newton pizza restaurant is suing the driver. eleanor miele was killed when a car slammed into the sweet tomatoes restaurant in march. her husband has filed a wrongful-death suit, a few weeks after the driver was criminally charged. according to the d.a., the driver, bradford casler, was speeding and ran a red light. the d.a.m. says casler never hit the brakes, even after his s.u.v. hit two other cars before restaurant. cass lar was formally charged just last month, six months after the crash. he's facing two counts of motor vehicle homicide and one count of operating a vehicle to endanger. state police are investigating the rollover in revere. police say a 17-year-old lost control and crashed on route 145. that driver and two passengers were taken to the hospital. one of the passengers was seriously injured. two other people in the car were not hurt.

have arrested a 16-year-old in connection with a murder that happene back in july. jayden smith was arrested just before midnight. he's expected to be arraigned in court a bit later on this morning. also breaking, reports of a tentative agreement between harvard and its striking dining workers. according to the "harvard crimson," the head of the union says the agreement will be sent the a subcommittee and all workers will be able to vote on the deal wednesday. the workers went on strike earlier this month seeking higher wages health benefits. also there will be increased security at durfee high school in fall river today. police say that they put the school into lockdown monday when a picture of someone holding a gun appeared on snapchat. the picture included the caption, "life at durfee." officers later took a 15-year-old student into custody. >> sarah: a driver deadline fast approaching. starting friday night, all tolls in massachusetts will go electric.

weapon on school grounds. live in fall river this morning, jennifer eagan, 7news "today in new england." >> christa: jen, thank you. 6:49. the husband of one of the victims of a deadly crash at a newton pizza shop is now suing the driver. eleanor miele was one of two people killed when that car slammed into sweet tomatoes back in march. her husband now filing a wrongful death lawsuit claiming the driver was negligent. according to the d.a., the driver, bradford casler, was speeding and ran a red light. he says he never hit the even after his s.u.v. hit two other vehicles. right now he's facing two counts of motor vehicle homicide and one count of operating a vehicle to endanger. >> sarah: new this morning firefighters in topsfield racing to the rescue after a porch collapse. fire investigators tell us the man got trapped in a ten-foot hole when a screened-in porch collapsed at a home on boston street monday evening. two firefighters were low sweerd the hole to help pull the man out. this morning he's recovering with minor injuries.
