person arrested for the death of her son richard finley, jr. who died last sunday at sunrise children's hospital. police and paramedics say he had been bound and beaten before his death. they also arrested malone's room, 31-year-old kenneth robinson the day that the child actually died. robinson is facing anp rancher cliven bundy is going off congressional candidate over a campaign ad. bundy says the ad links him to the murder of two metro police officers and he and the attorney don't want this to impact him from having a fair trial. bundy is currently in federal custody awaiting for his february trial for his connection to the april 2014

standoff. >> the reason i have done this is to stop it and ask for an apology. we are not here asking for money. we simply want this stopped. >> anchor: the democratic candidate calls the lawsuit a political stunt and in the next half hour we take you more in-depth into the claims and you will get another response from the campaign. in that race for congress in nevada's fourth district, kris hardy's fellow republicans say he deserves to be re-elected. speakers called his record an accomplishment and claims his opponent not so much. his opponent said he is proud of his record in the state senate and the campaign called hardy's event quote, a political stunt. with decision 2016 fasting approaching, bernie sanders is coming to las vegas. in an effort to make one final push before election day, we are just three days away.

clinton. sanders is expected to show support for the democratic candidate for senate. if you would like to hear from the senator head to for more information on how you can rsvp for the event. more than 30 million votes have been cast already across 48 states with early voting. in nevada we are one of those states and early voting ended late last night with huge lines in the las vegas area. more than 57,000 people actually voted early in clark county alone for this election. some who waited in line to vote were faced with register glitches though and had to cast provisional ballots in the meantime. they tell us they registered to vote well in advance but they were told they were not signed up when they went to an early election voting location. officials with the elections say most of those cases are due to different deadlines set by service providers like the dmv. of course, we are just three days away from election day. news 3 will have complete

>> anchor: welcome back. i can tell you this is a caught on camera moment that is also an uh-oh. abc news is caught on camera staging a crime scene tape during a broadcast. as you can see in the photo the police is tied to abc news equipment which is a no-no when it comes to journalism. when the segment aired live on "good morning america" this is where the problem is coming up. you couldn't the tape begins. the story was about a kidnapping in south carolina from correspondent lindsay davis. sources say the place was taped by abc news for the purpose of the live shot but that is staging the area. abc says the producer has been taken out of the field and they are currently investigating exactly what happened there. this isn't the first time abc news has actually doctored a live shot. in april a producer created a fake reservation list for a

the most clue in the world but that was making things up. the denver campaign office for donald trump was vandalized overnight on friday. trump campaign volunteers saw spray paint on windows and side of the building when they arrived. it is unknown who exactly is responsible but the denver co-and chairman hopes the cameras capture who did this. he says the building has been vandali dash cam video shows florida troopers pulling over a man driving on the wrong side of the highway. the toll employee called for help immediately after he saw the driver. police said the 76-year-old man wasn't hurt but did seem confused. his wife reported him missing earlier that day. the elder driver will have to be medically re-eeval baited to see if he can keep his driver's license. four children were taken to the hospital after their daycare

this happened yesterday afternoon in that state. five other children were on board the bus but immediately evacuated. police are investigating the cause of this crash. and back in september you might remember that two people were shot and wounded at mccarran airport in what turned out to be a domestic dispute. this actually isn't the first time that there has been violence at the airport. when it happened back in 1984, the circumstances were very different. here's tom hawley with this week's >> reporter: on sunday, april 8, a man with a gun tried to sneak through this metal detector. in the minutes that followed two security guards were shot. >> what i gleaned from the record probably a disgruntled employee tried to force his way through. >> reporter: mark hall is the clark county aviation museum. >> he shot two guards. didn't kill them. >> i looked over.

fairs according to a report from the cdc. out of 18 people, 16 of them children were infected with a type of swine flu not seen before in humans. all of them reported some kind of exposure to pigs at agricultural fairs. 13 say they either handled or touched the animals. one actually reported indirect contact. so far four children say they simply passed through that exhibit. all patients are now fully recovered and researchers say they have seen no evidence of person-to-person transmission. have identified the first u.s. cases of a drug resistant fungal infection. the cdc say 13 people have become ill from the infection and sometimes fatal infections with a high likelihood of causing outbreaks in health care facilities have been tracked. this deadly organisms hard to identify using traditional methods. seven cases between may of 2013
