and for that i am going to bring back in the host of current tv's "viewpoint," eliot spitzer, who like me is a former prosecutor and a former attorney general and governor of course. vites eliot, thank you for joining me. >> thrilled to be with you. >> i know you covered this but what is your take on second degree murder? is that the appropriate charge? >> absolutely. of course, we need to be cautious. we don't know the evidence. we don't know what has been turned up in these three weeks. given first degree murder premeditated murder was almost off of the table from the get-go. it was technically off of the table when special prosecutor said no grand jury. that was the only thing that was excluded jurisdictionally. depraved indifference, which is what we call it here in new york seems to be the right charge based on what we know. acting in a way that shows a complete lack of regard for human life almost a desire to act in a way that puts life at risk. >> that's what seems to have event weighted here. the guy pulled a gun and shot. >> i thought she did a good job at her press conference
