the family of brandon tate brown who died in that shooting however thinks the out come should have been a lot different. fox 29's bruce gordon live in our newsroom tonight with more on this decision. bruce? >> reporter: 26-year-old brandon tate brown was on parole from an aggravated assault convict at the time of that faithful traffic stop but officers didn't know that. all they new says philly's d i was it was a health violation had suddenly become a life and death struggle. district attorney seth williams said a three month probe into the fatal police shoot fg 26-year-old brandon tate brown led him to conclude -- >> what transpired in those early hours of december the 15th was a tragedy. it was not a crime. >> reporter: williams laid out the evidence of a pre-dawn traffic stop on the 6600 block of frankford avenue. including security camera video showing the healths of tate brown's white dodge charger were off. during the stop, william said police noticed a handgun which was later matched to tate brown through dna tucked between the console and the front passenger seat. >> it is what.
