he is a key leader in al-shabab, that's the group behind the nairobi mall attacks last month. he also planned several other big terror attacks. now with the failure of the u.s. raid, it is likely he remains a serious threat. >>> joining us is ambassador robin sanders, the normer ambassador to nigeria and republican of congo. ambassador welcome. >> thank you, john. >> what is your reaction to this raid? >> well, the raid in libya, i think is really a good closure for the families of the victims from 1998. >> you knew many of those people. >> i knew many of those people. i lost a good friend in the bombing. and for them 15 years later it was a good closing. what we did was the right thing to do. there has been a $5 million bounty on the head of alibby since 1991. >> so it comes after this attack in nairobi. so what is the connection if any? >> it may not be direct ex-september they are all involved with al-qaeda in some way. in the case of al-libby in libbyia he was the main syndicate of al-qaeda. so they are all connected to the al-qaeda syndicate, some with regional and local

through the elite within the country. >> you mentioned the affluent area of nairobi. kenya is a major hub for commerce and tourism in africa. how much do u.s. interests rely on a stable kenya? >> kenya is stable. there's no question about that. despite the fact that the president is having issues with the international criminal court. as a country they are stable. they had legitimate elections and the u.s. commercial interests are strong of the the u.s. embassy is one of the largest in the region, the united nations has its afghan headquarters there. i don't think you'll see the reason destablilize. >> you don't think it will be destablilized. >> no, but what you'll see is an intense reaction to what happened in order to protect the soft targets. there's no telling when this kind of attack could happen again or be attempted again. >> in what way do you think security will be intensified specifically. >> i think the some articly community, the immigrant community lives in east nairobi. i think you'll see a lot more aggressive action on the part of nairobi security forc

peter has been monitoring the court ruling and has more for us now from the kenyan capitol nairo nairobi. >> reporter: they had to deal with when the trial judges have the authority in principle to give the accused the rights to be excused from part of their trial. on that score they found the appeal, the trial judges were right to consider his request to be excused but that they overstepped the authority and granting what amounted to a blanket excusel. the trial judges said that he could be excused from appearing throughout most of the trial apart from certain key parts of it but the appeals judges say that was too much and said that, in fact, the trial judges should be allowed to adjust their court calendars and should be allowed to grant adjourn ms for brief periods for specific circumstances when william ruto has to come back to kenya to deal with certain crisis and certain official duties. generally what it means is william ruto must be present for the entire duration of his trial in principle and that only from time to time will he be allowed to come back. >> reporter: he was tippe

let's speak to our correspondent peter who joins us from the kenyan capitol nairobi so peter what is next now for the deputy president? >> well, he says he will stay in the hague. this is going to quite some problems and arguments back here. icc has been under enormous political pressure not just from kenya but from the entire african union. the african union betrayed the icc as a near colonial constitution persecuting african leaders and will lend weight to the argument. we can expect to see attention focused on the un security council which is to consider a resolution by the african union asking the security council to put off both trials until both of kenya's president and ruto has left office and that is a controversial move and that is where the focus will be for the diplomatic and political efforts here in africa. >> reporter: how do you see this affecting kenya's ties with the rest of the african neighbors? >> this is an interesting one. i think there is now enormous pressure on both william ruto and kinyata to somehow withdraw from the icc. they have a difficult line because

peter greste has more from nairobi. >> difficult angry questions for just a brief period to memorialize the victims that were killed in the westgate attack. each family of the victims has planted a tree to memorialize and one of the things you notice is the incredible range of names. an asia, a kenyan from the coastal regions. we've got western names, french, english so on, there was a nigerian that was killed in the attack. it speaks to the incredible range of ethnicities, backgrounds, muslim, hindu, were involved from across the country. the organizers have set up this plaque, a temporary plaque like that for a very good reason. as the authorities continue to search through the rubble they're still finding the remains of the 16 bodies that still have to have names attached to them. so once those names are finally finalized once we get a complete list only then will the authorities be able to put a permanent plaque and memorialize all the viments killed in the -- victims killed in the westgate attack more than amonth ago. five men accused of planning the 9-11 attacks will be back in a

attacked a shopping mall in neighboring kenya. 71 people died in the siege at the westgate mall in nairobi. we have reporters in both countries. let's begin with peter gresta in mogadishu. peter, how much or what do we know about this raid? >> reporter: well, stephen, as you just mentioned, there are conflicting accounts. al shabaab insists it was a sea-borne raid. it happened about 2:00 o'clock this morning. they said that the attackers, western attackers came ashore, launched their offensive on a safe house close to the beach, and they said it lasted anywhere from an hour to an hour and a half before they were able to fight off attackers. al shabaab insists there were no senior commanders there at the time but they acknowledged one of their fighters was killed in the operation. western security forces have said that it was an operation that was carried out by the americans. they say that the al shabaab leader was believed to have been at the house at the time although they understand he escaped unharmed. there has been speculation this may be part of the start of a major offensive agains
