have a great monday. . this is new york's number 1 news, channel 7 eyewitness news with lori stokes and ken rosato, heather o'rourke with traffic, and bill evans with the exclusive accuweather forecast. now eyewitness news this morning. breaking in ferguson, missouri, gunfire erupts between police and a suspect at protests marking the anniversary of the death of 18- year-old michael brown. one person is in critical condition. eyewitness news is live with the details. >> here at home, another person has died from legionnaire's disease. today mayor bill de blasio has an update on the outbreak. >> brazen burglar wanted for sneaking into a home snatching luxury items from gucci to wedding rings.

the a and c trains will be running via the f lines until 5 a.m. that's because of that work they're doing there. long island railroad, new jersey transit on or close. metro north, waterbury branch have that bridge work in bridgeport. and the deegan northbound side 183 street to yankees stadium, that's a long-term construction project. in the car lanes you do have an accident. thank you so much. we are following breaking news out of missouri. one person is in critical condition following a police- involved shooting that happened in ferguson. >> it happened at an event where hundreds gathered to mark michael brown. eyewitness news reporter toni know. >> the one of year anniversary of michael brown's death began with peace, his father calling for calm and if hours that is exactly how it was until late last night. gunfire, injuries, protestors

facing off against police, officers returning gunfire, and they were fired on by one man. this is happening as the police chief was speaking to reporters. >> we want to be as patient as possible. >> that was just after 11 last night that that chaos escalated to this point. at a press conference this morning, officials say he ran around a building and turned and began firing. the officers returned fire hitting the suspect who is in critical unstable condition. st. louis county's police chief says in all during that violence at least 50 shots were fired in two separate incidents. one he called a clash between two different faction of protestors. >> there is a small group of people out there that are

intent on making sure we don't have peace that prevails. i don't know how else to say that. >> this is how that sunday observance began with michael brown's father leading a march. the group was formed in the wake of michael brown's death august 9th last year. he was unarmed when he was shot and killed by a white officer. the officer involved in the shooting last night have been placed on administrative leave. demonstrations took place here in new york city as well. the nypd says there were multiple arrests outside the barclays center in brooklyn people silently laid down on the ground for four and a half minutes. this symbolized the roughly 4 1/2 hours brown's lifely body was on the street in ferguson. many protestors say they want a different kind of policing. >> it takes us continuously being out here, continuously

talking about it and bringing awareness to every single solitary person that has been killed. >> demonstrators in union square in manhattan as well, a large banner had pictures of people protestors say were murdered by police officers. a new analysis says 24 unarmed black men have been shot and killed by police this year alone. we're seeing new images this morning of a texas teenager shot and killed by a police officer. surveillance pictures show is the-year-old christian taylor at a car dealership early friday morning where police say he was caught standing on cars and kicking in windshields. the police officer responding to the scene used a taser on taylor before shooting him multiple times. taylor was not armed. the fbi is assisting into the investigation of the shooting. this morning sports fans are remembering the life of a legend, frank gifford, an

important part of new york city sports history died sudden ly at the age of 84. he was a sports anchor at eyewitness news, one of the hosts of monday night football. he's still very fondly remembered here at abc. >> frank gifford was an exceptional man who will be missed by everyone who had the joy of seeing his talent on the field, the pleasure of watching his broadcasts or the honor of knowing him." . eyewitness news reporter lucy yang has the city's reaction from the upper west side. >> my father was a big fan of his. in fact, he named me -- my nickname was the giff growing up. >> after him. >> after frank gifford yeah. >> from fans who adopted his name to fans who considered frank gifford a must watch every monday night, the sports hero and sports caster was

i remember meeting him at an abc event years ago. he was as charming and friendly as ever. on the upper west side lucy yang channel 7y eye. >> thousands of people have been reading about frank gifford on social pages and our website. you can find more details plus some amazing photos chronicling his life at abc7ny. new this morning, we have video of a burglar who spent his saturday night ransacking a brooklyn apartment. here is a look at the man police are trying to find. he broke into an apartment at sheeps head bay and got away with $4000 in cash, six gucci watches. he also grabbed some earrings and three wedding rings. two serial rape and robbery suspects are in jail. police took joey cruz and isaiah rivera into custody. they're accused of luring at least three women online to meet them and attacking and

sexually assaulting them. they also robbed their victims. one of their accomplices was arrested friday. mayor bill de blasio is expect today hold a press conference introducing new legislation. officials have confirmed another case of legionnaire's disease. officials say there have been no diagnoses since last monday. also, no new contaminated cooling towers have been defected by workers test -- detected by workers testing buildings. the governor says he wants to establish a statewide registry of buildings with cooling towers and a system of regular inspections. ten people have died since outbreak started in the south bronx last month: 4:39 right now. in dutchess county the search resumes for a kayaker who's missing in the hudson river. 32-year-old ian jones and his girlfriend tali fruchtmann were

