happened or the conditions of the victims. we have a crew heading to the screen and will have an update as soon as -- scene and will have an update as soon as we get more information. >> also tonight a fox 5 weather alert, storms stretching from detroit to new orleans marching our way. thanks for joining us tonight. i'm brian bolter. >> i'm shawn yancy. that line of storms could bring severe weather our way tomorrow. let's get right to sue palka in the weather center for the details. >> we're keeping a close eye on that 1 because storms have been doing a -- one because these storms have been doing a lot of wind damage as they've been moving east. these may not have not heavy rain but winds to boot. let's look at how things ared an the mid at lang now -- are around the mid at lang now. just -- mid-atlantic now. in the roanoke area we have a few showers and thunderstorms. that first batch will generally weaken moving towards d.c., maybe a spotty shower

overnight. for the main action we have to look out through the ohio valley and tennessee valley. so far tonight we've had 96 reports of wind damage, no tornadoes, but a a lot of strong winds as these have been marching east. there is potential for severe thunderstorms tomorrow afternoon i think from 4:00 until 2 a.m. that's because there will probably be two waves of storms to watch. there will be some late in the rush hour, but damaging wind gusts, large hail, isolated tornadoes, maybe some flash flooding as well. this is a good time to remind you that our fox 5 weather app, if you aren't close to a tv or can't watch us tomorrow at 5:00 and 6:00, keep an eye on this. download the app for free. you can see radar and also see that big line of storms as it's getting closer to us. you'll know if there's a severe thunderstorm watch or warning for our area because we will alert you on the fox 5 weather app. you can go to the iphone store,

android market or get it for your ipad. the download is free and on a day like tomorrow it could come in really handy. i'll join you later with the full weather forecast. another big story tonight, jurors in the john edwards trial found the former presidential candidate not guilty on one of six counts of campaign violences. the judge declared a mistrial -- violations. the judge declared a mistrial when the jury could not reach a verdict on those other counts. the. >> the jury gave a not guilty verdict on the money from supporter bunny mellon. after it was all over edwards admitted the blame falls squarely on him but that no crime was ever committed. >> while i do not believe i did anything illegal or ever thought i was doing anything illegal, i did an awful, awful lot that was wrong.

>> reporter: with his daughter cate and his parents by his side john edwards spoke out after the trial was over. >> thank goodness we live in a country that has the kind of system that we have and i think those jurors were an example of what juries are supposed to do. >> reporter: just minutes before the judge catherine eagles declared a mistrial edwards was facing several charges, conspiracy, illegal campaign contributions and giving false statements. he was accused of masterminding a plan to use money from wealthy donors to hide his pregnant mistress in 2008 during his white house run, but defense attorneys say edwards did not knowingly break campaign laws and the money to hide his mistress were gifts, not campaign contributions, but after nine days jurors could not come to neighbor decision on five counts, much to edwards' relief. >> there is no one else

responsible for my sins. none of the people who came to court and testified are responsible. nobody working for the government is responsible. i am responsible. >> reporter: in his remarks ed wads mentioned all of his children, but -- edwards mentioned all of his children, but he got choked up when he talked about the love child he had with rielle hunter. >> and then finally my precious quinn. i love her more than anyone could man and am so close to and so grateful -- imagine and am so close to and so grateful for quinn. >> we want to bring in prince george's county state's attorney glenn ivey for some more legal respective. this is a big win for the defense, of course, but given the outcome was this a good strategy by the defense or not so strong a case made by the

prosecution? >> well, i think it was an overreach on the charge. i don't think that this was the right kind of case to bring in a criminal court. i thought by criminalizing the campaign finance laws in this aspect they really put themselves out on a limb and the jury sawed it off today. >> i want to find out, too, what does a hung jury really mean in this case? the jury as we know was able to reach a verdict on one of the counts but not on the five others. with that outcome is it likely prosecutors will retry the case? >> i think probably not. i think the fact that you had a hung jury on most of the counts except for one, which was a not guilty, gives a strong indication that this probably wasn't the best case to bring from the beginning and i know there were concerns about it raised within the department of justice even before it was brought forward. so i think this will strengthen those voices in the department and they'll carry the day now. >> how difficult would it be to bring in a new jury pool if they do retry the case?

