should stay in prison until his case is resolved in court. dassey's conviction for his role in the rape and murder or teresa halbach was tossed in august. the state has appealed. state prosecutors argue the lower court did not have the authority to order dassey's release and by doing so would cause irreparably harm to the case. dassey's attorney argue the state has not made a case to keep him locked up. his family hopes he'll be out by friday. it's one step closer, their do their thing and they are fighting but we want him out this week. dassey must be released no later than 8 p-m on friday unless the 7th circuit of appeals rules otherwise. the appeals court has been asked to make a decision before the deadline. you can read the judge's order on our website fox6 now dot com. the story's on our home page. you can also search "avery

story going back as far as 2003. kim and jessob. back to you. developing overnight... a customer is shot during an armed robbery at a cricket wireless store in west allis. police say the customer suffered a gunshot wound. the robbery happened at the cricket store near highway 100 and cleveland last night. the victim was taken to a nearby hospital. we are told that person's injuries were not life threatening. no arrests have been made as police continue to investigate. also from overnight... two sheboygan county. authorities say a driver failed to stop at a stop sign in the town of rhine-- colliding with another vehicle. an 80 year old man and 79-year-old woman were killed. the driver of the car that was struck is expected to be okay. happening now-- milwaukee police are searching for the suspect after a teenager is shot and killed on the city's north side. officers say an 18-year-old man was shot and killed near 68-th and congress around 4 yesterday afternoon... investigators believe the shooting followed an argument. witnesses

when the suspect came up and fired multiple times. police are still looking for the suspect. three men -- accused of impersonating milwaukee police officers and holding another man at gunpoint-- are due in court today. police say zedric byrd.... justin figgs... and brandon streff.... went to a home near 67-th and carmen and told the residents they were m-p-d officers serving a search warrant. investigator say the three targeted the man who lives in this house because he allegedly shorted them on a drug transaction. the alleged drug after... is also in custody... their preliminary hearings are each scheduled for 8-30 this morning. an 18-year-old delafield man faces multiple felonies-- accused of making and selling drugs. according to court documents - authorities caught on to 18-year-old jason makofski after he sold marijuana to a confidential informant. police got a search warrant and found marijuana, l-s-d and cocaine inside his home. that's on top of two different synthetic drugs. they say they also found quite a bit of drug

sheriff says they made a bust so big it will have a ripple effect across dodge county. 27-year-old lucretia lightfoot faces 16 counts related to creating and delivering heroin and cocaine. she's accused of running a large- scale operation, with multiple, lower-level distributors. vulgar-- offensive and tasteless--- thats what m-p-s officials are calling a controversial ad recently published in a local culture magazine. it mentions pregnancy and abortion -- while calling attention to students at bradley tech high school at walkers point. it reads 'sabbatic is for lovers' and in bold print: 'our back alley: where 50% of bradley tech pregnancies start and end'. bar owner jay stamates is no stranger to controversy, but the ad is causing him to receive a flood of angry calls and texts. it turns out a lot of people whove never come to my bar never been to my bar really are upset with me! for safety reasons he did not

air quality is causing health concerns for many communities. the flames are being fueled by unusually dry conditions... and efforts to extinguish the fires are being hampered by a continuing drought... and the constant threat of high winds. in central illinois-- a natural gas explosion leaves one person dead, and several others injured. it happened just before 6 last night. several downtown buildings sustained heavy damage... power was knocked out... and emergency authorities ordered an evacuation of the for several hours after the explosion. a judge in chicago denies bail to a man accused of killing a toddler. two-year-old kyrian knox's dismembered remains were found in a park lagoon last year. police say kyrian's mother moved to iowa and left the baby with 41-year- old kamel harris -- who is a friend of a friend. police believe the lactose-intolerant child ingested milk, causing him to cry for an entire afternoon -- and police say harris snapped.

arrested him tuesday. the minnesota police officer who shot and killed 32-year old philando castile during a traffic stop in july -- now facing charges.... but first-- new developments this morning in the investigation into an officer-involved shooting in chicago. angelica joins us from the newsroom with the latest. a grand jury will hear evidence on whether the chicago police department covered up the shooting death of laquan mcdonald. mcdonald is the teenager who was shot and killed by officer jason van the incident shows van dyke shooting mcdonald 16 times within seconds of leaving his s-u-v as mcdonald walked away with a knife in his hand. the video contradicts officers' claims the teen lunged at police. a special prosecutor says the grand jury could begin issuing subpoenas next month. in minnesota... the police officer who shot and killed 32-year old philando castile in july... has been charged with manslaughter. saint anthony police officer jeronimo yanez is charged with

counts of dangerous discharge of a firearm. yanez shot and killed castile after pulling him over for a broken tail light. castile's fiancee says the officer shot castile as he reached for his wallet. she says castile had a license to carry a weapon and that he had been trying to tell yanez about the gun. yanez will make his first court appearance tomorrow. castile's family says they plan to file a civil suit. kim and jessob. back to you. the japanese prime minister will be in new york today to meet with prese the prime minister will likely be looking to confirm that president-elect trump will remain committed to the u-s / japan security alliance. meanwhile-- the president-elect may be looking at south carolina governor nikki haley to be his secretary of state. that's according to a trump transition source. governor haley and president-elect trump are set to meet today - along with former secretary of state henry kissinger and florida governor rick scott...among others. former new york city mayor rudy giuliani has also expressed interest

officially milwaukee firefighters. the milwaukee fire department held a special graduation ceremony last night at the training academy. the recruits have spent the past 16 weeks preparing physically and mentally. it was an extra special night for one of the recruits. his 93-year-old grandfather-- a world war two veteran-- pinned on his badge.
