superior -- [ inaudible ] >> -- execution, which is set to take place this week. it would be the state's first execution in five years. kraig debro is at san quintin this morning with an update. >> reporter: good morning, pam. ever since the supreme court reinstated the death penalty especially 1976 there have been multiple challenges to its constitutionality. well this morning there is going to be yet one more, the state is preparing to execute albert greenwood brown on wednesday morning at 12:00. he was sentenced to death in 1982 for the rape and murder of a 15-year-old riverside girl. this morning his attorneys will ask a judge for a stay of the execution. they say changes to the lethal injection protocol are minor and the judge that allowed it to go forward didn't didn't respond to public comment. >> even if they don't stop it the u.s. supreme court may intervene and say go forward. >> reporter: if all goes ahead

this will be the state's first in nearly five years, a judge halted them after he said the procedures for preparing and administering the drugs were not clear, recordkeeping was bad and the death chamber was too dimly lit for staff to monitor their procedures. the judge said he is allowing it to proceed because a supreme court ruling upheld lethal injections in kentucky and because ohio and washington state also have had 1 drug lethal injections for a year with no reported problems. that even as he presides over a lawsuit challenging the very same procedures. brown had a choice by noon yesterday to choose either a one drug injection or a three drug cocktail. he did neither. coming up we are going to tell you how the prison officials here at san quintin right now appear to be the only ones that could stay the, excuse themselves in a manner of speaking. live at san quintin, kraig

lasts. pg&e wants you to conceive energy to prevent another heat related outage. more than 30,000 customers lost power on saturday because of a system overroad. they recommend setting your air- conditioners around 75 degrees when you are at home. >> we have new information this morning about efforts to force drivers to hang up their cell phones altogether. paul chambers joins us from the bay bridge toll plaza with the details. >> reporter: good morning. pam i actually moved around. we are here on 880. we got to tell you guys that. but i tell you what people do this every day, drive while talking or texting on their phone. some states already have that law and in many states it is illegal to text while driving. however no states have banned

using cell phone and cars altogether but the national safety council wants to change that. over the weekend safety organizations met in kansas to discuss this matter, however some consider the governor's highway safety association the leaders on the issue, and that group said at this time they will not join forces with the national safety ciewps for a total ban l ban on cell phone usage but this isn't a done deal. they safety council is still supporting this issue and they are willing to look at this in the future so as of right now it is still pretty safe to use your cell phone in the car but make sure you have it hands free and, of course definitely not text in our state. live in oakland, paul chambers, ktvu channel 2 news. >> 5:05. hey, sal, anything happening out there? >> yeah, not too much.

communications technology is getting so sophisticated government spies are struggling to keep up. as more people communicate on line instead of by phone the feds say their ability to wiretap criminal and terrorism suspects is going dark. so the new york times reports today that the obama administration is going to ask congress to okay legislation that will make it easier for the government to eavesdrop on internet and e-mail communications like social networking sites and blackberries. it wants all on line services technically equipped to comply with a wiretap order. now internet privacy groups say the legislation would have huge implication but the feds are pointing to a he cent high profile terror attempt they say could have been stopped much sooner. i will have more on that during my next update in an hour. live from washington, d.c., alison burns, ktvu channel 2 dmus. >> we are now learning about a

book burning at the pentagon. the defense department says it bought and destroyed all 10,000 copies of operation dark heart because it revealed military secrets. the book was written by an army reserve officer about his special opens mission in av a. the publisher has since changed some sensitive information and is sprinting a second edition of the book. >> efforts continue this morning to win the release of two remaining uc berkeley grads jailed in iran. an iranian newspaper says a delegation from yeoman is expected to visit to fight for their release. they were key players in getting sarah shourd released earlier this month. we are following conflicting reports about an incident on the border between iran and iraq over the weekend. iranian tv says the iranian forces crossed into iraq yesterday and killed 30 kurdish

fighters. iran accuses kurdish rebels of a bombing attack last week on a military parade in iran that killed 12 women and children but a spokesmen for the kurdish rebels said there have been no recent battles with iranians. >> today israelis are once again building settlements in the west bank. a 10 month moratorium expired yesterday. some israeli settlers immediately started building again. palestinians have threatened to walk out of peace talks with israel if the building resumes. a top house democrat is criticizing comedian steven colbert's appearance before a congressional committee about undocumented farm workers, majority leader stan hoyer says colbert's testimony, loaded with jokes and saturday catch was inappropriate. >> what he had to say i think was not the way it should have been said -- [overlapping speakers] [ inaudible ] >> -- issues, he should have given those issues and -- you asked my personal opinion.