it was difficult from the beginning in this one. >> that's always tough on a case that get this kind of national exposure and change of venue doesn't help because there's really no place else you can go where people haven't heard about this case. so it would be a challenge, but i think the threshold question for the prosecutors is does it really make sense to go forward with it anyway? >> glenn ivey, thanks for being with us tonight. >> thank you. ♪[ music ] a memorial service full of music and dancing for hours. friends, relativelies and fans in the district celebrate -- relatives and fans in the district celebrated the life of the godfather go go chuck brown. it was held at the washington convention center because so many people wanted to attend. fox 5's karen gray houston attended today's service. >> reporter: you can hardly call it a funeral, home going

reservation based which were full today and we've called all those guests, apologized, but unfortunately without the water we weren't able to open today. >> again d.c. water hopes to have the pipe fixed overnight and water restored by tomorrow morning. one southbound lane of connecticut is open, two northbound lanes open. n street is closed in the area. d.c. water says drivers should avoid the area, if possible. the federal government announced a major crackdown on some of those discount bus companies that shuttle passengers to new york and other east coast cities. fox 5's bob barnard with the story. >> federal transportation officials say they are targeted so-called chameleon characters, bus companies with horrible safety records that are shut down under one name and get back into business using another. it was the deadly skyexpress bus crash on interstate 95 north of richmond one year ago today that helped spark the

es is and twoingly sies, but in a cents -- twosies, but in a comprehensible manner. >> to get to here and new york or here to atlanta, it doesn't break the bank but you need to be assured when you get on the motor coach the driver will be safe and well rested and the equipment is in good shape. >> the federal government introduced a new app called safer bus that allows you to look up bus companies to inspect their safety records and see if they're legit. the government says those 26 bus companies put out of business this week were used by roughly 1,800 passengers a day along the i-95 corridor from new york to florida. maryland has become the first state in the nation to declare pitbulls are inherently dangerous. the court of appeals ruling means it will be easier for victims to go after dog owners if they're bitten. animal shelters are bracing for an influx of pitbulls for

people worried about the liability issues. fox 5's audrey barnes has the story. >> you want to play with your friends? >> reporter: you wouldn't know it by looking at them, but the maryland court of appeals has ruled that ginger, layla and hugo are inherently dangerous. >> it's crazy. all dogs are individuals. a breed doesn't make the personality of a dog. it's experiences, how it's treated. >> reporter: after some serious mauling incidents in maryland the court of appeals handed down this ruling. it means dog owners and their landlords can be held financially liable for any damage a pitbull does even if it's never bitten anyone before. >> people are being forced to choose between their homes and pets basically and shelters are bracing for an influx of pitbulls when they're already full. so it could result in lots of animals being euthanized totally unnecessarily. >> reporter: the maryland state director of the united

states humane society was invited to speak at a panel at george washington university on what this new ruling will mean for maryland pitbull owners and landlords. the av casey group is one of several that has already -- advocacy group is one of several that has already spoken out against it. >> discrimination against a specific breed that is unfounded. >> reporter: dog bite victim as laud the ruling and hope other states follow -- victims applaud the ruling and hope other states follow suit. there has been a task force set up to look into it. >> we're grateful to the senate president for establishing a joint task force of legislators to look at this issue and hope they put it on the agenda if they come back for special session in july. former president george w. bush and wife laura visit the white house today to leave behind a public momento unveiling their official portraits in the east room. mr. bush noted that's where

a ranch drink in new york city may not be an -- large drink in new york city may not be an option soon. now sugary drinks are the next front in the war on nutrition. fox's anna coyman has the story. >> reporter: if the mayor of new york has his way, the city may soon have the toughest anti- soda laws in the country. >> there are many factors that contribute to childhood obesity, but the single biggest is soda and other sugar sweetened beverages. >> reporter: mayor michael bloomberg's anti-obesity campaign has a new target, large sodas. the proposed first in the nation ban would target any sugary drink more than 16 ounces anywhere those types of beverages are sold in the city. >> i think above 16-ounces is reasonable. i think it's a good way to send the message that he's supporting healthier lifestyles. >> i think soda is really unhealthy and i don't see any reason you need to drink 20

