thompson isn't taking any chances. i can't keep my children in there because they don'tno if somebody else there has it. >> reporter: he plans to keep his children at home until a health vaccine is available. >> today the government is going to allow states to begin ordering the h1n1 vaccine. >> reporter: it's unclear when it will be available. >> defendant me parker is the second child in maryland to die from the h1n1 virus. dr. an drez alonzo issued a statement expressing sympathy. he goes ahead to say that the schools will take appropriate he precautions, cleaning, disinfecting and enforcing good hygiene in an effort to prevent any other deaths. how bad is swine flu compared to seasonal flu? we tried to put the numbers in perspective. every year about 36,000 people died in the u.s. from the seasonal flu. this year the cdc predicts 30 to 90,000 people could die from swine flu and children are among

the most at risk. in a typical flu season about 60 children die from seasonal flu. already this year since april, there have been at least 50 child deaths from swine flu. about 2/3 of those children, though, had other medical conditions. health officials are urging people to get the h1n1 vaccine when it becomes available, but a consumer report poll shows that many parents are on the fence about the vaccine. only 35% say they will definitely have their child get the shot. 14% say they won't get their kids vaccinateds and half said they will hold off on making that decision. for more information, you can call the state swine flu hot line, that number 1877md flu for u. and stay tuned to fox 45 morning news for continuing coverage of this story. we will talk with secretary john

introduced evidence of legislative acts. as of right now, mayor dixon will go on trial for allegedly stealing gift cards from the needy, that happens in six weeks. a host of new laws take effect today including two focusing on driver's safety. it's no longer legal to text while driving, and if you're speeding in some school zones, an officer no longer needs to be the one to catch you. joel d smith is live in northeast baltimore with the details. good morning, joel. >> reporter: good morning, patrice. i'm actually going to send you a text right now, which is legal, and had a is fine. but if i was in a car sending you this to you, it could be a fine. that is because of this new law in effect today. it could be up to $500. the key is, police have to see you do it, which is unlike the other law we are talking about today, which is the speeding cameras. this is an intersection out in front of glen mont school. they are being retrofitted with a lot of cameras that already

exit. 51 of them the red light cameras. the cameras are near schools for safety sake, and based on crash data and areas known for speeding. that is why people say it's more than about safety and money, making money for the city. the texting ban it is being criticized because of the problem with enforcement. it's okay to play games, and post on the internet and even read text. it's illegal to send them. we asked how the law will be enforced. >> the officer if he has the suspicion, he can pull you over. if you're a driver, you probably shouldn't text or read a text during driving, because a driver based on what you are doing, looking up and looking down at the road, he can pull you over. >> reporter: as for the cameras they must be placed within a half mile from the school zone. that is the official focus to get the people slow down around the kids. some say it's just to make mon hey anmoneyand millions of reves

way on the southbound lanes and that i same deal in the northbod direction, heading to 695. on outer loop taking the lanes, nothing to disturb your ride. to 795. the west end. , we haven't seen any problems, but we are starting to see a lot of cars filing there, toward 70 and a carbon copy of that traveling through catonsville all the way down toward 95. on 95 moving through howard county route 32, you can see the volume picking up. so far the cars are traveling at getting dirty

the country and may be a model for of the rest of the nation. sherri lee has the details. >> reporter: matthew english works at a small bakery delivering bread in one of the richest country in the nation, but he earns only $17,000 a year. >> there's not much money in the bread business. >> reporter: he couldn't afford health insurance. >> every time you hit on the brakes, you think that could have been it. >> reporter: this year he enrolled on the experimental program created by howard county maryland. the plan provides emergency and inpatient care through howard county medical hospital and access to a network of specialists. >> we reduced the need for healthcare. >> reporter: many who initially applied qualified for state or federal programs but didn't know. the county ended up with about 400 members. they pay 50 to $85 a month.

han honor's high school have made it public that a student who goes to school here does have swine flu. the school will still be open here today. many parents are worried about this recent case and they are concerned about the recent death of a student who went to school just down the street from here. on tuesday night, destiny parker died in hospital. she was a student at montbello elementary and middle school here in northeast baltimore. parker is the second child in maryland to die from the h1n1 virus. health officials do not believe that she had any prior medical problems. her death is the 5th here in maryland. others are sick with the virus, news that has parents on the edge. >> my oldest daughter is terrified. i had to talk to her this morning and let her know that everything is going to be okay. >> this is a disease that is spreading in our community. >> reporter: some parents have decided to keep their kids at home until a swine flu vaccine is ready. we are told that the federal

government is now allowing the state to begin ordering the h1n1 vaccine, but at this point it's unclear exactly when it will be available for you. in the meantime, baltimore he city ceo andres alonzo has issued a statement for the recent death and the cases that are popping up. he goes to say that the schools around the city are taking precautions in teaching about washing your hands and that kind of thing and making sure that the schools are clean and disinfected to try to prevent another death and another sickness from happening again. i'm megan gilliland, fox 45 morning news. maryland isn't the only state dealing with the swine flu, 26 states, the ones in red also have widespread flu outbreaks. 60% of the tested cases in those states turned out to be swine flu. most of the cases are in the southern half. country. a family in fort worth texas is questioning some of the advice concerning medications. 14-year-old cloe lindsay died on