a cleanup is underway in south dakota where a storm left large pieces of hail. severe weather hit several states. the central plains saw tornadoes with twisters spotted in nebraska and kansas. >> scary stuff. nothing like that here at home thankfully. it is 4:45. meteorologist bill evans joining us now with the exclusive accuweather forecast. look at gotham tonight. >> very nice this morning, yep, we're looking at a pretty morning, just a couple of clouds around. clouds. that's the intersection of 5th avenue, central park south right there. the morning has a nice temperature to it, 72 degrees and a humidity kind of in the moderate to low area. 68% for the morning hours. got a southerly wind and the

pressure right at 30 which is our mark of fair weather. yesterday's high 85. what a nice day on sunday. humidity. it was a great day. 8:01. muggier day. you'll feel a little more humidity west of the city in western jersey could be a shower that pops up. the drenching rains and storms come in after midnight. showers and thunderstorms for the commute and through the day. they'll be slow moving. they could be capable of producing heavy downpours of rain that could produce flooding around the area. a uv index of 9. a lot of sunshine. the pollen count is moderate. mostly grasses and nettle. that's because heather's been growing chenapods at her house. hauppauge 62, 59 towards east hampton 71 newark and 55 to 65 monticello to poughkeepsie. a 10-degree spread.

a calm wind this morning to a southerly wind around. it's going to feel great across the area. today a lot of sunshine, clear skies, there are those showers back to our west. this band of right here, this band of right here, that starts to march eastward and that gives us the rain tomorrow. simply you'll see on our futurecast this afternoon one or two showers pop up in here around morris county west of the hudson river valley, even maybe dutchess county in here and by tomorrow, 6 a.m., 7 a.m., we've got heavy rain tomorrow into the afternoon, into the evening. there could be a leftover shower as we go into wednesday. we've got a beautiful day today. we're looking at sunshine. we're looking at cloudy skies coming in tonight. we're looking at the showers and thunderstorms starting after midnight. showers and thunderstorms will be heavy tomorrow morning and then again in the afternoon. there might be a leftover shower on wednesday. the rest of the week is looking good. then we get into the weekend. it's hot. on saturday.

they're going to go after the death penalty. reporting from houston, tracy clements channel 7 eyewitness news. to colorado now, the toxic yellow sludge from an abandoned gold mine is still flowing south contaminating rivers. it has already stretched more than 100 miles shutting vacation spots and killing business. the epa says the brew of heavy metals will not harm wildlife but the epa is under fire for waiting 24 hours to notify state and local officials of the spill. it turns out the release is 3 million-gallons and growing. that amount is three times what 4:51. a new nonprofit research center is promising to be the voice of science about healthy lifestyles, but critics say the global energy balance network is being funded by coca-cola to obesity.

an unarmed black teenager. toni yates joins us live in the newsroom. >> reporter: yes, you know michael brown senior asked that the day remembering his son's death be peaceful. that is how it was during the afternoon but as night fell shots were fired and violence took over. what you're seeing in this video, police and reporters ducking behind cars. police trying to get civilians to safety as those shots rang out. two different groups of protestors began firing at each other as police tried to regain calm. at least two cars were hit with gunfire. this morning one man as you said is in critical unstable condition after police shot him. this is after officials say the man fired on an unmarked police van with four officers inside. none of the officers are hurt. there is word others may have been injured during the violent end to this day. >> several shots rang out, i'm

guessing 40, 50, probably over 45 seconds. i can tell you that it was a remarkable amount of gunfire. >> the brown family set the peaceful tone that began that day with a moment of silence at the spot where 18-year-old michael brown was shot and killed by a white officer august 9th of last year. officer darren wilson resigned but was not indicted. marchers passed a memorial for brown where his father stopped and said miss you. now police have not yet given any numbers on arrests. the detectives involved in that shootout with the gunman are on administrative leave as a back to you. thank you. new this morning, a tragic situation on a brooklyn veto as a man was hit and killed by a car. it happened along atlantic avenue in cobble hill. a 66-year-old man was trying to cross atlantic avenue at clinton last night when he was hit by mercedes. hospital. the man who was in the

