another week, another candidate surging. now, it's newt gingrich whose campaign was written off for dead last summer. he talked about the race with sean hannity on fox news. >> there will be ups, downs, counterattacks. certainly a long, long way from june and july. >> reporter: a new poll has gingrich neck in neck with mitt romney for the lead. >> the last debate saturday night really affected a lot of people. they sort of clicked and said yep i'm for him. >> reporter: since july, romney holding steady at the top or near the top of the republican field. but every month, a new face is there to keep him company. >> candidates, the republicans jump to, haven't been able to sustain a campaign. >> reporter: why would this gingrich surge be any different? >> newt gingrich has the capacity to have a staying power unlike the others in the race because of his experience apt the national level. >> texas governor rick perry plummeted in the polls and seems to be frying anything to win over conservative voters.

wall street protestors from new york police and a judge. >> that's after an overnight rude awakening by police in riot gear who evacuated the park that is home to the protest movement. it's wednesday, november 16th. good morning, everybody, i'm rob nelson. >> and i'm sunny hostin. the protestors are welcome to gather at new york's zuccotti park, but due to health and safety, use they cannot sleep there. but are the protestors following police orders right now after the camp was shut down 24 hours ago? >> a dramatic scene unfolded there last night for sure. we'll see how today shakes things out. this morning how doctors cure a baby boy's life tlenting illness using medicine and injection that contained algae of all thing t things. what this means for people awaiting a liver transplant. important medical news. >> a thanksgiving day tradition in millions of households.

a special sneak peek at what is new in macy's thanksgiving day parade. >> great national tradition there. first get to the news from here in new york. protestors have returned to the new york city park they have been camped out. this tomb without their tents, tarps, or sleeping bags >> you can see we have live pictures from zuccotti park where demonstrators are trying to figure out their next move now that a judge has ruled against their encampment. abc's scott goldberg here with the latest. scott? >> reporter: good morning, the birth place of the occupy wall street movement its a park and not a campground. there are new rules after the police crackdown temporarily forced protestors out of the place they have been calling home. hundred of police officers ryne yryne -- in riot gear occupied the park where the national movement started. after two months new york's mayor said health and safety at the camp in lower manhattan became intolerable. >> there is no ambiguity in the law. the first amendment protects

speech does not protect tents and sleeping bags to take over a public space. >> reporter: late in the day, the park reopened, the judge agreeing that the first amendment does not give protestors the right to camp out indefinitely. the new york sweep comes a day after police in oakland did the same thing. from coast to coast, the occupy movement inspired thousand to speak out against corporate greed and income inequality. but outbreaks of violence are testing the public's tolerance. in new york it's been a peaceful protest, but people in permanent homes near the tent city complained about noise and filth. >> make no mistake, the final decision to act was mine and mine alone. >> reporter: now the movement is at a crossroads. cleaning out the park where it all started could mark the beginning of the end, or, it could galvanize protestors looking to make a major statement two months after the occupation began the this thursday, the occupy wall street website is calling for a

national day of action. here in new york that means appropriate testers are going to try to set up a blockade preventing traders from getting to work at the stock ex-change and later move to the city's subways. rob, sunny. >> thank you, scott. >> all these weeks later, they're still relentless and say the protests will continue. >> they have a right to free speech, right, of course, they don't have a right to camp out in a public space forever. i wonder if this is the beginning of the end. arrests in atlanta. probably moving to los angeles. california. >> other locations, uc berkeley in california. interesting developments out there in the last few hours as well. live aerial picture of the protest there. apparently tense moments earlier, you know, last night, when there was a gunman worked his way into the business school there, a half mile away from the protest. police shot and wounded the man after he lifted a gun in a room that had a few stew dinudents i.

