lanes are open in the northbound direction. the beltway is running smoothly. the big problem today will be everybody heading back from the beach. everything looks good right now. no problems here eastbound at sandy point. that's a check of your fox 5 on-time traffic. >> thank you. president obama is keeping with the labor day theme today. he is headed to ohio address an organized labor group. >> the president will speak for a friendly audience at the annual afl-cio labor day picnic. he will announce to union members his selection for senior counselor for manufacturing. his appointee, ron bloom, has served as senior advisor to treasury secretary tim geithner on the auto industry task force since february. president obama's highly anticipated speech on education just a day with a now. his message to school children across the nation, do well in

school but some are concerned his speech could be politically motivated. sarah simmons joins us from wakefield high school in arlington where the president will make his remarks. good morning. >> reporter: good morning. this upcoming speech from the president has caused quite a controversy. there are some parents out there who are urging teachers and schools to actually boycott the president's address to the nation's schools that will take place here tomorrow. some of his critics are even saying that he will use this platform to push a socialist agenda and his supporters are saying this is absolutely ridiculous. the nation's education secretary coming out even yesterday on cbs's face the nation saying the controversy over president obama's speech is, quote, just silly. he says the speech is about challenning students to take their education very seriously. parents are dided. some are worried about what exactly the president will say while others say they have no problem at all with the speech.

>> this is all about the president challenging our young people to take responsibility for their education. >> i have absolutely no problem with my children listening to what the president says especially if it is a stay in school message. >> reporter: now, at the same purely voluntary that the students see th speech. loudoun county schools last week already pulled the plug on allowing students to watch the speech. prince george's county schools last week said they will allow it to be shown during government classes and that students will be allowed in there to watch that. we should have a better idea of exactly what he will say tomorrow during that sweech. we are expecting a transcript to be posted on the white house's web site so we should get a better idea then. shrouded in controversy, a white house advisor is calling it quits. van jones is resigning after what he calls a vicious smear campaign.

jones had come under fire for signing apetition that suggested a government role in the september 11th terror attacks and for allegedly making derogatory comments about republicans. schools have become ground zero for swine flu. right now, the university of maryland is reporting 15 more possible cases and that brings the total to 79, just two weeks into the school year. the school asks students to go home if they feel like they have the regular flu. if they can't be they are not being isolated but a sense of unease seems to be spreading across the campus. >> i hope whoever has it tells me straight up. they say if you have it, you can't come to class for 48 hours after your symptoms end. that would be bad. >> they say take purell before you leave, when you come in.

>> on myfoxdc.com, we have posted a whole lot of information for you on the swine flu. we are ilinmpnews updates on the spread of the virus, traveling and prevention along with phone numbers and links. a hiker took a pretty hard fall and that led to a risky rescue. it happened along the billy goat trail in great falls. the hiker had climbed so far, the first rescuer had to get to her by boat and climb a rock ledge to where the hiker was waiting. a helicopter was sent in to lift her off the rocks and take her to the hospital. turns out remains found in anne arundel county do not belong to a human. the body parts were taken to a morgue where the remains were determined to be bear paws. the feds are looking into a

making headlines this morning, a prison van was involved in a deadly crash. it happened yesterday morning near hattiesburg, mississippi. police say the van carrying 1 people drove off an interstate embankment. the private security guard who had been driving died.

in all, 10 people were hospitalized. now, to a tragic accident off the coast of the philippines. nine people were killed when a ferry capsized. nearly 1,000 people were on board when that vessel flipped over in the middle of the night. crews were able to rescue 9 # 6 passengers and crew members bringing them safely to nearby boats but 30 people are still missing this morning. the war in afghanistan is weighing on the minds of leaders around the world and germany wants a quick and thorough investigation into nato's air strike that killed 70 people including civilians. that could cause tension to rise between germany and the united states. u.s. jets carried out that attack. germany order the air strike. a swedish charity has accused american troops of storming a hospital in afghanistan being breaking down doors and tying up staff. the u.s. military says it is investigating. former university of maryland star shawne merriman is in trouble with the law.

police say the san diego chargers linebacker was arrested on suspicion of choking and restraining s girlfriend. police say it happened as she tried to leave merriman's southern california home. she was ken to the hospital. her condition was not immediately available. it is a reprieve for thousands arrested during the civil rights movement. they are getting more than just an apology. of a beautiful weekend being we have changes in the form of cloudiness, cooler temperatures and you would know it, a chance for some showers. i'll have all the details on the forecast and lauren demarco is in with a look at your on- time traffic coming up right after the break. air. not really. frederick is 68. hagerstown is currently 68 as well. not going to be a great day across the lower eastern shore. a lot of cloud cover expected. we have a storm system across the carolinas that will throw a lot of clouds up along the lower eastern shore and introduce the possibility of some showers. i mentioned the rain in washington. there it was last night. just a little shower or thunderstorm complex that pushed from the ocean. here comes the cloud cover. can you see it really filling in this morning. it will be mostly cloudy today. we've got a couple different players here in atmosphere. we have a little disturbance out to the west in west virginia and western maryland. the real player will be this area of low pressure off the carolina coast. a lot of shwer activity at this hour and all of this is drifting very slowly to the north. this will be a very slow mover so our forecast will stay pretty much the same. clots of clouds with the possibility of these showers thrown back into the washington