crosswalk at the time described the horrific scene. >> the car hit him. he went up in the air about this high, and then the vehicle over there on the windshield, the car caught him again and flipped him up a little higher. >> the driver stayed at the scene. filed. witnesses say the victim was a store owner that area. all right. michelle, 5:05. happening today, a new push toward finding solution to end the legionnaire's outbreak in the south bronx and an effort to prevent future outbreaks. eyewitness news reporter kala rama is live with us right now from city hall. >> reporter: shirleen, the mayor says it's time to roll out new legislation because basically nothing is working. the mayor says this is contained and he wants it to stay that way. let's take a look at the numbers just released here. there are 109 people reported with legionnaire's, 76 individuals have been treat sod

for a and discharged. ten people have died but everyone who passed were adults with underlying medical conditions. according to the mayor everything about tackling this legionnaire's outbreak has been a learn as you go system. they didn't have a comprehensive list of cooling towers in the bronx which is basically where the bacteria can breed. over the we could the governor stepped in -- over the weekend the governor stepped in to test more buildings in the bronx. let's listen to the governor. >> a few days ago i said that the state would test for free any cooling tower. that increased the number of cooling towers that were asking for testing, so i think we made good progress. i think we are ahead of it now. unfortunately ten people have died. over 100 people have gotten ill, and that is the sad story here.

>> and the mayor's agreeing with that, so today he's going to hold a press conference around 12:30 at city hall. he'll talk about the new legislation and provide an update on the latest numbers of legionnaire's here in the city in the bronx and of course we will be there. live in lower manhattan, kala rama channel 7 eyewitness news. 5:07, drones continue to create scares in the air for pilots navigating the skies in our area. >> we just saw the drone at 3,000. >> chopper 1637, saw the drone. >> 3,000 feet was 400 off our left wing. >> that's one of four commercial pilots who spotted a drone as they landed yesterday at limited regulation is creating lots of concern. >> it's a new thing. it's like the internet when it first came out, people didn't know how to police it.

both girls are charged with attempted murder in adult court bars. prosecutors say trying them in juvenile court would take away crime. the victims survived after being stabbed 19 times. we're following the latest developments out of texas where police continue to investigate the horrific murders of six children and two adults. 48-year-old david conley is facing capital murder charges after being arrested late saturday night. investigators say an official with texas child protective services had previous contact with that same family, and police say one or two of the children killed in the houston area home may have been conley's own children. 5:13. right now emergency crews in northern california are battling yet another wildfire. this is amateur video of the new fire north of napa valley called the jerusalem fire after a nearby road.

people out there that are intent on making sure that we don't have peace that prevails. i don't know how else to say that. >> well, take a look at this because this is how it began sunday with the observances with michael brown's father leading a march for peace with the community and having prayers with the members of black lives matter. that was a group formed in the wake of 18-year-old michael brown's death august 9th of last year. he was unarmed when he was shot and killed by white officer darren wilson. he later resigned. the officers involved in the shooting last night have been placed on administrative leave. they were wearing bullet proof vests and were not hurt. thank you. and the demonstrations stretched from ferguson to the tri-state. the nypd says there were multiple arrests across new york city. outside the barclays center in brooklyn people silently laid down on the ground for four and a half minutes.

standing on cars kicking in windshields. an officer used a taser on taylor before shooting him. the fbi is assisting into the investigation of the shooting and that officer is on routine administrative leave. we have video of a burglar who spent this saturday night ransacking a brooklyn apartment. here is a look at the man police are trying to fine. he broke into an apartment in sheep's head bay, $4000 in gucci, six gucci watches. he also grabbed earrings and three wedding rings. two serial rape and robbery are in custody. the men are accused of luring at least three women online to meet them and then attacking and sexually assaulting them. police say the suspects also robbed them. one of their alleged accomplices was arrested on friday. in dutchess county, the search resumes for a kayaker

welcome back, 5:43. new this morning, a suffolk county family is safely on dry land after their boat sank off the south shore of long island. this picture shows a police marine boat pulling the sinking vessel out of the water. officials say the engine stalled with a family of five on board including two children. a passing boat happened to have three volunteer firefighters on board. they helped pull the family to

safety and called police. 5:43 right now. the toxic yellow sludge from an abandoned colorado gold mine is still flowing south contaminating rivers. it has already stretched more than 100 miles shutting down vacation spots and killing business. the epa which accidentally caused the disaster now says the brew of heavy metals will not harm wildlife. the epa is under fire for waiting almost thousands to notify state and local officials of the spill. it turns out the release is 3 million-gallons and four times what the epa first reported. bill evans joining us now with that gorgeous accuweather forecast on top for today. >> we've got one more nice day before we get showers and thunderstorms. sun's coming up. it's officially up just after 6:00, 6:01 this morning.