tense moments there with the protests going on. >> it's become dangerous. a criminal element involved. >> public safety issue to all of this. interesting, last 24 hours for sure. >> we are also following several developments in the penn state sex abuse scandal. the assistant coach who witnessed the alleged abuse says he did stop the attack as it happened. mike mcqueary says he went to police about the incident. which contradicts his earlier statements and the mother of an alleged victim is also now speaking exclusively to abc news, about jerry sandusky's flat denial of the charges against him. >> it sickened me that he would be on tv trying to downplay his charges and he is just -- i think he made himself look guilty. >> another man is coming forward to say he was abused by a professor at penn state. the alleged vick temperature said he want to authorities but nothing was ever done. he sued and within a settlement.

case. at the tomb of the shooting, president obama was not in d.c. he actually was out in california. >> a dozen or more demonstrators, arrested in alabama over a protest over the state's new tough immigration law. about 100 people took part in the protest at the state house and nearby capital building in montgomery. an appeals court blocked parts of the law from going into effect. the case will likely end up before the supreme court. >> police in washington state are still coming up empty. ten days into the search for a missing toddler. >> the toddler's mother says she left him alone in the car. police don't buy that. and there is word she was trolling a website for wealthy dates. good morning. >> reporter: good morning. authorities in washington state say they're doing everything they can to find little sky. and while his mother refuses to talk to police they say an online dating profile may provide some clues. his face is everywhere, his whereabouts unknown.

little sky metalwala has been missing for more than a week last seen in the company of his mother. so far, his mother has refused to cooperate with police who have openly questioned her claims that she ran out of gas and left sky in the car while she and her 4-year-old daughter walked to the nearest gas station. she told detectives when she returned, sky was gone. her estranged husband is suspicious. >> i do believe julia is responsible. >> reporter: while not named a person of interest. >> we are all aware of some of the inconsistencies from julia. >> reporter: then this, a profile, seeking arraigneningment.com. that features pictures of the mother. an internet dating service that matches so-called sugar daddys and mommies with sugar babies. on it, a person named j.b. says she is "looking for financial stability and assistance" and expects between $3,000 to $5,000 monthly. police refuse to comment. >> i read and watched the

transplant he was given an injection of cells, the surface was porous, it allowed toxins to flow in, be processed and proteins to flow out. immune cells were too big to enter so it couldn't destroy the donor tissue. after two weeks his liver started to recover. >> that looks normal. >> reporter: a key benefit over a liver transplant is that iad will never need anti-rejection drugs, immunosuppress entents. doctors are delighted. the next step is to see whether this technique could be used to benefit other patients with failing livers. who currently need a transplant. many patients die before receiving a liver transplant. so it's hoped that treatment that saved iad may yet help many others. fergus walsh, bbc news.

protestors have been living for months. >> the protestors fought back in court, but a judge didn't buy it. what happens now to demonstrations across the country? it's wednesday, november 16th. good morning, everybody. i'm rob nelson. >> and i'm sunny hostin. the protestors at new york's zuccotti park are under strict orders this morning. no sleeping or camping. after a legal defeat we get the latest on the wall street protests this morning and see what is next for the protest movement. >> they're vowing to stay there. this is not over. a small set back. they plan to get back in there. winter is coming. the penn state scandal and who is defending jerry sandusky after his bombshell interview earlier this week. get the latest on the whistle blower and angry comments from an alleged victim's mother. abc news exclusive. >> later this half-hour, some one tried to go down a family's chimney. but it wasn't santa claus.

a criminal who got stuck. wait until you see this. >> our favorite moron of the day. before all of that, the latest confrontation between police and occupy protestors is now happening in seattle. six people have been arrested after officers used pepper spray to end a pretty tense standoff. >> here in new york it appeared tense but peaceful as protestors returned to the park where they have been camped out for two months. wabc's m.j. burkett reports from zuccotti park. >> everybody when they let us in be really cool. >> reporter: organizers pleaded for calm and moments later. ♪ our park! protestors began pouring into zuccotti park. >> it's good. very good. >> it's wonderful. >> reporter: but the judge's ruling took the occupied out of occupy wall street. camping is now prohibited. this man was asked to move after he tried to lie down. this woman with a yoga mat was turned away. >> we needed to stay here the way we were staying here.