>> colbert recently spent a day working alongside farm workers as part of a campaign by the united farm workers union and was invited by bay congresswoman zo love gren to testify about his experience. >> 5:14. well as the two candidates go governor get ready for their first debate tomorrow there is a new poll that shows jerry brown with a narrow lead over meg whitman. the poll found that 49% of likely voters said they would support jerry brown compared to 44% for meg whitman. again the first debate between the candidates takes place tomorrow evening. you can see it exclusively live right here on ktvu channel 2 beginning at 6:00 p.m. >> today supervisors will consider banning toy give-aways and fast food restaurants.

moving well. here is steve. >> over by the coast you have to deal with thick fog right along the coast. so hot for some today. 90s and 100s after everything is said and dope. by the coast 70s and 80s, maybe on highway 1 you might encounter reduced visibility. the fire danger goes up today even though it is a big old guy high pressure coming in. not really a northeast wind. we do get a northeasterly breeze. watch the big system to the left of your screen deepens and fires up the ridge right over us so it is going to be one of those hot ones away and the fog is very very shallow, but it is there. inland though it is in the 100s so nice for some, warm to hot. could have a 40 degree spread on these temperatures, 58 san francisco, 63 oakland-berkeley, 62 san jose, upper 50s many, santa rosa napa 51.

won't say in advance if there will be a strike after the san francisco business times says there could be a strike this week at the hilton union square. the union has held short term picketing at several major san francisco hotels this year. workers at 60 major san francisco hotels have been working without a contract since august of last year, no new talks are scheduled and hotel management is not commenting. we may hear details today of the state budget deal worked out by governor schwarzenegger and legislative leaders. the big five stayed quiet over the weekend about the negotiations but last thursday they said they had reached a tentative agreement. the group has been meeting in the governor's southern california office. they said they would be back in sacramento today to unveil the details. >> all right. 5:21. go back over to sal. we understand there is breaking traffic news, sal. >> that's right, it is police activity. this is in berkeley, east 80, at ashlee avenue. this is after a chase, a short

bodega highway. fire officials say he is doing a lot better but still in a san francisco hospital. he was hurt when he came in contact with a downed power line. that fire destroyed one outbuilding and two cars. this morning oakland police are searching for the gunman who shot and wounded two people. this happened last night right near the intersection of 102nd avenue and pippen. investigators say the man fired several shots at the two victims then ran away. both victims are expected to survive. still not clear what led to that gunfire. >> a lawsuit will be filed today on behalf of the family of an inmate who died in custody at san francisco's hall of justice. 31-year-old joe cy a downs died last september. according to the medical examiner's report sheriff's deputies cuffed shackled and subdued him after a struggle. after the restraints were removed he stopped breath inch.

really hot for some, let's get to the highs, there they are. once you hit 100 what difference does it make? it is hot. i told you it is hot. napa 98, santa rosa 98. now the coast, 70s, 80s to maybe near 90. here is sal. >> all right. steve, right now traffic is affected by police activity. the fire department has now arrived. it was a crash that ended up in an injury crash, east 80 near ashby avenue. the two left lanes are blocked. this person was trying to escape from police apparently and got into an accident. it is going to be there for a little bit but it is not effecting traffic in the westbound direction, which is the commute direction and eastbound still three lanes to go so there is a slow down past the scene but nothing major. this is a look at the westbound bay bridge, that traffic moves well. at 5:30. back to dave and pam. >> there will be a new attempt to block california's first scheduled execution in almost five years, albert greenwood

at the granada residence hotel. when the officer contacted the hotel resident pools say he displayed a weapon forcing the officer to shoot. people living there had this reaction. >> i feel concerned living here, it is a very unsafe place. yeah, i don't like the place at all. i am getting out of here as soon as i can. >> for officers were hurt and police have not released his name but neighbors tell us his name was michael lee and he was 40. >> three people robbed a ha salon. investigators say were wearing dark hooded sweatshirts and white masks when they robed the workers and customers at gunpoint. luckily no one was hurt. investigators in contra costa county are searching for a door to door carpet cleaner. now they are calling him a person of interest in the

sexual assault of a woman living in the apartment complex near walnut creek, a white man 6 feet tall between 20 and 30 with a full bird. b e a r d . >> people hope tape will provide clues in a terrifying robbery at a jewelry store. investigators say 3 hooded men burst into the store and immediately used pepper spray on the employees and customers. witnesses say they then used a sledgehammer to break open the jewelry cases. >> well it all happened so quickly, personally i was in the office, an employee came through the door with the phone, she grabbed the phone she said a little bit about pepper spray and she was calling 911. >> no one was seriously hurt. the three robbers got into a white sedan with a get away

