the man accused in the navy yard shooting lied when applying for security clearance. according to cnn, government background checkers knew this... but did not tell the navy. when aaron alexis enlisted in 2007, he answered "no" to questions about whether he was ever arrested.

that was a lie... three years earlier he was arrested and charged for shooting out tires on a construction worker's vehicle... he called that incident an anger-fueled blackout. the report given to the navy simply stated alexis deflated the tires, and no gun was involved. alexis is accused of killing 12 people at the washington navy yard last week. one week after 13 people die during the navy yard shooting in washington d.c. one survivor is speaking to us about his grief and his guilt. last monday navy commander tim jirus evacuated building 197 when shots rang out. the man standing next to him dropped to the ground dead. that victim was kenneth proctor a mantainence man at the base. "its just rough, again i have a little bit of guilt about this situation and what went down.. so i live with that.. i try not to let it cloud my judgements every day and drive the way i feel every day.. i still have a job to do" building 197 remains part of the federal

investigation. hundreds of workers are operating out of temporary sites as investigators continue to collect evidence. they hope to get the building back to the navy sometime this week. to see all of our stories about the navy yard shooting go to fox- baltimore dot com and click on navy yard shooting in the hot topics section on the left side of the screen. an annapolis man who was on a mission to raise money for cochlear implants will not ride into his final destination as planned. jacob landis was biking his way around america... stopping at every m-l-b ballpark along the way. saturday he was nearing the marlins stadium in miami when a car hit him and drove off. landis suffered a concussion and other injuries that will prevent him from biking into the stadium today, but he still plans to attend the finale party. the 24-year-old started pedaling out of annapolis earlier this year hoping to raise awareness and money for those who can't afford cochlear implants. he received one when he was a kid. fox45 is committed to bringing you

kewane gatewood played a significant role, neither is believed to be the actual shooter at cornell square park. authorities believe the incident was gang related... and is still under investigation. people with disabilities will no longer get special treatment when going on rides at walt disney world. earlier this spring news spread that rich families took advantage of the theme park's policy by hiring a disabled person to escort them throughout disney world... that way they could skip the long lines for rides. some wealthy mothers reportedly said "that's how the one-percent does disney." now because those guests abused the system, disney will no longer usher disabled people to the front of the lines. burger king is making a change today that will have calorie- counting fast food lovers rejoicing. the number two hamburger chain is launching a new crinkle-cut french fry. b-k says a small order of "satis- fries" has 270 calories... by

comparison, the regular fries clock in at 350 calories. burger king says a different batter brings down the fatness factor. burger king is hoping the lower calorie option will help people feel a little less guilty about gobbling up its french fries. another product that disappeared following the hostess bankruptcy is back on store shelves. you should be able to pick up a bag of wonder bread today. the product vanished about a year ago... but "flowers foods" bought the brand from hostess, which is allowing the bread to make a comeback. i can speak from experience... i share this kid's reaction to the new iphone operating system... not all apple lovers are sold on the new i-o-s-7 software. it has some of us adults confused and frustrated... and for one little four- year-old, the new system brought him to tears. jeanne moos shows us the epic i-tantrum. we adults clutch our smartphones like babies with pacifiers. and now babies hold smart phones like adults... this morning ravens pro bowl player jacoby jones is nursing a head injury. according to t- m-z, a stripper hit him over the head with a champagn bottle on a party bus yesterday morning. after the game on sunday, some of the players reportedly rented a party bus and headed to d-c to celebrate bryant mckinnie's birthday. but at about three a-m, that turned into a brawl outside a nightclub. t-m-z is reporting a stripper named "sweet pea" hit jones in the head with a champagne bottle... leaving him with a bloddy head injury. this is on top of the game injury he suffered in week one. coach john harbaugh says he's disappointed. he suffered in week one. coach john harbaugh says he's disappointed. new this morning... authorities continue to work to end a days-long saga at a besieged shopping mall in kenya... this as more clues are emerging about who is responsible for the attacks. sunlen miller is live in washington with the latest on this developing story. sunlen? it is day four of this deadly standoff.

d@pickup trucks are the top- selling vehicles in america, with nearly two million bought every year. the ford f-150 leads the pack in sales. but the new chevrolet silverado and ram 1500 bring some stiff competition. consumer

baltimore city police have now classified an infant's death.. as a homicide. on september 2nd... officers responded to a home on north broadway near east federal street in east baltimore... for reports of an unresponsive child. police began investigating and have now determined the 5- month- old died of asphyxiation. a woman who was shot during the navy yard shooting last week... goes home. medstar washington hospital confirms that a female civilian who suffered gunshot wounds to her shoulder was released late last night. the hospital says it now has just one remaining patient from the shooting... a police officer who was shot in the leg. he is in good condition this morning.

democratic hopeful for governor is kicking off his bus tour today. attorney general doug gansler is launching a 17- stop tour in his campaign. starting this morning in rockville the tour will go through ellicott city before ending the first day in baltimore. gansler is challenging lt. governor anthony brown and heather mizeur for the nomination.

all three democratic candidates for maryland governor come out swinging... trying to convince a crowd they are the right person for the job. the three spoke in front of the maryland state and washington d-c building and construction trades council. they focused on what they've accomplished for the state so far... and talked about what they want to do in the future. on the other side of the ticket... republican candidates include harford county executive david craig... state delegate ron george... former chairman of the charles county republican central committee, charles loller... and businessman, brian vaeth. lieutenant governor anthony brown picks up another endorsement. representative john sarbanes is backing brown for governor. he's the fourth of maryland's eight representatives to announce his support for brown.

sarbanes' district includes parts of anne arundel, baltimore, howard and montgomery counties... and baltimore city. a spooky statistic for retailers... the national retail federation says americans will spend less on halloween this year. the survey shows that people who celebrate the holiday are expected to spend 75 dollars on costumes, decorations and candy. that's down from the approximately 80 bucks the average american spent last year. still... the survey shows more than seven in ten halloween participants will hand out candy, which will bring in more than two billion dollars in sales. one new jersey town... is spooking little ids everywhere... by canceling halloween! in gloucester township... the council approved a resolution asking parents to restrict halloween activities to private parties.. and not to allow children to trick or treat. and if they do go door to door they ask the kids to be home by 7 p-m. nat sound: "it's for the safety of the community not only for the children but for the adults, the houses." nat sound: "when

off... sparking a chase. the car eventually hit a jeep... headed east on northern parkway. in: as a result 2 individuals out: local hospital the names of the victims haven't been released a few hours earlier... there was another deadly crash... this time in southeast baltimore. this photo is from the scene... underneath the o'donnell street overpass at south haven street. police were called to the area around 7 o'clock last night. they say the 51- year-old driver of a toyota s-u- v... crashed into the bridge abutment. he later died at the hospital. the cause of remains under

investigation. a virginia beach child isn't going to school today... because of something he did at home. 12-year-old khalid caraballo's school district suspended him... and may even expel him for a year... for shooting an airsoft gun on his family's private property. a neighbor saw him and his friends using the pellet guns in an "airsoft gun" war... they shot at each other, but no one was hurt. his school district said the investigation found khalid and his friends were firing near the bus stop... which is against the law. the pre-teen says that wasn't the case... and explained why his suspension is unfair. "because we were in our yard this had nothing to do with school. i didn't have anything of this at school. anytime." "he disobeyed me and that is a home issue its not a home issue because he won't be doing it again and like he said he will never do this ever again." the part of the