abuse charms but admit he showered and did horse around with young boys. >> the mother of one of the alleged abuse victims is speaking out about sandusky's bizarre denial. abc's scott goldberg has the latest. good morning, scott. >> reporter: good morning, rob, sunny. there is a new effort by jerry sandusky and his lawyer to tell a story other than the one in the grand jury report. it started with sandusky speaking out on tv and continues with his lawyer granting interviews and insisting that sandusky is innocent. the most graphic allegation against jerry sandusky comes from 2002 when a graduate student said he saw the former football coach raping a boy in the showers at penn state. the story sandusky's lawyer tells abc is not true. >> the kid is adamant, now grown up, in his 20s, he is adamant, nothing sexual occurred. he the same boy? that's what we are still working on. >> reporter: the problem is he can't say he is talking about

the same alleged victim. but working to corroborate sandusky's events that the coach and boy were horsing around. if it were view, it would contradict gara contradict graduate student mike mcqueary, a graduate student an assistant football coach. mcqueary was placed on administrative leave over reports he never called police to report the rape to the grand jury. now he did more than people realized write to friends in an e-mail i did the right thing. i didn't just turn and run. i made sure it stopped. as for jerry sandusky -- >> i said that i am innocent of those charges. >> it sickened me that he would be on tv trying to downplay his charges and he's just -- i think he made himself look more guilty. >> reporter: sandusky broke his silence on nbc monday night. but he seemed to stumble over the answer to one critical question? >> am i sexually attracted to underage boys, sexually attracted? i -- i, no. i'm not sexually attracted to young boys.

>> some have questioned the wisdom of doing that interview. but not the lawyer, he said the public needed to hear from sandusky directly. rob, sunny. >> if you are accused of something that heinous, are you sexually attracted to young boys, absolutely no, i am not. >> you would be emphatic. you would feel persecuted the you would want to set the record straight. the denial seemed creepy almost. >> soft, too soft for the nature of the charges. a very weird interview. all the way around. troubles for penn state not slowing down on top of that. now, a faculty member at penn state alleging another case saying, in that matter, an 11-year-old boy abused in that case. now a whole another, you know, possible matter. >> i am hopeful that what comes out of this people will start talking about this more. because sex abuse is always shrouded in secrecy. that's how perpetrators are able to continue offending. perhaps that's one of the things that will come out of this, people are talking about it. >> let's hope there is a silver lining. because this is

messier every day. for sure. philadelphia charity is suffering fallout because of the scandal. as you see -- the name of a charity thrift store is second mile. of course the same name as the the charity once headed up by former coach sandusky. that led to ugly phone calls, the operators had to explain the store had nothing to do with sandusky's same titled foundation. >> students at uc berkeley are rattled after their first campus shooting since the 1980s. a man was shot by police when he raised a gun inside the business school, several students were in the room, only the gunman was wounded. the shooting took place as occupy protestors gathered on campus. it is not clear if the suspect is somehow linked to the movement. >> also increasing concern this morning about the threat posed by a man who fired an assault rifle near the white house last week. police have been searching for

21-year-old oscar ortega hernandez. the secret service looking into whether two rounds found at the white house are connected to that shooting. agents are trying to interview ortega hernandez's family and friend now. president obama was not in d.c. when the incident happened. he was in california friday night. >> congresswoman gabrielle giffords is making it clear that she is not giving up her life in politics. as we have seen this week in her exclusive interviews with diane sawyer, giffords is making remarkable progress since being shot in the head in january and just posted a recorded message on facebook directly addressing her arizona constituents. >> representing arizona is my honor. i miss tucson. the mountains. blue skies. even the heat. i'm getting stronger. i'm getting better. i want to get back to work. >> gifford acknowledged it has been a hard year for everyone. and said it makes her sad to think about fact that six people died in the shooting. >> incredible story.
