. >> keith live in north baltimore with the very latest on the story tonight. keith what can you tell us? >>reporter: well, jeff we are live in the 300 block of east university parkway. now police initially told us the intruder donald rice was hiding in the garage behind the home. but now they say rice was in fact hiding behind this fence in the court yard between the porch and the garage. now police and neighbor called police early tuesday morning of report of suspicious person. security guard and city police officer arrived. looked around. found nothing. but investigators say the student john armed with a sword found rice crouched in the court yard and tried to hold him there for police. now investigators say rice lunged at john who killed rice with a single below from the sword. rice family members say there was intent to kill. but police disagree. >> we have to support the story with forensic evidence. that's how the system works. but at this point in the game there's no reason to suggest that he wept down there with any criminal intent to kill anybody. >>
