we start with breaking news in it the penn state scandal. no police have any record of a report by assistant coach mike mcqueary. in an e-mail he reportedly said he talked with police about an alleged sexual assault by jerry sandusky. in the meantime, the charity that places kids with other homes now say the sandusky may have hosted six children back to the '60s. the authorities have been warned in new york and pennsylvania. a new judge has been assigned to the preliminary hearing scheduled for december 7th. the original judge had ties to the second mile charity. the question he is, how did jerry sandusky keep raising money despite all the rumors about his involvement in a sex scandal? one business donated $50,000 to sandusky's family last year is the family clothes line. tracy bell is the star coordinator. tracy bell, obviously deeply concerning course of events in the last few days. you are one of the businesses that's donated money to this charity. how do you feel? >> we were blindsided by everything that has happened past week and a half

important breaks news in the penn state child sex abuse scandal. former penn state coach joe paterno is hiring a high-pow pro file criminal defense attorney. joe paterno said quote -- he's absolutely distraught over what happened to the children and their families. he also wants very much to speak publicly and answers questions. he cop ko operated fully with the grand jury and he will continue to cooperate with that investigation as it moves forward. it comes a short time after the university president announced another member of the football team's coaching staff is out. assistant coach mike mckwaery put on administrative leave. he reported seeing the defensive coordinator at the team coach jerry sandusky but mckwaery reported it not to the police but to head coach joe paterno. there's outrage over what prosecutors believe was a cover-up at the school. former top two university officials face criminal charges. tonight, penn state's interim president says there may be more revelations and more victims. >> it's certainly appears from what we know, w

specifically, timothy curley, penn state's athletic director. he and gary schultz, senior vp for finance and business, took away sandusky's locker room keys and banned him from having children in the football building but never reported the incident to law enforcement or child protective services. >> their inaction likely allowed a child predator to continue to victimize children for many, many years. >> reporter: in total, sandusky faces 40 charges tied to sexual assault on eight boys. curley and schultz are charged with failing to report abuse and lying to a grand jury. longtime penn state president graham spannier is under mounting pressure to resign for his handling of the 2002 incident. and 84-year-old joe paterno announced today he'll retire at the end of the season, saying in a statement, "this is a tragedy. it is one of the great sorrows of my life. with the benefit of hindsight, i wish i had done more." >> joining us now is penn state alumnus troy craig, also corey geiger of the altoona mirror newspaper and the local espn radio station.

and the penn state authorities, the director of sports, the cfo of penn state and joe paterno say, you know, maybe this will go away. maybe we shouldn't call the cops. maybe we shouldn't call and tell the campus police. and now it comes out that this was a man who allegedly created a charity -- and that charity did a lot of good work -- so that he could cherry pick the kids that he wanted to do whatever. it's really appalling, and it's really sad. and my 17-year-old son called me -- i was out on the road. he said, dad, the students are rioting on penn state because joe paterno got fired. a couple years ago those students were kids themselves. nobody's talking about those kids at risk, those kids that were in the second mile charity that jerry sandusky allegedly, allegedly hurt. i thought, you know, hayden for a 17-year-old guy, you're prett perceptive. they're worried about that football program and that's all that school's worried about. >> yeah, couldn't agree more. it was deeply disturbing, the whole thing. after the break, i want to know what you really thing is going on behind som

college football, shocking allegations of sexual child abuse against a former coach for the revered penn state nittany lions and a pair of university big wigs are accused of covering it up. you may not know his face but if you're a college football fan, you know his name, jerry sandusky, penn state's former defensive coordinator, led away in handcuffs today, sandusky retired from coaching in 1999 and founded a charitable organization for at-risk children called second mile. he's accused of making sexual advances on eight young men he met through that program. the charges are piled up against him. sandusky is currently out on a $100,000 bail. on $100,000 bail. his attorney says he maintains his innocence. also involved in this case, penn state's athletic director timothy curly and the university's senior vice president for finance and business, gary shultz. now, pennsylvania's attorney general, linda kelly, made this statement. she said, this is a case about a sexual predator who used his position to repeatedly prey on young boys. it is also a case about high-ranking university officials

you also went to penn state, graduated from penn state. what are your thoughts as things escalated like this? >> well, good morning, carol. i have to tell you, for better or worse, penn state likes to celebrate or protest when penn state beat ohio in 2008 they tore down light posts. earlier this year, for example, osama bin laden when he was killed, they took to downtown state college as well and brought their american flags anç belted out the national anthem. depending on the topic depends on how much destruction there will be in the street. i wasn't quite expecting a tv truck to be overturned tonight. >> no. we weren't expecting that either. help us understand why these students are so upset, with the accusations against joe paterno they're very serious. a lot of people say as the moral compass of the university he certainly didn't do the moral thing in the sandusky case. >> i think what it is is not so much that joe paterno is connected to the alleged child abuse case. it's not so much that joe's connected to it, it's that the focus of

how exposed is penn state right now? >> you know, i think certainly, there is a bunch of civil exposure for penn state it is very neck negligent if the allegations are true that they sort of did harbor this predator. in terms of coach pattern know is there criminal lie fwoirlt him? he did what he was supposed to downed earth law, certainly. he was supposed to report this to school administrators, don, he did that i think many people were saying he has some civil exposure as well in terms of fail ing failing to do more there is a legal duty to warn. some people feel he dropped the ball in terms of his moral obligation to protect children to do more, to follow up. once he reported, he needed to basically find out what was the result of his reporting and he failed to do that civilly, there maybe something for pattern know and penn state, but morally, i think we all know they should have done more. >> in most state, if you see or witness this behavior, you are obligated to tell someone in authority, that is usually a police

really trying to heal at penn state. and trying to move forward. it's only been two weeks. but it feels like a lot longer on campus. students really want to project that this is not who they are. they want to have pride for their university again. they want to move past this. they want to show the world that they are bigger than just the scandal. >> sara, thank you for your great work. we really appreciate it. >>> today's "new york times" reports penn state may haven gauged in a major coverup of coach sandusky's behavior over the years. any way you look at it, a legal firestorm is about to hit. trial lawyer mark geragos is no stranger to high-profile legal cases. he joins us along with florida assistant state attorney who supervises broward county sex crimes unit. i'm not sure where to go in this, because it seem likes there are so many moving parts. what do you think, mark, is the next big moment in this case as we move forward? >> i think the next big moment is when they do a hearing and whether -- i don't think that's going to be sandusky first. i think it's going to be