hour. police spokesman anthony gluliami confirms that major roger bucheron is on leave without pay. he doesn't know why he was stripped of his duties, but the decision was handed down by police commissioner bealefeld. he has been the director of the department and has been in charge since december of 2007. deputy major harris has been named interim commander of the area. budget cuts are forcing the closure of a popular senior center. residents found that the harper senior center that serves 400 visitors will close on october 31st. the center has been around for decades and it's more than a gathering place. for many it's like home. it provides flu shots, and

provides lunches for $1 a day. but the city says the money is not in the budget to keep it open. >> it's not just about us. it's everybody in this area and there's nowhere else for them to go. >> it's going to be sad. i don't want to breakup. >> seniors plan to write letters to city and state leaders to keep the center from closing. what a difference one day makes. yesterday drivers could drive and send text, and even get away with speeding without getting caught, but today is october 1st and two new laws are in effect that could change that. joel d smith is live in northeast baltimore with more this morning. good morning, joel. >> reporter: good morning, patrice. i feel like i'm being watched and specifically it's not me, it's drivers and there's those out here out at glen mont, elementary school. that's point. they want things to be safer through here. they're already being placed at

the spot where red cameras exist. they're retrofitting that right there, to get speeders and red light runners at this intersection. by law the cameras must be placed within a half a mile of the school zone. that is the official focus, getting people to slow down around where school children potentially are more prevalent. the sites are being selected based on crash data known for speeding. that is why people are being critical, it's not just about safety but making money for the city and getting the biggest bang for the buck. >> we can't be everywhere and these cameras are from a supplier and they can stand silent watch and be vigilant and hopefully they don't issue a single ticket. >> reporter: the other big change for maryland drivers is texting. no longer legal to send a text while driving. drivers are more likely to be in a crash if they're texting. it will be up to a 500 fine if

as of today texting while driving in maryland is against the law. if an officer suspects you're sending a text, you can be fined up to $500. the question is, how will that be enforced. the talk show host ed norris joins us for this week's fox undercover, good morning. >> good morning. >>all right you can't write and send a text. you can still read your text and dial your phone, do e-mail and play games on your phone. that is not covered under this law. how are the officers going to know what you're doing? >> first of all, common sense, you shouldn't be texting while driving. a police officer was killed in

>> my older child is terrified. >> reporter: a 14-year-old classmate is the latest swine flu fatality. >> this is a disease that is spreading in our community. >> reporter: nine people in maryland have now died from the h1n1 virus, two of them children. and health officials do not think this latest victim had any prior medical problems. >> there was no apparent other condition that aggravated it, but that is pending further investigation. >> reporter: many parents at montbello aren't sure if they should send their kids to school or keep them at home. >> at this point i don't know what to do. i don't know if i should take them home. a lot of parents are taking their kids home. i don't know. >> reporter: javon thompson isn't taking any chances. >> i can't keep my kids there, because they don't know if anybody else there has it. >> reporter: he plans to keep his kids at home until a swine

ceo andres alonzo has issued a statement for the recent case that is are popping up. he says that the schools are taking the precautions disinfecting and making sure that the students are aware of washing their hands and covering their mouths. i'm megan gilliland, fox 45 morning news. a study by the cd dc shows many people dying from the swine flu had other bacterial infections. 29% had cobacterial infections. about half were pneumonia. the cdc says doctors may have missed detecting these infectionses in swine flu patients. >> for that reason, the cdc adding one more shot of the recommended vaccines. people may want to think about getting vaccinated for pneumonia. about 70 million people are at risk for infection, including those between 18 and 49 years old. those are the prime ages for swine flu.

same location. the two are retrofitted, that really is the focus to try to keep things as sai a safe outsif the schools. the sites are being selected based on crash data and areas known for speeding. well, that has some people thinking, it's not just about safety, it's also about making money for the city and getting the best bang for the buck. >> we can't be everywhere ask these speed cameras are for a small supplier for the baltimore city police department. they can stand silent watch and being vigilant and hopefully they don't issue a single ticket. the other big change for drivers today texting. no longer is it legal to send text while driving. text show that drivers are twice as likely to be in a crash if they're texting while driving. you are still permitted to receive text or even play games while on your phone.

maryland is the first to enforce a ban of texting while driving but enforcement could be an issue. as for speeding, you're 12 miles per hour from the posted speed limit you're looking at a $40 fine. you will get a warning for the first 30 days, but after that you will get a ticket. the other thing you don't want to do is send a text to somebody while you're mad. you will face another fine there up to $500. plenty of other new laws also take effect today. there are harsher penalties for duis and for people who are found giving alcohol to minors. judges will have more discretion when it comes to taking the guns out of hands of domestic abusers. maryland becomes the first state to include homeless in hate crime statutes. that is as of today. president barack obama is flying to denmark to help push chicago as host city for

