nbc 10 breaking news. viewer video shows flames shooting from a montgomery county apartment complex. dozens of people are homeless. right now we'll take you live to the scene. a man shot to death inside a car in delaware had just achieved a major life accomplishment before that life was cut short. we will warm into the 80s today. but it is cool. you'll feel it when you walk out. 4:30. 69 degrees outside. i'm tracy davidson. >> i'm chris cato. feels great out there. one of those mornings where you want to linger outside for a little longer, bask in the fall-like coolness.

am i going on too long for this? >> bill henley, can you help us here? >> i wanted to linger in my bed for a few more hours. that was my first thought. if you want to get out and enjoy, this is what you'llç encount encounter, the temperatures are cooling down under a northerly breeze, the dry air coming in. it's a pleasant start. 58 degrees in doylestown, wrights down 52 degrees, philadelphia, roxborough and northeast philadelphia in the middle 60s to start with. and right along the delaware river trail and at 5th and wharton, it is 70 degrees. a few scattered high clouds will be thinning out. 67 degrees at 6:00. low 70s and really comfortable at 9:00. the humidity drops as the day goes on. back in ten minutes with a look at your neighborhood by neighborhood forecast to show you which spots will stay in the 70s today. right now let's get a check of

traffic. jessica boyington has your first alert traffic. jessica? >> we're checking out the schuylkill expressway right now. we're doing just fine, around girard avenue, you can see right in here, headed westbound no problems. westbound drive times 12 minutes from the vine street expressway up towards the blue route, an average speed of 60 miles per hour there. eastbound right behind here, doing just the same, 12 minutes there as well. no problems right now on the schuylkill expressway. but heading on over into new jersey we do have an accident investigation scene out in burlington township. route 130 northbound right around beverly road is where we'll see all that police activity and all lanes are currently closed and being detoured through the scene. you don't need an alternate right now. follow the detours and you'll do just fine. if you're heading out the door on 422, eastbound from 29 up towards the schuylkill expressway, an eight-minute trip, no problems or delays. if you're heading towards the schuylkill. mass transit doing just fine. no problems or delays there. we continue to follow breaking news out of montgomery county this morning. >> fire burned through at least

16 apartments overnight in king of prussia. in fact, the fire is still burning. nbc 10's katy zachry is there on scene. she got there shortly after the fire broke out. katy, what's the situation there now? >> reporter: so this fire broke out about three hours ago here at the abrams run apartment complex in kin prussia. right now, as we focus in on these peco crews, i don't you can see they are trying to dig down, trying to reach the gas line, because as soon as they reach the gas line they're beginning to turn it off. if we pan over to the right, turning off that gas line i'm told will eliminate this fire that's still burning. the only portion of this larger fire that's still burning in this small area as we focus in, this is the part of the building the utility room where the gas line and the power lines come in. so right now, we have a gas-fed fire but other than that, firefighters were able to put out the larger scale fire, if we go to video from early on in the firefighting efforts with be

flames were shooting from the roof, shooting from the inside of the building. it was quite a scene. many fire departments arrived here. it was -- it broke out around 1:30 this morning and forced the evacuation of dozens of people living in this one building. right now, 16 units, 16 apartments are completely destroyed. people are needing to find shelter with the red cross, the apartment complex is helping to set them up with shelter or they're relying on friends and family. here's what the fire chief told us not long ago. >> concern is that gas-fed fire. most of the fire is knocked down. i don't want to declare it under control until we have access to the gas fire and control where that's going. some fire is still burning up the wall. we're working diligently with that, trying to extinguish that and control it along with the gas company. >> reporter: and chief jim gallagher of the king of prussia fire department, again, speaking to this portion of the fire, this gas-fed portion of the fire that's still burning and has

been for the last three hours. again, there was a much larger scale fire when fire crews arrived here and police arrived here around 1:30. fortunately that's been put out and they're really just waiting on peco to dig down to the gas line, shut it off and hopefully that fire will be put out. no injuries reported to firefighters or anyone living in this area. the red cross as i said is here, assysting people. coming up in the next half hour, you'll hear from some of the people being assisted by the red cross. katy zachry, nbc 10 news. >> 4:35. we have new information on a bizarre twist in a suspicious death investigation. we now know the man found dead inside a car in new castle county monday night recently balm a lawyer. we also know the victim, 27-year-old shazim uppal graduated from temple university last month. he was found shot to death inside his car monday night. investigators say the victim lived close to where he was

found. yesterday police were still combing the area around the scene. 4:35 now. this morning, a warning from drexel university police after a string of home burglaries over the past few days just as college students are returning to the area. police say since saturday, five homes have been broken into in philadelphia's powelton village neighborhood the thieves took things like backpacks and jewelry. they are urging everyone to keep windows and doors locked. the state of a montgomery county elementary school won't be decided until at least december. the school board met last night to talk about the potential closing of audubon elementary school in eagleville. the move would mean the district's remaining four elementary schools would have to absorb more than 400 students. the board postponed any vote on closing the school until december. pennsylvania is no closer to a budget after a public majority