money he was fined. we have the story. >> this is my receipt of where i paid my fine for being a foot soldier in 1966. >> reporter: melvin j. short was jailed and fined in april of 1966 by the city of birmingham alabama. >> i had signed up at the church to be arrested because we knew we were going to get arrested. >> reporter: his crimes, using a whites only drinking fountain and walking into the segregated restaurant, total cost, seven days in jail and a $48 fine. back then, $48 was more than a week's salary for melvin short. after 4 # years, he getting it back. >> it makes it easy. he has a 43-year-old receipt. >> reporter: the mayor decided it was time to give refunds to thousands who were arrested and fined for breaking jim crow

laws. >> has nothing to do with the $48. negligible amount. it is the symbolism behind it. >> reporter: he calls the refund a pardon, not for those who were arrested but a pardon for the city who wronged so many for so long. >> the city is scorey for what it did t can never be a crime to fight for human decency. >> reporter: many ever the peple listed in the old city jail logs are here today still marching in honor of a turbulent time that changed history. they are grateful for the refund and what they represent. >> it has given us recognition of what we have done and where we have come from. >> reporter: others are a permanent part of the history books for the leadership they provided during a strug struggle -- struggle for freedom and justice. today mark the unofficial end to the beach season. at ocean city, plenty of sun but not nearly enough dollars. we'll look at the bottom line. a big year at the box

cio's annual labor day picnic in cincinnati. there, he will speak to union members about health care reform and also announce he has named ron bloom as senior counselor for manufacturing policy. bloom is currently senior advisor to treasury secretary tim geithner. the uproar continues over the president's plan to address the nation's school children. the president will deliver a speech from wakefield high school in arlington tomorrow. in it, he will encourage kids to work hard and stay in school. critics believe he could be pushing a political agenda. sarah simmons joins us live from wakefield high school with more this morning. >> reporter: good morning. this upcoming speech has really sparked quite the controversy to the point where some parents around the country are even urging teach enters schools to boycott the president's upcoming speech to the nation's schools. his critics are saying this is really a platform to push a socialist agenda. the nation's education secretary spoke out on cbs saying that the controversy over the president's speech is

quote, just silly. he says the speech is about challenging students to take their education seriously and to be responsible with it. now, some schools around the country have chosen to pull the plug on it altogether. >> it falls during the 1:00 lunch hour which is really inconvenient for a left our planning during the day. >> i do think the superintendent shielded the principals from needing to get caught up in the partisanship. >> reporter: now, the loudoun county schools here in virginia, they chose last week to go ahead and pull the plug on the speech. they will not be showing it ve to try to avoid the controversy. they say she had a lot of complaint so they tea sided not to show it altogether. prince george's county schools will be allowing to be shown in the government classes. students will be allowed to go in there and watch if -- it if they so choose. it is expected a transcript

first rescue are ares had to get to her by boat and climb a rock ledge to where she was waiting. eventually, a helicopter was sent in to lift her off to the ro and on to the hospital. a somber candlelight vigil was held last night for two victims of a deadly crash. a family was stopped when they were rear ended by an suv. 2-year-old jonathan wade ortiz and his grandmother died on impact. driver of the suv, 26-year-old william mallory, was charged with dui and is being held without bond. the investigation into june's deadly metro crash now includes a look at a near miss. investigators are now comparing equipment from the summer's accident that killed nine people with equipment removed from the site f a 2005 accident or near accident. metro's crash avoidance system failed causing two trains to nearly collide. the "washington post" is reporting metro never followed up on sick recommendation made back then. metro says it made the changes

evdia . we know one person who won't be taking over the seat of senator ted kennedy. the lieutenant governor has decided not run. she says a campaign isn't in the before the interests of her family. those considering a run include scott brown, michael sullivan. a 4-year-old boy missing since last friday turns up dead and police near pittsburgh day it's homicide. authorities found the boy saturday in a septic tank stuffed into a sewage container just a couple of people from his home. his family reported him missing friday night. police questioned his father and later released him sow. a boy kidnapped in illinois during a custody battle nearly two years ago has been found alive. investigators found six-year- old rickey chekevdia at his grandmother's home where he and his mother had been hidden in a small specially built secret crawl space. he-been to the school or the

the winds out of the east. highs later today only in the mid-70s. there is a small craft advisory along the bay. if you are out on a boat and you are in a small boat, be warnedded that the winds will be gusting out of the east here as we have a big area of high pressure off to the north. there is the hour activity that moved through during the oong hours yesterday. notice all cloud cover that has started to move in overnight. it will be slow to get out of here. we have a couple of areas of disturbed weather. a lot of showers out to the west and west virginia. our focus is really this area of storminess, an area of low pressure along the carolina coast. it will slide slowly it the north an east during the next couple of days. i'm concerned about showers down at the beaches. some of that shower activity will slide up here into the washington area this afternoon. not going to be raining all day here in d.c. but i got to tell you there is at least a possibility we will see afternoon showers. plenty of clouds. showers possible. cool temperatures, highs only in the mid- to upper 70s. winds out of the east at five to 10 miles per hour. there is your five-day

it looks cool. that is coming out october 2nd in theaters. >> i have to tell you that i cannot wait until my girls are old enough for me to read to them where the wild things are. it was one of my favorite books as a child and now it will be out as a film. >> i read this book all the time when i was a kid. i would go to sleep at night. i couldn't fall asleep sometim as a child and she would bring this book in and she would read it to me. spike jones is now bringing this film to life. it comes out october 16th in theaters. they tried to keep it as realistic as possible. >> and core macmccarthy is one of my favorite authors. there is a new movie coming out based on one of his books. >> he won a pulitzer prize for this book called the road. this particular film, it looks lake a great thriller.