child is hospitalized and indeed there's h1n1, there's h1n1 is widespread. our fire surveillance systems are picking up people reporting to hospitals with flu-like illnesses and showing up at physicians offices. >> let's talk about the young girl at montbello where everybodis soconcerned because a fayfatality with her. there's reports that she had pneumonia and there were other reports she didn't. >> there's no parent underlying health condition preexisting with this child, but i say no apparent, and the investigation will continue to that. >> that makes it even scarier for the parents of all of the other students in that school if she didn't have anything. what is important for the parents to any. know. >> it's important to know that even with seasonal flu, there's rare cases where people don't

have preexisting health conditions and they can have serious illness and dying. the best protection people can take for the flu are as follows, preventing it from happening, first and foremost would be the vaccination and that will become available later on this month. it's beginning now and will ramp up over the course of the next several weeks and also to practice good hand hygiene. wash your hands frequently. i know it's hard with kids to get them to do that that is the eelbow if instead of the the hih 5. if you're sick, stay home. it's a way of stopping the spread of the disease. how do you alleviate parent concerns about the vaccine itself. they say it's new. i'm not sure i want to exp expoy child to this. >> that's a get question and from the clinical trials that have been, and some of those

flu, so particularly among children, they pass it among each other. they don't practice good hand hygiene. they sneeze and so forth around each other, so it can be quite infectious. so keep an eye on your kids. if they begin to show signs of disease, particularly if they have a fever, a cough or sore throat, keep them away from school. if they become more ill make sure that they go to see a physician. i would urge you to take the vaccine when it becomes available. >> let's go to our next caller susan, good morning. >> susan. >> yes. >> hi, good morning, what is your question. >> i am the grandmother of two toddler boys who live in maryland. my daughter has decided she does not want to get them the vaccine and the reason she is telling me is that she has done research on the internet and there are extremely high levels of mercury in this vaccine. is that true?

dies from swine through there's another confirmed case of the flu down the street. according to the website baltimore city college high school, one of their students has the virus. you can see on the map how close the schools are, about half a mile apart. now parents and health officials are on alert. destiny parker is the second child in maryland to die from the h1n1 virus the health officials do not believe she had any prior medical problems. after news of her death and the new confirmed cases of baltimore city college, some parents have decided to keep their kids at home until a swine flu vaccine is ready. >> my oldest child, my daughter is terrified. i had to talk to her this morning and let her know that everything is going to be okay. >> this is a disease that is spreading in our community. >> now we are told that the federal government is now allowing the state to begin ordering h1n1 vaccine, but at this point it's unclear when it will be available.

a study by the centers for disease control shows many people dying from the swine flu also had other bacterial infections. out of 77 patients who died from h1n 129% had cold bacterial -- 29% also had cold bacterial infections, many pneumonia. for that reason the cdc is adding one more shot of the list of recommended vaccine. they say people may want to think about getting vaccinated for pneumonia. about 70 million people are at risk for infection, including those between 15 to 49 years old. those are prime ages for 29 flu. health experts are urging people to get the swine flu vaccine when it becomes available. a poll shows that many parents are on the fence about the vaccine. 35% say they will definitely have their child get the shot. 40% say they won't get their kids vaccinated.

half of the parents asked, say they are going to hold off making that decision. for more information, you can call the state swine flu hot line, the phone number is 1877-md-flu-for u. a host of new laws take effect today, including two focusing on driver safety. it's no longer legal to text while driving. if you're speeding in school zones, an officer doesn't need to be the one to catch you. joel d smith is live with the details. good morning, joel. >> reporter: good morning, megan. if i wanted to text somebody right now, that would be fine, but if i did it while driving, it would be a fine starting today and maybe up to $500 worth. that is one of the new laws, but the thing with that one, you have to be caught by police officer doing it. that is different from another law today where the police really aren't involved. it's that camera that you see over there. those are the red light cameras, now there's speed light cameras

as well. there's all over maryland and they're legal. many of those are around the school zones. we are at glen mont school. they are used on crash data. that's why some think it's not just about save het safety, buto about making money for the city. it's still legal to play games and post notes on the internet except to send text. we are wondering how enforcement will work. >> the officer if he has a suspicion, he can pull you over. so if you are a driver, you probably shouldn't text or read a text during driving, because an officer based upon what you're doing, looking up, looking down at the road, you can tel pull you over. >> reporter: now as for the cameras, they must be placed within a half mile from the school zone. that is the initial focus to get the folks be safer around the

bring us showers for saturday. here is showing the western counties getting the chance for the showers for late tomorrow night around 9 or 10:00. then the frontal boundary will continue to push off toward the east. as it does, the rest of us get a chance of seeing the showers on saturday through at least the mid-part of the day before it moves through completely by the time night. as it does, we will see drier air move in. temperature wise a 52-degree reading in baltimore, not too bad now. 48 -- come on dover, give us a break. we want to see what is happening. there you go, 51 degrees in hagerstown, you know, 36 degrees in oakland. oakland is proud of that. they're the cool spot this morning. very chilly there and it's usually cooler in the mountains. we will get up to 66 degrees for the high temperature. plenty of sunshine, and central part of the state, just a couple of degrees warmer than that getting up to 68 degrees. and that is pretty much what we will find for the western part of maryland even though we start