failed to convince democrats to override any part of governor tom wolf's budget veto. the house struck down all 14 proposals. democrats argued the procedure violated the state constitution. republicans claim there was legal authority to restore spending by individual line item vetoes. the state has been without a budget now since june 30th. pennsylvania lawmakers have introduced a bill aimed at protecting pets left in hot cars. the measure would ban confining dogs orç cats in unattended vehicles when it's dangerous for the animal's health or safety. the bill would allow a police officer to remove the pet from the vehicle and that officer would not be liable for any damages. violators would face a fine of up to $300. >> people think if they leave a pet in a car, one into a store, run out, it's not a big deal. in a very short period of time because of of the biology of dogs and cats in particular, it can lead to serious health issues. >> if that bill passes, 17 states would also have laws

now your nbc 10 first alert weather with meteorologist bill henley. >> 20 minutes before 5:00. a gentle breeze blowing here at the nbc 10 studios. a few thin clouds overhead. the humidity is low this morning, making for a cooler and comfortable start. look at northeast philadelphia. 12 degrees cooler than yesterday at this time. 66 right now. light breeze out of the north/northwest at 8 miles an hour. the humidity starting off at 56%. that number was in the 80s yesterday at this time. that number will go lower as the day goes on.

there are the showers offshore and a few showers way off of the north and west, western new york state. none of those are heading our way. we'll see sunshine today. we'll certainly need your sunglasses today with clear skies at the shore as well. the temperatures will be hovering right around the 80 degree mark. not everybody will make it in the 80s. look at low 70s today for the pocono mountains. allentown, quakertown and reading up to 79 degrees this afternoon. brill yapt sunshine, low humidity, doylestown 79 degrees. 82 for norristown and trenton and atlantic city will see a high of 79 degrees. low 80s for rehoboth and dover. inland, a nice çwarmup, typica for this time of year. middle 80s for philadelphia, 84 degrees, westchester tops out at 80 and 82 in wilmington. the weekend will be warmer. near 90 degrees on saturday and sunday up to 90 degrees with partly sunny skies. notice a little bit more humidity coming into play on sunday. but before we get there, some

coast. he's going to check out the progress made since hurricane katrina. craig fugate will visit several schools. new orleans was one of the hardest hit cities by katrina. over the past decade there's been a lot of work to repair and make sure the storm cannot do that kind of damage to the city again. since katrina, billions of dollars worth of projects have been built, including this new levee. crews have even created new land using sediment from the mississippi river and planted new marshes to protect the new levees since been built. officials say new orleans has never been this prepared or this protected. >> never in the history of new orleans has there been a protection as great, as good, as complicated as the one that's in place for today. >> money from the bp oil settlement is being funneled into the flood and protection center in new orleans.

the waiveland city center is th ground zero hurricane museum. a new exhibit called backyard and beyond opened saturday. the alleged shooter in the france train attack foiled by three americans and a britt is now a suspected terrorist. authorities led the moroccan man barefoot and blind folded into a paris courtroom yesterday. he's charged with attempted mass murder and belonging to a terrorist group. prosecutors said the suspect watched a jihadist video minutes before walking through the train with an assault rifle on sunday. the three americans helped subdue him, a fourth american shot in the back is in stable condition. now, the three americans got a heroes tribute on their way out of paris. they received france's legion of honor award on month. college student anthony saddler says heç can't believe the public's response to what happened aboard the train. >> i feel like i'm in a dream.

this is unreal. >> saddler's two friends travelled to germany, one of them an airman is seeing military doctors for injuries that he suffered on board the train. as for saddler, he's back home in the u.s. a private jet owned by a sportswear ceo flew him from france to oregon yesterday. he'll soon be back home with his family in sacramento. that city is planning a parade in the hero's honor. 4:48 now. they call her baby harlin. she's named after the street she was found abandoned on moments after she was born. take a look at this precious little girl here. a family near atlanta came home to find the baby near their door step monday night in southwest atlanta. police say she's healthy and they're desperate to find her mother or even a relative who could explain how she made it on to this road. >> the baby was wrapped in a pink hello kitty blanket. nothing else. >> there's no keck to the family

who found the baby, police say. george george has a safe haven law which allows a mother to leave a newborn baby at a hospital or medical facility, as long as the baby is no more than a week old. 4:49. a black labrador may have played a big role in the arrest of former subway spokesperson jared fogle on child pornography charges. he's one of only five dogs specifically trained to sniff out electronic devices like sd cards and flash drives. bear's trainer, todd jordan confirms the dog was used to find evidence at fogel's home in indianapolis. jordan explains how the labrador does what he does. >> he will hit on as card, thumb drive, an ipad and whatever the components inside of that, it's just something with the canine's help we can find some children with that. >> jordan said the local u.s. attorney told him just the other day it was indeed bear that was used in the fogle çcase.

southbound drive time from the schuylkill expressway up towards 95. we're still doing okay. as for mass transit, no problem for patco or new jersey transit. but for septa's west trenton into woodbourne station, they'll be shuttle busing passengers this morning again. a main line restaurant is apologizing to customers via facebook. yangming in bryn mawr was recently cited after inspectors found roaches, mold and spoiled food inside. this is the message posted yesterday on facebook by the restaurant. it reads, a sincere apology to our patrons. we are very, very sorry for the problem which is caused the township to temporarily close our restaurant. there are no excuses. it goes on to say we owe you better. we will renovate, refurbish, renew and refresh our establishment. we hope you'll give us another chance to regain your trust. we continue to follow