driver at the wheel. >> 5:33. the public will have a chance to weigh in own san francisco's proposed crack down on kid's meals today. jade hernandez joining us now with a look at why the city's plan is so controversial. good morning, jade. >> reporter: good morning. when you think of toys and kids meals one might immediately think of happy meals but this ban is not specifically targeting this fast food chain. we are live in san francisco this morning. san francisco's crack down would encompass toys in happy meals. other fast food chains and even local restaurants. the industry has been lobby is hard against banning them outright but the city wants to make it illegal for kids meals to come with prizes if the food exceeds city set limits on calories, fat, salt and sugar, it requires meals which come with a toy to contain sphriewt and veggies, but all us negotiable at this point. many fear government regulation

has gone too far. a voice of opposition even coming from within city hall. mayor gavin newsom. according to a spokesman he says dick taiting what plastic toys can be put in a cardboard box is not the right way to achieve that. santa clara has adopted a similar law but only covers unincorporated parts of the county and effects only four businesses. the first public hearing on this issue in san francisco is scheduled for this afternoon at 1:00 p.m. at city hall. reporting live in san francisco this morning, jade hernandez ktvu channel 2 news. >> 5:35. let's go back over to sal and check in on traffic, sal. >> that's right. we are still watching that police activity east 80 at ashby avenue with the two left lanes closed. it looks like we still have fire crews on the scene and a tow truck for this vehicle that was involved in a high speed chase. it looks like may have run into that guardrail there but the two left lanes are closed east 80 at ashby. west 80 is not effected. the traffic continues to move

along well. also this morning's commute at the toll plaza is getting busier, not stop and go just yet but some busy traffic here already. and this morning's drive in san francisco along northbound 101 looks good approaching the 80 split. at 5:35 here is steve. >> thank you, sal. well the tough challenge today is really along the coast and in san francisco you could go from 68 to 84 in san francisco alone. there is a hint of a west wind on the immediate coast. i looked at 20 oiivevation san francisco there is not much wind, temperatures 50s and already 60s for some, by the coast 70s and ini 80s, inland it won't matter. thick fog hugs the coast but there is a big boy high building in. you can see like the ammy fix, like the teeter-totter effect right there. make just too darn hot for some of you or just right. 70s again temperatures just even a mile or so away could be a huge difference but around the bay 90s and then inland 90s and low 100s, 80 at mt. tam

right now, five degrees warmer than sunday morning, e mean that is warm air aloft. which a lot of that fog has been smashed down to 200 feet. the marin district 55, i have seen upper 50s low 60s in the city. stanford 55, pleasanton 56, vallejo at 60. 30s mountain, 50s, 60s, 70s l.a. or san diego sitting at 70 degrees. that low deepens in the gulf of alaska and fires up the high pressure system over us, sunday we had that. today the 100s inland but still 70s, 80s by the cost. so nice by the coast. hot away. patchy fog over there that should get wiped out later today. 70s, 80s, for some 90s around the bay and inland 90s and low 100s, we start a trend and take it down thursday into friday.

>> time now 5:37t it looks like charter schools are handling california's budget crisis a little better than traditional public schools. a new report says almost 90 new charter schools will open their doors this year. many charter schools have reduced their expenses by hiring newer teachers who earn less money and most charter schools aren't bound by teacher union contracts and have more flexibility with their budgets. this morning san francisco mayor gavin some and school officials will announce they have received a $3 million grant to help students finish college. the bill and melinda gates foundation will give a million dollars a year for three years to help finance program to help students get ready for college and get their degrees. san francisco was chosen because of high levels of cooperation and communication between city and school officials from kindergarten through college. >> well, some armed men in black created some tension moments at a major bay area

their homes. the river is cresting about four feet over the flood level and is leaking enough water to flood a major roadway into portage. the river it's swole especially because of all the thunderstorms last week but the water is expected to recede on wednesday. a lot of residents evacuated until the water goes fully back down. in chile the first of three rescue capsules have arrived at that mine where 33 miners are trapped underground. the so call phoenix capsule is designed to hold a single miner at a time and just wide to be sent all the way down and pulled back up an escape item and has yitsd own air supply and an escape hatch. the government is hoping to free them by early november. >> the pastor of a mega church in georgia made his first public comments from the pulpit about sexual misconduct allegations against him. bishop eddie long spoke before