10:00. a manassas man facing a felony gun charge after the fbi said he made threatening remarks against the president. douglas story fell for an fbi sting when he paid an undercover agent to turn a rifle he owned into a fully automatic machine gun. fox 5's paul wagner with the detailses. >> reporter: the fbi says its agents began taking a closer look at doug story in august last year after a confidential informant came forward to say story expressed interest in modifying an ak47 to fire three shot bursts. story the screen name confederate brother while posing messages on white supremacist websites. an agent who read them said they had a propensity for hatred and violence. in fact, the after day of the quotes two posts attributed to story threatening violence against president obama and attorney general eric holder. story wrote, "i think there's one way o bummer would be proven as a mere mortal, if

a man was hit by a stray bullet when driving, a woman hit in a drive by shooting and a woman wounded near the space needle. brian banks is getting the chance to live out his dream and play in the nfl perhaps in washington. he was a top college prospect when he was sent to prison 10 years ago for a crime he did not commit. last year a judge threw out his rape conviction. the redskins say they will give him a tryout. banks will be in town next week. the seahawks and several other teams have also been in contact with him. you don't think of the end of may as being football season, but for the redskins this is an important time especially for the rookies. dave ross joins us with a look now at the key rookies. >> we're always talking about robert griffin, iii and there was another rookie quarterback that surprised some people when they signed him in the fourth round. he made the bigger news today, kirk cousins from michigan state, officially a member of the redskins inking a deal today and the last two yet to

we're doing that on purpose so you will know we expect some severe weather tomorrow. we've had a number of days with strong and severe thunderstorms. so why is tomorrow different? there's a big push of cold air behind it and cold air aloft. what we are finding is it looks as though these showers and stops that will come through will be in two waves, one of which will be righted an the 4:00 hour. so -- right around the 4:00 hour. we're concerned that will come through and produce perhaps some rotating storms. then there will be another wave. so between 4:00 and 7:00, one wave, maybe some strong and rotating thunderstorms. then another 1 will come through around 9:00, 10:00 and that won't get east of the bay until about 2 a.m. we know there will be damaging potentially because that's what -- gusts potentially because that's what we're seeing tonight there. have been about 97 reports of strong and severe storms.

the other thing we're seeing is isolated tornadoes may be possible with those storms tomorrow, a few could rotate and there maybe some flash flooding. let me pick and choose. i want you to see this may briefly go away for a second, but i want you to see the severe thunderstorm area from south central pennsylvania all the way to the carolinas. that's where we're thinking the risk will be tomorrow. we don't want you to be surprised by that. nothing really i think to worry about tomorrow morning. we should be okay there. as we put up the forecast, you'll be able to see what we're talking about. to tonight just a fairly call night, a couple clouds around, a little later tonight maybe an isolated shower, temperature about 63 degrees. tomorrow as we head through the day, that's when we expect to see more activity and temperatures will be the big deal. you can see washington is 76, but chicago is 50 degrees. so that's the kind of cold air

some local libraries, where the steamy novels are getting yanked off the shelve. here's another that's my take, the ambitious plan to improve d.c. schools. >> now that's my take with vice president and general manager duffy dyer. >> kaya henderson announced a five-year plan to boost achievements of the district's 123 public schools and dramatically rise the high school graduation rates. the plan is aggressive which includes raising the math and reading proficiency rates from 43% to 70%, increasing proficiency rates of the 40 poorest performing schools by 40%, boosting graduation rates from 53% to 75%, adding a pilot program to expand the school day at some schools. henderson has already gone on record saying this aggressive plan cannot be achieved given the current size of the

district's public school system. we have too many schools with low enrollment creating an inefficient system. 45 schools have less than 300 students. d.c. averages 382 students per school compared with fairfax county which averages 915. closing schools as the chancellor called for after the 2012/'13 school year is the most effective way to increase the efficiency of the school system. we agree with henderson. we can no longer afford to run 123 public schools. closing schools is the third rail for all school officials. chancellor henderson surely knows this, but to her credit she has proposed a series of community discussions regarding the number and location of schools that should be considered for closing, renovation or replacement by charter schools. chancellor henderson's use of tells fox 5 a series of state of -- office tells fox 5 a series of state of the schools meetings will be held in the next few weeks. this is your time to share your
